If you selected the wrong tax regime in an Indian income-tax return, do not immediately submit a second return or assume that a revised return can change the election. First identify the assessment year, your income type, whether the return was only prepared or has been filed and verified, and whether you filed Form 10-IEA in this or an earlier year. From assessment year (AY) 2024-25, the new regime is the default for the taxpayer categories covered by the Income Tax Department’s rules. An eligible taxpayer without business or professional income generally opts out to the old regime in the return filed under section 139(1). Specified taxpayers with business or professional income use Form 10-IEA and face restrictions on switching.
The Income Tax Department says a submitted return may be revised when a mistake is discovered. That general facility does not, by itself, prove that every regime election can be changed through a revision. Treat the election as a legal eligibility question first and a tax-calculation question second.

These rules assume India—and the assessment year matters
“Tax regime” is not a universal term. This article addresses India’s old and new personal income-tax regimes. If your return is for another country, stop here and use that country’s tax authority because the forms, deadlines and election rules will be different. HM Revenue & Customs, for example, has a separate process for amending a UK Self Assessment return.

The Income Tax Department states that the new regime became the default from AY 2024-25 for the listed taxpayer categories, while eligible taxpayers may opt out to the old regime. Rules, ITR forms and deadlines can change for later assessment years, so check the current instructions for the exact year on your return.

What the old and new regime choices actually mean
| Question | Old regime | New regime |
|---|---|---|
| Default from AY 2024-25 | No. An eligible taxpayer generally has to opt out of the default. | Yes, for the taxpayer categories covered by the Income Tax Department’s rules. |
| How a taxpayer without business or professional income chooses | Select the applicable opt-out/old-regime choice in the return filed under section 139(1). | Remain in the default unless an old-regime choice is made. |
| Business or professional income | Specified taxpayers use Form 10-IEA and must follow its timing and switching restrictions. | Form 10-IEA and the restrictions applicable to the taxpayer’s business/professional income determine the route. |
| Deductions and exemptions | More deductions and exemptions may be available, subject to each provision’s conditions. | The deduction and exemption menu is different and generally narrower; confirm each item for the relevant year. |
| Which produces less tax | Cannot be determined from the headline rates alone. | Cannot be determined from the headline rates alone. |
A larger deduction under the old regime does not automatically make it cheaper. Compare the complete taxable income, eligible deductions, exemptions, surcharge, cess and other applicable items after confirming that the regime is legally available to you.
First, establish where your return stands
The correction route depends on what has happened to the return. Write down the following before changing anything:
- Assessment year and the ITR form used.
- Whether the return is still a draft, has been submitted but not verified, has been verified, or has already been processed.
- Whether you have salary and other non-business income only, or any income from a business or profession.
- Whether Form 10-IEA was filed for the current year or an earlier year.
- The section 139(1) filing deadline and any applicable deadline for a revised return for that assessment year.
- The regime shown in the submitted return and the regime you believe is available and preferable.
Save the acknowledgement, verification status, filed JSON or PDF copy, Form 10-IEA acknowledgement if applicable, and the tax calculation used. Those records let the Income Tax Department or a tax professional see exactly which election was made.

If the return is only a draft
Do not submit it with the wrong selection. Reopen the return, confirm the assessment year and ITR form, and choose the regime that is legally available. In the ITR-1 online manual, the portal directs a taxpayer who wants the old regime to select the opt-out choice in the return. Recalculate tax after entering all income and deductions; changing the regime can change which deductions the form accepts.
If you submitted the return but have not verified it
Check the portal’s current instructions before taking action. A return that has been submitted but not verified is not the same as a completed, processed return. Do not create duplicate filings simply to force a different regime. Use the portal’s available resubmission, cancellation or correction route only if the current instructions expressly permit it for your status and assessment year.
If you verified the return or it has been processed
The Income Tax Department’s ITR-1 FAQ says that a taxpayer who later discovers a mistake in a submitted return may resubmit or revise the return. A revised return is a correction mechanism, not an automatic override of every statutory election. Before filing one, confirm that the relevant year’s law and form instructions allow the regime choice to be changed in your facts. If the return has already been processed, compare the intimation with your filed return and preserve both documents.

Business or professional income changes the answer
Do not tell a business owner, freelancer or professional to simply change the regime box in an ITR. The Income Tax Department’s Form 10-IEA manual and FAQs cover specified individuals, Hindu undivided families (HUFs), associations of persons other than cooperative societies, bodies of individuals and artificial juridical persons that have business or professional income. For covered taxpayers, Form 10-IEA is the relevant election route and its timing is tied to the section 139(1) return deadline.

The department also describes restrictions on changing regimes for these taxpayers; the choice is not freely switchable every year. Check whether Form 10-IEA was filed for the current year, whether an earlier withdrawal or election affects you, and whether the form was filed within the required time. A revised ITR cannot be assumed to cure a missing, late or inconsistent Form 10-IEA.
If your income includes even a small business or professional component, ask an Indian tax professional to review the classification and election history before revising. The consequences can extend beyond the tax calculation to whether the return is valid under the applicable form instructions.

Check eligibility before comparing tax
- List all income. Include salary, house property, capital gains, interest, dividends and business or professional receipts. The ITR form and regime rules can depend on the income mix.
- Separate deductions from expenses. Record only deductions and exemptions supported by the relevant provision and assessment year. An item available under the old regime may not be available under the new regime.
- Apply regime-specific rules. Use the current Income Tax Department ITR instructions rather than a calculator that assumes an older year or ignores restrictions.
- Compare total liability. Compare tax after all applicable deductions, rebate rules, surcharge and cess—not just slab rates or one large deduction.
- Check the election deadline. For non-business cases, the old-regime choice is generally made in the return due under section 139(1). For Form 10-IEA cases, check the form’s separate timing requirement tied to that deadline.
Keep a side-by-side worksheet showing income, each claimed deduction, taxable income and final liability under each legally available regime. If one regime is not legally available, remove it from the comparison even if a calculator displays a lower number.

The return was never filed
Correct the selection before filing. This is the least complicated situation because you can enter the appropriate election and supporting figures in the original return.

The return was filed before the section 139(1) deadline
Check the current assessment-year instructions for revision and regime-election treatment. The fact that a revised return is generally permitted does not settle whether a particular election can be changed. If the old-regime choice had to be made by the original due date, ask whether a later revision preserves or changes that election under the year’s rules.

The original deadline has passed
Do not promise yourself a refund or a regime switch. Determine whether a revised-return deadline remains open, whether the taxpayer is eligible to revise, and whether the election is restricted. Contact the Income Tax Department promptly or obtain advice from a qualified Indian tax professional. A late correction may have different consequences from a timely revision.
You filed the wrong regime but the tax difference is small
Still verify the legal position, but include the cost and risk of an unnecessary revision, changed deduction claims, additional documentation and possible mismatch with employer or withholding records. A numerical saving is not enough if the chosen regime is not available or the correction is procedurally invalid.
Common mistakes to avoid
- Confusing financial year and assessment year: Always use the year printed in the ITR and its instructions.
- Assuming the new regime is optional by default: From AY 2024-25 it is the default for covered categories; the old regime requires the applicable opt-out.
- Using a salary-only workflow for business income: Form 10-IEA and switching restrictions may apply.
- Assuming revision changes every election: The general revision facility does not prove that a regime election can always be changed.
- Comparing rates without deductions: Compare complete tax computations for the exact year.
- Ignoring verification: A submitted return is not necessarily a verified or processed return. Record the status and acknowledgement.
- Relying on an old calculator or article: Use the current ITR form, portal manual and department FAQ for the assessment year concerned.
What to take to the Income Tax Department or your adviser
Prepare the filed return and acknowledgement, verification or processing status, Form 10-IEA acknowledgement if any, proof of income and deductions, the calculation under both regimes, and a short timeline of filing and verification dates. State precisely what you want corrected: the regime selection, a deduction, an income figure or another field. Ask whether the proposed action is a revised return, a portal resubmission, a response to an intimation or no action because the election cannot be changed.
