A VA burial-benefits denial is not necessarily the end of the claim. First, read the decision notice closely, identify the exact burial benefit and reason for denial, then choose the review lane that fits your situation: add new and relevant evidence with a Supplemental Claim, challenge an error in the existing record through Higher-Level Review, or ask a Veterans Law Judge to review the case through a Board Appeal. The notice controls the deadline and filing instructions.
The Department of Veterans Affairs summarizes the choices this way: “If you disagree with a VA benefit decision, you can choose from 3 decision review options to continue your case: a Supplemental Claim, a Higher-Level Review, or a Board Appeal.” See VA’s decision-review overview for the agency’s current descriptions.

Start by preserving and decoding the denial notice
Do not begin by sending a generic packet of documents. The denial letter tells you what VA decided, why it decided it, what evidence it considered, and how to seek review. Make a complete copy, keep the envelope, and record the date printed on the decision. That date usually starts the review period.

A single notice can address more than one burial benefit, and each issue may have a different evidentiary problem.
- Copy the specific rationale for each denial, including statements that a document was missing, a payment was not established, or an eligibility condition was not met.
- Note the evidence VA says it reviewed. This determines whether you can present something as new evidence or must argue that the existing record was misread.
- Write down the submission address, online filing route, and review-rights language printed in the notice.
- Save proof of every later submission, including a copy of the form, attachments, confirmation page, certified-mail receipt, or delivery tracking.
VA Form 20-0998 explains review rights for covered decisions dated on or after February 19, 2019. Use the notice that accompanied your own decision, however; older or specialized decisions can have different instructions or deadlines.

Choose the review lane that matches the problem
VA’s three options are alternatives for the same issue in most cases. Pick the route that addresses the defect in the denial rather than filing every form at once.

Supplemental Claim: use it to add evidence
A Supplemental Claim is the evidence-adding route. The submission must include or identify evidence that is both new (not previously considered) and relevant (it tends to prove a requirement VA found missing). Examples could include a newly located death record, an itemized funeral bill, proof of who paid an expense, or documentation addressing the exact eligibility issue identified in the letter. Explain in a short cover note what each document proves and which denial reason it answers.
For a burial decision issued within the past year, the instructions to VA Form 21P-530EZ direct a claimant with new and relevant evidence to Form 20-0995. The Supplemental Claims page describes the route and filing requirements. A Supplemental Claim can generally be filed after the first year, but VA recommends filing within one year of the decision to preserve the effective date when the claim is later granted. A late filing does not automatically restore the earlier date.
Higher-Level Review: challenge an error in the existing file
Choose Higher-Level Review when the documents already before VA establish your position, but the decision applied the rule incorrectly, overlooked evidence, or reached a factual conclusion the record does not support. Use VA Form 20-0996 and identify the precise error. You cannot submit new evidence in this lane; sending additional bills or records will not turn an HLR into a Supplemental Claim. Board Appeal: request a Veterans Law Judge
A Board Appeal sends the issue to the Board of Veterans’ Appeals on VA Form 10182. Select one docket:
- Direct Review: the judge reviews the record without new evidence or a hearing.
- Evidence Submission: you may submit additional evidence without requesting a hearing.
- Hearing: you request a hearing before a Veterans Law Judge and may submit evidence under the rules for that docket.
Read the Board Appeal instructions before selecting a docket. The choice affects when evidence can be filed and whether a hearing is available.
Target the evidence to the burial benefit and denial reason
Burial claims are not one uniform benefit. Form 21P-530EZ covers non-service-connected burial allowance, service-connected burial allowance, plot or interment allowance, transportation reimbursement, and situations involving unclaimed remains. Its evidence tables differ by benefit and processing option. Start with the denied issue and supply only the records that resolve that issue.
Death and expense documentation
For a standard burial allowance claim, VA’s burial-benefits guidance lists acceptable proof of death and receipted bills or an account statement. The expense record should show the deceased Veteran’s name, the services or merchandise supplied, each cost, credits, and any balance. If the denial says VA cannot establish payment, include evidence showing who actually paid, such as a paid receipt, canceled payment record, or account statement that clearly identifies the transaction.

The same page states general eligibility conditions for the benefit, including that the applicant paid the costs and has not received an equal or greater reimbursement from another source. Those are initial-claim rules; the denial letter may focus on a different element, so do not assume this list is the complete evidence requirement for your appeal.
Match each document to a disputed element
Create an index with three columns: the denial statement, the document that responds to it, and the page number where the proof appears. If VA already had a document, explain why the decision misread or ignored it rather than labeling it new. If a bill combines covered and noncovered services, ask the provider for an itemization. If another organization reimbursed part of the expense, document the amount so VA can determine whether any remaining allowance is payable.
Calendar the correct deadline
For most VA benefits, VA says a Higher-Level Review or Board Appeal must be requested within one year of the date on the decision letter. Some benefit types have shorter periods, so the notice for your burial issue controls. A contested claim generally has a 60-day period for a Board Appeal, according to the Board’s instructions. A contested case is one in which another party, such as an opposing claimant, receives notice of the decision.

Count from the date printed on the decision, not the date you happened to open the envelope. If the notice gives a different deadline or method, follow the notice and obtain confirmation from VA promptly.

Submit the review request methodically
- Choose one route for each denied issue. Use Form 20-0995 for new and relevant evidence, Form 20-0996 for an existing-record error, or Form 10182 for Board review.
- Complete every identifying field. Include the claimant’s contact details, the Veteran’s identifying information, the decision date, and each issue being reviewed. Copy the issue wording from the notice so there is no ambiguity.
- Attach a focused explanation. State the denial reason, your response, and the document or record that supports it. For an HLR, identify the alleged error without attaching new proof. For a Supplemental Claim or Board Evidence Submission docket, label each new document and explain its relevance.
- Use the delivery route in the notice. The letter may specify an online route or a mailing address. Do not substitute an address found on an unrelated form. If you mail the request, use a service that provides delivery evidence.
- Keep a complete submission file. Retain the signed form, every attachment, the delivery confirmation, and any VA confirmation number. Record the date sent and the deadline you were trying to meet.
- Watch for follow-up requests. Respond by the date VA gives you and keep copies of anything you send. A request for clarification is not a reason to submit a second review option for the same issue.
Do not request two review options for the same issue at the same time. The review-rights notice generally treats the options as alternatives; if you already filed and are unsure what remains available, contact VA or an accredited representative before filing another form.

The potential payment depends on the benefit and the Veteran’s circumstances. The Veterans Benefits Administration page lists a non-service-connected burial and funeral allowance of up to $978 and a $978 plot-interment allowance for deaths on or after October 1, 2024. Those figures are time-sensitive, and the page was accessed October 13, 2026; verify the amount and eligibility that apply to the date of death and your claim before relying on them.
A service-connected burial allowance, a plot or interment allowance, transportation reimbursement, and payment involving unclaimed remains have different qualifying facts and evidence. The VA burial and memorial benefits overview and the Form 21P-530EZ instructions describe the categories. A denial of one category does not automatically decide another, but you must identify the category actually listed in the decision.

Get qualified help when the record or deadline is complicated
VA says an accredited attorney, claims agent, or Veterans Service Organization representative can help with a Higher-Level Review request. Accreditation matters: verify the person or organization through VA’s official resources before appointing anyone or signing a fee agreement. Representation is not required, and no private service can guarantee that a denial will be reversed.

Assistance is especially useful when the notice lists several denied issues, another person may be a contested claimant, the one-year period is close to expiring, or the evidence involves reimbursement by an employer, insurer, state program, or another federal source. Give the representative the complete notice, envelope, prior submissions, receipts, and your deadline calendar.
Common mistakes and how to correct them
- Sending new evidence with an HLR: HLR cannot consider it. If the document is essential, investigate whether a Supplemental Claim or the appropriate Board docket is still timely.
- Arguing generally that the denial is unfair: Address each stated requirement with a fact and a document. Reviewers decide the listed issue, not an unspecific hardship narrative.
- Using the wrong evidence list: A receipt that supports a funeral expense may not establish a plot allowance, transportation reimbursement, or unclaimed-remains requirement. Use the category-specific tables in Form 21P-530EZ.
- Missing the deadline while gathering records: File the proper review request before the deadline with the evidence available, then follow the lane’s rules for additional material. Do not assume a later Supplemental Claim will preserve the original effective date.
- Filing duplicate lanes: Two simultaneous requests can create confusion and may not be allowed for the same issue. Confirm the status of the first request before changing lanes.
- Ignoring reimbursement credits: VA may need the amount and source of any payment already received. Ask the payer for a written statement instead of leaving credits unexplained.
If the deadline has already passed
A late Supplemental Claim may still be possible, but the effective-date consequences can differ from a request filed within one year. Higher-Level Review and Board Appeal deadlines are generally stricter, with shorter periods for some benefits and a 60-day Board period in contested cases. Read the notice, document why you believe the period should be calculated differently, and seek accredited assistance promptly. Do not assume that an appeal is automatically accepted because the underlying burial expense is genuine.
Use official VA instructions for the final filing decision
The controlling documents are your decision notice and the instructions for the selected form. Before submitting, compare your packet against the relevant VA pages: Supplemental Claims, Higher-Level Reviews, Board Appeals, and Decision Reviews FAQs. Those pages can change, so save a copy of the instructions you relied on and follow any newer direction in the notice sent for your claim.
