What to Do if the IRS Says You Owe a Tax Debt You Think Has Expired

If the IRS says it can still collect an old tax debt, do not count ten years from the tax year, the filing date, or the date on the latest letter. Federal collection is generally limited to ten years from the date each liability was assessed. That deadline is called the Collection Statute Expiration Date (CSED), and each assessment can have a different one.

Before disputing the bill or choosing a payment option, identify the exact assessment, obtain your account history, and reconstruct events that may have paused or extended the clock. Bankruptcy, collection due process (CDP) proceedings, installment-agreement requests, offers in compromise and other statutory events can move the CSED. The notice’s deadlines still apply while you investigate.

What “expired” means for an IRS tax debt

The Taxpayer Advocate Service (TAS) defines the rule this way: “The CSED is normally ten years from the date of the assessment.” The Internal Revenue Service similarly states that it generally has 10 years from the assessment date to collect unpaid taxes. This is a legal collection period, not a promise that every debt disappears ten years after a return was filed.

An assessment is the formal recording of a tax liability on the IRS account. The assessment date, rather than the tax year printed on a return, starts the normal period. A single tax year can contain several assessments, each with its own balance and CSED. If one assessment is still collectible while another has expired, the IRS may continue pursuing the first one.

Assessments that may carry separate deadlines

  • The tax shown on an originally filed return.
  • An amended-return assessment.
  • A substitute-for-return assessment made when the IRS files a return for a taxpayer who did not file.
  • An audit or examination assessment.
  • Penalty or interest assessments entered separately or later.
  • Later adjustments that create an additional assessed liability.

Because of these differences, a notice that identifies one tax period does not by itself establish one CSED for everything associated with that period.

Start with the notice, not an assumption

IRS letters generally identify the tax year, the action the agency is taking and the next steps. Read every page, keep the envelope, and record the date you received it. A levy warning, lien notice, balance-due letter and examination notice have different response routes and deadlines.

Match the notice to your account information. Look for the assessment type, assessment date, current balance, payments, abatements, credits and later adjustments. The exact expiration date cannot be calculated from a tax year or a letter alone; it requires the assessment-level account history and the procedural events attached to that account.

How to determine the correct CSED

  1. List every assessment. For the tax period in the notice, write down each assessment date and type, the amount assessed and any subsequent assessment or adjustment. Do not combine them merely because they share a tax year.
  2. Obtain account records. Request the IRS account information or transcripts that show assessment activity, payments, adjustments and collection actions. Compare those records with the notice and your own filings.
  3. Build a dated timeline. Mark the date each event began and ended: payment-plan requests and appeals, bankruptcy filing and conclusion, offer-in-compromise submissions and decisions, CDP requests and court proceedings, and any other event that may affect the period.
  4. Separate pauses from additions. A suspension pauses the running clock and it resumes afterward. An extension adds a legally specified period. Apply each rule to the affected assessment and dates.
  5. Check for overlap. When two suspension events occur at the same time, do not add both periods as if they were consecutive. TAS explains that overlapping events generally run simultaneously.
  6. Compare the adjusted end date with the current action. If the adjusted CSED appears to have passed, raise that issue through the contact and appeal route in the notice before a levy or other action proceeds.

Keep copies of notices, delivery envelopes, account transcripts, appeal filings and proof of submission. Dates can determine whether a request is timely and whether a suspension applies.

Events that can delay the collection deadline

The ten-year period is subject to statutory suspension and extension rules. The following are common examples; they are not an exhaustive list. TAS also describes special rules for matters such as innocent-spouse claims and other statutory events.

Installment-agreement requests and defaults

The IRS generally suspends or prolongs the collection period while an installment-agreement (IA) request is pending. If the IRS rejects the request, the period is suspended for 30 days under the applicable procedure. A timely appeal can suspend the period while Appeals considers it. Similar rules can apply when the IRS proposes to terminate an agreement after default. The exact dates depend on the request, rejection or termination notice and any appeal.

An IA can therefore make an unaffordable immediate bill manageable, but requesting one is not a neutral way to wait out an old CSED. Estimate how much time remains and whether the proposed payments can retire the balance before the adjusted deadline.

Offers in compromise

An offer in compromise (OIC) generally suspends the collection period while the offer is pending, for 30 days after rejection, and while a timely rejection appeal is pending. The IRS considers offers under specific eligibility rules, including inability to pay in full or another recognized basis. Taxpayers who can fully pay through an installment agreement or other means generally will not qualify in most cases, and current filing and payment compliance is required.

An OIC may reduce a liability for an eligible taxpayer, but filing it can delay the CSED. Review the timing effect before submitting an offer, especially when only a short period remains.

Bankruptcy

The collection period is generally suspended while a bankruptcy case is pending and extended by six months after the case concludes. IRS Publication 908 (2025) describes the relevant period as running from the petition through discharge, dismissal or closure, followed by that six-month addition under the stated rule.

Bankruptcy treatment of tax debts is separate from the collection clock. Whether a particular tax, penalty or interest amount is dischargeable depends on facts such as the type of tax, filing and assessment dates and the proceeding. Do not assume that an expired-looking CSED or a bankruptcy filing automatically eliminates the liability.

Collection due process proceedings

A CDP request generally suspends the collection period through withdrawal or a final determination, including a court appeal. TAS guidance dated April 1, 2026, describes an additional protection when fewer than 90 days remain: after the determination becomes final, the period is extended to 90 days from that date. The notice controls the request deadline, and a late filing may not provide the same suspension or review rights.

Other statutory events

Federal law contains additional rules that can suspend or extend a CSED. The common events above should not be treated as a complete checklist. If your history includes an innocent-spouse claim, litigation, a period outside the United States or another unusual procedure, have the applicable rule analyzed rather than relying on a simple ten-year calculation.

What to do when your records suggest the CSED has passed

  1. Do not ignore the current notice. Follow its contact and appeal instructions and preserve the deadline. An expired CSED argument does not automatically stop a scheduled levy while the IRS reviews the account.
  2. State the issue precisely. Identify the tax period, assessment type, assessment date and the CSED you believe applies. Attach the account records and a timeline of suspensions or extensions.
  3. Ask for an account and collection-eligibility review. Request confirmation of which assessment the IRS is pursuing and how it calculated the current CSED. Ask that collection action be corrected if the agency is relying on an expired assessment.
  4. Address a levy separately. IRS and TAS guidance says administrative or judicial collection of a particular debt cannot be initiated after its collection period has expired. When a liability becomes unenforceable because of the lapse, a levy release may be required; request that relief through the route given in the notice.
  5. Escalate when necessary. If the IRS does not resolve a documented date error, use the appeal or review path described in the correspondence. A tax attorney, certified public accountant or enrolled agent who regularly handles IRS collection cases can reconstruct complex timelines and represent you in an active levy or appeal.

Choosing among the available responses

The right response depends on whether you dispute the liability, how much time remains, the immediate collection risk and your ability to pay. The table compares the principal paths without assuming that any one is suitable for every taxpayer.

Response When it fits Effect on the CSED Important conditions or risks
Account and notice review The disagreement concerns the assessment, dates, payments or the action in the letter. No voluntary request is needed; the goal is to correct the record before choosing a collection option. Gather assessment-level records and observe every notice deadline.
Installment agreement You can pay the full amount within the time remaining and need scheduled payments. The request and specified rejection, appeal or default procedures can suspend or prolong the period. Calculate the adjusted CSED before applying; approval does not erase the balance.
Offer in compromise You meet an IRS basis such as inability to pay in full or another recognized ground. The period is generally suspended while pending, for 30 days after rejection and during a timely rejection appeal. Current returns and payments are required; taxpayers able to pay in full generally do not qualify in most cases.
CDP hearing or appeal A notice grants a right to challenge proposed collection action or raise permitted issues. A timely request generally suspends the period through final determination and any court appeal; a special 90-day rule can apply when fewer than 90 days remain. Deadlines are short, and the notice determines the filing method and date.
Qualified tax professional The timeline is complex, a levy is imminent or the amount at stake justifies representation. The professional does not itself change the CSED; representation can help preserve procedural rights and present the calculation. Verify the person’s license or enrollment, collection experience, scope of work and fees before signing an authorization.

Common mistakes that lead to a wrong “ten-year” conclusion

  • Counting from the tax year. The year printed on a return is not necessarily the assessment date.
  • Using the latest letter date. A notice may report an existing assessment rather than create a new one.
  • Treating one tax period as one debt. Original-return, substitute-for-return, audit, amended-return and penalty assessments can have separate CSEDs.
  • Adding overlapping pauses twice. Simultaneous suspension events generally run at the same time.
  • Filing first and checking later. An IA request or OIC can suspend the clock, so understand the consequence before submitting it.
  • Assuming bankruptcy solves everything. Bankruptcy has its own suspension and six-month extension rule, while dischargeability depends on the liability and case facts.
  • Missing an appeal deadline. A CDP or other notice right may be lost or changed by a late request.
  • Expecting a generic calculator to decide the issue. Only the assessment history and legally applicable events can establish the CSED for your account.

When professional help is justified

Consider advice from a tax attorney, CPA or enrolled agent experienced in IRS collections when multiple assessments are involved, records conflict, a bankruptcy or OIC overlaps with another suspension, a levy is scheduled, or the balance is large enough that an error would materially affect you. Ask what records the professional will review, whether they will calculate each assessment’s CSED, which deadlines they will monitor and how fees are charged. No generic service or software can determine your legal collection deadline without your account history.

What the IRS can and cannot do after a CSED

If the correct CSED for a particular assessment has passed, IRS and TAS guidance states that administrative or judicial collection of that debt cannot be initiated. That conclusion applies only after the assessment, suspensions, extensions and overlaps have been established. It does not automatically remove other assessments for the same tax year, and it does not excuse a taxpayer from responding to a notice while the record is disputed.

The IRS may need to release a levy when the liability is no longer enforceable because the collection period lapsed. Request the release and correction through the notice’s stated channel, supplying the timeline that supports your position. Until the agency confirms the affected assessment and date, continue protecting your rights under any active notice.
