Missing the revised-return deadline does not automatically end your options. First identify your assessment year (AY), whether a valid original return was filed, the section used, and whether any assessment or other proceeding is pending. A revised return may still be possible if that year’s window remains open; otherwise, an updated return (ITR-U) may be available, but only under restrictive conditions and usually with additional tax.

This guide applies to India and is general information, not a determination of your eligibility for a particular year.

Start with the four facts that determine your route

Do not begin by selecting a form. Write down these facts first:

  1. Assessment year: The deadline and governing statute depend on the AY. For example, AY 2025-26 and AY 2026-27 have different revised-return rules.
  2. What you filed: Record whether you filed an original return, a belated return, or a previous revised or updated return. If you filed nothing, the analysis starts with a late original return or ITR-U, not a revision.
  3. How and when you filed: Note the filing date, section selected, acknowledgement number and whether the return was e-verified. An unverified return may not have the same status as a validly filed return.
  4. What is happening now: Check for an assessment, reassessment, recomputation, revision, notice, search or survey, communicated information, or prosecution proceeding. These events can prevent an updated return.

Also classify the correction. Is it omitted income, an understated tax amount, a missed deduction, a calculation error, or a change that would reduce tax or create a larger refund? That direction matters because ITR-U is designed to increase the income or tax reported, not to reduce an earlier liability.

Which filing route fits your situation?

Situation Potential route Important limit
No valid original return was filed by the normal due date Belated return, if the statutory period for that AY remains open Late fee and interest can apply; this is not the same as revising an already-filed return.
A valid return was filed and the revised-return window is still open Revised return Use the AY-specific deadline and check whether an assessment has been completed or an extension announced.
The revised window has closed, and the proposed correction increases taxable income or tax Updated return (ITR-U), if all section 139(8A) conditions are met It generally cannot report a loss, reduce tax, or create or increase a refund. Additional tax is payable.
The change would lower tax, increase a refund, or is blocked by an ITR-U restriction Do not assume ITR-U works Obtain professional advice about any other statutory remedy; the facts and proceeding status control.

A late original return and a correction to an already-filed return are separate questions. Filing a belated return is not a substitute for revising a valid return, and an ITR-U is not a general-purpose replacement for a revised return.

Revised-return deadlines are assessment-year specific

AY 2025-26

The Income Tax Department’s AY 2025-26 FAQ gives 31 December 2025 as the revised-return deadline. As of October 2026, that date has passed unless a later, case-specific official extension applies. Do not rely on a prior-year deadline displayed in an old utility or saved browser bookmark.

AY 2026-27

The Department’s AY 2026-27 FAQ describes a revised-return deadline of 31 March 2027, in connection with the Finance Bill, 2026 proposal. It also says that filing after 31 December and through 31 March attracts a section 234I fee of ₹1,000 when total income is up to ₹5 lakh and ₹5,000 when total income exceeds ₹5 lakh. These amounts and the deadline are tied to AY 2026-27 and the rule in force; confirm the portal’s calculation on the day you file.

Which Act applies?

The Department says returns for AY 2026-27 and earlier years continue under the Income-tax Act, 1961 even though the Income Tax Act, 2025 takes effect on 1 April 2026. Its materials describe the AY 2026-27 revised-return window under the old Act as ending on 31 March 2027. Later tax years use the new Act framework. This transition means you should not apply a single formula to every old year.

What an updated return (ITR-U) can and cannot do

Section 139(8A) provides a possible route after the revised-return period, including where no original, belated or revised return was filed. Eligibility is factual and statutory, not automatic.

Situations an ITR-U is generally intended to address

  • Income was omitted or understated and the correction increases the tax payable.
  • A return was not filed, but the taxpayer can now make a compliant disclosure within the permitted period.
  • A prior return contained an error that can be corrected without reducing the tax determined earlier or increasing a refund.

Core restrictions

The Department’s explanations state that an updated return generally cannot:

  • Be a return of loss.
  • Reduce the tax liability determined in an earlier return.
  • Create or increase a refund.
  • Be filed more than once for the relevant year under the new Act summary.

The statutory exclusions also cover specified search and survey events; pending or completed assessment, reassessment, recomputation or revision proceedings; a previous ITR-U for the year; certain communicated information; and prosecution proceedings. The exact wording and effective dates matter. A return that appears to increase income may still be barred because of a notice, search, survey or proceeding.

Updated-return time limits

The Department describes the Income Tax Act, 2025 updated-return period as 48 months from the end of the financial year succeeding the relevant tax year. Current materials under the old Act also describe an expanded ITR-U window of 48 months, but the calculation depends on the relevant AY and amendments. Use the rule applicable to that year rather than treating “48 months” as a universal calendar shortcut.

Additional tax can make ITR-U expensive

The Ministry of Finance’s Finance Bill 2026 material describes additional income tax on an updated return at these rates, calculated as a percentage of aggregate tax and interest payable:

When the updated return is filed Additional tax described in the Finance Bill 2026 material
First year 25%
Second year 50%
Third year 60%
Fourth year 70%

The same material describes a further 10% for a notice-based updated return under the new Act beginning 1 April 2026, applicable to tax year 2026-27 onward. Enactment, commencement and the old-Act/new-Act transition determine whether a particular percentage applies. Do not multiply an estimate from memory; use the current portal calculation and verify the provision for your AY.

In addition to any ITR-U additional tax, ordinary tax and applicable interest must be paid. A professional calculation is prudent when the omitted income is substantial, spans several sources, or involves foreign assets, capital gains, business income or tax credits that do not reconcile.

How to prepare before choosing a form

  1. Collect the return trail. Download the filed return, acknowledgement, computation, challans and e-verification record. Note the section under which it was filed and every previous revision or ITR-U.
  2. Gather year-specific evidence. The Department lists Form 16, Form 16A, Form 26AS, the Annual Information Statement (AIS), pay slips, bank statements and other relevant records as useful filing documents.
  3. Reconcile tax data. Compare AIS and Form 26AS with actual receipts and tax deducted or collected. Ask the employer, bank or other deductor to correct a mismatch before filing where necessary; do not copy an incorrect entry simply because it appears in an information statement.
  4. Describe the error in one sentence. Examples include “salary per Form 16 was omitted,” “interest income was understated,” “a deduction was claimed without support,” or “the proposed change would reduce taxable income.” This makes the route easier to test.
  5. Check proceedings. Search the e-filing portal for notices, assessment or reassessment status and communications. Record dates and section numbers.
  6. Estimate the complete cost. Include tax, interest, any late fee, ITR-U additional tax and payment reference. A correction that appears small can become material after interest and the applicable additional-tax percentage.

Step-by-step: filing a revised return while the window is open

  1. Sign in to the Income Tax Department e-filing portal and select the correct AY and the option to file a revised return.
  2. Use the current, AY-specific ITR form and utility. Enter the original acknowledgement number and filing date exactly as shown in your records.
  3. Correct every affected schedule, not only the line where you first noticed the error. Recheck income, deductions, tax credits, bank details and residential status.
  4. Validate the computation and pay any resulting tax, interest or applicable fee before submission.
  5. Submit the return and complete e-verification using an available method. Save the acknowledgement and verification confirmation.

If the portal does not offer a revised-return option, stop and confirm the deadline, filing section and return status. Do not submit an ITR-U merely because the revision button is unavailable; the two routes have different eligibility rules and costs.

Step-by-step: evaluating and filing ITR-U

  1. Confirm the year and window. Determine the AY, the Act governing it and whether the 48-month period or another applicable period is still open.
  2. Run the exclusion check. Review search or survey history, notices, assessment or reassessment status, communicated information, prosecution proceedings and any earlier ITR-U.
  3. Test the direction of the change. The updated return must not reduce earlier tax or create or increase a refund, and it generally cannot be a loss return.
  4. Open the current utility. The Department’s downloads page provides year-specific utilities and versions. Prepare the relevant ITR using the current utility and generate the required JSON; do not rely on an old saved copy.
  5. Enter the additional income and recompute. Include the correct tax, interest and the portal-calculated additional tax. Check that the resulting liability is paid through the proper challan before filing.
  6. Submit and e-verify. Download the acknowledgement and retain the payment and verification records with the supporting documents.

Only one updated return may be available for a relevant year under the new Act summary. Treat the submission as final for that year and have a chartered accountant review the computation first when the amount or eligibility is uncertain.

Common mistakes that cause a second problem

  • Using the wrong AY: Income earned in a financial year is reported in the following assessment year. Selecting a neighboring AY can change the form, deadline and law.
  • Confusing an unfiled return with a bad return: If nothing valid was filed, investigate a belated return or ITR-U. A revised return presupposes an eligible earlier return.
  • Trying to claim a bigger refund through ITR-U: The restriction is fundamental; ITR-U is not a route for reducing liability or increasing a refund.
  • Ignoring verification: Submission without the required e-verification can leave the filing incomplete or invalid.
  • Relying on stale utilities: Forms, JSON schemas and portal validations change by AY. Download the current release.
  • Overlooking proceedings: A notice or assessment can change eligibility even when the tax calculation itself is straightforward.
  • Assuming AIS is conclusive: Reconcile it with source documents and corrected statements. Information reports can contain mismatches.

When to involve an Indian tax professional

Consult a qualified Indian chartered accountant or tax professional before filing when a search or survey is involved, an assessment or reassessment is pending or completed, the proposed correction would reduce tax or increase a refund, the return includes business or foreign income, several years are affected, or the potential tax and additional tax are material. This recommendation follows from the interaction of statutory exclusions, changing Acts and year-specific calculations; it is not a guarantee that a professional can make an otherwise ineligible return allowable.

Give the adviser your original and revised acknowledgements, notices, AIS, Form 26AS, Forms 16 and 16A, bank records, challans and a written description of the error. That file allows the eligibility analysis and tax computation to be checked together.

A practical decision checklist

  • Have you identified the exact AY and the Act that governs it?
  • Was a valid original or belated return filed, and was it verified?
  • Is the revised-return deadline still open for that year?
  • Does the correction increase income or tax, rather than reduce tax or increase a refund?
  • Is there any notice, assessment, reassessment, revision, search, survey, communicated information or prosecution issue?
  • Have you checked whether an ITR-U was already filed for the year?
  • Have you downloaded the current AY-specific utility and calculated tax, interest, fee and additional tax?
  • Will you retain the acknowledgement, payment challan, JSON and e-verification proof?

Bottom line

If you missed the revised-return deadline, first establish whether the year’s revised window is truly closed and whether the original return was valid. A belated return addresses a missed original filing; it does not replace revision. After the revision window, ITR-U may correct an upward tax adjustment if the statutory exclusions do not apply, but it cannot generally create a loss, lower tax or increase a refund and may add 25% to 70% of aggregate tax and interest depending on timing. Use the current portal calculation for your AY, verify the old-Act/new-Act transition, and obtain professional advice where proceedings or eligibility are unclear.
