A denial, discouraging comment, higher price, or different treatment can be a warning sign, but none proves discrimination by itself. Your goal is to create a clear factual record and protect your options while the events and deadlines are still current.
Start with the evidence, not an accusation
Mortgage discrimination can occur during an application, underwriting, pricing decision, closing process, or servicing. The Consumer Financial Protection Bureau (CFPB) cautions that “Discrimination by a creditor is often hidden or even unintentional, which can make it hard to spot.” A lender may have a legitimate, repayment-related reason for a decision, yet the explanation, documentation, or treatment of comparable applicants may reveal a problem. Treat warning signs as reasons to investigate and document, not as a final legal conclusion.

- The property, loan type, requested amount, down payment, interest rate, fees, and any change in terms.
- The names, job titles, phone numbers, and locations of the people involved.
- What each person said or did, using exact words when you remember them.
- How the treatment differed from what you were told, from an earlier offer, or from terms offered to a comparable borrower.
- The outcome you want, such as a written explanation, correction of inaccurate information, reconsideration, or an end to improper servicing conduct.
Preserve every relevant record
Save the application and supporting documents, preapproval or approval letters, loan estimates, closing disclosures, rate-lock information, denial or adverse-action notice, emails, texts, call logs, letters, portal messages, and screenshots of changing terms. Keep notes of in-person conversations immediately afterward, including who was present. Preserve complaint submissions and confirmation numbers so you can prove when and where you reported the issue.
Keep a separate copy of documents you send to the lender or an agency. Redact unnecessary account numbers or Social Security numbers when sharing records, but do not alter the substantive information needed to evaluate the decision.
Check the adverse-action notice and request the reasons
If the lender denied your application, approved less credit, increased the cost, or took another adverse action, read the notice line by line. Federal consumer guidance says the notice should state the specific reasons for the decision or explain that you may request those reasons. CFPB guidance describes a 60-day period for requesting specific reasons when the notice says they are available on request. Send the request promptly, preferably through a method that creates a delivery record, and keep both your request and the response.

What to look for in the notice
- The stated reason or reasons, such as debt-to-income ratio, credit history, collateral, income verification, or incomplete information.
- Instructions and the deadline for requesting more specific reasons.
- If a credit report influenced the decision, the credit score information and the name of the reporting company, as described in CFPB guidance.
- Any notice that you can obtain a free copy of the relevant report from the reporting company within 60 days of the notice.
Compare the written explanation with what you were told verbally and with the documents you supplied. A stated reason is evidence to analyze, not proof that the reason was lawful or unlawful. For example, an income issue may be legitimate, but an unexplained change in how income was counted, contradictory explanations, or different treatment of comparable applicants may warrant further review. Do not exaggerate or omit facts when asking for clarification; credibility matters if the dispute later becomes formal.
Understand which federal protections may apply
Several federal laws can cover mortgage credit and related housing conduct. The exact protection depends on the transaction, the decision, the people involved, and the facts.
Equal Credit Opportunity Act
CFPB mortgage guidance says the Equal Credit Opportunity Act (ECOA) applies to credit applications, including mortgages. The protected bases identified in that guidance are race or color, religion, national origin, sex, marital status, age when the applicant is legally able to contract, receipt of public-assistance income, and exercising rights under consumer credit-protection laws. A lender may ask certain demographic questions for legally permitted monitoring or compliance purposes. That does not authorize discriminatory treatment.

Fair Housing Act
The CFPB also explains that the Fair Housing Act covers mortgage, home-equity, and certain home-improvement loans. The listed protected bases are race or color, religion, national origin, sex, disability, and familial status. The Fair Housing Act can be relevant to lending and, in appropriate circumstances, to servicing or other housing-related conduct.
State and local protections
State or local law may protect additional characteristics or provide different procedures and remedies. Whether a rule applies can depend on the lender, property, loan product, conduct, and location. Do not assume that a federal list is complete for your situation. A housing or consumer-law attorney, legal-aid organization, or state consumer-protection office can help identify the rules in your jurisdiction.
Choose a complaint route based on what happened
You may contact the lender directly to seek a correction or explanation, but direct contact is not a prerequisite to filing a government complaint. The best route depends on whether the problem occurred during loan origination, involved an adverse credit decision, arose during mortgage servicing, or concerns another housing practice.

| Situation | Possible channel | What to prepare |
|---|---|---|
| Application, underwriting, pricing, denial, or other lender credit decision | CFPB complaint intake; the FTC, state attorney general, or state consumer-protection office may also be options | Application and decision dates, loan details, names, stated reasons, communications, and the resolution you seek |
| Mortgage servicing conduct, including alleged housing discrimination during servicing | CFPB and, where appropriate, a HUD fair-housing complaint | Servicer name, account history, payment records, servicing communications, and details showing how treatment differed |
| Conduct covered by state or local protections | State attorney general, state consumer-protection office, or a local fair-housing agency where available | Property location, protected characteristic involved, chronology, documents, and any state or local notice requirements |
These channels are not interchangeable in every matter, and an agency may have limits on what it can investigate or remedy. You can ask more than one agency or an attorney which forum fits the facts, but avoid sending inconsistent accounts. Use the same accurate timeline and identify any prior complaints.
File a CFPB complaint
The CFPB’s mortgage-discrimination consumer page accepts complaints online and by phone at 855-411-2372. The agency asks complainants to prepare dates, amounts, and other details. Its process may provide a way to monitor the complaint’s status. Upload only documents necessary to explain the issue, and retain the submission and confirmation number.

CFPB credit-discrimination guidance identifies the FTC, your state attorney general, and your state consumer-protection office as possible options. For alleged discrimination connected with mortgage servicing or other fair-housing issues, CFPB housing guidance identifies HUD fair-housing complaints as another route. An agency complaint can create an official record, but it does not guarantee a particular investigation, settlement, or payment.

Get legal advice before a deadline closes
Claim deadlines and available remedies depend on the legal theory, the date of the conduct, the type of loan or property, and your jurisdiction. There is no reliable universal deadline that can be stated from a short description. Contact a qualified housing or consumer-law attorney promptly if you are considering a legal claim, have received a demand to sign a release, face foreclosure or another urgent servicing action, or believe evidence may be destroyed.
Where to look for help
- State-by-state legal resources identified by the CFPB.
- Legal-aid organizations funded through the Legal Services Corporation, if you meet their eligibility rules.
- Your state attorney general’s office or consumer-protection office.
- A private attorney experienced in fair lending, fair housing, mortgage servicing, or consumer credit.
When you call, bring the timeline, adverse-action notice, requested-reasons correspondence, key loan documents, and a list of deadlines. Ask about conflicts of interest, fees, confidentiality, likely next steps, and whether the lawyer can preserve evidence or communicate with the lender. A consultation is not a finding that discrimination occurred, and no lawyer can responsibly promise a recovery without reviewing the facts.
Know the current-law qualification
The legal framework is subject to change. The CFPB’s ECOA resource page reports that the Bureau issued a final rule on April 22, 2026, amending Regulation B provisions concerning disparate impact, discouragement, and special-purpose credit programs. The CFPB’s Regulation B electronic page says the rule removed the effects test and changed the discouragement provision, while warning that the electronic resource is not the official legal edition.
Because those changes may affect how particular theories are evaluated, verify the current official regulation and obtain situation-specific advice before relying on a detailed legal interpretation. Consumer-facing pages may have been reviewed or modified before the regulatory updates, so an older explanation may not describe the full current regulation. This date sensitivity does not change the immediate practical steps: preserve records, request the lender’s reasons, and act promptly.
Common mistakes that can weaken your position
- Waiting for perfect proof: You can document warning signs and ask for explanations without deciding that discrimination is proven.
- Relying only on a phone conversation: Follow up in writing and preserve the response.
- Missing the reasons-request period: Check the notice and make any request within the stated period, which CFPB guidance describes as 60 days when reasons are available on request.
- Sending every sensitive record everywhere: Share only what is needed and protect account and identity information.
- Assuming a complaint replaces legal advice: An agency process may not preserve every private claim or remedy.
- Signing a release under pressure: The CFPB’s credit-discrimination guidance says, “You shouldn’t ever feel pressured to sign.” Obtain advice before signing a settlement, waiver, or revised loan document you do not understand.
- Using inconsistent descriptions: Keep your account factual, chronological, and consistent across the lender, agencies, and any attorney.
A practical checklist for the next seven days
- Create the timeline, including application, decision, communications, and any changed terms.
- Collect the application, loan estimates, offers, adverse-action notice, credit-related notices, and communications.
- Read the adverse-action notice and calendar the stated deadline for requesting specific reasons.
- Send a written request for reasons, if the notice permits one, and save proof of delivery.
- Check your credit reports for inaccurate information if the lender cited credit data; dispute errors with the reporting company and keep the dispute record.
- Choose a complaint route that matches origination, servicing, or another housing issue; prepare dates, amounts, names, and the resolution you seek.
- Submit a CFPB complaint or contact another appropriate agency, without waiting for direct contact with the lender unless you choose that as a separate step.
- Arrange a prompt consultation with qualified legal help if a claim, foreclosure, release, or other deadline may be involved.
These steps preserve your ability to investigate without overstating what the initial facts prove. Keep monitoring correspondence, meet any stated deadlines, and update your timeline when new information arrives.
