What to Do If Social Security Overpays You Because of Outdated Income Information

If Social Security says it overpaid you because it used old or incorrect income information, do not assume the bill is correct or start repaying blindly. First identify whether the notice concerns SSI or Title II benefits, compare the agency’s month-by-month figures with your records, and then choose the right response: reconsideration to challenge the calculation, a waiver to seek relief from collection, or a lower repayment rate if the debt is correct but unaffordable.

What an income-related Social Security overpayment means

Social Security Administration (SSA) guidance defines an overpayment as receiving more money for a month than you should have received. With Supplemental Security Income (SSI), the amount can change when countable income changes. An overpayment may result when income exceeds an estimate, a change was not reported promptly, or SSA calculated the benefit using incorrect or incomplete information. See SSA’s SSI overpayment guidance.

“Outdated income information” can describe several different situations. SSA may have continued using an old wage estimate, applied earnings to the wrong months, failed to record a report you made, or used incomplete information about wages, self-employment, a pension, or another income source. The notice—not the label alone—controls what SSA says happened, which months are involved, and how much it claims you owe.

Do not apply SSI rules automatically to retirement, survivors, or disability benefits under Title II. The programs have different recovery procedures and withholding policies. The first practical task is to identify the program named on the notice.

Start with the overpayment notice

The notice is the starting point for both correcting bad income data and protecting your appeal rights. Keep the entire notice, including any enclosed forms and instructions. Write down:

  • the notice date and the date you actually received it;
  • whether it concerns SSI (Title XVI) or a Title II benefit;
  • each month SSA says you were overpaid;
  • the amount SSA says it paid and the amount it says you should have received for each period;
  • the income figures, source, or estimate SSA used;
  • when SSA proposes to begin withholding or other collection; and
  • the exact address, phone number, forms, and deadline listed for responding.

SSA says an SSI notice explains the proposed recovery and how to appeal or request a waiver. If the calculation or cause is unclear, ask SSA to explain it and ask how to inspect the relevant file. Its public SSI instructions specifically describe asking to examine the file and obtain an explanation of the calculation: SSA SSI overpayment instructions.

Check SSA’s income information month by month

Make a comparison rather than trying to prove the entire case from memory. Create one line for every month in the alleged overpayment period and place SSA’s figures beside your records.

Check What to compare Why it matters
Income amount SSA’s reported or estimated amount versus pay stubs, employer records, bank statements, pension statements, or self-employment records A stale estimate can make a later month look as though it had income that was never received.
Income month The month SSA credited the income versus the month it was earned or received Putting earnings in the wrong month can change the benefit calculation for both that month and later months.
Reported change Your proof of when and how you reported a new wage, job ending, pay reduction, or other change It can show that SSA had updated information before the overpayment period.
Completeness Whether SSA included all relevant facts, such as a job ending, variable hours, a pension change, or a correction to an earlier report Missing information can produce an incorrect payment amount even when the income figure itself is genuine.

Keep copies of every document and record the date, method, and destination of anything you send. If you reported the change by phone, note the date, office, and representative if you remember them. Ask SSA to tell you what evidence it needs for the particular income source; there is no single universal document list for every case.

Choose the remedy that matches your problem

There are three principal responses. They address different questions and can have different effects on collection.

Option Use it when What it challenges or changes Important point
Reconsideration You believe the overpayment did not occur, or the amount, months, or reason are wrong The underlying overpayment determination For SSI, SSA’s operating instructions describe a 60-day filing period and a recovery pause for a timely initial reconsideration.
Waiver The debt may be valid, but you believe you were not at fault and collection would be unfair or create qualifying hardship Whether SSA should collect all or part of the debt SSA says a waiver may be requested at any time; it is not a substitute for correcting an incorrect calculation.
Changed repayment rate You accept the debt but cannot afford the proposed withholding The speed and amount of recovery SSI and Title II have different default withholding rules. Use the procedure for the program on your notice.
Reconsideration plus waiver You are unsure whether the calculation is right and also believe collection should be excused Both the debt’s correctness and whether it should be collected SSA instructions say it processes reconsideration first and stops recovery when it receives a waiver request, subject to the applicable program rules.

When to request reconsideration

Reconsideration is the route for disputing the facts or mathematics: the income was not yours, the income was assigned to the wrong month, SSA ignored a report, the alleged period is wrong, or the amount was calculated incorrectly. It is not necessary to concede the debt before asking SSA to correct its records.

SSI deadline and recovery effect

SSA’s SSI POMS says an initial reconsideration request should be filed within 60 days of the initial overpayment notice. When filed timely, recovery stops while SSA decides the reconsideration. The public SSI page says that appealing within 60 days from receipt of the notice allows current payments to continue until SSA makes a determination. Because the wording and deadline instructions can vary by notice, use the deadline printed on your actual notice and file promptly. See POMS SI 02220.017 and SSA’s SSI appeals page.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How to file

  1. Complete Form SSA-561-U2, the reconsideration form identified by SSA.
  2. State precisely which months, income figures, or calculation steps you dispute.
  3. Attach copies—not irreplaceable originals—of records supporting each disputed month.
  4. Explain when you reported the income change and include proof of that report if available.
  5. Submit the request using the method and address in the notice, and keep proof of delivery or submission.

Requesting reconsideration does not itself establish that the debt will be canceled. It asks SSA to make a new decision using the information you provide.

When to request a waiver

A waiver asks SSA not to collect a debt, even when the underlying overpayment may be correct. SSA’s general waiver policy requires both of these elements:

  • you were not at fault in causing the overpayment; and
  • recovery would defeat the purpose of the Social Security Act or would be against equity and good conscience.

Those are case-specific standards. Explain the facts that show why you could not reasonably have prevented the error and provide the financial information SSA requests to evaluate the effect of repayment. The governing policy is in SSA POMS GN 02250.001.

Timing and form

SSA says a waiver may be requested at any time, including after recovery has started or the debt has been repaid. For SSI, the public overpayment page directs most people to Form SSA-632-BK. It also says a person who believes they were not at fault and whose SSI overpayment is $2,000 or less may request a waiver by phone. Follow the instructions on your notice because procedures can differ by program and case.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

You may request reconsideration and waiver together when you are unsure whether the calculation is correct but also believe collection would be unfair. SSA’s processing instructions say reconsideration is handled first; recovery stops when SSA receives a waiver request under the applicable process. See POMS GN 02250.002. Do not assume that every later appeal level automatically pauses collection.

If the debt is correct but the payment is unaffordable

If you accept that SSA overpaid you but cannot manage the proposed withholding, ask for a lower rate rather than ignoring the notice. For SSI, SSA identifies Form SSA-634 for requesting less than the proposed monthly withholding. Its current public SSI guidance describes a proposed withholding of the lesser of 10 percent or the entire monthly payment.

Title II rules changed for notices issued on or after April 25, 2025. SSA’s policy update says the default withholding rate changed from 10 percent to 50 percent, with stated exceptions for earlier notices. Earlier notices retain the 10 percent rate when recovery resumes under the conditions described in that update. This change applies to Title II, not SSI. Read the rate and effective date on your notice and ask SSA what lower-rate options apply to your case. The policy update is at SSA EM-25029 REV.

When requesting a lower rate, propose an amount you can actually sustain after necessary living expenses. Include the financial information SSA asks for and continue responding while the request is pending.

What happens if SSA denies your request

Read the denial notice immediately; it should identify the next review level and deadline. SSA’s SSI appeals sequence includes reconsideration, an administrative-law-judge hearing, Appeals Council review, and federal court review. The SSI overpayment page also says a person may seek reconsideration of a waiver denial. See SSA SSI appeals information.

Do not assume collection remains paused after moving to a later appeal level. The effect depends on the program, the type of decision, and the notice. Follow the next-step instructions and ask SSA how recovery will be handled while the review is pending.

A practical recordkeeping and contact checklist

  • Keep the original notice, every revision, and all envelopes showing mailing dates.
  • Maintain a month-by-month income worksheet that matches each figure to a document.
  • Save copies of forms, letters, uploaded files, fax confirmations, and delivery receipts.
  • Write down each call’s date, number used, office, representative, and summary of what was said.
  • When sending a correction, identify the overpayment notice and ask for written confirmation that SSA updated the income record.
  • Ask for an explanation or file inspection if the calculation still cannot be reproduced from the notice.
  • Respond before the notice deadline even if you are still gathering additional evidence; explain what is missing.

Common mistakes to avoid

Assuming the notice must be right

An agency notice is a determination, not proof that every income figure or month is accurate. Check it against contemporaneous records before agreeing to repayment.

Using the wrong remedy

A waiver does not primarily correct a bad income calculation, and reconsideration does not by itself establish that repayment would cause hardship. Choose the request that answers the problem, or file both when both issues genuinely apply.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Using the wrong program’s withholding rule

The SSI 10-percent-or-full-payment description and the Title II 50-percent default for qualifying 2025 notices are not interchangeable. Identify the benefit type before estimating what will be withheld.

Waiting for a perfect package

Missing a deadline can be harder to fix than supplementing a timely filing. Send the required request promptly, then provide additional records as SSA instructs.

Illustrative examples

Old wage estimate after a job ended

An SSI recipient’s notice continues an earlier wage estimate for months after employment ended. Pay records show no wages in those months, and the recipient has proof of the job-ending report. The central response is reconsideration, supported by the records and report date. If the calculation is later upheld but repayment would meet the waiver criteria, a waiver can also be pursued.

Correct debt, unaffordable withholding

A Title II beneficiary agrees that the income information was accurate and the overpayment is valid, but the notice proposes a withholding the household cannot sustain. The issue is not reconsideration of the debt; it is a request for a lower repayment rate using the procedure SSA identifies for that Title II notice.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Unclear months and immediate collection concern

A notice does not explain which income was assigned to which months. The recipient should request an explanation and file a timely reconsideration rather than guessing at the figures. If the person also believes they were not at fault and recovery would be unfair, a waiver request may be filed with the reconsideration.

Where to get case-specific help

SSA’s forms, notices, and POMS explain the agency’s procedures, but they do not replace individualized legal or benefits advice. A legal-aid office, benefits counselor, or attorney familiar with Social Security overpayments may help organize evidence, especially when the amount is large, several benefit programs overlap, or a waiver and appeals issue are both present. Bring the complete notice, income records, and your submission history to any appointment.

The Bottom Line

Verify the months and income SSA used, then act on the correct track: timely reconsideration for an inaccurate overpayment, waiver for a debt that should not be collected under SSA’s fault and hardship standards, or a lower repayment rate when the debt is valid but unaffordable. Keep proof of every step and follow the deadline and program-specific instructions on the notice.
