What to Do If Social Security Withholds Benefits Because You’re Still Working

If Social Security withholds part of your retirement or survivors benefit because you are working, first determine whether it is applying the annual earnings test or recovering an alleged overpayment. The remedies are different: update an earnings estimate for an earnings-test adjustment; appeal an overpayment when SSA’s facts or math are wrong; request a waiver when repayment would be unaffordable or unfair. Check the notice for your benefit type, the months and earnings SSA used, and whether it actually says “overpayment.”

Start by identifying the reason for the withholding

Social Security retirement and survivors benefits can be paid while you work. SSA’s FAQ states, “You can get Social Security retirement benefits and work at the same time.” The key question is why the payment changed.

What the notice describes What it usually means First response
Earnings-test reduction, withheld benefits, or excess earnings You are below full retirement age (FRA) for part or all of the year and your counted work earnings exceeded the applicable limit. Verify the correct year, age category, earnings and months; report a changed estimate to SSA.
Overpayment, amount you owe, or recovery SSA says it paid more than you were entitled to receive. This is a debt-collection process, not the annual earnings-test formula. Appeal if the facts or amount are wrong; request a waiver if repayment would create hardship or be unfair; ask about a lower withholding rate.

Read the entire notice before acting. Record the benefit type (retirement, survivors, disability or SSI), the earnings year, each month affected, the earnings amount, the date you reached or will reach FRA, and every deadline. Disability benefits and SSI have different work rules, so the retirement earnings limits below do not apply automatically to them.

How the 2026 retirement earnings test works

The earnings test applies to retirement and, in many cases, survivors benefits claimed before FRA. It counts wages and net earnings from self-employment. Bonuses, commissions and vacation pay count when determining earnings. It does not count pensions, annuities, investment income, interest, veterans benefits or other government or military retirement benefits for this test. SSA explains the calculation in its Receiving Benefits While Working planner.

Use the limit for the calendar year and age group that match your situation. The following figures are SSA’s 2026 amounts.

Your situation in 2026 Earnings exempt from the annual test Reduction above the limit
Below FRA for the entire year $24,480 $1 in benefits withheld for each $2 of excess earnings
Reaching FRA during 2026 (earnings before the month you reach FRA) $65,160 $1 in benefits withheld for each $3 of excess earnings
FRA reached, beginning with the month you reach it No earnings limit Earnings no longer reduce benefits

These are annual limits published by the Social Security Administration’s Office of the Chief Actuary. The higher $65,160 limit applies only to earnings before the month you attain FRA; it is not a full-year limit for someone who reaches FRA late in the year. Once the FRA month begins, work earnings do not trigger the retirement earnings test.

What counts as a work year for the test

SSA generally uses when wages are earned or when self-employment services are performed, not simply when a paycheck arrives. If you believe SSA assigned a bonus, commission or vacation payout to the wrong period, gather the employer’s payroll explanation and identify the period in which the work was performed. For self-employment, keep profit-and-loss records and evidence of the services performed.

Special monthly rule for someone who starts benefits midyear

If you retire or start benefits during a year and have already exceeded the annual limit, a special monthly rule may allow a payment for an eligible month. In 2026, a person below FRA throughout the year can generally qualify for a month when earnings are no more than $2,040 and the person did not perform substantial self-employment services. For someone reaching FRA during 2026, the monthly amount is $5,430. Other conditions apply, including rules about self-employment services. See SSA’s Special Earnings Limit Rule page for the month-by-month requirements.

Benefits withheld under the earnings test are not permanently lost

Withholding can look like a permanent penalty, but SSA says benefits withheld while you continue to work are not “lost.” When you reach FRA, SSA recalculates your benefit to credit months in which payments were reduced or withheld because of excess earnings. SSA also reviews your earnings record; a later year with higher covered earnings can replace a lower year in the benefit formula and raise your monthly amount. Details are in SSA’s benefits planner.

The recalculation does not mean you should ignore an incorrect current adjustment. You still need to correct the earnings estimate or challenge an erroneous notice so that the withholding and future record are based on accurate information.

Check the notice and your own records step by step

  1. Confirm the benefit program. Retirement and survivors benefits use the earnings test described above. Disability and SSI use separate work-incentive and income rules; call SSA if the notice concerns either program.
  2. Identify the stated reason. Look for “earnings test,” “excess earnings,” “withheld,” “overpayment” or “recovery.” An overpayment notice should state the amount SSA says you owe and explain repayment or review options.
  3. Match the dates. Compare the notice’s months and calendar year with your age at the time, including the month you reached FRA. The $65,160 limit is only for earnings before the FRA month in 2026.
  4. Recalculate counted earnings. Add wages, bonuses, commissions, vacation pay and net self-employment earnings. Exclude pensions, annuities, interest, investments and veterans or other government retirement payments from this particular test.
  5. Collect supporting documents. Use pay stubs, Forms W-2, employer letters, time sheets, amended payroll records, tax schedules and self-employment ledgers. Mark which document supports each figure and month.
  6. Compare SSA’s math. For a person below FRA all year, divide excess annual earnings by two to estimate the benefit reduction. For a person reaching FRA, divide earnings above $65,160 by three, limited to pre-FRA-month earnings. SSA may implement the result by withholding whole monthly payments rather than reducing every payment by an identical amount.
  7. Write down the correction you are requesting. State the correct earnings, months, age category and supporting document for each disputed item. Keep copies and a dated log of every call, office visit, upload or mailed document.

Report a changed earnings estimate promptly

If you receive retirement benefits before FRA and your expected earnings change, tell SSA as soon as you know. The SSA FAQ says earnings changes cannot be reported online. Call 1-800-772-1213 (TTY 1-800-325-0778) weekdays from 8 a.m. to 7 p.m., or contact a local Social Security office. The instructions are in SSA’s “What happens if I work and get Social Security retirement benefits?”

When you call, have your Social Security number, benefit information, revised annual estimate, employer or self-employment details and the notice available. Ask the representative to repeat the estimate entered, the months SSA expects to withhold, and whether additional proof is required. Save the date, representative or office name, documents sent and any confirmation number. If your income changes again, update the estimate rather than waiting for the annual earnings review.

If the notice says you were overpaid

An overpayment means SSA says it paid more than the law allowed, which is separate from withholding benefits in advance under the earnings test. SSA’s public Resolve an overpayment guidance describes two different requests.

Appeal when the facts or amount are wrong

File an appeal if you disagree that an overpayment occurred or believe SSA calculated the wrong amount. Examples include wages attributed to you that belong to another person, earnings assigned to the wrong months, a payment that SSA’s own records show was returned, or a calculation that ignores your FRA month. Follow the form, delivery method and deadline printed on your notice. Include a clear calculation and copies of evidence; retain the originals.

Request a waiver when repayment would be unfair or unaffordable

Ask for a waiver when you are not at fault for the overpayment and repayment would cause financial hardship or would be unfair for another reason. A waiver is not a substitute for an appeal: if the amount itself is wrong, appeal it. If the amount is correct but you cannot repay it without giving up basic needs, provide a detailed household budget, income, assets, necessary expenses and evidence explaining why the error was not your fault. Use the instructions in the notice and SSA’s waiver process.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Understand collection timing and the 50 percent policy

SSA’s public guidance says it waits at least 30 days before starting collection and pauses collection when an appeal or waiver is requested within 30 days. Your notice controls the applicable deadline, so act immediately rather than relying on the mailing date or a general rule.

For Title II overpayment notices sent beginning April 25, 2025, SSA’s revised policy sets a default recovery withholding of up to 50 percent of monthly benefits, depending on the case. This is a recovery policy, not the earnings-test formula. If that rate would prevent you from paying necessary living expenses, request a lower monthly recovery rate and document the amount you can afford. The policy is described in SSA’s August 28, 2025 emergency message and current operating instructions in POMS GN 02201.009. Older articles that mention a 10 percent default may describe an earlier policy and should not be applied to a newer notice without checking the notice date.

Special situations that change the analysis

Disability benefits and SSI

Do not use the $24,480 or $65,160 retirement limits for Social Security Disability Insurance or Supplemental Security Income. Those programs evaluate work, wages, impairment-related rules and income differently. Identify the program on your notice and ask SSA which work rule it applied before sending a retirement earnings-test calculation.

Work outside the United States

SSA has a separate monthly work test for certain work performed outside the United States. Whether the work is covered by U.S. Social Security can change which test applies. Tell SSA where the work occurred, the dates, the employer or business, and whether U.S. Social Security taxes covered it. Review SSA’s Work Outside The United States guidance rather than assuming the domestic annual limits apply.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Self-employment

Self-employment can involve both net earnings and a determination of whether substantial services were performed in a particular month. Keep invoices, contracts, calendars, client communications and time records, especially if you stopped working during the year but received delayed payments.

When to escalate your case

Contact SSA promptly if the notice uses the wrong benefit program, omits your FRA month, includes another person’s wages, or gives no understandable explanation of the amount. Consider help from a qualified benefits counselor, legal-aid office or attorney if the disputed amount is substantial, the notice threatens immediate hardship, or SSA denies an appeal or waiver and you believe the decision is unsupported. Bring the notice, your earnings evidence, tax records, contact log and copies of every request.

Keep a single file—paper or digital—with the notice, calculations, pay records, self-employment evidence, correspondence and delivery confirmations. A precise chronology makes it easier for SSA to correct an estimate, evaluate an appeal or decide whether a waiver and lower recovery rate are justified.
