What to Do if TDS Is Deducted From Your EPF Withdrawal Despite Form 121

If tax was deducted from your EPF withdrawal even after you submitted Form 121, first verify that the deduction appears in your tax records and obtain the reported TDS details from the deductor. Report the withdrawal income in your income-tax return, claim the TDS credit, and request a refund of any excess after your final tax liability is calculated. Form 121 is intended to prevent withholding before payment; it is not itself a refund application, and current official material does not confirm that EPFO reverses a completed deduction.

What the deduction means

A TDS deduction does not by itself establish your final tax bill. It is a payment credited toward the tax that may be due on the EPF withdrawal. Your return calculates the taxable income and final liability for the relevant tax year. If the TDS exceeds that liability, the excess can be claimed as a refund through the return.

The immediate question is whether the amount was correctly reported. Compare the EPFO settlement statement with your Annual Information Statement (AIS) and Form 26AS. Check the amount, deductor name, PAN details and the tax year. If the entry is absent or differs from the settlement document, ask the deductor or EPFO to confirm what was filed and to correct the reporting if necessary.

What Form 121 does—and what it cannot do

The Income Tax Department describes Form 121 as a declaration that your estimated tax liability for the tax year is nil. When a valid declaration is furnished to the payer in time, the payer may be permitted not to deduct TDS on specified payments. The department advises submitting it before the income is credited or paid, preferably at the start of the tax year.

That timing is decisive. Form 121 is a preventive declaration. It asks the deductor not to withhold in the first place; it does not automatically cancel or refund TDS that has already been deducted and reported. The Form 121 manual expressly tells declarants to furnish the declaration on time so that tax is not deducted in the first place.

A completed deduction may therefore leave you with two separate tasks: establish whether the withholding was reported correctly, and recover any overpayment through the normal return and refund process. The material currently available does not establish a general EPFO post-payment reversal procedure for a Form 121 claim.

Use the form and rules for the correct tax year

Do not assume that a form used for an earlier financial year remains the correct document. The Income Tax Department says that, for tax years beginning on or after 1 April 2026, the nil-tax declaration is furnished in Form 121 under the Income Tax Rules, 2026. Forms 15G and 15H belonged to the earlier Income-tax Act, 1961 framework; the corresponding provision under the 2025 Act is section 393(6).

Tax years beginning before 1 April 2026 Earlier Income-tax Act, 1961 framework, including Forms 15G and 15H where their conditions applied Match your declaration and eligibility to the rules for that earlier year.
Tax years beginning on or after 1 April 2026 Income Tax Rules, 2026; Form 121; corresponding provision under the 2025 Act is section 393(6) Use Form 121 and the process applicable to that tax year, rather than automatically reusing an older form.

The Form 121 manual says the deductor must have a valid TAN registered on the e-filing portal and that the declaration must be complete and valid. It also refers to a unique identification number (UIN) and a deductor filing deadline of the seventh day after the quarter. That deadline belongs to the deductor’s filing flow; it is not a deadline for an EPF member to submit a return or make a refund claim. The available material does not establish how EPFO currently implements this flow for member withdrawal claims.

Why an EPF withdrawal may be assessed for TDS

EPFO’s 2015 circular discusses withholding under section 192A on certain taxable accumulated provident-fund payments. It identifies situations such as a transfer from one provident-fund account to another and withdrawal after five years of service as exclusions in the historical framework. Because that circular is old, its rupee thresholds and rates should not be used as current advice.

For a current reference point, the Income Tax Department’s TDS table lists a 10% rate for section 192A for assessment year (AY) 2026–27 under the Income-tax Act, 1961, as amended by Finance Act 2026. That figure is tied to that assessment year and legal regime. It is not your final tax rate and should not be applied automatically to every withdrawal or every tax year. The taxability of your particular payment depends on the governing year, the nature of the withdrawal and the facts of your provident-fund service and account.

What to do after TDS has already been deducted

1. Confirm the amount and reporting

  1. Download the EPF settlement statement or other payment record showing the gross withdrawal, TDS and net amount.
  2. Check AIS and Form 26AS for the same deductor, amount and tax year.
  3. Compare the PAN used in the EPF claim with the PAN in your tax account.
  4. If the entry is missing, duplicated or incorrect, ask EPFO or the relevant deductor what was reported and on what date. Request correction of the tax statement where the reported data is wrong.

Do not treat a bank-credit amount alone as proof of the tax treatment. The settlement record and the tax statement together show whether withholding was actually reported.

2. Preserve evidence of the declaration and claim

Keep a copy or acknowledgment of Form 121, the date and method of submission, the EPF claim reference, settlement statement, PAN details and any response from EPFO. This is sensible documentation if you need to explain why you expected non-deduction. The available official material does not prescribe a special evidence packet for disputing a Form 121-related deduction, so retain the ordinary records that show what you submitted and when.

3. Ask EPFO for the specific reason

Send a focused request rather than simply asking for “TDS back.” Ask EPFO or the deductor to identify:

  • the tax year and legal provision used;
  • the gross amount considered for withholding and the TDS amount;
  • the PAN and deductor details submitted to the tax department;
  • whether the Form 121 declaration was received, validated and linked to the claim;
  • the date on which the payment and TDS statement were filed; and
  • whether a correction can still be made if the reporting is inaccurate.

This request can clarify whether the issue was late submission, an invalid or incomplete declaration, a tax-year mismatch, a PAN or reporting problem, or a disagreement about eligibility. Do not assume that a valid declaration guarantees reversal after settlement; no current official EPFO guidance located for this question confirms that remedy.

4. Include the withdrawal in your income-tax return

The Income Tax Department directs taxpayers to disclose income on which tax was deducted and claim the corresponding TDS credit in the income-tax return. Use the return form and instructions applicable to your tax year and tax regime. Enter the income and credit consistently with the records available in AIS or Form 26AS and the EPF settlement statement.

If the TDS credit does not appear in your statement, contact the deductor for a correction rather than silently entering a figure that the department cannot match. Keep the settlement document and correspondence in case the return is later queried.

5. Claim any excess as a refund

After the return computes your total tax, compare it with the TDS and other taxes credited to you. If the total paid is greater than the final liability, claim the excess in the return. The Income Tax Department says the refund is credited after the return is processed and the claim is accepted. A refund claim is therefore made through the return; Form 121 does not replace that step.

Choosing the right route

There are two practical routes, and they can be used together when necessary:

Situation Action Purpose
TDS is shown correctly in AIS or Form 26AS Report the withdrawal income and claim the TDS credit in the return; claim a refund if the credit exceeds final tax. Recover the overpayment through the established tax process.
TDS is missing or the amount, PAN or deductor details are wrong Ask EPFO or the deductor to confirm and correct the reported statement, then reconcile the corrected record with your return. Make the tax credit match the actual settlement and avoid a mismatch.
You believe Form 121 was valid but was ignored Provide the declaration acknowledgment and claim details to EPFO, asking for the exact reason and any available correction. Seek an explanation or reporting correction; do not rely on an unconfirmed post-payment reversal.

The best route depends on whether the deduction was reported, whether the withdrawal is taxable in your circumstances, which tax-year rules apply and whether you have already filed the return.

Eligibility is not a blanket exemption

A nil-tax declaration is available only when its conditions are met. Under the earlier framework, the Income Tax Department describes Form 15G for qualifying resident individuals below age 60 and Form 15H for qualifying resident individuals aged 60 or above. It says the eligibility criteria continue under the corresponding new provision. The relevant test is based on estimated total income and the rules for the tax year; submitting a form does not by itself create an exemption.

Check the declaration’s eligibility before arguing that withholding was necessarily wrong. Factors such as residence, age category under the applicable framework, estimated total income and the payment’s tax treatment can affect whether the payer was permitted to rely on it.

Common mistakes that delay the refund

  • Using the wrong year’s form: A form submitted for one tax year may not satisfy the rules for another, especially around the 1 April 2026 transition.
  • Confusing TDS with final tax: The 10% section 192A figure listed for AY 2026–27 is a withholding rate for that stated regime, not a universal or final rate.
  • Ignoring a statement mismatch: A settlement statement and AIS entry that disagree should be reconciled before filing.
  • Assuming submission guarantees acceptance: The declaration must be complete, valid and furnished in time; the deductor’s filing requirements also matter.
  • Waiting for EPFO to refund the TDS: The established recovery route is to claim the reported credit and any resulting excess through the income-tax return.
  • Omitting the withdrawal from the return: Claiming credit without disclosing the related income can create an inconsistency.

A records checklist

Before filing or escalating the issue, assemble:

  • EPFO settlement statement showing gross payment, TDS and net payment;
  • EPF claim or reference number;
  • Form 121 acknowledgment, or the applicable earlier declaration, with submission date;
  • PAN details used in the claim;
  • AIS and Form 26AS entries for the payment;
  • messages or letters from EPFO or the deductor; and
  • your filed-return acknowledgment and refund computation, once submitted.

These records let you distinguish a withholding decision from a reporting error and give a tax professional enough information to review the case if the figures do not reconcile.

When to get individual tax advice

Consider advice from a qualified Indian tax professional if your service period, transfers between provident-fund accounts, residence status, age, estimated income or tax-year transition makes eligibility unclear; if the TDS entry remains wrong after a correction request; or if a notice questions the income or credit. A professional can assess the applicable return treatment and correspondence, but no adviser can promise a refund before the return is processed and accepted.

Direct answers to the practical questions

Why was TDS deducted even though I submitted Form 121?

Possible explanations include late submission, an incomplete or invalid declaration, a tax-year or form mismatch, eligibility not being met, PAN or claim-linking problems, or the deductor’s process not acting on the declaration before settlement. Ask EPFO for the exact reason and reporting details instead of assuming which one occurred.

Can you get EPF withdrawal TDS back?

You can recover excess tax by reporting the income, claiming the TDS credit and requesting the resulting refund in your income-tax return. The available official material does not confirm an automatic EPFO reversal of TDS that has already been deducted.

Where do you claim TDS deducted from a PF withdrawal?

Claim it as TDS credit in the income-tax return for the relevant tax year, using the amount reflected in your tax records and reconciling it with the EPF settlement statement. Any excess is claimed as a refund in that return.
