What to Do If Social Security Withholds Too Much After You Return to Work (2026 Guide)

If Social Security reduced your payment after you went back to work, first determine why. A retirement benefit may be reduced temporarily under the earnings test; a disability benefit may trigger a work review; or the notice may say you were overpaid and that SSA is recovering a debt. Those are different decisions with different forms and deadlines.

Read the entire notice, identify the benefit program and months at issue, compare SSA’s figures with your pay records, and then choose the matching request: SSA-561 to challenge whether an overpayment exists or its amount, SSA-632 to request a waiver, or SSA-634 to seek a lower recovery rate. Follow the filing instructions and deadline printed on your notice.

Start by identifying what kind of withholding you are seeing

The phrase “withholds too much” can describe a lawful reduction, an incorrect calculation, or collection of an overpayment. Look at the notice or payment history before taking action.

Retirement benefits and the earnings test

You can work while receiving Social Security retirement benefits. If you are younger than full retirement age (FRA), however, SSA can withhold benefits when your earnings exceed the annual limit. This is an earnings-test reduction, not an overpayment bill. SSA generally adjusts the amount withheld after it receives your earnings information, and benefits are not reduced for earnings beginning with the month you reach FRA.

SSDI and a return-to-work review

Social Security Disability Insurance (SSDI) has work incentives and disability-review rules. Returning to work or increasing your earnings can cause SSA to examine whether you are in a trial work period, an extended period of eligibility, or another stage of the disability work rules. The result may be a benefit adjustment or an overpayment determination. Do not apply the retirement earnings-test limits to SSDI.

SSI and income-based payment changes

Supplemental Security Income (SSI) is needs-based. Wages and other income can change the monthly payment under SSI’s income rules, and SSA may issue a separate overpayment notice if it paid more than your record supports. The notice should identify the months, income, and calculation used. SSI rules are not interchangeable with retirement or SSDI rules.

An overpayment recovery notice

An overpayment notice says SSA paid more than it believes was due and proposes how to recover the money. Federal regulations require the notice to explain the amount, how and when the overpayment occurred, and available review, waiver, and repayment options. A reduction labeled as “recovery,” “collection,” or “overpayment” calls for one of the specific requests described below.

  • Every month SSA lists, the benefit it says was paid, and what it says should have been paid.
  • The total alleged overpayment and the proposed withholding percentage, dollar amount, or installment plan.
  • The explanation SSA gives, such as unreported wages, changed earnings, or a computational correction.
  • Where and how the notice says to submit forms or evidence.

Do not rely only on the amount shown on a bank statement. The notice’s month-by-month explanation determines which remedy fits and whether a deadline applies.

Build a record of your actual work and payments

Gather documents for each month listed. Useful evidence includes pay stubs, payroll registers, W-2 forms, employer letters, timesheets, start and stop dates, unemployment records, bank statements showing benefit deposits, and copies of wage reports you previously sent to SSA. Mark any pay that was earned in one month but paid in another; that timing issue can change the month SSA counts.

For disability benefits, report a return to work and earnings promptly and keep proof of submission. Eligible beneficiaries may authorize SSA to obtain monthly wage information from payroll data providers through the Payroll Information Exchange (PIE), using authorization form SSA-8240. PIE availability and eligibility can change, so confirm the current process with SSA; authorization does not remove your responsibility to check the record and correct errors.

Choose the request that matches your problem

What you dispute Request Form Evidence to emphasize Result you are seeking
SSA says you were overpaid, or the amount or months are wrong Reconsideration SSA-561 Correct wages, work dates, payment history, prior reports, and a month-by-month calculation Reversal or correction of the overpayment decision
You accept an overpayment but believe recovery should not occur Waiver SSA-632 Why you were not at fault and why repayment would defeat the purpose of the program or be against equity and good conscience; financial information Waiver of some or all recovery
You accept the debt but the proposed deduction is unaffordable Change in recovery rate SSA-634 Income, essential expenses, assets, dependents, and a realistic amount you can pay A lower withholding rate or different repayment arrangement

These requests answer different questions. Filing a waiver does not, by itself, challenge whether SSA’s math is correct. If both the debt and your ability to repay are issues, state each issue clearly and follow the notice’s instructions about submitting more than one request.

How to challenge a wrong overpayment with SSA-561

  1. Identify the exact error. For example, state that SSA counted wages in the wrong month, included a job you never held, omitted a previously reported work stoppage, or used a payment amount that does not match your records.
  2. Recalculate the affected months. Create a simple table showing the earnings or other fact SSA used, the correct figure, and the document proving the correction.
  3. Complete Form SSA-561. Explain that you request reconsideration of the overpayment decision and list each month or calculation you dispute. Avoid a general statement such as “the amount is too high.”
  4. Attach copies, not irreplaceable originals. Include pay stubs, employer statements, wage-report confirmations, and relevant notices. Organize attachments in the same order as the months in your explanation.
  5. Submit it using the route and deadline on the notice. Keep a copy of the completed form, attachments, and confirmation of delivery. If you submit through an online or electronic channel offered by SSA, save the confirmation screen or receipt.

SSA says recovery stops while it decides a properly submitted reconsideration request through the relevant process. Continue reading later notices, because SSA may ask for additional records or issue a revised determination.

How a waiver works when you agree there was an overpayment

A waiver is not an argument that SSA made a mathematical mistake. It asks SSA not to recover some or all of a debt because you were not at fault and recovery would meet a statutory standard, such as defeating the purpose of the program or being against equity and good conscience.

Show why you were not at fault

Describe what you reported, when you reported it, and what SSA told you. Include submission receipts, letters, call notes, or instructions that reasonably led you to believe your payments were correct. Be candid about any delay or mistake; the question is whether your conduct caused the overpayment and whether recovery would be unfair under the circumstances.

Show the effect of repayment

List household income, housing, utilities, food, medical costs, transportation, taxes, insurance, debts, dependents, and available assets. Explain which expenses are necessary and what would happen if SSA withheld the proposed amount. A waiver request is stronger when the figures are current and supported by statements or bills.

Complete SSA-632 and check the small-debt rule

Use SSA-632 for the waiver request and follow the notice’s submission instructions. Current SSA policy says that for an overpayment of $2,000 or less, an individual does not need to complete the longer SSA-632-BK; verify the procedure when you file because policy and forms can change.

SSA says recovery stops while it decides a waiver request through the applicable process. Keep paying attention to correspondence and provide any requested financial updates.

How to ask for a smaller withholding with SSA-634

If you agree that the debt is valid but cannot afford the proposed deduction, use SSA-634. This is separate from reconsideration and waiver. The form asks for the financial information SSA needs to evaluate a different rate or installment amount.

  1. Write down the proposed recovery rate and the amount it would remove from each payment.
  2. Prepare a monthly budget using actual take-home income and essential expenses, including medical and caregiving costs.
  3. List assets and debts accurately; do not omit accounts or property that the form requests.
  4. State the amount you can realistically repay and attach documents supporting the budget.
  5. Submit SSA-634 by the method and deadline in the notice, then save proof of submission.

SSA’s form guidance says recovery stops while it decides a request for a changed rate through the relevant process. A lower rate changes the pace of collection; it does not erase the underlying debt.

Understand the withholding-rate language in your notice

SSA internal instructions describe a default 50% withholding rate for Title II overpayment notices issued on or after April 25, 2025. The instructions also provide transition treatment for some earlier notices, including retention of a 10% rate in specified circumstances. That policy is technical and date-sensitive. Do not assume that every beneficiary is subject to 50% or 10%.

Check the notice issue date, the program listed, and the exact rate or dollar amount proposed. If the deduction is incorrect, unaffordable, or inconsistent with the notice, promptly file the matching reconsideration, waiver, or rate request rather than waiting for several payments to disappear.

Retirement earnings-test figures for 2026

For someone under FRA for all of 2026, SSA states an annual earnings limit of $24,480. SSA withholds $1 in benefits for every $2 earned above that limit. In the calendar year a person reaches FRA, the 2026 limit is $65,160 for earnings before the month FRA is reached, with $1 withheld for every $3 above the limit. Starting with the month FRA is reached, SSA does not reduce retirement benefits because of earnings.

These are retirement earnings-test figures only. They are not SSDI or SSI income limits, and they do not determine whether an SSDI beneficiary is engaging in substantial gainful activity.

Disability work figures for 2026—and why they are not automatic cutoffs

SSA lists average monthly earnings of $1,690 in 2026 as the amount usually considered substantial gainful activity for a non-blind person and $2,830 for a blind person. Those figures are used within disability work rules and must be evaluated with the applicable work incentives, deductions, and work history. They are not an automatic termination line for every SSDI beneficiary.

If your notice concerns SSDI, use SSA’s current work guidance and consider free work-incentive counseling before assuming that one month’s gross pay determines your eligibility. Report changes promptly and preserve evidence of any impairment-related work expenses or special conditions that the rules may consider.

When to contact SSA and what to preserve

  • Contact SSA promptly if the notice is unclear about the benefit program, months, amount, or deadline.
  • Use the local Social Security office or the specific online, fax, or mail route identified for your form. SSA’s waiver process may allow online submission through a my Social Security account, as well as fax or mail to a local office.
  • Keep the original notice, every form, all attachments, delivery confirmation, and notes of calls with dates and names or identification numbers when available.
  • Open and respond to follow-up letters. Missing a request for evidence can cause SSA to decide from the existing record.

A practical decision path

  1. No overpayment language: determine whether the payment change is a retirement earnings-test reduction, an SSDI work review, or an SSI income adjustment.
  2. Overpayment alleged and facts are wrong: file SSA-561 for reconsideration, with month-by-month proof.
  3. Overpayment accepted but repayment would be unfair or unaffordable: file SSA-632 and document fault and financial hardship.
  4. Debt accepted but the deduction is too high: file SSA-634 with a complete budget and proposed affordable rate.
  5. More than one problem: state each issue separately and follow the notice’s directions for filing concurrent requests.

The fastest way to protect your benefits is not to guess which rule applies. Match the notice to the correct program, compare every month with your records, and submit the form that addresses the specific decision SSA made.
