What to Do If the Income Tax Department Disallows Your Gratuity Exemption (Section 10(10))

If the Income Tax Department has denied the gratuity amount you claimed, do not submit a second return blindly. First identify whether you received a proposed adjustment, a section 143(1) processing intimation, a rectification order, or another assessment order. Then verify the section 10(10) category, employer details, gratuity reported in your return and supporting records. The correct remedy may be a revised return, CPC rectification, rectification to the Assessing Officer, or an appeal in Form 35; each route has different limits and deadlines.

“Gratuity deduction” is common shorthand, but section 10(10) treats qualifying gratuity as an exemption from income. The law separates government gratuity, gratuity covered by the Payment of Gratuity Act, 1972, and other gratuity, so the eligibility test and exempt amount depend on the category and facts. Read the actual communication before choosing a response.

The same numerical mismatch can require different action depending on the document you received. Download the communication or order from the e-filing portal and note its section, issue date, service date, assessment year, demand and the reason given for reducing or rejecting the exemption.

What you received What it usually means Immediate focus
Return is still unprocessed The return has not yet reached a completed processing result. Check whether a permitted revised return can correct the filed data before processing.
Section 143(1) intimation from CPC Computerised processing made an adjustment to the returned income. Compare the intimation with the filed return and decide whether the record contains an apparent error or the return itself needs correction.
Section 154 or 155 rectification order A prior order or intimation was considered under the rectification provisions. Read the rectification reasoning and preserve any appeal time still running.
Another assessment or demand order The issue may require an adjudicated response rather than a simple processing correction. Check whether the order is appealable and calculate the Form 35 deadline.

The document controls. A portal label, email alert or tax-preparer description is not a substitute for the signed intimation or order.

Understand what section 10(10) covers

Section 10(10) is the statutory provision for gratuity exemption. Its text distinguishes three broad situations: gratuity received by a government employee, gratuity covered by the Payment of Gratuity Act, 1972, and gratuity that falls into the other category. The conditions and computation are not interchangeable. Read the current statutory text at section 10(10) of the Income-tax Act before recalculating your claim.

That classification is the first substantive check. A private-sector employee, a government employee, a pensioner and an employee whose payment is governed by the Payment of Gratuity Act may have different limits or conditions. Do not select a category merely because it produces a larger exemption. Use the employer status, the legal basis of the payment and the service records that existed when the gratuity was paid.

The Department’s processing systems may reject an amount even when gratuity was genuinely received if the return places it in the wrong section, reports it under the wrong employer, or claims more than the applicable statutory amount. A rejection therefore does not, by itself, establish that the underlying payment is non-qualifying.

Reconcile the claim before filing anything

Make one working file containing the return as filed, the processing intimation or order, employer-issued salary information, the gratuity calculation and proof of payment. Then trace the amount through the return rather than relying on a tax-software summary.

  • Identify the employer that paid the gratuity and the employer category selected in the return.
  • Match the gratuity actually received with the gratuity amount reported in the salary schedule.
  • Check which section 10(10) category applies under the statutory facts.
  • Recalculate the exempt amount using the applicable rule and the figures in the employer’s certificate or Form 16.
  • Confirm that the same exemption was not allocated to more than one employer in the return.
  • Record the assessment year, filing date, intimation or order date and date of service.

Keep the filed return, employer certificate or Form 16, gratuity computation, payment record and relevant employment or service information together. This is a practical evidence checklist; the exact documents required depend on the communication and the disputed fact.

Check the AY 2026-27 ITR-3 validations

If you filed ITR-3 for assessment year 2026-27, the published validation rules impose specific data checks. They are form- and year-specific, not a universal replacement for the statute. The CBDT e-filing ITR-3 Validation Rules, AY 2026-27, Version 1.0 state that the section 10(10) exemption cannot exceed gratuity offered under salary section 17(1) as gratuity received.

Employer category selected in the AY 2026-27 ITR-3 validation Stated maximum
Public Sector Undertaking; PSU-Pensioners; Others-Pensioners; Others ₹20 lakh
Central Government; State Government; CG-Pensioners; SG-Pensioners ₹25 lakh

The same validation rules state that the exemption cannot be allowed against more than one employer. If your return shows gratuity from two employers, verify which employer should carry the exemption and whether the salary schedule contains the corresponding gratuity receipt. Do not treat ₹20 lakh or ₹25 lakh as an automatic entitlement: they are the stated ITR-3 validation caps for the listed categories and assessment year. Your statutory eligibility and computation may produce a lower amount.

If you used another return form or assessment year, do not import these checks automatically. Confirm the applicable form, year and live validation rules before changing data.

If the return has not been processed

Review the filed return for an obvious data-entry error while the return remains pending. The Department’s rectification guidance describes rectification for specified completed orders or intimations; for an unprocessed return containing an error, it says a revised return may be submitted where the law still permits one.

  1. Open the filed return and identify whether the problem is a wrong employer category, omitted gratuity, duplicated exemption or arithmetic entry.
  2. Check the statutory deadline and current portal availability for a revised return for that assessment year.
  3. Use the revised-return route only to report the facts correctly; retain the original acknowledgement and a copy of the revised submission.
  4. If revision is no longer available, wait for or respond to the communication actually issued rather than filing a rectification request against an order that does not yet exist.

If CPC issued a section 143(1) intimation

First decide whether the filed return was correct and CPC missed information already on record, or whether the return itself contains a wrong claim. The Department’s CPC rectification guidance describes separate portal choices.

When the filed data was correct

Where the return already contained the correct gratuity, employer and exemption details and processing appears to have overlooked them, the guidance describes a “Reprocess the return” rectification option. Attach a concise explanation that identifies the relevant schedule, line item and document, and show how the intimation differs from the filed record.

When the return data needs correction

If you entered the wrong amount, category or employer allocation, the portal describes a return-data correction option with restrictions. The guidance says that workflow cannot be used to introduce a new source of income or an additional deduction. Because section 10(10) is an exemption and the workflow has its own limits, do not use it to create a claim that was absent from the return or to replace a contested legal position.

Observe the CPC time limit

The Department describes a four-year limit for CPC rectification measured from the end of the financial year in which the relevant intimation or order was passed. It is not a generic four years from the notice date. For example, the relevant calculation starts with the financial year of the section 143(1) intimation, then runs from that year-end. Check the specific order and current portal instructions before relying on the limit.

When CPC rectification is unavailable

The portal also describes “File rectification to AO” for specified situations, including circumstances in which CPC rectification is unavailable after that period. This is not an automatic extension of every claim. The jurisdictional Assessing Officer route and the order’s wording determine whether it is available.

  1. Save the intimation, computation sheet and filed return as PDFs.
  2. Mark the exact mismatch, such as gratuity reported in salary but omitted from the exemption calculation.
  3. Select the portal option that matches an apparent record error; do not combine unrelated changes.
  4. Upload only relevant supporting records and keep the acknowledgement number.
  5. Monitor the portal for a rectification order or request for clarification.

When the issue needs an appeal

Rectification is designed for a mistake apparent from the record. It is not a general forum for introducing a new claim or replacing a substantive dispute about eligibility, employer status or the interpretation of section 10(10).

The Department’s Form 35 FAQ and User Manual lists, among appealable matters, an intimation under section 143(1) that makes adjustments to returned income and rectification orders under sections 154/155. It states that an appeal is filed online in Form 35 and generally must be filed within 30 days from service of the order or demand, as applicable.

The 30-day clock is tied to the type of order and the relevant service or demand date, not simply to the assessment year. Record the date you can prove the order was served. The Department says delay may be condoned for reasonable cause in exceptional cases, but that is not a reason to wait.

  1. Identify the precise adjustment or finding you challenge and the section cited in the order.
  2. Calculate the 30-day period from the applicable service or demand date.
  3. Prepare the return, order, employer records, gratuity computation and a fact-based statement of grounds.
  4. File Form 35 online with the required order and demand details.
  5. Keep proof of filing and track notices after submission.

If a rectification request could consume the appeal period, seek qualified Indian tax advice promptly and preserve the appeal option. A rectification application does not automatically suspend the appeal deadline.

How to explain the error clearly

Whether you use rectification or an appeal, write in the order a reviewer can verify:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • State the assessment year and the communication or order number.
  • Identify the employer, gratuity payment date and amount received.
  • Point to the exact salary-schedule entry where gratuity was reported.
  • State the section 10(10) category and the calculation used.
  • Explain the numerical difference between the return and the intimation.
  • Request the specific correction or relief supported by the record.

Avoid arguing that gratuity is “always exempt” or that a cap applies simply because the payment came from a familiar employer type. The decision-maker needs the statutory category, the recorded figures and the link between them.

Common mistakes that make a disallowance harder to fix

  • Calling the claim a deduction: section 10(10) is an exemption, so look in the salary and exempt-income schedules rather than adding a separate deduction.
  • Using the wrong employer: the AY 2026-27 ITR-3 validation does not allow the exemption against more than one employer.
  • Claiming more than salary shows: the same validation rules limit the exemption to gratuity offered under section 17(1) as gratuity received.
  • Treating a validation cap as the legal calculation: ₹20 lakh and ₹25 lakh are stated caps for listed ITR-3 categories and AY 2026-27.
  • Filing rectification for a new claim: the Department’s guidance limits rectification to covered apparent errors and restricts return-data correction.
  • Waiting for rectification before considering appeal: the Form 35 period can expire while a portal request is pending.
  • Ignoring the assessment year: form validations and portal workflows can change, so use the rules applicable to the return that was filed.

When professional help is sensible

Consider a qualified Indian tax professional when the payment involves several employers, a disputed government or non-government classification, incomplete service records, a rectification rejection, a demand that includes interest or penalty, or an appeal deadline that is close. Provide the complete file rather than only a screenshot of the demand. An adviser can determine whether the dispute is a record error suitable for rectification or a substantive eligibility issue requiring grounds of appeal.

Neither rectification nor appeal guarantees restoration of the exemption. The result depends on the statutory category, facts, evidence, wording and date of the order, and the procedural route used. The Department’s live portal instructions and the governing law should be checked again before filing.
