If a tax-audit report appears to be late, first verify the assessment year and taxpayer category: an extension may still apply. For a genuinely overdue filing, contact the appointed chartered accountant (CA), prepare the correct audit form and evidence explaining the delay, and use the e-Filing portal’s statutory-form condonation process. Submitting a request does not by itself authorise late filing.
Check whether the deadline has actually passed
Do not treat a missed calendar reminder as proof of default. The applicable date depends on the assessment year, the taxpayer’s statutory category and any later Central Board of Direct Taxes (CBDT) notification or circular.

AY 2026–27 (FY 2025–26) dates
The Income Tax Department’s Income Tax Forms guidance lists 30 September 2026 as the baseline date for furnishing the audit report for Assessment Year (AY) 2026–27. CBDT Circular No. 07/2026, dated 28 September 2026, extends that date to 21 October 2026 for the category covered by the circular—the category whose income-tax return date was extended from 31 October to 21 November 2026. The extension is conditional, not a blanket change for every taxpayer.

Questions to answer before taking any remedial step
- Which financial year and assessment year are involved?
- Which provision and taxpayer category make an audit report necessary?
- Was the return date, and therefore the related audit-report date, extended for that category?
- Has the CA uploaded a report, saved a draft or received a portal error?
- Is the account governed by another audit law, affecting the report form?
Keep screenshots or downloaded notices showing the date and category you relied on. They help the CA explain the chronology if a condonation request is needed.
Choose the correct audit-report form
For FY 2025–26/AY 2026–27, the Department says the Income-tax Act, 1961 forms remain applicable even when the electronic filing occurs after 1 April 2026. The report is filed as a pair: Form 3CA or 3CB together with Form 3CD.

| Accounts situation | Report combination for AY 2026–27 | Portal submission | What to confirm |
|---|---|---|---|
| Accounts are required to be audited under another law | Form 3CA with Form 3CD | Submitted electronically by the appointed CA | Identify the other law and retain that audit report and particulars |
| No audit requirement under another law, but section 44AB requires a tax audit | Form 3CB with Form 3CD | Submitted electronically by the appointed CA | Ensure the business or profession falls within the relevant section 44AB category |
| Tax Year 2026–27 under the Income-tax Act, 2025 | New Form 26 combines the earlier reports | Follow the form available for that tax year | Do not carry AY 2026–27 instructions into this later tax-year regime |
The Department’s Form 3CB-3CD FAQ explains that the taxpayer must register and assign the CA before the CA can access the form. The CA prepares the utility and submits the report with a digital signature certificate (DSC). A taxpayer cannot cure a late report by selecting an incorrect form or by uploading the report personally where CA submission is required.
What to do immediately after discovering a delay
- Call the appointed CA. Ask for a written confirmation of the assessment year, the applicable date, the correct 3CA-3CD or 3CB-3CD route, and the current status of any draft or submission. If no CA is assigned on the portal, complete the assignment before expecting the form to be available.
- Reconcile the accounts and audit particulars. Provide the final books, financial statements, ledgers, tax records and information needed for Form 3CD. The CA should work from complete records rather than backdating a report.
- Build a factual delay file. Collect portal messages, system acknowledgements, correspondence, medical or other contemporaneous documents, and a short chronology. Include only material that is genuine and relevant. Never invent, alter or backdate an explanation.
- Check whether the portal permits the overdue form. Your CA should attempt the normal statutory-form filing after confirming the period and form. If the system blocks an overdue period or instructs you to seek permission, use the condonation route rather than repeatedly submitting an incorrect form.
- Submit the report or condonation request through the correct account. The taxpayer generally initiates the request, while the CA prepares and digitally signs the audit report. Keep the taxpayer login, CA login and DSC steps separate so that the wrong user does not leave an incomplete transaction.
- Preserve every reference number. Download the acknowledgement, request ID, attachments list and portal messages. Give copies to the CA and monitor the account for a decision or additional-document request.
How to file a statutory-form condonation request
The Income Tax Department’s Condonation request for filing Statutory Forms: User Manual sets out the portal path. Labels can change, so follow the wording displayed in your account.
- Sign in to the e-Filing portal with the taxpayer’s credentials.
- Open Services, choose Condonation Request, then select Application for Statutory Forms.
- Create a new request and enter the relevant assessment year, statutory form and report details exactly as the CA has prepared them.
- Describe the delay in a chronological, fact-based statement. Explain what prevented timely filing, when the issue was discovered, and what action was taken to complete the report.
- Attach the necessary supporting documents in the format and size accepted by the portal. Use readable files whose dates and names match the explanation.
- Review the declaration, submit the request and complete e-verification using the method offered for that account.
- Save the acknowledgement and monitor the request under the portal’s condonation or pending-actions area. Tell the CA immediately if the authority asks for clarification.
A request is an application for permission, not a late-filing acknowledgement. The manual states that statutory-form filing is subject to permission from the appropriate competent Income Tax authority. The portal may therefore leave the overdue period unavailable until the authority acts, and the existence of a submitted request does not prove that the audit report has been furnished.

What happens after submission
If the portal accepts the report
Download the final acknowledgement and ask the CA to verify that the form is visible against the correct taxpayer and assessment year. Match the report details with the income-tax return before relying on the filing as complete.

Read the exact error, confirm that the CA assignment and DSC are valid, and check that the selected form and assessment year are correct. If the message points to an overdue statutory form, stop attempting random combinations and file the condonation application described above.
If the authority asks for more information
Respond through the portal within the displayed time, using documents that existed when the delay occurred. Keep the response consistent with the original chronology. Ask the CA to review technical and legal wording before submission.

If the request is refused
Obtain the refusal message and have the CA determine what remedy, additional application or other compliance step is available for that assessment year. Public portal guidance does not establish the outcome for every taxpayer, so do not assume that a refusal can be ignored or that a later upload will automatically be accepted.

The official material used here does not establish a single penalty amount or a universal waiver for every late tax-audit report. The result can depend on the assessment year, the statutory requirement, the facts causing the delay, whether the report was eventually furnished and the competent authority’s decision. Have the CA check the law and administrative guidance applicable to the specific case before quoting any amount or promising relief.
Do not describe condonation as an amnesty. It may permit the late statutory form to be filed, but it does not automatically settle every consequence connected with a late audit, late return or inaccurate particulars. Keep the audit work truthful and complete even while the permission request is pending.

Common mistakes that make a late filing harder to fix
- Assuming the 30 September date applies to every AY 2026–27 taxpayer without checking the circular’s category.
- Using Form 3CB when another law required an audit, or using Form 3CA without that underlying audit.
- Confusing FY 2025–26/AY 2026–27 forms with the later Tax Year 2026–27 Form 26 regime.
- Submitting a condonation request with a vague explanation and no supporting chronology.
- Backdating records, altering a portal screenshot or asking the CA to certify an event that did not occur.
- Assuming that an acknowledgement for the condonation request is the same as acceptance of the audit report.
- Quoting a penalty from another year or taxpayer category without checking the governing law.
Records to retain for the case file
Keep the signed engagement and CA assignment details, final accounts, the completed report and Form 3CD, portal acknowledgements, error messages, condonation request and attachments, e-verification proof, and all communications with the CA and the Income Tax Department. Store the files under a clear assessment-year naming system so that a future query can be answered without reconstructing the timeline.
Because deadlines and forms can change, ask the CA to confirm the applicable assessment year, category, latest CBDT communication and portal status immediately before filing. For AY 2026–27, use the 1961 Act forms described above; for a later tax year, verify whether the new Form 26 applies.
