What to Do If You Lost an IRS Letter or Missed Its Deadline

By TheFinanceBase Team 8 min read

If you lost an IRS letter, first sign in to your IRS Online Account and check Notices and Letters. Only selected notices are available there, so keep checking your postal mail. Once you identify the notice number and date, follow that notice’s instructions and contact the IRS promptly if its deadline has passed.

Do not assume that every IRS deadline can be extended. A statutory Notice of Deficiency—often called a 90-day letter—has a separate Tax Court petition deadline that generally is 90 days, or 150 days for certain notices addressed outside the United States.

1. Check your IRS Online Account first

Sign in to your IRS Online Account and open Notices and Letters. You may be able to view or download a digital copy of the missing correspondence. The IRS states: “No, only select number of notices are available to view or download in your online account.”

That limitation matters. An empty Notices and Letters section does not prove that the IRS never sent a letter. Continue checking the postal address the IRS has on file, including mail received after you first searched online. If you recently moved, confirm that your address is updated through the IRS’s official procedures, but do not wait for an address change to deal with an existing deadline.

What online access can and cannot do

  • It can: provide a downloadable copy of some notices and let you review certain account information without waiting for another mailing.
  • It cannot: serve as a complete archive of every notice, replace the instructions on a notice that is unavailable online, or prove that no notice was issued.
  • If nothing appears: use official IRS notice-assistance or contact channels and keep monitoring postal mail. Do not use an unverified third-party “notice lookup” service.

2. Identify the notice number and printed date

Before you pay, upload documents, fax anything, or send a written explanation, identify the notice number. IRS correspondence normally has a code such as CP2000, CP14F, CP169, or CP3219A, or a letter number. Record the tax year, the date printed on the notice, the response deadline, the amount shown, and the telephone number or mailing address printed on it.

The notice number determines the correct response path. IRS Topic 651 explains that a notice should tell you why the agency contacted you and how to handle the issue. It also states: “All notices should tell you where to send your response.” Use that address, fax number, upload portal, or payment instruction rather than an address found in an unrelated online discussion.

Use a transcript only as a supplement

An account transcript can help you understand account history, but it is not necessarily a copy of the missing letter. The IRS warns that transcripts may not show the most recent penalties, interest, changes, or pending actions. A transcript therefore cannot establish every fact that appeared in the notice or substitute for the notice’s specific deadline and submission instructions.

Find the IRS page for the exact notice

After you have the CP or letter number, read the IRS page devoted to that exact notice. Notice-specific pages explain what triggered the contact, what documents to send, where to send them, and what happens if you do nothing. Do not apply a response period from one notice to another. A 30-day period, for example, may apply to a particular notice such as CP142 but is not a general IRS deadline.

3. What to do when the deadline has passed

Act as soon as you discover the missed date. Use the official contact details printed on the notice or the IRS’s official notice-assistance channels. Explain that the letter was lost or found late, state the notice number and tax year, and ask what options remain.

A late contact does not automatically create an extension, waiver, or right to have a response accepted. The IRS may have different procedures depending on the notice, the type of tax issue, and the action already taken. Ask the representative to explain the next available step and write down the date, time, representative’s identifying information if provided, and any confirmation number.

Prepare before you call or write

  • Your full name, taxpayer identification information, and current mailing address.
  • The notice number, tax year, printed date, and deadline, if known.
  • Copies of the notice or any scan, envelope, transcript, or prior IRS correspondence.
  • A concise explanation of when you discovered the notice and why the response was not made earlier.
  • Supporting records, such as payment evidence, income documents, amended-return information, or authorization forms if someone is representing you.

Keep the explanation factual. Do not send original records unless the notice specifically requires them. If you cannot obtain a copy of the letter, tell the IRS exactly what information is missing and ask how to obtain or confirm it.

Example: CP2000

A CP2000 generally concerns a possible mismatch between information reported to the IRS and information on a tax return. The IRS lists upload, fax, or mail options for responding to CP2000 notices. If you need more time, the CP2000 instructions say to send a request for more time with your reply. That option is specific to the CP2000 process; do not assume another notice offers the same procedure.

Use only the submission channel and destination shown for your CP2000. Include the notice response page, identify whether you agree or disagree with the proposed change, and attach the records requested. Preserve evidence that the IRS received your response.

4. Understand the consequences of different missed notices

A missed date can lead to very different outcomes. The consequence depends on what the notice required and whether the IRS has already taken further action.

Notice example What the IRS guidance warns about Practical response
CP169 The return may be treated as delinquent, and collection enforcement may begin. Contact the IRS promptly, determine whether a return is missing or another issue is involved, and follow the notice’s filing or payment instructions.
CP14F A late unpaid balance can continue accruing penalties and interest. Confirm the balance and payment instructions, ask about available options, and do not delay while waiting for a replacement letter.
CP2000 The IRS proposes a change based on information matching; the notice provides response methods. Respond through the listed upload, fax, or mail route and include an extension request with the reply if needed.
Statutory Notice of Deficiency, including CP3219A guidance A separate Tax Court petition period applies; an IRS response does not extend it. Confirm the notice date immediately and consider qualified tax or legal advice if the period is near or has expired.

These examples are not interchangeable. A payment notice, a proposed adjustment, a delinquent-return notice, and a statutory court notice require different decisions. Always anchor your response to the notice number and its own instructions.

5. Treat a Notice of Deficiency as urgent

A statutory Notice of Deficiency is sometimes called a 90-day letter. It generally gives the taxpayer 90 days from the date on the notice to file a petition with the United States Tax Court. For certain notices addressed outside the United States, the period is generally 150 days. The notice itself controls the date and explains where and how to petition.

The Tax Court period is different from an ordinary IRS correspondence deadline. Calling the IRS, mailing a response, asking for another copy, or waiting for an IRS employee to answer does not extend the petition deadline. IRS guidance for CP3219A states: “No. But if you have additional information you want us to consider, reply as soon as possible.” That invitation to provide information does not replace or lengthen the court-petition period.

If the 90-day or 150-day period is still open

  1. Confirm the notice date and calculate the deadline exactly as stated in the notice.
  2. Read the petition instructions and preserve the complete notice, including all pages and the envelope.
  3. Decide promptly whether you need qualified tax or legal advice about filing a petition.
  4. Do not rely on an IRS phone conversation as proof that the court deadline has been extended.

If the period may have expired

Contact qualified tax or legal help immediately and ask the adviser to evaluate the procedural posture. An adviser may help explain available remedies, but you should not assume that anyone can restore a missed statutory deadline. Also contact the IRS using official information so you understand the account status, while recognizing that an IRS reply does not revive the Tax Court period.

6. Submit the response correctly and preserve proof

Follow the method printed on the notice. If it lists an upload portal, use that portal; if it lists a fax number, use that number; if it requires mail, use the specified address and include the requested response form. Do not send duplicate submissions unless the notice or an IRS representative specifically instructs you to do so.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Build a response record

  • Save a complete copy of the notice and every page you send.
  • Keep copies of tax returns, schedules, statements, receipts, payment confirmations, and other supporting documents.
  • Record the date and method of submission.
  • For online uploads, save the confirmation screen or confirmation number.
  • For fax, retain the transmission report and the exact files sent.
  • For mail, use a service that provides mailing or delivery evidence when appropriate, and keep the receipt.
  • Keep notes of calls, including dates, numbers used, and instructions received.

Proof of submission does not guarantee that the IRS will accept a late response, but it helps establish what you sent and when. Keep the record with your tax files for the relevant tax year.

7. When to get professional help

Consider qualified tax or legal assistance when the notice involves a statutory Tax Court deadline, a large proposed adjustment, collection enforcement, several missing years, identity or filing-status disputes, or records you cannot reconstruct. Bring the notice, envelope, account transcripts, returns, payment records, and your submission history.

Professional help is especially time-sensitive when a Notice of Deficiency may be near its 90-day or 150-day period. Do not wait for a replacement letter before asking for advice if you already know the notice type and date.

8. A practical recovery checklist

  1. Search online: Sign in to the IRS Online Account and check Notices and Letters.
  2. Search paper records: Check mail, scanned documents, tax folders, and envelopes from the IRS.
  3. Identify the code: Record the CP or letter number, tax year, printed date, amount, and deadline.
  4. Read the exact instructions: Use the IRS page and the notice’s listed payment, upload, fax, or mailing route.
  5. Check for court rights: If it is a Notice of Deficiency, calculate the 90-day or applicable 150-day petition period immediately.
  6. Contact the IRS: If the letter is unavailable or the date has passed, use official contact information and explain the situation.
  7. Respond with evidence: Send the requested forms and documents through the permitted channel.
  8. Preserve proof: Save copies, confirmations, receipts, and call notes.
  9. Escalate when needed: Seek qualified tax or legal advice for court deadlines, collection action, or complex disputes.

What not to assume

  • An IRS Online Account is not a complete notice archive.
  • An account transcript is not necessarily the missing letter and may omit recent or pending activity.
  • Contacting the IRS does not automatically extend a deadline.
  • A response period printed on one notice does not apply to all notices.
  • Requesting another copy does not pause a Tax Court petition period.
  • A late response will not automatically be accepted or have penalties and interest removed.

The safest approach is notice-specific: recover the document if possible, identify its number and date, follow its own instructions, and address any missed deadline without delay.
