Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsFor most U.S. home purchases, signing the closing documents ends the deal; there is no general cooling-off period that lets you simply change your mind. The Consumer Financial Protection Bureau (CFPB) states: “If you are buying a home with a mortgage, you do not have a right to cancel the loan once the closing documents are signed.” Your practical choices are to stay and solve the problem, sell, rent the property (if permitted), or seek mortgage assistance if payments are becoming unaffordable. The right path depends on your contract, loan, equity, state law, tax position and the reason for your regret.
First, determine what kind of problem you have
Regret after moving in can mean anything from buyer’s remorse to an immediate inability to make the payment. Treating every situation as ordinary remorse can be dangerous, because missed payments, hidden defects and possible fraud require faster action.

Affordable payment, fixable dissatisfaction
If you can make the payment and have no evidence of wrongdoing, pause before listing the property or making another major commitment. Write down the specific source of the regret: the neighborhood, commute, noise, layout, maintenance, an unexpected household change or a mismatch between expectations and reality. Separate a problem that can be repaired or managed from one that is fundamental, such as an unsafe condition or a location you cannot reasonably tolerate.

Track actual utility bills, commute times, repair needs and household reactions for a full month or two. A written list helps distinguish a solvable inconvenience from a problem that will continue to affect health, safety, work or finances. Avoid spending heavily on cosmetic changes until you know whether you intend to keep the property.

Payment difficulty or a likely missed payment
If the next payment may be late, contact the mortgage servicer before it is missed. Ask which loss-mitigation options apply to your loan, what documents are required, how long a decision takes and how any postponed amount will be repaid. A HUD-approved housing counselor can help at no cost, according to the CFPB. Do not wait for collection calls or foreclosure notices before asking for help.
Have your loan number, income information, expenses, hardship explanation and recent bank statements ready. Keep a log of every call, the representative’s name, the date and any promised follow-up. A request for help does not automatically stop late fees, foreclosure activity or credit reporting, so ask the servicer exactly what protection applies while an application is reviewed.
Possible legal or disclosure problem
Contact a local real-estate attorney promptly if you suspect the seller concealed a material defect, a required disclosure was false or incomplete, a promised repair was not performed, your documents do not match the transaction, or you were induced to sign through fraud or a serious misrepresentation. A legal claim is fact-specific; ordinary disappointment does not by itself undo a completed sale.

Photograph defects with dates, preserve inspection and contractor reports, and save listing descriptions, texts and emails. Ask counsel about notice requirements, warranty rights, arbitration clauses and any state deadlines before sending an accusatory letter or signing a release.
Can you cancel the purchase after signing?
Usually, no. A completed purchase transfers ownership under the deed and binds you to the mortgage and other closing documents. The CFPB’s consumer guidance says a buyer who purchases a home with a mortgage does not have a right to cancel the loan once the closing documents are signed.
That rule is different from backing out during a contract contingency period. Inspection, financing, appraisal or sale-of-another-home contingencies generally expire or are waived according to the signed purchase contract. After closing, the question is normally whether a breach, fraud, title defect or statutory remedy exists—not whether you still feel comfortable with the purchase.
Do not confuse the federal right of rescission with a purchase cancellation. Rescission generally covers certain credit transactions secured by a principal dwelling that are not used to buy or build that dwelling. Common examples can include some refinances and home-equity loans. It generally does not cover the purchase-money mortgage used to acquire the home.

How the rescission window works when it does apply
For an eligible non-purchase transaction, CFPB guidance describes a general three-business-day period after the required credit contract, disclosures and notice are provided. Written notice must reach the lender by the deadline; keep proof of delivery. In certain situations involving missing or improper disclosures, the period can potentially extend to as much as three years. That possibility is not a reason to assume you qualify. Ask a qualified local attorney to review the transaction immediately.
The three-business-day rule does not give a purchase buyer three days to reverse a house closing. State cancellation rights, contract contingencies and remedies for fraud or defects are separate questions and must be reviewed under local law. A lender, title company or online commenter cannot substitute for advice based on your signed contract and state law.
Secure your documents and create a fact file
Put the complete transaction record in one physical and digital folder. The CFPB recommends retaining key loan and purchase documents after closing. Scan paper records, use a secure backup and keep originals in a safe place.
- Closing Disclosure and any corrected versions.
- Promissory note, mortgage or deed of trust, and payment instructions.
- Recorded deed and title or settlement documents.
- Purchase contract, addenda, inspection report, appraisal and seller disclosures.
- Invoices, photographs, messages and dates relating to promised or discovered repairs.
- Insurance policy, HOA or condominium documents, rules, budgets and notices.
- Loan-servicer letters, escrow analyses, payment history and hardship applications.
Make a dated timeline: when you noticed the problem, whom you contacted and what was said. Preserve original emails, texts and photographs. Never sign a deed, release, modification or “rescue” agreement before an independent professional explains its effect. If a document appears inconsistent with what you agreed to, ask the closing agent or attorney for an explanation in writing rather than altering it yourself.

Calculate the cost of each realistic path
Emotionally appealing choices can be financially destructive if you do not compare the full numbers. Build a one-year and three-year view using actual statements and written estimates rather than a listing price or an optimistic rent quote. Use a range for uncertain values and identify how much cash you would need on a bad-but-plausible outcome.
Cost to stay
- Principal and interest payment.
- Property taxes and homeowners insurance, including any escrow increase.
- HOA or condominium charges and special assessments.
- Utilities, routine maintenance and known repair projects.
- Expected one-time improvements needed for safety or livability.
- Commuting, childcare or other household costs caused by the location.
- A reserve for unplanned repairs and insurance deductibles.
Net proceeds if you sell
Use a conservative market-value range from several local professionals or comparable recent sales. Then calculate:
Estimated sale price − mortgage payoff − other liens − broker and settlement charges − repair or preparation costs − moving costs − taxes or other transaction costs = estimated cash (or shortfall) at closing.

Ask the servicer for a payoff statement valid through an actual date; the principal balance on your statement may not equal the payoff. Selling and buying involve transaction costs, taxes and commissions, and property values can fall. If you have owned the property only briefly or made a small down payment, the sale may produce little or no cash after expenses. Request written estimates of every seller charge, including title, recording, attorney, transfer-tax and prorated expense items that apply in your jurisdiction.
Cost to move into replacement housing
Include a new security deposit or down payment, application and inspection fees, moving and storage, utility deposits, possible overlap between homes and the monthly cost of the replacement. A sale that appears to break even can still require substantial cash to relocate. If you would rent after selling, compare rent increases, deposits and lease-breaking costs; if you would buy again, include a new loan’s closing costs and the risk of another short ownership period.
Compare the available exit and relief options
| Path | When it may fit | Questions to answer before choosing |
|---|---|---|
| Stay and reassess | The home is affordable and the regret may be temporary or fixable. | What is the full monthly cost? Which specific issue can be addressed, and at what price? How long can you reasonably remain? |
| Sell with equity | Expected proceeds can cover the mortgage and selling expenses. | What is the written payoff? What are realistic settlement, repair, tax and moving costs? What will replacement housing cost? |
| Rent the property | You want to move but can carry the home and rental use is allowed. | Will the mortgage, insurance, HOA and local rules permit it? What remains after vacancy, maintenance, management, taxes and repairs? |
| Mortgage assistance | The payment is or may become unaffordable. | Which programs does the servicer offer? Is relief temporary or permanent? How and when are deferred amounts repaid? |
| Short sale or deed-in-lieu | You cannot afford the home and ordinary sale proceeds will not cover the debt, subject to approval. | Will the servicer or loan owner approve it? Is a deficiency waived? What are the credit, tax, moving and occupancy consequences? |
These paths can overlap. For example, you might request a modification while testing the market, or investigate a rental only after confirming insurance and HOA permission. Do not assume that applying for one option preserves every other option; ask the servicer about deadlines and whether an application changes foreclosure or sale requirements.
If you stay: make a time-limited recovery plan
Staying is not passive. Choose one or two measurable problems and set a review date. Obtain at least two written repair estimates, verify permits where relevant and keep a reserve for surprises. For a location or lifestyle mismatch, test alternatives such as a different commute schedule, sound mitigation or a room reconfiguration before spending heavily.
Do not make irreversible improvements solely to chase a resale price you cannot verify. Recheck the budget after the first complete cycle of taxes, insurance, utilities and maintenance; the first mortgage payment rarely shows the home’s full carrying cost. If safety is involved, prioritize temporary measures and qualified inspections rather than cosmetic work. At the review date, compare actual results with the sale and rental calculations instead of relying on sunk costs or embarrassment about changing course.
If you sell: protect yourself from an expensive rushed listing
- Confirm the payoff and liens. Request a current mortgage payoff and check for a second lien, unpaid HOA balance or other title issue.
- Get a market analysis. Ask local agents for comparable sales and a written estimate of seller charges. Treat an advertised list price as a starting assumption, not your proceeds.
- Price necessary work. Decide which repairs are required for safety or disclosure and which are unlikely to return their cost.
- Model the move. Add temporary housing, storage, moving, deposit and overlap costs to the sale calculation.
- Review the listing and sale contract. Understand the agent’s term, cancellation provisions, compensation and disclosure duties before signing.
- Plan for a shortfall. If proceeds may not cover the debt and expenses, speak with the servicer before accepting an offer; a normal sale cannot close without addressing the shortfall.
A quick resale can be costly when appreciation has not offset transaction expenses. There is no universal number of years you must stay; use your own payoff, market value and moving budget. Ask how a proposed offer affects disclosure obligations, repair credits and your net proceeds, and have the settlement statement reviewed before closing.
If you rent it: verify permission and the real cash flow
Renting can turn a personal housing problem into a landlord obligation. Check the mortgage documents, insurance policy, HOA or condominium rules, zoning and local licensing requirements before advertising. Some loans or insurance policies have occupancy conditions, and local law may require registration, inspections or tenant protections.

Prepare a conservative monthly calculation:
Rent actually collected − vacancy allowance − property management − repairs and maintenance − taxes − insurance − HOA − utilities you pay − mortgage payment = expected cash flow.
Use a reserve for major systems and periods without a tenant. A rent amount that covers only principal and interest is not necessarily profitable. Decide who will respond to emergencies, document property condition, screen applicants lawfully and comply with local notice and deposit rules. Obtain tax advice about rental income, depreciation, deductible expenses and the consequences of later selling; treatment varies with your facts and jurisdiction.

If you cannot afford the mortgage
Call the servicer using the number on your statement, not a number in an unsolicited letter. Explain whether the hardship is temporary or permanent and ask for the complete application process for every option that may apply. Ask who owns or guarantees the loan, because the available program can depend on that information.
- Refinance: A new loan may change the payment, rate or term, but approval, closing costs and current market conditions matter.
- Loan modification: The servicer may change loan terms for an eligible hardship; request the payment, interest and total-cost effects in writing.
- Repayment plan: Past-due amounts may be spread over future payments, increasing them for a period.
- Forbearance: Payments may be reduced or paused temporarily. It is not forgiveness: the full amount remains owed and must be repaid under the agreement.
- Short sale: The lender or loan owner agrees to accept sale proceeds below the debt, with approval required before completion.
- Deed-in-lieu: You transfer the home to the lender to avoid a foreclosure sale, subject to approval and negotiated terms.
Ask specifically about the due date for deferred sums, interest accrual, fees, credit reporting, tax consequences, relocation help and whether a deficiency will be waived. Freddie Mac describes sale with equity, short sale and deed-in-lieu as possible ways to leave a home, but availability depends on the borrower’s circumstances and loan. These options are not interchangeable entitlements. Get every approved arrangement in writing and continue making payments as instructed while the review is pending.
Recognize scams and misleading “urgent” mail
New owners can be targeted because deed and mortgage information is public. A letter may imitate a government office, demand an upfront fee or promise to stop foreclosure immediately. The CFPB warns consumers to verify companies independently and not to pay upfront for promised foreclosure rescue.
- Contact your servicer directly through a verified statement or official website.
- Do not pay a company that guarantees a modification, tells you to stop paying, or demands money before providing a written service agreement.
- Do not sign over title, a power of attorney or a deed without independent legal advice.
- Keep copies of every message, payment and document, and report suspected fraud to the appropriate state or federal consumer-protection authority.
When professional advice is worth the cost
Consult a local real-estate attorney for alleged nondisclosure, fraud, contract breaches, title issues, a proposed deed-in-lieu or any document that could release your rights. Consult a tax professional before a short sale, rental conversion or sale that may create a gain, loss, cancellation-of-debt income or other filing issue. A HUD-approved counselor can help organize a mortgage-hardship application at no cost. These professionals cannot guarantee a reversal or a particular servicer decision, but they can identify deadlines and consequences that a generic online answer cannot.

Frequently Asked Questions
Can I change my mind after signing the mortgage closing documents?
Usually not for a purchase loan. The CFPB says a buyer does not have a right to cancel the mortgage once closing documents are signed. A legal remedy may still exist for fraud, certain disclosure violations, title problems or contract breaches, which require local legal review.

Does the three-day right of rescission apply to buying a house?
Generally no. The three-business-day rescission period usually concerns certain non-purchase-money loans secured by a principal dwelling, such as some refinances or home-equity transactions. It generally does not apply to the mortgage used to buy or build the home.
What should I do if I may miss my mortgage payment?
Call the servicer before the due date or as soon as possible, ask which assistance options apply and request the repayment terms in writing. A HUD-approved housing counselor can help at no cost.
Is forbearance mortgage forgiveness?
No. Forbearance temporarily reduces or pauses payments, but the full amount remains owed and must be repaid under the agreement. Ask when deferred sums are due, whether interest accrues and how credit reporting will work.
Should I sell immediately if I regret the purchase?
Not automatically. First compare a written mortgage payoff and realistic sale expenses with likely proceeds, moving costs and replacement housing. A quick sale may produce little or no cash if the home has not appreciated and you have built little equity.
Can I rent out a house I just bought?
Only after checking the mortgage, insurance, HOA or condominium rules, zoning and local rental requirements. Calculate rent after vacancy, management, repairs, taxes, insurance, HOA charges, utilities and the mortgage; principal and interest alone do not show true cash flow.
What are a short sale and deed-in-lieu?
In a short sale, the servicer or loan owner approves a sale for less than the debt. In a deed-in-lieu, you transfer the home to the lender instead of completing a foreclosure sale. Both require approval, and you must ask about deficiency waivers, credit, tax and relocation consequences.
The Bottom Line
Buyer’s remorse after closing usually cannot be cured by simply canceling the purchase. Protect the mortgage payment, preserve every document, investigate possible fraud or defects promptly, and compare staying, selling, renting and hardship options with real payoff and transaction figures. Verify permissions and get local legal or tax advice when the facts involve disclosures, title, rental use, a shortfall or a proposed transfer to the lender.
