If you deducted the wrong tax deducted at source (TDS) from a contractor payment, do not try to fix it by changing a later invoice or asking the contractor to claim a credit that is not visible in the tax records. First establish the payment date, the contractor’s status, the provision that actually applies, the amount withheld, the amount deposited, and what your TDS statement reported. Then use the remedy that matches the error: a statement correction for wrong reporting, a current refund process for eligible excess tax, or further compliance action for a shortfall or missing deposit.
This article addresses Indian income-tax TDS. The correct section, form and procedure depend on the transaction and the date. Events on or before 31 March 2026 remain under the Income-tax Act, 1961; events on or after 1 April 2026 are handled under the Income-tax Act, 2025 framework.

Start by freezing the facts
Preserve the original transaction before making any adjustment. Gather the contract or work order, invoice, credit and payment dates, gross amount, amount actually withheld from the contractor, challan details, TDS statement acknowledgement, contractor PAN, residency and entity status, and any lower- or nil-deduction certificate. Record exactly what went wrong: the rate or amount, section code, payee identity, challan particulars, failure to deposit, or a mismatch between the statement and the contractor’s tax credit.

Separate three figures that are often confused:
- Withheld: the money taken from the contractor’s payment.
- Deposited: the amount remitted to the government and the particulars used for that remittance.
- Reported and credited: the amount shown in the TDS statement and eventually reflected in the contractor’s tax-credit record.
Those figures can differ. A correction that fixes one does not automatically fix the others.

Section 194C is not a label you can apply to every invoice
For a covered payment to a resident contractor, the Income Tax Department’s displayed section 194C text states deduction at one per cent where the payment is made or credited to an individual or a Hindu undivided family, and two per cent where the recipient is neither an individual nor a Hindu undivided family. See the official text at Income Tax Department: Section 194C.
Those rates apply only when section 194C covers the work and its statutory conditions are met. Confirm the nature of the contract, whether the payee is resident, applicable thresholds and exclusions, and whether another provision governs the payment. A description such as “contractor” on an invoice is not, by itself, proof that 194C is the correct section.
Use the payment-or-credit rule
The section 194C text says deduction is made at credit or payment, whichever is earlier. Use the actual credit and payment chronology when deciding which tax-year rules, rate and reporting period apply; do not rely only on the date printed on an invoice.

The department’s TDS compliance FAQ explains that an event before 1 April 2026 is governed by the 1961 Act, while an event from 1 April 2026 is governed by the 2025 Act framework. The section or form reference can therefore change. The same FAQ warns that using an old section number for a post-transition event can cause TDS-return processing errors and require a correction statement. Read the current guidance at TDS Compliance FAQs before submitting a correction.

Classify the mistake before choosing a remedy
| Error type | Questions to answer | Likely next action |
|---|---|---|
| Wrong rate or amount withheld | Was the payee resident? Which provision and rate applied on the credit/payment date? Was a valid lower- or nil-deduction certificate in force? | Recalculate separately from the amount deposited and the amount reported; then determine whether a statement correction, refund process or short-deduction action is needed. |
| Wrong section code or payee data in a filed statement | Is the PAN, name, assessment year, section or amount wrong in the filed statement? | File a correction to the relevant TDS statement or form and retain the acknowledgement. |
| Tax withheld but not deposited | Was any challan paid? If so, for the correct period, amount and particulars? | Treat the missing deposit as a separate compliance problem; do not describe it as merely a tax-credit mismatch. |
| Deposit made with incorrect particulars | Which challan fields are wrong, and has the amount already been mapped to the payee’s statement? | Reconcile the challan and statement using the current department procedure; avoid filing an unrelated correction that leaves the deposit error unresolved. |
| Short deduction | Was the lower amount legally due, and did the payee report the income and pay the tax? | Assess the deductor’s exposure and any conditional protection before attempting to collect or amend the amount. |
| Excess deduction | Was too much taken from the contractor, and was that excess deposited and reported? | Keep the three amounts separate and check the prescribed excess-TDS/TCS refund route; do not assume a unilateral set-off is allowed. |
If the TDS statement or tax credit is wrong
A filed statement error is normally addressed by the deductor through a correction statement or correction to the applicable form. Department material refers to forms including 24Q, 26Q, 27Q and 27EQ. For many resident contractor payments, Form 26Q is the relevant quarterly statement, but use the form that actually applies to your transaction rather than selecting it by habit. The correction guidance is in the department’s TDS Compliance FAQs.
- Compare the original statement with the contract, invoice, payment date, PAN and challan.
- Identify the exact record requiring correction: section, rate, amount, PAN, name, assessment year, quarter or challan linkage.
- Prepare the correction in the applicable statement utility or filing channel, using the law and form for the transaction date.
- Save the correction acknowledgement and the underlying working papers.
- Ask the contractor to check the department’s tax-credit mismatch service rather than claiming an unreflected credit.
- Recheck the credit after the correction has been processed. Do not promise an immediate update or a fixed processing time.
The contractor can use the portal’s “View Tax Credit Mismatch” service to identify a discrepancy and request action from the deductor. The department’s user manual is available at View Tax Credit Mismatch User Manual. A mismatch notification is evidence of a reporting problem to investigate, not permission to invent a credit on the contractor’s return.
If you withheld too much
Reconcile the three different amounts
Suppose your calculation shows that the correct deduction was lower than the amount taken. Determine separately whether the excess is still with the contractor, has already been deposited with the government, and has already been reported as the contractor’s credit. The answer affects who must act and what can be corrected.

The Income Tax Department identifies Form 26B as the prescribed claim route for excess TDS or TCS refunds, with procedure and verification administered under Rule 31A. The transition FAQ discussing TDS compliance is available at Updated FAQs on Interplay and Transitions; the rule text is at Rule 31A.

That reference does not establish that every excess withholding can be refunded to the payer, that you may freely net it against a later contractor payment, or that the contractor will receive a particular result. Verify the current filing, deposit and verification requirements for your facts. If the excess is corrected in the statement but the contractor has already filed a return, coordinate the records rather than creating a second, unsupported credit.
If you deducted too little
Do not describe a short deduction as automatically cured by collecting the difference after the payment. First establish whether a shortfall is actually due: confirm residency, the correct provision and rate, the payment date, thresholds and exclusions, and whether a valid lower- or nil-deduction certificate covered the transaction.
The department’s FAQ describes a conditional protection under the former Act framework. Where the deductee has filed a return, included the income, paid the tax due, and the prescribed certificate is furnished, the deductor may not be treated as an assessee in default under the referenced rule. This is not general amnesty. The FAQ discusses Form 26A in that former framework, so check the law, certificate and form applicable to an event on or after 1 April 2026.

If the tax was not deposited or the challan is wrong
A statement correction cannot substitute for a missing government deposit. Reconcile bank records, challan identification, amount, date, assessment year and minor-head or other particulars before amending the statement. If no deposit was made, address that failure under the current payment and compliance rules and document when and how it was resolved.
If money was deposited but mapped to the wrong particulars, do not file a random rate or section correction and assume the tax will move to the contractor’s account. Match the challan to the statement, use the department’s current correction mechanism for the specific field at issue, and retain proof of every submission. The department’s tax-payment guidance is available at Tax Payments FAQ.
Tell the contractor exactly what is being corrected
Give the contractor a written reconciliation showing the gross payment, amount withheld, amount deposited, statement quarter, acknowledgement number and the correction being filed. State whether the issue concerns money withheld, a government deposit or only a reported detail. Ask the contractor to rely on the official tax-credit record, not on an informal email or a revised certificate that has not been reflected.
Keep the contract, invoice, payment evidence, PAN and residency records, certificates, challan, original and correction acknowledgements, correspondence and tax-credit checks together. This file should allow another person to reproduce your calculation and see why the selected correction route fits the payment date and error.

Illustrative calculations
The following examples are arithmetic illustrations, not conclusions about any particular contract.
Individual contractor under a covered 194C payment
If a covered payment credited to an individual contractor is ₹100,000 and the applicable displayed 194C rate is 1%, the calculated deduction is ₹1,000. If ₹2,000 was withheld, the excess is ₹1,000. You must still determine whether the extra ₹1,000 was deposited and reported, because the remedy differs in each case.
Non-individual contractor under a covered 194C payment
If the same ₹100,000 payment is to a contractor that is neither an individual nor an HUF and the 2% rate applies, the calculated deduction is ₹2,000. If only ₹1,000 was withheld, there is a potential ₹1,000 shortfall, subject to the statutory conditions, certificates and transaction facts.
Post-transition section-code error
If a payment or credit occurred on 10 April 2026 but the statement used a section reference from the 1961 Act framework, the familiar old code may be the cause of processing failure. Check the 2025 Act form and section mapping before submitting the correction; do not simply repeat the old code with a different amount.
Quick Recap
Common mistakes that make the problem harder
- Applying 1% or 2% without confirming that section 194C covers the work.
- Using the invoice date instead of the earlier credit-or-payment event.
- Correcting the return but not the challan, or correcting the challan but not the statement.
- Assuming the amount withheld equals the amount deposited and the amount credited.
- Using a pre-1 April 2026 section or form for a post-transition event.
- Promising the contractor a refund, credit or processing date that has not been confirmed.
- Collecting a shortfall from the contractor without first checking certificates and the conditional deductor protection.
- Discarding the original acknowledgement after filing a correction.
Final review checklist
- Payment or credit date identified and placed on the correct side of 1 April 2026.
- Contractor residency, entity type, PAN and certificate status verified.
- Correct provision, thresholds and exclusions checked rather than assumed.
- Withheld, deposited and reported amounts reconciled independently.
- Applicable TDS statement or correction form selected.
- Challan and statement linkage checked.
- Contractor informed in writing of the factual correction.
- Original and correction acknowledgements stored.
- Tax-credit mismatch checked again after processing.
