Start by reading the entire Social Security notice, identifying exactly what the agency decided, and marking the appeal deadline. For most decisions, the administrative path is reconsideration → administrative law judge (ALJ) hearing → Appeals Council review. After the Appeals Council acts, you may seek review in federal district court. Each step has its own filing requirements, and some benefit-continuation choices have shorter deadlines than the ordinary appeal.
Do not wait for a phone call or assume a general disability appeal form fits every issue. The notice controls the route, filing method, and deadline for your case.

First, identify the decision you are challenging
“Social Security decision” can mean several different things. Your notice may concern medical disability entitlement, a finding that disability has ended, SSI eligibility or payment amount, a non-medical requirement, or an overpayment. The correct request and evidence depend on that classification.
- Medical disability decision: whether you are disabled, or whether disability has ended.
- Non-medical eligibility or payment decision: income, resources, living arrangements, work activity, or the amount payable.
- Overpayment decision: whether you were overpaid and, separately, whether collection should be waived.
- Other determination: the notice should identify the applicable review route.
SSA regulations describe an initial determination and the administrative review levels that follow it (20 CFR § 416.1400). Write down the notice date, the date you actually received it, the decision being disputed, and the instructions printed on the final page or accompanying forms.

The appeal ladder at a glance
| Stage | What it does | Typical deadline | How to start | Possible result |
|---|---|---|---|---|
| Reconsideration | A new review of an initial determination by someone who was not involved in the first decision. | Generally 60 days after receipt of the notice. | Use the disability or non-medical request path identified by SSA and your notice. | Decision affirmed, changed, or sent for further action. |
| ALJ hearing | A hearing before an administrative law judge after an unfavorable reconsideration. | Generally 60 days after receipt of the reconsideration notice. | Online, by mail, or through a local SSA office; disability cases may require additional forms. | Favorable or unfavorable decision, or another action directed by the judge. |
| Appeals Council | Review of an unfavorable ALJ decision; it is not automatically a new hearing. | Generally 60 days after receipt of the ALJ decision. | Secure online request, Form HA-520, a letter, or fax. | Review denied, a new decision issued, or the case returned for further proceedings. |
| Federal district court | Judicial review of an unfavorable Appeals Council action or denial of review. | Generally 60 days after receipt of the Council notice. | File a civil action where the notice directs, following both SSA and court instructions. | The court may affirm, reverse, or remand under applicable law. |
You do not necessarily use every level. The next step is determined by the decision you just received and the instructions in that notice.
Step 1: request reconsideration
Reconsideration is normally the first appeal from an initial decision. SSA provides separate online routes for disability and non-medical reconsideration; its instructions also explain how to obtain help by telephone or at a local office (SSA: Request reconsideration). Select the path that matches the notice instead of submitting a generic request.
What to include
State clearly which determination you dispute and why. Add relevant information through the channel SSA identifies in the notice. There is no single evidence checklist that applies to every type of Social Security decision, so follow the specific request instructions and preserve copies of anything you submit.
After filing
Keep the confirmation, mailing receipt, fax confirmation, or a dated copy of an in-person submission. If SSA asks for more information, respond by the stated date and keep proof of delivery. A reconsideration is an agency review, not a court proceeding.
Step 2: request an ALJ hearing
If reconsideration is unfavorable, the usual next level is a hearing before an ALJ. SSA allows an online request, mailing the request, or asking a local office to help file it (SSA: Request hearing with a judge).

Disability hearing forms
For a disability claim, the instructions for Form HA-501 identify additional disability-report and medical-release forms that may be required (Form HA-501). Read those instructions before sending the request so the hearing office receives all required components.
How the hearing may occur
SSA’s current instructions describe online, in-person, and telephone hearing options. Your notice or hearing office will provide the arrangements for your case; do not assume you can require one particular format. Organize the facts you want the judge to consider and be ready to explain how the disputed decision conflicts with your records or circumstances.

You may ask the Appeals Council to review an unfavorable ALJ decision using the process described in the decision notice (SSA: Request review of hearing decision). SSA accepts a secure online request and also identifies Form HA-520, a letter, or fax as possible filing methods (Form HA-520).
New evidence and written extensions
If you have evidence that relates to the period on or before the ALJ decision, tell the Appeals Council about it or submit it as directed in the HA-520 instructions. If you need additional time for evidence or legal argument, request that extension in writing rather than assuming extra time is granted.
What the Council can do
The Council may deny review, issue its own decision, or return the case for further proceedings. A request for review does not guarantee another hearing.

Step 4: consider federal district court review
After an unfavorable Appeals Council decision or denial of review, federal district court is the last level in the Social Security appeal sequence (SSA: Federal Court Review Process). The Council notice explains where to file, how to send copies of the complaint and summons to SSA’s Office of the General Counsel, and the applicable deadline.
A federal filing fee generally applies. Court rules and local filing requirements can add steps beyond SSA’s instructions, so follow both the Council notice and the court’s directions. A court case is a civil action, not another agency reconsideration request.
How the 60-day deadline is calculated
For most administrative appeals and court review, SSA generally gives 60 days after you receive the notice. SSA commonly presumes that you received a notice five days after the date printed on it unless you can show that it arrived later. The notice remains the practical authority for your particular case (Your Right to Question the Decision Made on Your Claim).
Do not use the five-day presumption as a reason to delay. Count from your actual receipt when you can document it, and file as soon as possible. Save the envelope, electronic delivery record, or other proof if the delivery date is disputed.
If you missed the deadline
A late request is not automatically accepted or automatically lost. File promptly, explain the specific reason for the delay, give the relevant dates, and ask SSA to extend the time. SSA evaluates good cause under its rules and the facts of the case; an extension is not guaranteed. Include any documents that support the explanation and retain proof of submission.

Can benefits continue while you appeal?
Payment continuation is more case-specific than the ordinary appeal deadline. Read the notice before electing it, because continued payments can later become an overpayment if the decision is upheld.
SSI medical cessations
SSA’s SSI appeal guidance says a person appealing a medical disability cessation who wants payments to continue must make a written request within 10 days after receiving the notice (SSA: Appeals Process — Understanding SSI). This 10-day election is not a universal deadline for every Social Security or SSI appeal. Other SSI initial determinations have their own continuation conditions and timing.
The repayment risk
Continuing payments during review may mean you must repay those amounts if you ultimately lose. Before choosing continuation, read the exact notice and consider whether you can manage that potential debt. Do not assume that filing any appeal preserves current payments.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Overpayment notices: separate the two disputes
An overpayment notice raises two different questions:
- Disagreement with the determination: you believe you were not overpaid or that the amount is wrong. Request reconsideration of the overpayment decision.
- Request for waiver: you accept or do not contest the overpayment but ask SSA not to collect it under the applicable waiver rules.
SSA materials explain that a timely appeal or waiver request can stop collection while the matter is reviewed, but the procedure depends on the program and the notice (Important Information About Your Appeal, Waiver Rights, and Repayment Options; SSA: Overpayments). Contact SSA using the information on the notice, state which relief you seek, and keep copies and delivery records. The SSI program also has detailed continuation and collection rules in its operating instructions (SSA POMS SI 02301.310). For questions about collection after continued benefits, see SSA’s guidance on benefit-continuation overpayments (SSA FAQ).

Build a case file before you submit anything
A disciplined record reduces missed deadlines and conflicting submissions. Create one folder—paper or electronic—with:
- The complete decision notice and envelope or electronic delivery record.
- A timeline of filing dates, calls, appointments, and responses.
- Copies of every form, letter, fax confirmation, upload receipt, and mailing receipt.
- The facts and documents that address the specific issue in dispute.
- Names, dates, and summaries of conversations with SSA personnel.
- A calendar reminder for the next response or evidence deadline.
Use the submission channel identified by SSA. If you upload documents, save the confirmation page; if you mail them, use a trackable method; if you deliver them in person, request a dated receipt.
Should you appoint a representative?
Representation is optional. You may appoint an attorney or another qualified person to help with an SSA proceeding. SSA’s representation guidance explains that fees for services before the agency generally require SSA authorization and that the rules depend on how the matter is handled (SSA: Overview — Representing SSA Claimants).

Ask any prospective representative for a written fee agreement and an explanation of expenses before signing. Fee agreements and authorization procedures are described by SSA (SSA: Fee Agreements). Do not assume representation is free or that a particular fee will apply.
A practical action plan for today
- Read the notice twice. Identify the determination, the next review level, the filing method, and every deadline.
- Record receipt. Note when the notice arrived and preserve proof.
- Choose the correct request. Use the disability, non-medical, hearing, Appeals Council, overpayment, or court process specified for your case.
- File promptly. Submit through SSA’s stated channel and save confirmation.
- Address payment continuation separately. If the notice offers continuing benefits, check for the shorter election period and understand the repayment risk.
- Get help when the issue is complex. A qualified representative can explain the record and filing strategy, but you remain responsible for watching deadlines unless SSA confirms otherwise.
SSA received 13,514 new federal court cases in fiscal year 2024 (October 2023 through September 2024). That count measures cases received, not the probability that any individual claimant will win. The practical advantage comes from identifying the correct review level, meeting its deadline, and preserving a clear record.
