What to Do if Your Critical Illness Insurance Claim Is Denied

By TheFinanceBase Team 9 min read

A denied critical illness claim is not automatically the end of the matter, but a diagnosis alone does not prove that the policy pays. Get the denial and the policy wording, identify the exact reason, test it against the contract and medical evidence, then file a documented complaint through the insurer’s formal process. If the insurer does not change its position, use the ombudsman, regulator or legal route that applies where you live. Deadlines differ sharply by country, policy and dispute type, so protect them immediately.

Start by preserving the decision and every deadline

Save the denial letter, the envelope or delivery email, the claim number and the date you received the decision. Do not rely on a telephone explanation; the written decision is the document you can answer point by point.

Read the appeal instructions in the letter and the policy’s claims and complaints sections. A policy may impose a time limit for submitting a claim, while an insurer, ombudsman or court may have separate response, referral or limitation periods. The Financial Consumer Agency of Canada (FCAC) says insurance claim-submission periods commonly range from 90 days to 12 months, but that range is not a universal appeal deadline. Check your own policy and ask the insurer in writing to confirm the applicable date.

  • Request the precise policy version, schedule, endorsements and exclusions that applied when your cover began or when the event occurred.
  • Ask for the medical, underwriting and factual material relied on, subject to the privacy and disclosure rules in your jurisdiction.
  • Ask the insurer to confirm the date by which a complaint must be made and whether any information is missing.
  • Create a dated log of letters, emails, calls, names, promises and documents sent.

Do this before waiting for an informal call to be returned. An informal conversation does not necessarily preserve a formal complaint or a court deadline.

Find the contractual reason for the denial

Critical illness insurance pays only when the illness satisfies the definition in the applicable contract. The Financial Ombudsman Service (FOS) in the United Kingdom states: “The types of illness covered will depend on your policy.” A diagnosis that sounds serious may still fail a contractual test for type, severity, permanence, treatment, imaging or survival period.

Stated denial reason What to compare Useful evidence or question
Condition not covered The insured-condition list, definitions and any amendments Does the diagnosis fall within the named condition, or is the claim being treated as a different condition?
Definition or severity not met Every clinical element in the definition, not just the diagnosis label Ask the treating specialist to address each element with dates, test results and documented findings.
Waiting or survival period The qualifying period, commencement date and any post-diagnosis or survival wording Check the policy’s exact count of days and the event date used by the insurer.
Exclusion The exclusion clause, its scope and any exceptions Ask which facts trigger the exclusion and whether the insurer has applied it to the correct condition or period.
Non-disclosure or inaccurate application answer The original application, medical questionnaire, underwriting questions and answers Compare the alleged omission with the exact question, what was known at the time and the insurer’s underwriting evidence.
Insufficient or conflicting evidence Claim forms, records, tests, consultant reports and information requests Identify the missing item and ask whether the insurer will reconsider after receiving it.
Sales representation or mis-selling Policy documents, adviser correspondence, needs assessment and recorded statements Explain what was represented, why it mattered and how the written cover differs.

These are issues to investigate, not proof that the insurer acted wrongly. The FOS considers the individual policy and medical evidence, while the FCAC describes internal complaint handling rather than deciding whether a particular claim is payable.

Build a focused evidence file

Organize one indexed copy of the material. Keep originals and send copies unless the insurer specifically requires otherwise.

  1. Contract: policy booklet, schedule, certificate, amendments, renewal documents and the wording in force at the relevant time.
  2. Application and disclosure: application forms, health questions, answers, medical reports supplied during underwriting and any correction you requested.
  3. Claim record: claim form, notice of claim, insurer requests, authorizations, correspondence and the denial letter.
  4. Medical material: consultant letters, hospital records, pathology or imaging reports, treatment dates and test results relevant to the contractual definition.
  5. Chronology: symptoms, diagnosis, investigations, treatment, notice, requested documents and every decision date.

When the dispute concerns severity or a technical definition, ask the treating specialist to respond to the wording directly. A useful report distinguishes the clinical diagnosis from the contract’s threshold and identifies the records supporting each element. Do not alter records or ask a clinician to state a conclusion unsupported by the chart.

For an alleged non-disclosure, do not simply argue that the illness was diagnosed later. The questions are what the application asked, what you knew when you answered, what you disclosed, and whether the omitted fact would have changed underwriting. Obtain the insurer’s explanation of materiality and the evidence behind it.

Make the insurer’s formal complaint

Use the complaint address or online route specified by the insurer, rather than sending a general email to a salesperson. A clear complaint gives the company an opportunity to correct an error and creates a final position for any external review.

Structure the submission so an assessor can match each issue to a document:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Identify the case: name, policy number, claim number and preferred contact details.
  2. Give a short chronology: diagnosis, claim notice, information supplied and denial date.
  3. Quote the denial reason: reproduce the insurer’s wording accurately and separate each reason.
  4. Identify the clause: cite the page and paragraph of the definition, exclusion, qualifying period or disclosure term in dispute.
  5. Explain the evidence: show how the records satisfy the test or why the insurer’s factual premise is incorrect.
  6. State the remedy: request reconsideration and payment if the definition is met, correction of an inaccurate record, a fresh medical review, or another specific correction.
  7. Request a final written decision: ask the insurer to confirm receipt, identify anything still missing and give reasons for its final position.

Attach an index and legible copies. Keep the complete submission, attachments and proof of delivery. FCAC guidance recommends preparing the relevant documents, using the insurer’s internal complaint process, asking for a clear final decision and keeping notes of conversations.

United Kingdom

Contact the insurer first. For most complaint types, FOS consumer guidance says the firm should issue a final response within eight weeks. You may approach the Financial Ombudsman Service if you disagree with the response or the eight-week period passes without one, subject to the service’s eligibility and referral rules.

FOS examines the parties’ evidence, relevant rules, the policy and medical material. It may require payment and interest where the illness meets the definition. Depending on the facts, it may also consider premium or policy remedies for mis-selling and compensation for avoidable delay. It can reject a complaint where the contractual test is not met. An eight-week insurer response period is not a universal court or referral deadline; check the current FOS rules and any date in your final-response letter.

Some policy terms illustrate why dates matter. FOS business guidance gives 14- or 28-day post-diagnosis periods as examples that may appear before a benefit becomes payable under particular contracts. Those periods are examples, not standard terms for every policy.

Canada

Life and health insurance complaints generally begin with the insurer’s internal process. After that process, FCAC points consumers to the OmbudService for Life & Health Insurance (OLHI). Quebec residents can also use the Autorité des marchés financiers (AMF), and provincial or territorial insurance regulators may review complaints, including while the insurer’s process is underway.

FCAC does not resolve individual claims. Its role is to explain the process and point consumers to the appropriate body. Confirm that your policy, insurer and complaint type fall within the external service’s mandate before filing, and verify any submission period directly with that body.

Other countries and jurisdictions

Use the ombudsman, regulator or dispute-resolution body named in the policy and the official guidance of your local insurance regulator. There is no single cross-border procedure established for critical illness disputes. Eligibility, binding effect, evidence rules and deadlines can differ between states, provinces, territories and countries.

Compare the available routes before choosing the next step

Route Purpose Timing and eligibility Possible result Important caution
Insurer internal complaint Lets the company review its decision and issue a reasoned final position Use the policy and insurer’s complaint instructions; claim and complaint dates vary Reversal, further assessment, request for evidence or confirmation of denial Keep proof of submission and do not assume an informal call counts as a complaint
External ombudsman Independent review where the insurer and complaint type are eligible Usually requires first contacting the insurer; referral windows differ May direct payment, interest or compensation within its legal powers Its process and deadlines do not automatically pause a court limitation period
Regulator Supervisory or complaint assistance, depending on jurisdiction Mandate varies; some regulators accept complaints during the insurer process Investigation, guidance, referral or regulatory action; not always an order to pay A regulator may not decide contractual entitlement for you
Legal advice or litigation Advice on contract rights, evidence, settlement and court action Limitation dates, costs and procedures are jurisdiction-specific Negotiated settlement or a court judgment, subject to the law and evidence Do not infer that an ombudsman complaint preserves a court deadline

Know which dates are actually running

  • Claim-submission deadline: the policy’s period for notifying or submitting a claim. FCAC’s 90-days-to-12-months range describes common examples across insurance policies, not a rule for your policy.
  • Insurer response period: in the UK, FOS guidance uses eight weeks for most complaint types before a consumer can normally move to the ombudsman.
  • External referral period: an ombudsman may require referral within a stated period after the final response.
  • Court limitation period: a separate legal deadline that may continue while an insurer or ombudsman reviews the complaint.

Ask each body to confirm dates in writing. If a limitation date may be near, obtain qualified legal advice promptly rather than waiting for an external complaint to finish.

Common mistakes that weaken an appeal

  • Arguing from the diagnosis alone: map the medical facts to every word of the definition.
  • Sending an unstructured medical bundle: use an index, chronology and a short explanation of each document’s relevance.
  • Ignoring an exclusion or qualifying period: address it directly and show why it does or does not apply.
  • Making unsupported accusations of bad faith: focus on the clause, evidence and requested correction.
  • Missing a request for information: ask what remains outstanding and respond by a trackable method.
  • Relying on a sales conversation you cannot document: provide emails, recorded advice, needs assessments or witness details where available.
  • Sending originals or changing records: preserve the evidential trail and retain secure copies.
  • Assuming every cancer, heart attack or stroke qualifies: the covered condition and threshold are policy-specific.

When professional legal help is sensible

Consider a qualified lawyer in your jurisdiction when the benefit is substantial, the insurer alleges fraud or non-disclosure, the policy is provided through an employer, the medical definition is technically disputed, or a court limitation date may apply. Ask specifically how an ombudsman complaint interacts with litigation, whether legal notices are required and what costs could arise. An adviser who understands insurance medical evidence can also help a specialist address the contractual test without overstating the clinical record.

Possible outcomes

A review can uphold the denial, request additional evidence, or reverse the decision and pay the benefit. In the UK, FOS may add interest when it directs payment and may consider premium, policy or delay-related remedies in appropriate mis-selling or service cases. The result depends on the wording, evidence, conduct and powers of the body reviewing the complaint; no process guarantees an award.

Final checklist before you submit

  • Denial letter, receipt date and claim number saved.
  • Correct policy wording, schedule and exclusions identified.
  • Each denial reason matched to a clause and supporting document.
  • Medical specialist asked to address the exact definition where needed.
  • Application and disclosure records checked if non-disclosure is alleged.
  • Formal complaint sent through the insurer’s stated channel with proof of delivery.
  • Final written decision requested and all calls logged.
  • Correct ombudsman or regulator confirmed for your location and policy type.
  • Claim, referral and court dates checked separately.
  • Local legal advice obtained promptly if the dispute or deadline is complex.
