Do not ignore the notice, and do not assume it is automatically void. Authenticate it on the official Income-tax e-filing portal, download the notice and every attachment, preserve the response deadline, and identify the exact provision, tax year, issuing authority and procedural stage. Then read the court judgment’s operative directions—not just a headline or summary—to determine whether the court invalidated the provision itself, one particular notice, or only a step in the procedure. A timely, evidence-supported reply is usually the safest immediate action at the show-cause stage; a final assessment or demand requires prompt, case-specific advice on the available challenge and deadlines.
This guide is for Indian income-tax notices. The correct response depends on the statutory section, the judgment, the assessment year (or tax year), the date and manner of service, and whether the matter is a notice, an assessment order or a demand.

1. Secure the notice and its deadline first
A court ruling does not suspend the compliance date printed on a notice. Start by creating a complete, dated record.
Authenticate the communication
- Sign in to the official Income-tax e-filing portal using the taxpayer’s credentials.
- Open the notice or proceeding shown in the taxpayer’s account and download the original PDF, all annexures and any information or documents relied on by the department.
- Check whether an identical communication arrived by email, post or through an authorised representative. Keep each copy, including the portal’s issue and service records.
Do not rely on a screenshot, a search-result extract or a forwarded message. A notice that cannot be found or authenticated through the official account should be checked with the department before personal information is supplied or a response is filed.

Make a one-page case timeline
- Date shown on the notice and date it was served or made available on the portal.
- Response deadline stated in the notice.
- Assessment year or tax year and the return period covered.
- Statutory provision invoked, including any sub-section, rule or explanation.
- Name and designation of the issuing authority and the jurisdiction shown.
- Stage: information request, show-cause notice, reassessment notice, assessment order, penalty proceeding or demand.
- Earlier returns, scrutiny notices, orders, appeals, writ proceedings and correspondence for the same year.
Use the date in the notice for planning, but read the governing statute and the notice together. There is no universal response period for every income-tax communication.
2. Establish what the judgment actually decided
“The provision was struck down” can describe several different outcomes. They do not have the same effect on a live file.
Separate the three possible targets
- The provision itself: a court may hold a statutory section, rule or part of it unconstitutional or otherwise invalid.
- A particular notice or order: the court may quash one taxpayer’s document because of limitation, jurisdiction, lack of reasons or another defect without erasing the provision for everyone.
- A procedure: the court may require a prior hearing, disclosure of relied-on information or a particular approval before the department can proceed.
Obtain the complete judgment and the operative portion of the order. Check the date, court, jurisdiction, parties, statutory text considered, relief granted, whether the ruling was stayed or appealed, and whether a later order modified its effect. A judgment may bind the issuing authority only within a particular territorial or procedural setting, while a Supreme Court ruling generally has nationwide precedential force subject to its exact directions and subsequent orders.
Match the ruling to the document in hand
Compare the section and wording in the notice with the provision addressed by the judgment. A decision about one version of a section may not govern a later amendment or a different tax year. Also determine whether the judgment applied prospectively, retrospectively or only to a defined group of notices. Until that comparison is complete, describe the ruling as a possible objection—not as proof that the notice is void.

3. Respond differently at the show-cause and order stages
If the communication is a show-cause notice
File a reply by the stated deadline, even if you believe the legal basis has been invalidated. The response should be factual, document-supported and organised so the officer can decide each objection.
- Identify the notice number, date, assessment year or tax year and the provision cited.
- State the judgment’s case name, court and date, and quote only the short operative passage needed to identify the ruling. Explain whether it addresses the provision, the notice or a procedural step.
- Set out the dates and documents that show why the ruling applies to this notice.
- Raise independent statutory objections, such as limitation, missing jurisdictional conditions, lack of required information, absence of a hearing or failure to provide relied-on material, where the facts support them.
- Attach the return, computation, prior orders, correspondence and evidence that answer the department’s allegations. Label each attachment and refer to it in the reply.
- Request that the proceeding be dropped or corrected, while reserving all rights if the authority rejects the objection.
The reply should not claim more than the judgment decided. For example, if the court required a hearing before a notice, ask for that procedural protection; do not assert that every notice issued under the section has disappeared unless the operative order says so.
If a final assessment, penalty order or demand has issued
A final order changes the decision path. The notice-stage reply may no longer be enough, and an appeal, rectification request, revision, writ petition, stay application or another remedy may have a specific limitation period. The appropriate route depends on the actual order and the procedural history. Give an Indian tax professional the authenticated order, service proof, return, earlier replies, relied-on material and the complete judgment immediately. Do not estimate the appeal deadline from a general internet article.

4. What section 148 reassessment notices require under the 1961 Act
For a reassessment under the Income-tax Act, 1961, the official text of section 148 makes the notice subject to section 148A. Section 148A ordinarily requires the Assessing Officer to provide an opportunity to respond to information suggesting that income has escaped assessment before issuing the section 148 notice. The statutory language includes the phrase provide an opportunity of being heard to such assessee
.
Rank #3
The section 148 notice identifies the return period and operates within the limitation rules in the Act. Section 148A is not a substitute for reading the individual notice: the applicable deadline, information supplied, approval and limitation period must be checked in that file. If information relied on by the department was not supplied, say so specifically and request it rather than responding to an incomplete description.
5. The Supreme Court’s 2022 transition for old-form reassessment notices
Union of India v. Ashish Agarwal, order dated 4 May 2022, dealt with a defined batch of reassessment notices issued in the old form after the 2021 amendments to the 1961 Act. The Supreme Court directed that those notices be treated as show-cause notices under section 148A(b). The department had to provide the information and material relied on, taxpayers could submit replies, and the Assessing Officer then had to follow the prescribed section 148A process. Defences under section 149, the Finance Act 2021 and other applicable law remained open.
The direction also covered notices that High Courts had already quashed within that litigation. It was a special transition for that identified group. It is not an automatic cure for every later notice, nor a general answer to a notice based on an unrelated provision that a court subsequently struck down.

The judgment described approximately 90,000 reassessment notices and more than 9,000 writ petitions in the High Courts. Those figures describe the litigation discussed by the Court, not a current count of unresolved notices. Before relying on either decision, verify the later case history and the operative order against the notice’s date and form.

6. Decide which Income-tax Act governs in 2026
The transition to the Income-tax Act, 2025 makes the tax year and the date proceedings began critical. The Income-tax Department’s 2026 transition FAQs state that proceedings under the Income-tax Act, 1961 pending on 1 April 2026 continue under that Act. They also state that reassessments for tax years beginning before 1 April 2026 use the 1961 Act, while sections 279–286 of the 2025 Act apply to tax year 2026–27 and later.
| Question | Why it matters | What to record |
|---|---|---|
| Which tax year is named? | It indicates whether the 1961 or 2025 Act’s reassessment provisions are potentially relevant. | The exact year or period printed in the notice. |
| Had proceedings begun before 1 April 2026? | Pending proceedings generally continue under the 1961 Act under the Department’s transition guidance. | Date of the first notice or proceeding and proof of service. |
| Is the notice for tax year 2026–27 or later? | Sections 279–286 of the 2025 Act apply to those years. | Tax year, section cited and notice date. |
What sections 280 and 281 say in the 2025 Act
Under the current consolidated text of section 280, a reassessment notice follows the section 279 process and requires a return within the period stated in the notice. The post-Finance Act 2026 text sets that period at not less than 30 days from the notice date and not more than three months from the end of the month in which the notice was issued. This is a statutory range, not permission to disregard the specific date printed on the notice.
Section 281 provides a pre-notice opportunity to be heard, subject to the section’s conditions. Whether that opportunity was required, supplied or adequate must be tested against the facts and the applicable text. These provisions do not by themselves establish that a particular notice is valid or invalid.
7. Compare an old-form transition notice with a new notice
Do not compare outcomes until the following facts are aligned:
Best Value
- It can be a gift option
- Comes with secure packaging
- Helpful in various ways
| Comparison point | Old-form section 148 notice in the 2022 transition batch | New or unrelated notice |
|---|---|---|
| Statutory basis and date | Old-form notice issued after the 2021 amendments and within the batch addressed by Ashish Agarwal. | Exact section, wording and issue date must be established; no automatic transition follows. |
| Supreme Court directions | Potentially treated as a section 148A(b) show-cause notice, with disclosure and a reply opportunity. | Apply only if the notice actually falls within the judgment’s defined directions. |
| Information and hearing | The department was directed to provide relied-on material and follow section 148A. | Check the governing statute and the notice for the required material and hearing. |
| Act and tax year | Generally a 1961 Act reassessment issue. | Tax years beginning before 1 April 2026 and pending proceedings may remain under the 1961 Act; 2026–27 onward uses the 2025 Act framework. |
| Procedural stage | Usually a notice converted into a show-cause process by the Court’s directions. | Could be a notice, assessment order or demand, each with different remedies and deadlines. |
8. Preserve the evidence that can decide the objection
Create a secure folder containing the authenticated notice and attachments, portal access and service records, filed returns and computations, assessment orders, the department’s relied-on information, every reply and acknowledgement, and the complete judgment with later orders. Keep the original file names and note when each document was downloaded. If the issue concerns a procedural hearing, preserve proof of what was disclosed, when it was disclosed and how much time was allowed to respond.
Do not delete an earlier order merely because a later notice refers to the same year. The procedural history can determine whether the department had jurisdiction, whether a limitation period ran, and which remedy remains available.
9. Common mistakes and how to avoid them
- Ignoring the deadline: a potentially strong legal objection can be weakened by a late or missing reply.
- Relying on a headline: read the operative directions and later orders, not only a news summary.
- Confusing a quashed notice with a struck-down provision: one taxpayer’s relief does not necessarily invalidate every notice.
- Assuming Ashish Agarwal applies universally: its transition concerned a defined group of old-form reassessment notices.
- Using the wrong Act: establish both the tax year and whether proceedings were pending on 1 April 2026.
- Sending unsupported assertions: connect each objection to a date, document, statutory condition or paragraph of the judgment.
- Choosing a remedy too early: an order-stage appeal or writ decision cannot be selected responsibly without the actual order and service history.
10. When to obtain professional help
Seek an Indian tax professional promptly when the notice alleges escaped income, involves a completed assessment or demand, cites a limitation-sensitive provision, follows an earlier writ or appeal, or relies on a judgment whose operative effect is disputed. Provide the professional with the complete record rather than only the first page of the notice. Ask for a written view identifying the governing Act, the judgment’s applicability, the immediate filing deadline and the proposed procedural remedy.
