What to Do if Your Employer Delays or Denies Your Gratuity Payment in India

If an Indian employer delays or refuses your gratuity, apply to the employer in the prescribed form, preserve proof of delivery, and escalate to the competent authority if the employer does not pay or rejects the claim. The current central framework is the Code on Social Security, 2020, which the Ministry of Labour and Employment says applies to gratuity calculations from 21 November 2025. This article explains the central process and deadlines. State, Union Territory, sector, employment category, and special schemes can change the correct authority or filing instructions, so verify those details before filing.

1. Confirm which gratuity rules and authority apply

India’s framework changed on 21 November 2025

The Code on Social Security, 2020 is the current central framework for gratuity from 21 November 2025, according to the Ministry of Labour and Employment’s communication dated 29 January 2026 and its 2026 labour-code FAQs. Do not rely on an old explanation that treats the Payment of Gratuity Act, 1972 as the complete current rule without checking the transition and the rules applicable to your employment.

The central rules do not answer every local question. The competent authority can differ according to your workplace, industry, state or Union Territory, and whether you work for a government body, an excluded establishment, or an employment scheme with special rules. Identify that authority before sending an escalation. If you work outside India, use your local labour authority and the law of the country where the employment is governed; the deadlines below are an India-focused guide.

When gratuity is generally payable

Section 53 generally provides gratuity when employment ends after five years of continuous service in the circumstances covered by the Code. The five-year condition has important exceptions. The Ministry’s 2026 FAQs state that death and disablement are exceptions, and that a fixed-term employee is eligible after one year of service under the contract. Your actual contract, reason for separation, continuity of service, and employment category matter. Do not assume that every worker, resignation, termination, retirement, or contract ending qualifies in exactly the same way.

2. Establish the date and amount that became payable

Why the payable date matters

Several deadlines run from the date gratuity becomes payable. Section 56(3) requires the employer to arrange payment within 30 days from that date. Section 56 also provides simple interest from the date gratuity became payable until the date it is paid, subject to a narrow exception described below. Write down the employment-ending event and the date on which it took effect, then keep the employer’s settlement statement or calculation if one was issued.

The Code places responsibility on the employer to determine the amount, give written notice to the claimant and the competent authority, and arrange payment. You do not need to wait for a final settlement document before protecting your claim. If the employer has not calculated the amount, submit your application with the records you have and explain what remains unpaid.

3. Apply to the employer first

Use Form IV and the 30-day employee period

Under rule 33 of the Social Security Code (Central) Rules, 2026, an eligible employee ordinarily applies in Form IV within 30 days after gratuity becomes payable. The application may be delivered electronically, personally, or by registered speed post. Use the method that gives you reliable evidence of what was sent and when it was received.

A late application is not automatically invalid. The rules allow the employer to entertain a delayed application when there is sufficient cause, and they state that a claim is not invalid merely because it was filed late. Explain the reason for any delay in the application and attach supporting evidence where available. Filing promptly is still safer because it reduces arguments about dates and gives you a clear record of the employer’s response.

What to include in your submission

  • Your name, contact details, job title, establishment, and dates of employment.
  • The date and reason employment ended, and why you believe gratuity is payable.
  • Your requested amount or the employer’s calculation, identified as an estimate if it has not been confirmed.
  • A request for written determination, payment, and any interest required for late payment.
  • Copies of supporting records, while retaining the originals.

Keep the completed form, attachments, email headers, portal acknowledgments, postal receipt, delivery confirmation, and any conversation about the claim. If you hand-deliver the application, ask the receiving office to stamp a duplicate. If you use email or an electronic system, save the submission number and the complete sent message.

4. Know the employer’s notice and payment deadlines

Event Rule or deadline What you should obtain
Employee submits the claim Ordinarily within 30 days after gratuity becomes payable; a late claim may be accepted for sufficient cause. Proof of submission and the date received.
Employer treats the claim as inadmissible Written notice explaining the reasons, with a copy endorsed to the competent authority, within 15 days of receiving the application. The rejection notice and evidence that it was sent.
Employer treats the claim as admissible The payment date stated in the notice cannot be later than the 30th day after the employer receives the application. The determination, amount, payment date, and any calculation.
Payment is late Section 56 provides simple interest from the date gratuity became payable until payment. A payment record and an interest calculation or explanation for any shortfall.

Section 56(3) states: “The employer shall arrange to pay the amount of gratuity within thirty days from the date it becomes payable to the person to whom the gratuity is payable.” The interest exception is limited: the delay must be caused by the employee, and the competent authority must give written permission for the delay on that ground. An employer cannot remove interest merely by asserting that the employee caused a delay; the statutory conditions must be met.

5. If the employer rejects, ignores, or underpays the claim

Read the reason, but do not treat a rejection as the end of the matter

A rejection should explain why the employer considers the claim inadmissible and should be copied to the competent authority. Check whether the stated reason concerns service length, the employment category, the reason for separation, the person entitled to receive the money, or the amount. Compare the explanation with your contract and employment records. A refusal without the required written notice, a missing calculation, or silence after the deadline should be documented in your escalation file.

If the employer pays only part of the amount, record the payment as partial and identify the balance. The Code requires the employer to deposit any amount it admits is payable when a dispute is taken to the competent authority. Accepting an undisputed amount does not, by itself, prove that the remaining claim is settled; state in writing that you reserve the balance if that is your position.

6. Escalation routes and when to use each one

Route Purpose Filing and jurisdiction points
Application to the competent authority under section 56 Determines a dispute about the amount, admissibility, or person entitled, and can direct payment. Use the authority for your location and employment category. Attach the employer application, response or proof of non-response, service records, and payment evidence.
SAMADHAN grievance portal Raises a labour grievance; the Ministry lists non-payment of gratuity as a category. Check the current module and routing instructions. An online grievance does not automatically replace a statutory claim to the competent authority.
Professional employment-law advice Helps with a contested eligibility, calculation, authority, or evidence issue. Advice is optional; paid representation is not stated as a prerequisite to filing. Confirm the adviser’s qualifications and the applicable local forum.

The competent authority route is the formal process for a dispute over gratuity. SAMADHAN can be useful for recording and routing a grievance, but do not assume that submitting an online complaint stops a statutory clock, substitutes for Form IV, or starts an appeal period. Follow any instructions issued by the authority that has jurisdiction over your establishment.

7. File before the competent authority

What the authority can decide

Section 56 allows the employer, employee, or another person raising the matter to apply to the competent authority when there is a dispute about the amount, whether gratuity is admissible, or who is entitled to receive it. The authority conducts an inquiry, gives the parties a reasonable opportunity to be heard, and can direct payment. The employer must deposit the amount it admits is payable while the disputed balance is considered.

Build a clear evidence bundle

Arrange your documents chronologically and label each item. Include the employment or appointment contract; joining and exit records; salary slips; attendance or service-continuity evidence where relevant; the employer’s gratuity calculation or settlement statement; Form IV and every attachment; delivery proof; rejection notices; bank statements showing non-payment or partial payment; and written communications about the dispute. This is a practical preparation list, not a statement that every item is a mandatory attachment in every jurisdiction.

In your written statement, separate facts from estimates. State the dates, the amount the employer admitted, the amount you say remains due, and the documents supporting each point. Ask for a written order and retain the filing acknowledgment. If the authority asks for additional records, respond by the stated date and keep proof of delivery.

8. Appeal a decision within the statutory window

An aggrieved person may appeal within 60 days under section 56(8). The appellate authority may allow a further 60 days when sufficient cause is shown. Treat 60 days as the working limit: obtain the written decision, calculate the deadline from the date specified by the applicable procedure, and file early enough to correct any defect. Include the decision, your grounds, the original filing and evidence, and proof that required parties were served. Confirm the filing format and fee, if any, with the appellate authority because local instructions may differ.

9. Special situations that often change the analysis

Fixed-term employment

The Ministry’s 2026 FAQs say a fixed-term employee is eligible after one year of service under the contract. Check that your arrangement is legally a fixed-term employment relationship and that the contract and termination event fit the rule; a label used by an employer is not conclusive.

Death or an employee unable to claim

Death is an exception to the usual five-year condition. The person entitled to receive the gratuity may need to establish that status. SAMADHAN’s FAQ identifies a legal heir in applicable cases and an authorized representative among potential claimants. Keep succession, nomination, authorization, or other entitlement records and ask the competent authority what it requires for your circumstances.

State-specific procedures

A Kerala Labour Department FAQ, for example, describes a state procedure using terminology from the Payment of Gratuity Act. That example should not be copied nationwide: its form numbers, 90-day claim period, and local authority details may not apply after the central-code transition or outside Kerala. Use it only as a reminder to verify the current office and forms for your own jurisdiction.

Government, excluded, or special establishments

The central Code and rules may not be the only instrument governing every government employee, excluded establishment, or special employment scheme. Before relying on the Form IV route or a particular authority, check the service rules, notification, or scheme that covers your employment. If two regimes appear to overlap, ask the authority to confirm jurisdiction rather than filing identical claims blindly.

10. A practical action plan

  1. Identify the governing regime. Record your work location, employer type, employment category, and the date employment ended. Check whether a special scheme or local authority applies.
  2. Check eligibility. Review continuous service, the reason employment ended, fixed-term status, and any death or disablement exception.
  3. Calculate the key dates. Mark when gratuity became payable, the 30-day employee application period, the employer’s 15-day notice period, and the 30-day payment period.
  4. Submit Form IV. Use electronic delivery, personal delivery, or registered speed post and preserve an acknowledgment. Explain any late filing and its cause.
  5. Wait only for the statutory response. If the employer gives no compliant notice, rejects the claim, misses payment, or pays less than admitted, organize the evidence immediately.
  6. Escalate correctly. File with the competent authority for your employment category and location. You may also register the grievance on SAMADHAN, but do not treat that portal as an automatic substitute for the statutory process.
  7. Track interest and appeal dates. Claim simple interest for qualifying delay, retain payment proof, and file any appeal within 60 days unless an additional period is formally allowed for sufficient cause.

The strongest claim is usually the one with a clear eligibility explanation, a dated Form IV submission, proof of delivery, a precise amount and interest request, and an escalation filed with the authority that actually has jurisdiction. When the facts involve a special employment scheme, a disputed service record, death benefits, or a complex ownership or restructuring issue, obtain qualified local advice while continuing to preserve the official filing deadlines.
