If you find an error in capital gains on an already-filed U.S. federal individual return, first determine whether the IRS will correct it during processing, has asked only for missing information, or requires you to change the return. Recalculate the affected year using its records and tax-year-specific forms; when income or tax liability changes, the usual correction is Form 1040-X with revised Schedule D and, for many transactions, Form 8949.
This guide covers federal returns. A federal amendment does not automatically change a state return, and the correct basis or classification for an unusual asset may require professional tax advice.

Decide whether the mistake requires an amended return
The IRS frames the starting question as, “What should I do if I made a mistake on my federal return that I’ve already filed?” Its answer begins, “It depends on the type of mistake you made.” Read the notice or compare the filed return with your records before sending anything.

Many arithmetic mistakes are corrected by the IRS while it processes the original return. If the agency changes a calculation and sends a notice, follow that notice’s response instructions rather than automatically preparing Form 1040-X. The notice should explain the proposed change, any resulting balance, and how to agree or disagree.

Missing forms or schedules
A letter asking for a missing schedule, statement, or document generally calls for the requested material. Respond using the address, deadline, and method printed on the notice. Filing a separate amendment when the IRS only requested an attachment can create duplicate or conflicting information.
Changes that affect income or tax
If you omitted a sale, reported the wrong basis, changed a capital loss, or otherwise need to change income, deductions, credits, filing status, other taxes, withholding, or total tax, the IRS directs taxpayers to use Form 1040-X when the facts require a correction. The IRS’s general amended-return guidance is at Amended returns & Form 1040-X.
If an IRS notice proposes an adjustment, read it carefully before amending. The notice may provide a way to agree and pay (or receive the stated refund) without filing a separate 1040-X. Your response should match the procedure the IRS specifies.
Reconstruct the correct capital gain or loss
Do not start with a blank amendment. Preserve a copy of the filed return, every schedule, the IRS or brokerage documents you relied on, and any notice. Then isolate the affected tax year and transactions.

Match records to each transaction
For each sale or exchange, assemble the acquisition date, acquisition cost or other basis, sale date, proceeds, expenses, adjustments, and whether the transaction was reported on a broker statement. Compare those figures with Forms 1099-B and other tax documents, purchase and sale confirmations, reinvestment records, and documentation for inherited, gifted, or transferred property. Calculate the corrected result under the rules for that year; do not use a current-year worksheet as a substitute for an older return.
Stop when the tax treatment is uncertain
Basis errors involving inherited property, gifts, wash sales, digital assets, business property, employee compensation, or partnership and trust interests can change both the amount and character of the gain or loss. The forms establish where to report a result, but they do not determine an undocumented basis or resolve every classification question. Obtain qualified tax help instead of guessing when records are incomplete or the transaction has specialized rules.
Use the right capital-gains schedules for the affected year
Schedule D (Form 1040)
Schedule D (Form 1040), Capital Gains and Losses, reports covered sales or exchanges of capital assets and specified other capital-gain items. It also carries totals into the main Form 1040 calculation. Use the Schedule D version and instructions for the year being corrected, including that year’s treatment of short-term and long-term results, capital-loss limits, and carryovers.

Form 8949 reports many individual sales and dispositions and is filed with Schedule D. The Instructions for Form 8949 explain which transactions belong there, how to reconcile broker-reported amounts, and when an adjustment code or an exception to detailed reporting applies. Recreate the transaction lines that change; attach the completed form when the amended filing requires it.

Distributions and carryovers
Capital-gain distributions and capital-loss carryovers can affect Schedule D even when no individual sale was omitted. Check the year’s original worksheets and supporting statements to see whether a corrected transaction changes a carryover into a later year. If later returns used that carryover, each affected year may need its own correction.
Complete Form 1040-X accurately
Form 1040-X is the federal vehicle for changing an individual income-tax return. Use the Instructions for Form 1040-X (12/2025) together with the forms and instructions for the tax year you are amending. Prepare a separate 1040-X for each year; do not combine multiple years on one form.
Show original, change, and corrected amounts
Enter the amount originally filed, or the amount previously adjusted by the IRS, in the appropriate original column. Enter the net change in the change column and the corrected amount in the final column. Explain what changed and why in the form’s explanation area or an attached statement. Recompute affected income, tax, credits, payments, refund, or balance due from the corrected schedules rather than changing only the capital-gain line.

Attach every changed schedule
Include the revised Schedule D, Form 8949 when applicable, and any other schedule or form whose figures changed or that was omitted from the original filing. Include documents the 1040-X instructions require to substantiate the adjustment. Keep complete copies and proof of filing for your records.

Paper-filing requirement noted in the December 2025 instructions
The December 2025 1040-X instructions state that a paper-filed 1040-X must include a completed updated Form 1040, Form 1040-SR, or Form 1040-NR carrying the changes. This requirement is tied to the filing channel and the applicable instructions, so verify the exact checklist for your tax year and taxpayer status before mailing.
Choose e-filing or paper filing
The IRS permits eligible Forms 1040-X to be filed electronically through tax software, while paper filing remains available under the instructions. Eligibility depends on the tax year, return type, and the software’s ability to transmit the required schedules and attachments.
| Consideration | Eligible electronic filing | Paper filing |
|---|---|---|
| Tax-year and return support | Confirm the software supports the exact year and your Form 1040-X situation. | Use the forms and instructions for the exact year being amended. |
| Attachments | Verify that revised Schedule D, Form 8949, explanations, and other required documents can be included electronically. | Include the required schedules and, for a paper-filed 1040-X under the December 2025 instructions, the updated Form 1040, 1040-SR, or 1040-NR. |
| Signing and delivery | Follow the software’s identity, signature, and submission steps and retain the acceptance record. | Sign where required, use the IRS mailing address for your situation, and keep a copy and mailing proof. |
| Payment | Use the IRS-approved payment method shown in the instructions or notice; submitting an e-filed amendment alone does not pay a balance. | Arrange payment separately according to the instructions and include any required payment voucher. |
The IRS confirms that e-filing exists for eligible amended returns but does not endorse a particular software provider. Check capability before beginning, especially for older years or unusual return types.
Handle a balance due or refund claim
When the correction increases tax
If the corrected gain increases taxable income or otherwise raises tax, follow the year-specific 1040-X instructions for payment. Interest and penalties may apply from the original due date, and an amendment does not automatically stop their accumulation. Use the IRS notice, payment instructions, and account information to determine the amount and timing; do not estimate those charges from the capital-gain difference alone.

When the correction reduces tax
A properly supported amendment can claim a refund or credit when the corrected return shows an overpayment. Recheck the payment and withholding figures carried from the original return, because a schedule correction may change tax without changing the amount already paid.

For a general federal refund or credit claim, the IRS says the deadline is the later of three years after the original return was filed or two years after the tax was paid. Special circumstances can alter that period, so do not rely on this general rule for every situation. If the deadline may be near, file promptly and retain evidence of timely submission. The IRS’s amended-return FAQ is available at https://www.irs.gov/faqs/irs-procedures/amended-returns-form-1040x.
The IRS says to allow up to 16 weeks for amended-return processing. Use the IRS amended-return status tool and keep your submission confirmation, mailing receipt, and copies of all schedules. A pending amendment does not by itself extend a separate payment deadline stated in an IRS notice.

Review the state return separately
Federal and state income-tax systems are separate. A federal capital-gain change may alter state-reported income, but a federal 1040-X does not automatically amend the state return. Check the relevant state tax agency’s instructions for whether a state amended return is required, which federal forms must be attached, and the state’s own refund deadline and payment rules. Do not apply the federal three-year/two-year rule to a state claim without confirming the state law.
Common failure points to avoid
- Amending before checking the notice: respond through the notice process when the IRS is only correcting math or requesting a missing attachment.
- Using the wrong year’s forms: download the Schedule D, Form 8949, Form 1040-X instructions, and related schedules for the return being changed.
- Changing only one line: carry the corrected gain or loss through Schedule D, total income, tax, payments, and refund or balance due.
- Ignoring a later-year carryover: determine whether the correction changes a capital-loss carryover used on a subsequent return.
- Assuming filing pays tax: arrange payment separately when the amendment produces a balance, including any applicable interest or penalties.
- Forgetting the state filing: check the state agency after determining the federal change.
- Guessing at basis: obtain qualified advice for inherited, gifted, digital, business, wash-sale, or otherwise specialized transactions.
When professional assistance is prudent
Professional help is especially valuable when the records do not establish basis, several tax years are connected, the IRS has proposed an adjustment, or the transaction involves a partnership, trust, estate, business asset, digital asset, wash sale, gift, or inheritance. Bring the preparer the filed return, IRS notices, brokerage statements, acquisition and disposition records, prior amendments, and proof of payments. The preparer can determine the corrected tax treatment; you remain responsible for reviewing and signing the return.
