What to Do If You Can’t Afford to Repay a Home Equity Investment

If you cannot afford a home equity investment (HEI) payoff, act before the deadline: read the signed agreement and current settlement statement, confirm exactly what triggered payment, and ask the provider in writing whether an extension, repayment arrangement, or contract modification is allowed. Then compare refinancing or another loan, available assets, a new home-equity contract, and selling the home against the contract’s total cost, timing, lien and foreclosure consequences.

An HEI usually has no required monthly payment, but it can create a large lump-sum obligation at maturity or after an earlier trigger. The calculation, notice rules and available remedies depend on your contract, recorded security documents and state law. If a default notice or foreclosure threat is near, obtain state-appropriate housing counseling or legal advice promptly.

First, establish what you owe and why it is due

The Consumer Financial Protection Bureau (CFPB) describes home equity contracts—also called home equity investments, home equity agreements or shared equity agreements—as arrangements in which a homeowner receives cash upfront and later repays a lump sum tied partly to the home’s value. The CFPB’s definition is quoted here: “Home equity contracts are financial agreements in which a homeowner gets an upfront cash payment from a company and, in exchange, must repay a lump sum amount in the future that is based, in part, on their home’s value.” Read the CFPB market overview.

Payment may be due at the contract’s stated maturity, when you sell the property, or after another event. Contracts may also make the balance due after a default on a senior mortgage, unpaid property taxes or insurance, or the homeowner’s death. A provider may secure its interest with a lien or another security instrument. Do not assume the date on an email or an informal statement is the controlling deadline.

Collect the controlling documents

  1. Find the fully executed HEI agreement and every amendment or addendum.
  2. Obtain the recorded lien, deed of trust, mortgage or other security instrument, plus any subordination or payoff documents.
  3. Request the most recent payoff or settlement statement, including its expiration date and any daily adjustment.
  4. Gather notices showing the event that allegedly triggered payment and proof of property-tax, insurance and senior-loan status.

Check the calculation, not just the headline balance

Providers use different settlement methods. The amount can depend on the original advance, the starting and ending home values, a multiplier and contract-specific adjustments. Review how the agreement defines valuation dates, appraisals, improvements, damage, depreciation and appreciation. Many contracts do not permit ordinary partial payments, and some restrict early settlement. A formula from a different provider is not evidence that your provider calculated your balance correctly.

Ask for a written itemization showing the starting value, current value, percentage or multiplier applied, credits, fees, valuation costs and the date through which the figure is valid. If the statement conflicts with the agreement, identify each discrepancy in writing and request a corrected statement.

Contact the provider before the deadline

Prompt, documented communication can reveal options that are not obvious from marketing materials. Use a channel that creates a dated record, such as email followed by certified mail or the provider’s secure message system. Keep copies of every document and note the name, date and substance of each call.

Questions to ask in writing

  • What exact contract clause makes the balance due, and what is the final date to pay without default?
  • Is the quoted amount fixed, or does it change with time, an appraisal, interest, fees or a sale event?
  • Does the agreement permit an extension, installment arrangement, payoff over time, modification or hardship review?
  • Can you make a partial payment, and if so, does it reduce the settlement amount or merely sit in suspense?
  • What notices, cure periods and fees apply if the deadline is missed?
  • Will a proposed arrangement alter the total settlement, lien priority, appraisal rights or foreclosure remedies?
  • What happens while the provider reviews your request, and is the original deadline suspended in writing?

Treat only a signed amendment or other formal written confirmation as a modification. A representative’s statement that an extension is “under review” does not by itself change the due date or stop enforcement.

Compare every realistic way to raise the payoff

The CFPB identifies refinancing, using other assets, entering another home equity contract and selling the home as possible repayment routes. None is guaranteed. Compare each option using the same measures: total dollars paid, speed, monthly affordability, any new balloon payment, fees, eligibility, lien priority, foreclosure exposure and dependence on a future sale or home-price appreciation.

Route How it may work Questions and risks to test
Refinance or another loan Borrow against the home or with another form of credit and use proceeds to settle the HEI. Can income, credit, equity and timing support approval? What are the rate, closing costs, monthly payment, prepayment terms and new balloon risk? Will the HEI lien be paid, subordinated or remain?
Other assets Use cash, investments or another asset to fund all or part of the settlement if the contract permits. What taxes, penalties, lost returns or emergency-reserve consequences result? Confirm that a partial payment is contractually accepted and credited.
Another home-equity contract Obtain a new cash advance to pay the existing settlement. Does the replacement contract simply defer a larger obligation? Compare both formulas, valuation assumptions, fees, lien rights and the next maturity or trigger.
Sell the home Use sale proceeds to satisfy the HEI and other liens at closing. Can the property sell before the deadline? Estimate commissions, taxes, repairs, moving costs, senior-loan payoff and the HEI’s sale calculation. A slow or lower-than-expected sale can leave a shortfall.

Refinancing or taking another loan

A refinance may replace the HEI with a conventional mortgage, home-equity loan or another credit product. Approval and closing can take time, especially when a nontraditional lien must be documented or released. Obtain written payoff instructions early, ask how long the quote is valid and confirm that the new lender will close before the HEI deadline. Evaluate the complete cost over the expected holding period, not only the new monthly payment.

Using savings or investments

Liquid assets can be faster than underwriting, but do not drain funds needed for taxes, insurance, repairs or an emergency. Selling investments may create income-tax consequences or lock in losses. Ask the provider whether it accepts a partial payment; many HEI contracts expect a single settlement and may not reduce the obligation for an unsolicited payment.

Replacing the contract

A second contract can create a cycle of deferred lump sums. Compare the existing and proposed agreements line by line, including the home-value baseline, multiplier, valuation process, improvement treatment, early-payoff rules, maturity, trigger events, fees and lien remedies. A lower initial payment does not prove that the replacement is cheaper.

Selling the property

Request a sale-specific settlement estimate and ask whether the provider must approve the listing, appraisal or closing statement. Model a conservative sale price and subtract the senior mortgage, HEI settlement, commissions, transfer taxes, repairs and relocation costs. If expected proceeds are insufficient, ask the provider before listing whether it will negotiate a written shortfall resolution; do not assume it must accept one.

Understand what a missed deadline can mean

An HEI provider may hold a lien. California’s Department of Financial Protection and Innovation warns that an HEI provider could foreclose if a homeowner cannot keep the contract terms or pay the contract in full on time. Its guidance is California-specific, not a nationwide rule; read it alongside your agreement and your state’s law: California DFPI guidance on home equity investments.

Missing a date does not automatically produce foreclosure everywhere. Consequences can include late fees, a notice of default, acceleration of the balance, collection activity, litigation or enforcement of a lien. The agreement, state procedures, senior-lien status and facts determine notice and cure rights. A provider may be required to give a specified period to cure, or the contract may provide little time; do not infer a universal grace period.

When a notice arrives

  1. Read the notice’s stated default, amount, deadline, cure method and contact information.
  2. Compare each assertion with the executed agreement, payoff statement and payment records.
  3. Respond in writing before the stated deadline, even if you dispute the amount, and request the documents supporting it.
  4. Contact a HUD-approved housing counselor, state housing regulator or qualified attorney familiar with your state and lien type.

Do not sign a deed transfer, new lien, release, confession of judgment or settlement agreement without understanding its effect. If a foreclosure sale, lawsuit or short cure period is mentioned, treat the matter as urgent.

Know which federal rules may—and may not—apply

Regulation Z, 12 CFR § 1026.40, contains disclosure and operational requirements for covered home-equity plans. It requires disclosures that the creditor takes a security interest in the dwelling and that the consumer may lose the dwelling upon default. It also addresses when a covered home-equity-plan creditor may terminate a plan and accelerate an outstanding balance. The rule is available at 12 CFR § 1026.40.

Those provisions do not automatically govern every product marketed as an HEI. Legal structure and regulatory coverage matter: an agreement described as an investment or shared-equity arrangement may differ from a conventional home-equity line of credit. Have a lawyer or qualified counselor determine which federal and state protections fit your documents rather than assuming a HELOC rule supplies a cure period or repayment right.

Use the CFPB example only as an illustration

The CFPB’s 2025 market overview gives an example from one company’s online calculator: a $50,000 upfront payment followed after three years by an illustrative repayment of $68,045 if the home depreciated by an average of 1% per year, or $71,538 if it appreciated by any amount. These figures are not a market average, forecast, interest rate or payoff quote. They demonstrate why the same initial advance can lead to a substantially different lump sum under a particular formula. The CFPB also reports that companies use different settlement methodologies. See the CFPB market overview for the example and its limitations.

A practical timeline for an unaffordable settlement

Today

  • Calendar the contractual maturity or trigger date and every notice deadline.
  • Secure the agreement, lien documents and current statement in one folder.
  • Stop relying on verbal estimates; request a written, itemized payoff.

Within several days

  • Send the provider the written questions above and request extension or hardship options.
  • Ask lenders or advisers for realistic eligibility and closing timelines, not generic prequalification.
  • Prepare a cash-flow list showing income, essential expenses, reserves, debts and realistic sale proceeds.

Before any offer expires

  • Compare total cost and enforcement consequences for each feasible route.
  • Confirm lien releases, payoff wiring instructions and the exact date funds must arrive.
  • Obtain legal or housing-counseling advice if the provider refuses clarity, a default is asserted or foreclosure is threatened.

Common mistakes that make the shortfall worse

  • Waiting until the maturity date to ask for help.
  • Assuming no monthly payment means no urgent obligation.
  • Using another provider’s online calculator to challenge the contractual formula.
  • Sending an unrequested partial payment when the agreement requires a lump sum.
  • Choosing a replacement loan by monthly payment alone while ignoring total cost and a new balloon.
  • Believing a phone promise changes a written deadline.
  • Assuming California guidance or federal HELOC rules apply identically in every state and to every HEI structure.

What a qualified adviser should review

A housing counselor can help organize income, expenses, liens and possible loss-mitigation paths. An attorney can interpret the contract, appraisal and security instrument, assess state notice and foreclosure rules, and negotiate or defend where appropriate. Bring the executed agreement, amendments, payoff statement, notices, senior-loan information, tax and insurance records, valuation documents and a timeline of communications. The sources cited here do not establish a reader-specific right to an extension, a universal cure period or a guaranteed settlement reduction.
