If you think you paid too much for silver bullion, do not start with a complaint or a payment reversal. Start with the sales records and the dealer’s written terms. Identify the product and its fine-silver weight, reconstruct the complete cost, compare it with the spot price on the purchase date, and then ask the seller in writing for a specific remedy. A large premium can be a poor deal without proving fraud, and U.S. law does not provide an automatic refund merely because the buyer later considers the price excessive.
Secure the evidence before contacting anyone
Preserve every document and message connected with the purchase. Save local copies of the product page, advertisement, quote, order confirmation, invoice, contract, return policy, cancellation policy, payment receipt, shipping record, tracking page, delivery confirmation and dealer emails or texts. If the conversation occurred by telephone, write a dated note describing who said what and when.

Keep the bullion, packaging, assay card and any certificates in the condition in which they arrived. Do not sell, melt, alter, clean or send the item back until you understand the return instructions. Photograph the package, labels, serial numbers and the item itself. Those records can matter if the dispute concerns what was advertised, what was delivered or whether a return condition was met.
Create a short timeline: the date you saw the offer, the date and method of payment, the promised shipping date, the actual delivery date and every attempt to obtain a resolution. Pennsylvania’s consumer-complaint guidance, for example, advises gathering supporting records and keeping notes; that is useful preparation even though state procedures differ. Work out whether the price was actually excessive
Use the market reference that applied when you bought the metal, not a later quote. The Commodity Futures Trading Commission (CFTC) describes spot price as the cash price for immediate delivery, normally quoted in U.S. dollars per troy ounce. Silver prices move every day, so a later rise or fall cannot by itself show that the original transaction was unfair.
Measure fine silver, not package weight
Record the actual fine-silver content. A coin or bar can contain less silver than its gross weight, and a package can include capsules or other material. For a product stated in troy ounces, multiply the number of ounces by the fineness. For example, a 1-troy-ounce .999 coin contains 0.999 fine troy ounces. If the product is quoted in grams, convert the stated fine-metal content to troy ounces before comparing it with a per-ounce spot quote.
Separate the components of your cost

A simple calculation is:
Premium dollars = dealer’s metal price − purchase-date spot value.
Premium percentage = premium dollars ÷ purchase-date spot value × 100.

Illustrative calculation
Suppose you bought ten fine troy ounces when spot was $28 per ounce. The spot value was $280. If the dealer charged $390 for the metal and $20 for shipping, the metal premium was $110, or 39.3% of spot, and your total cash cost was $410. If the dealer later quoted a $250 buy-back price, that quote reflects a potential spread and does not change the purchase-date calculation. The figures are an illustration, not a current market quotation.
Retail bullion commonly sells above spot, and dealers may buy it back below spot. The gap between a dealer’s selling and buying prices is the spread. The CFTC warns that “The greater the spread and other transaction or ongoing costs, the more the spot price would have to rise for you to make a profit.” There is no official universal premium cap that automatically makes a sale unlawful or entitles a buyer to a refund.
Decide what kind of problem you have
A disclosed but expensive transaction
If the product, weight, price, fees and return terms were accurately disclosed and you agreed to them, your strongest argument may be that the transaction was unfavorable rather than deceptive. Ask for a goodwill adjustment or return if the contract allows one, but do not describe an ordinary pricing disagreement as fraud without evidence.
A missing or misleading disclosure
Concern is more serious if the dealer misstated fineness or weight, advertised one price and charged another, hid mandatory fees, promised a buy-back arrangement that does not exist, substituted a different product, or made a material claim that the records contradict. Organize the exact wording, the date and the document or message where it appears.

Possible fraud or a suspicious operation
The CFTC has stated that, over the past decade, it charged numerous companies with selling overpriced precious metals to customers, for an alleged total of more than $500 million in fraudulent sales. “Alleged” matters: the statement does not mean every high-premium sale is fraudulent or that the figure represents adjudicated losses. Indicators such as pressure to liquidate retirement assets, promises of guaranteed profits, refusal to provide written terms, or unexplained changes to the product warrant prompt reporting and professional advice.
Read the contract before seeking a refund
Find the sections covering returns, cancellations, restocking charges, delivery, authentication and dispute procedures. Note the deadline, whether the item must be unopened, who pays return shipping and when a refund is issued. Match those terms against your timeline and the condition of the bullion.
The reviewed federal guidance does not establish a general cooling-off period for a bullion purchase simply because the premium now seems too high. The Federal Trade Commission’s shipment rule applies to covered mail, internet or telephone orders when the seller cannot meet the promised shipping time, or 30 days when no time was promised. In that situation, the seller must obtain consent to a delay or cancel and promptly refund unshipped merchandise. That rule should not be treated as a general right to cancel a delivered order because of a price-only disagreement.
Whether another cancellation, refund or damages right exists depends on your state, the contract, the sales method, delivery, representations and deadlines. Do not assume that a rule from another state or a general internet purchase article applies to your transaction.

Ask the dealer for a specific remedy
USAGov’s online-purchase guidance recommends trying to resolve the problem with the seller or website first. Send a calm written request through the dealer’s stated customer-service channel and, if appropriate, by a trackable method. Identify the order, state the discrepancy, attach your calculation and request one concrete outcome.
Subject: Request to resolve order [order number]
I purchased [product, quantity and stated fine weight] on [date] for [metal price], plus [fees]. My records show [specific discrepancy, such as a different weight, undisclosed charge or conflicting advertised price]. Using the purchase-date spot reference of [source and quote], the fine-metal calculation is [calculation].
Please provide [requested remedy: return authorization under clause X, a price adjustment of $Y, correction of the charge, or another specific resolution] by [date]. I have attached the invoice, listing, payment record and delivery documents. Please confirm the applicable return instructions and refund timing in writing.
Sincerely,
[Your name]Do not exaggerate the premium, threaten criminal action as a negotiating tactic or omit facts that weaken your position. Keep copies of the message and any response. If the dealer offers a partial credit, ask whether accepting it releases other claims and obtain the terms in writing before agreeing.

Consider payment disputes carefully
A card dispute, bank claim or other payment remedy may be available in some circumstances, but eligibility and deadlines depend on the payment method, the reason for the dispute, your location and the agreement with the provider. A disagreement over a disclosed premium is different from an unauthorized charge, non-delivery or materially misrepresented product.

Ask the payment provider for its written process and deadline. Describe the facts accurately, submit the same supporting records and continue responding to requests while the investigation is open. Do not claim that a payment was unauthorized when you made it, and do not rely on a chargeback as a guaranteed refund mechanism.
For a large loss, suspected deception, a contract with an arbitration clause or a dispute approaching a filing deadline, consult a qualified consumer attorney. Small-claims availability, court limits and limitation periods vary by state. Legal advice is especially important if the dealer is outside your state or if the transaction involved a retirement account.
If the purchase involved an IRA or other retirement account
Physical-metals transactions funded through a tax-advantaged account can involve custodian, storage, valuation, distribution and tax issues in addition to the dealer’s price. Do not move, liquidate or roll over retirement assets based solely on a sales pitch or an apparent loss calculation. The CFTC advises consulting qualified professionals before major changes to tax-advantaged retirement plans. A tax professional and an attorney can explain consequences that a dealer’s representative may not be qualified to assess.

- Request the exact product, purity, fine weight, retail price, premium, shipping, insurance, payment fees and buy-back terms in writing before paying.
- Record the spot quote, date, time zone and product assumptions used in your comparison.
- Ask whether the price is for generic bullion, a sovereign-mint coin, a collectible item or another category; premiums and liquidity can differ.
- Read return, cancellation, restocking and authentication provisions before placing the order.
- Check the dealer’s history with your state attorney general and consumer organizations.
- Be cautious when a salesperson creates urgency, promises guaranteed returns or urges you to transfer retirement funds.
- Keep the invoice and all communications for as long as the contract, payment network and applicable law could require.
What your records should show before you decide
You have a usable case assessment when you can answer seven questions: What exact item and fine weight did you buy? What spot reference applied on the purchase date? What did the dealer charge for the metal? Which fees increased the total? What return or cancellation term was agreed? What would the dealer pay to buy it back, if quoted? Was the item delivered exactly as represented? Those answers distinguish a disappointing but disclosed bargain from a possible misrepresentation and point to the right escalation route.
Base your request on the written deal and the facts that can be proved. Market volatility may change the value after purchase, but it does not rewrite the agreement. A documented, specific request gives the seller—and, if necessary, a consumer agency, payment provider or lawyer—the clearest basis to evaluate what happened.
