Start by identifying the decedent’s state of domicile, the location and type of each asset, your relationship to the decedent, and the date of death. Then ask the executor or personal representative—and the relevant state tax department—whether an inheritance-tax return, payment, transfer waiver, or tax clearance is required. Do not retitle or sell estate property until you know whether a state hold or unpaid tax could affect the transfer.
Inheritance tax is imposed by some states on a beneficiary’s receipt of property. It is different from federal estate tax, a state estate tax, and income tax on later earnings or sales. The answer depends on state law in effect on the date of death, the beneficiary’s relationship, asset location, asset type, value, and how the property passed.

First, establish which law applies
Inheritance-tax rules are not determined solely by where you live. The key facts are usually the decedent’s domicile at death and the location of particular property. Real estate and some tangible property may be connected to the state where they are located even when the decedent lived elsewhere. Financial accounts, business interests, trusts, jointly owned assets, and insurance proceeds can have separate treatment.

Pick the symptom - the matching free tool is one click away.
Record these facts before making assumptions:
- Decedent’s legal domicile and address at death.
- Date of death, including the year because effective dates can eliminate or change a tax.
- Location of every parcel of real estate and item of tangible property.
- Type of each financial or business asset and how it passed to you.
- Your relationship to the decedent, such as spouse, child, sibling, or unrelated beneficiary.
- Whether an executor, administrator, trustee, or personal representative has been appointed.
A state may exempt or treat beneficiaries differently based on family relationship, and an exemption for one asset or beneficiary does not establish an exemption for every item in the estate. Ask the representative to identify the state statutes and forms being used for your estate rather than relying on a general internet list.

Ask who must file, pay, or obtain a transfer waiver
The person who receives property is not automatically the person who files the return or sends the payment. Responsibility can be assigned to the estate, its fiduciary, a beneficiary, or another party under the applicable state procedure. Before distribution, ask the executor or personal representative:
- Has an inheritance-tax return been filed, or will one be filed?
- Is tax due, or is a return required even when no tax is owed?
- Does the state require a waiver, tax clearance, or consent before real estate or financial accounts can be transferred?
- Who is responsible for preparing the return and paying any amount due?
- Is an extension, installment election, or other payment arrangement available?
- Are any assets being distributed before the tax obligation is resolved?
Keep written answers and copies of filed forms. If the estate is distributing property while a tax issue remains open, ask how funds are being reserved for the liability. Pennsylvania guidance, for example, warns that fiduciary tax liability can follow assets distributed to heirs to the extent of the assets received. That warning illustrates the risk of accepting property before unresolved estate obligations are understood; it is not a universal rule for every state.
Calendar filing and payment deadlines separately
Use the tax department’s instructions for the death year, not an old form or a deadline found in a generic article. Filing and payment dates can differ, and an extension to file may not extend the time to pay.

| Jurisdiction or tax | Rule described in current guidance | What it means for you |
|---|---|---|
| Kentucky inheritance tax | When tax is due, the return is due within 18 months after death. Payment is due when the return is filed. Payment within nine months may qualify for a 5% discount. A timely filed return can support an installment election for qualifying liabilities above $5,000. | Ask whether the estate qualifies for the discount or installment option and reserve cash for the filing-time payment. |
| New Jersey inheritance tax | A required return and tax due are generally due within eight months after death. An extension may extend filing time but does not extend payment time. | Calculate the payment date separately from any extended filing date. |
| Iowa inheritance tax | No inheritance tax is imposed for deaths on or after January 1, 2025. Earlier deaths remain subject to the rules applicable to those dates. | Use the date-of-death rule; do not apply the post-2024 result to an earlier death. |
| Federal estate tax, 2026 | For a U.S. citizen or resident who died in 2026, Form 706 generally applies when the gross estate plus adjusted taxable gifts and specified exemption exceeds $15 million. A return may also be filed to elect portability for a surviving spouse. The return is generally due nine months after death. | This federal threshold does not determine state inheritance-tax liability or a state return deadline. |
These examples demonstrate why a deadline cannot be generalized across states. Confirm whether your state counts the date of death, the date of distribution, or another event, and whether a separate deadline applies to a waiver or real-estate transfer.
Handle real estate and other property transfers carefully
Real estate
Do not assume a deed can be recorded immediately after probate or trust administration. The county recorder, title company, or financial institution may require a state tax waiver or clearance. Ask the representative whether the state requires an inheritance-tax filing before the deed is retitled, and whether an unpaid liability could attach to the property. If the property is being sold, determine who will hold sale proceeds for taxes and how the closing agent will document the state’s requirements.
Bank and investment accounts
Financial institutions may release accounts under beneficiary designations while the estate’s tax work is incomplete. A release does not necessarily prove that no tax is owed. Obtain account statements showing the balance near the date of death and retain any state waiver, release, or correspondence.

Personal property and business interests
Vehicles, valuable collections, equipment, partnership interests, and closely held businesses may need appraisals or other valuation evidence. Ask who selected the valuation date and method, and whether the state uses the same value as a federal estate-tax filing. Keep transfer documents, purchase agreements, appraisals, and inventory schedules with the estate records.
Preserve date-of-death value and basis records
Valuation records can affect both the inheritance-tax calculation and your future income-tax result. Keep copies of:
- Professional appraisals and valuation reports.
- Brokerage, bank, and retirement-account statements near the date of death.
- Estate inventory schedules and amended inventories.
- Federal or state estate-tax returns that include the asset.
- Inheritance-tax returns, payment confirmations, waivers, and clearances.
- Any beneficiary Schedule A furnished by the executor with Form 8971.
- Documents showing improvements, depreciation, debt, ownership percentages, or prior gifts.
The Internal Revenue Service uses Form 8971 and Schedule A to report beneficiary-specific property and estate-tax values. In cases where those rules apply, a beneficiary’s basis must be consistent with the final estate-tax value reported for the property. Inherited property basis is generally tied to fair market value at the date of death, subject to asset-specific rules and exceptions. Before selling, ask a tax professional to reconcile the date-of-death value, later improvements, selling costs, and any alternate valuation election.

If the property is sold soon after inheritance
Do not use the probate inventory or an informal estimate as the selling basis without checking the final tax records. A later sale can create a capital gain or loss, and the correct calculation may depend on the estate’s final valuation, whether the executor made an election, and whether the asset has special federal rules.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Keep the federal estate-tax question separate
Federal estate tax concerns the transfer of the decedent’s taxable estate, while state inheritance tax generally focuses on the beneficiary’s receipt. A federal filing requirement does not establish a state inheritance-tax exemption, and a state inheritance-tax filing does not mean Form 706 is required.

For a U.S. citizen or resident who died in 2026, the Internal Revenue Service says Form 706 generally must be filed when the gross estate plus adjusted taxable gifts and specified exemption exceeds $15 million. A filing can also be useful or required to elect portability of a deceased spouse’s unused exclusion. The general federal due date is nine months after death, subject to extension rules. Ask the executor which federal filing position applies and keep any federal valuation information that affects your property.

What to do when more than one state is involved
Prepare a state-by-state asset schedule instead of treating the estate as one taxable pool. For each state, compare:
- Decedent domicile versus the property’s physical location, especially for real estate.
- Date-of-death rules and any effective-date change.
- Your relationship to the decedent and available exemptions.
- Asset class, ownership form, and valuation method.
- Who must file and who is responsible for payment.
- Separate deadlines for returns, payment, extensions, waivers, and installments.
For example, a decedent domiciled in one state may own a vacation home in another. The domicile state and the property state may each have a filing or clearance requirement, and the treatment of a beneficiary may differ between them. Do not assume that filing in the domicile state satisfies a requirement connected to out-of-state real estate.
Do not delay a state filing while waiting for federal matters
State and federal administrations move on different schedules. Kentucky guidance specifically cautions that a state filing should not be postponed because a federal estate-tax audit or closing letter is delayed, or because real estate is still being sold. If the state return is due, file using the best supportable valuation available, follow the state’s amendment procedure if values later change, and document any estimated amount or payment arrangement.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteLikewise, an extension request should be treated as a filing tool, not as permission to postpone payment. New Jersey’s guidance states that an extension to file does not extend the time to pay. Confirm the interest, penalties, and security requirements that apply if payment cannot be made by the original due date.
When professional help is worth the cost
Consider an estate attorney or tax professional familiar with the relevant state when any of these conditions applies:
- The estate owns real estate or business interests in multiple states.
- The beneficiary classification or family relationship is disputed.
- An appraisal is contested or the asset is difficult to value.
- The filing or payment deadline is close.
- The executor plans to distribute or sell property before tax clearance.
- The estate may need an installment election, amended return, or federal portability filing.
- You received property but no valuation statement, waiver, or explanation of reserves.
Give the adviser the death certificate, will or trust excerpts governing the transfer, inventory, appraisals, account statements, prior gifts if known, and every state or federal notice. A professional can determine whether the estate, beneficiary, or fiduciary must act; that assignment should not be guessed from who physically received the property.
Quick Recap
A practical checklist for the first 30 days
- Obtain the death certificate, will or trust documents, and the executor’s contact information.
- List every asset, its location, ownership form, beneficiary designation, and approximate date-of-death value.
- Identify your relationship to the decedent and how each asset passed to you.
- Ask the representative which states may require an inheritance-tax return, payment, waiver, or clearance.
- Write down each filing and payment deadline, including separate dates for extensions or installments.
- Ask whether distributions are being made before tax obligations are resolved and how reserves are calculated.
- Collect appraisals, statements, inventories, tax returns, waivers, and Form 8971 Schedule A if provided.
- Ask whether a federal Form 706 is required or whether portability is being considered.
- Before retitling, borrowing against, or selling property, confirm that no state transfer hold remains.
- Escalate to a qualified state tax or estate professional when facts cross state lines or deadlines are uncertain.
Common mistakes to avoid
- Confusing tax types: inheritance tax, estate tax, and income tax answer different questions.
- Using the beneficiary’s home state automatically: domicile and property situs may point to different jurisdictions.
- Assuming a family relationship guarantees no tax: exemptions and definitions vary by state and date.
- Waiting for a federal closing letter: a state deadline may arrive first.
- Treating an extension as a payment deferral: New Jersey expressly separates those dates.
- Discarding valuation records: they may be needed to establish basis when the property is sold years later.
- Distributing everything immediately: some states can pursue liabilities connected with assets already distributed.
