What to Do if Student Loan Collections Are Taking Money From Your Paycheck or Tax Refund

If a paycheck is smaller or a federal tax refund has disappeared because of student-loan collections, first identify the collection method, preserve the notice and its date, and contact the agency named on it. Wage garnishment, a Treasury refund offset and an IRS tax adjustment use different notices, deadlines and contacts. The procedures below concern federal student loans and other federal nontax debts; private student loans do not automatically follow these rules.

Take these steps before disputing or paying anything

  1. Read every page of the notice. Look for terms such as administrative wage garnishment, Treasury Offset Program or reduced refund. Keep the envelope, the notice date and any attachment because a hearing deadline may run from the date sent or the date received.
  2. Check the federal loan record. Sign in to StudentAid.gov to review federal loan status. If the Department of Education’s Default Resolution Group handles the account, use MyEdDebt for status, loan details and payment history. StudentAid.gov and MyEdDebt are separate accounts.
  3. Call the office identified on the notice. For a student-loan debt, that may be the Department of Education, a guaranty agency or another listed agency. For a federal nontax offset, the Bureau of the Fiscal Service can identify where the refund was sent, but the agency that received the money handles a dispute about the debt itself.
  4. Calendar the deadline immediately. Follow the notice’s hearing or dispute instructions, send the request to the stated address and retain a copy plus proof of delivery or postmark. Do not rely on an old form or a general internet address.

A hearing can temporarily pause collection, but it does not by itself erase the default or decide every repayment issue. Continue working with the loan holder while the request is pending.

Why federal student loans can reach your wages or refund

Federal Student Aid says a federal student loan generally enters default after at least 270 days without scheduled payments. Once a loan is in default, the Department of Education may use administrative wage garnishment without first suing the borrower. Up to 15% of disposable pay may be withheld under that process, according to current Federal Student Aid guidance.

A separate process sends eligible federal nontax debts to the Treasury Offset Program. A federal tax refund can then be reduced or eliminated and applied to the debt. These are collection tools for federal obligations; a private lender cannot simply use the federal Treasury process on its own.

If money is being withheld from your paycheck

Read the administrative garnishment notice

The notice should identify the debt, the proposed withholding and the way to request a hearing. It should also explain the grounds the agency will consider, such as disputing the debt, the amount or the legal authority to collect. Federal Student Aid’s current default FAQ says a hearing request should be postmarked no later than 30 days after the administrative wage-garnishment notice was sent. Use the date and address on your current notice because forms and procedures can change.

Requesting a hearing

Send the request exactly as instructed and explain the specific reason you believe garnishment is wrong. Attach records that support the point, such as payment confirmations, identity-theft documentation, a discharge or settlement record, or evidence that the amount is miscalculated. Keep the complete packet and mailing proof.

A timely hearing request temporarily pauses garnishment until the hearing process is completed. It does not resolve the default, and an unsuccessful hearing does not create a permanent repayment arrangement. Ask the agency in writing what happens to withholding while it reviews the request.

When a repayment agreement may stop garnishment

Federal Student Aid says a repayment agreement can avoid wage garnishment when the first payment is made within 30 days of the notice. That is a notice-specific condition, not a promise that any later payment will stop withholding. Ask the loan holder for the required payment, due date and written confirmation that the agreement prevents garnishment.

If garnishment has already started, contact the named agency immediately and ask which options remain open. A call alone does not guarantee that the next paycheck will be protected.

If a tax refund was reduced or taken

Understand which agency did what

The Bureau of the Fiscal Service sends the notice for a federal nontax debt offset. Its notice should show the original refund, the amount taken and the agency paid. Fiscal Service lists 800-304-3107 for questions when a notice is missing.

The IRS generally does not have the details of a student-loan or other nontax offset. Contact the IRS when the refund amount on the Fiscal Service notice differs from the amount shown on your tax return. For the offset itself, contact the agency that received the payment. The IRS explains this division of responsibility in its reduced-refund guidance.

Watch the 65-day window

Federal Student Aid says the Treasury notice is mailed to the borrower’s last-known address and describes a 65-day period before the offset and related negative credit reporting are scheduled to begin. Its default guidance also describes requesting a hearing to dispute the offset debt within 65 days of receiving the notification. Use the current notice for the exact filing method and address.

Potential grounds include that the debt is not yours, the balance is wrong, payments were not credited or the loan is not legally collectible. Send evidence with the dispute and ask for written confirmation of receipt. A hearing may pause collection temporarily; it does not automatically cancel the default.

When a joint return is involved

If a joint refund was reduced for a student-loan debt owed by only one spouse, the other spouse may be entitled to that spouse’s share. The Taxpayer Advocate Service directs eligible taxpayers to Form 8379, Injured Spouse Allocation. Injured-spouse relief is different from innocent-spouse relief, which addresses responsibility for a joint tax liability. The Taxpayer Advocate Service explains refund offsets and the form at Refund Offsets.

“Your tax return may show you’re due a refund from the IRS. However, if you owe a federal tax debt from a prior tax year, or a debt to another federal agency, or certain debts under state law, the IRS may keep (offset) some or all your tax refund to pay your debt.”

Compare the main ways to leave federal loan default

No option is best for every borrower. Compare the route’s payment burden, collection timing, credit effect, balance changes and eligibility with the loan holder before signing.

Route Payment or eligibility rule Effect on collection Credit and balance consequences
Rehabilitation Direct and FFEL borrowers generally make nine qualifying voluntary payments within 10 consecutive months. Perkins rehabilitation uses nine consecutive payments. The standard amount is 15% of annual discretionary income divided by 12; an Income and Expense form can request a lower amount based on current finances and vital expenses. Involuntary collection may continue until the loan leaves default or at least five rehabilitation payments have been made. After successful completion, the default status is removed and collections stop. The default record is removed from credit reports after the ninth rehabilitation payment, but earlier late payments may remain.
Direct Consolidation Loan Potentially faster than rehabilitation, but eligibility and required repayment terms depend on the loans and current rules. Ask the loan holder how and when the consolidation will affect an active garnishment or offset. The default record may remain. Interest capitalization and collection costs can increase the balance.
Repayment agreement Terms and amount are set by the loan holder. Federal Student Aid says the first payment must be made within 30 days of the garnishment notice to avoid wage garnishment, or within 65 days of the offset notice to avoid Treasury offset. May prevent the specified collection when the notice-based first-payment deadline is met. The default record remains. Confirm all terms and consequences in writing.
Pay in full Pay the verified payoff amount through the official loan holder. Resolves the balance when payment clears. May be unrealistic for many borrowers; obtain the payoff figure and payment instructions before sending money.

Rehabilitation: slower, but designed to remove default

Rehabilitation requires the qualifying payment schedule above. If the standard 15% calculation is unaffordable, submit the Income and Expense form so the holder can consider an alternative amount based on current income and vital expenses. Documentation may need to be mailed or faxed; libraries may provide printing and faxing if you do not have equipment. A printer or fax machine is not a government requirement.

Do not assume that signing the rehabilitation agreement immediately ends a garnishment or offset. Federal Student Aid’s rehabilitation guidance states that involuntary collections can continue until default ends or at least five rehabilitation payments have been made. Once rehabilitation is completed, the default status is removed and collections stop. The default entry is removed from credit reports after the ninth rehabilitation payment, while older late-payment entries can remain.

Direct Consolidation: potentially faster, with balance trade-offs

Consolidation can be faster than rehabilitation, but the default record may remain on the credit history. Capitalized interest and collection costs may increase what is owed. Eligibility, the loans that can be included and the repayment terms are governed by current rules, so confirm them with the official application and loan holder before choosing this route.

Repayment agreement: meet the notice deadline

A repayment agreement is useful only if its amount is sustainable and its first-payment deadline is met. The 30-day and 65-day windows above are tied to the respective notices. Ask for the agreement, payment amount and collection-stop terms in writing; a later payment or a promise made on the phone may not protect the next paycheck or refund.

Payoff

Paying the verified balance in full resolves the debt if you can afford it. Request the payoff amount, accepted payment method and confirmation of release from the official holder. Do not send money to an unsolicited company that promises a discount or immediate discharge.

How to challenge an error and preserve evidence

Use the notice’s dispute process when the loan is not yours, the amount is incorrect, payments are missing, the account was discharged or the debt is no longer legally collectible. Build a dated file containing notices, account screens, payment records, correspondence and delivery receipts. Write down every call, including the representative’s name or identification number and any promised follow-up.

If the dispute concerns where a refund went, start with Fiscal Service. If it concerns whether the student-loan debt is valid, contact the agency that received the offset or the loan holder named on the notice. If a joint return is involved, the spouse seeking their share should evaluate Form 8379 separately from any challenge to the loan debt.

Use official help and avoid paid-debt-relief traps

The Department of Education’s Default Resolution Group does not charge enrollment, subscription or maintenance fees to help borrowers get out of federal default. Be skeptical of a company demanding those fees, asking you to stop communicating with the government or guaranteeing that it will halt a garnishment, recover a refund or obtain a discharge.

Start with StudentAid.gov, MyEdDebt, the agency on the notice or an assigned guaranty agency for a commercially held FFEL loan. The Treasury’s Cross-Servicing information explains federal debt-collection administration, but your notice controls the action and deadline in your case.

A practical sequence for the next seven days

  1. Today: Photograph or scan the notice, envelope and paycheck or refund record. Label the date received.
  2. Within 24 hours: Check StudentAid.gov and, if applicable, MyEdDebt. Identify the loan holder, balance and collection type.
  3. Before any deadline: File a hearing or dispute request if the debt, amount or legal authority is wrong. Use tracked delivery or another method that creates proof.
  4. At the same time: Ask the holder for rehabilitation, consolidation, a repayment agreement and payoff figures, then compare payment affordability and credit consequences.
  5. After sending paperwork: Confirm receipt and ask what will happen to the next paycheck or refund while the request is reviewed.

Your notice, loan type, holder and dates control the available remedy. These federal procedures are general information, not individualized legal or tax advice.
