What to do if inherited jewellery was not disclosed in earlier tax returns

First establish which record was wrong: the deceased’s estate and Inheritance Tax (IHT) account, or your own tax return after you sold or otherwise disposed of the jewellery. They involve different taxpayers, deadlines and correction procedures. Merely receiving inherited jewellery does not usually create an immediate tax bill for the beneficiary, but an omitted estate asset can affect IHT and a later disposal can create Capital Gains Tax (CGT).

Start by identifying the omitted return, taxpayer and dates

“Earlier tax returns” is not precise enough to determine what to do. Gather the date of death, the will and probate papers, estate accounts, every IHT form or account, any valuation obtained at the time, the date the jewellery passed to you, and the date and terms of any later sale, gift or other disposal. Keep copies of earlier tax returns and your calculations.

What may have been omitted Who is normally responsible What question to answer next
Jewellery owned by the deceased but left out of the estate valuation or IHT account The personal representative, such as the executor or administrator Would including the item change the taxable estate or IHT already paid?
A sale or other disposal of inherited jewellery omitted from your Self Assessment return The beneficiary who disposed of it What were the proceeds, the value at the relevant acquisition date, and the allowable costs?
Income arising after inheritance, such as a separate investment connected with the asset The person who received that income Was taxable income received and, if so, was it reported for the correct tax year?

Do not assume that an insurance replacement figure is automatically the market value used for tax. Preserve the source, date and purpose of each valuation, because an insurance assessment and a tax market valuation can be prepared on different bases.

Do you pay tax when you inherit jewellery?

Usually, not as an immediate tax charge on the beneficiary simply receiving the item. HM Revenue & Customs (HMRC) says the estate’s personal representative usually pays any IHT due before distributing assets. HMRC also lists circumstances in which a beneficiary can become liable, so responsibility should be checked against the particular estate documents rather than assumed.

A separate liability can arise later. Tax may be due on income produced after inheritance, or on a profit when the jewellery is sold or otherwise disposed of. The inheritance itself and the later transaction are separate events: record the date and value at which you received the asset, then keep the disposal evidence if you sell it.

If jewellery was left off the deceased’s estate or IHT account

Ask the personal representative to review the account

If the jewellery belonged to the deceased at death and was missing from the estate account, tell the executor or other personal representative promptly. HMRC’s Inheritance Tax Manual describes a disclosure as an admission that an account is wrong. The representative should reconstruct what was owned at the date of death, how the item was valued, whether it formed part of a set, and whether the omission changes the IHT calculation.

Use the estate correction or disclosure route

HMRC manual guidance says amendments to estate values should, strictly, be reported within six months after discovering that the original account was incorrect, subject to the exceptions and procedures in that guidance. That is a deadline for dealing with a discovered error, not a rule that makes every case identical. The representative should follow the procedure applicable to the type of account filed and the date of the original submission.

A personal representative or executor can make a disclosure for someone who has died through HMRC’s digital disclosure service. HMRC may ask for evidence that the person making the disclosure has authority to act. If additional IHT is due, interest can accrue on unpaid tax, so delaying while the facts are known can increase the amount payable.

Work out whether the omission changes tax

  1. Identify the jewellery, ownership at the date of death and any co-ownership.
  2. Obtain the best evidence of open-market value at the date of death, noting who provided it and the valuation method.
  3. Recalculate the gross and net estate, including exemptions, reliefs and debts that applied at that date.
  4. Compare the corrected IHT position with the amount reported and paid.
  5. Prepare the correction or disclosure with a clear explanation, supporting documents and a calculation of tax and interest.

If the corrected value does not change IHT, the representative should still check whether HMRC requires an amended account or notification. Do not simply add the jewellery to a beneficiary’s personal tax return: an estate-account omission belongs to the estate’s correction process.

If you sold or gave away the inherited jewellery

Inheritance is not the disposal

For CGT, jewellery is a personal possession. HMRC’s current guidance states: “You may have to pay Capital Gains Tax if you make a profit (‘gain’) when you sell (or ‘dispose of’) a personal possession for £6,000 or more.” The £6,000 figure concerns disposal proceeds and the special personal-possession rules; it is not a blanket £6,000 tax-free gain allowance.

HMRC’s Personal possessions and Capital Gains Tax helpsheet (HS293), updated 6 April 2026, says a gain on a non-exempt personal possession is included in the return where proceeds are more than £6,000. Read the wording with the calculation rules: the proceeds threshold and the taxable gain are different figures. A disposal for less than the threshold can still require careful records if it is one of several related disposals or part of a set.

Collect the figures needed for the gain

  • Sale proceeds or the market value used for a gift or other disposal.
  • The value of the jewellery at the date it was inherited, supported by contemporaneous evidence.
  • Allowable costs, such as qualifying selling costs and costs of acquisition or improvement where applicable.
  • Whether the item was a single article or part of a matching set.
  • The tax year of disposal and whether you file Self Assessment.

A gift is also a disposal for CGT purposes, generally at market value rather than an arbitrary amount written into a private agreement. Because connected-person and special-relief rules can alter that result, obtain advice if the jewellery was transferred rather than sold for cash.

How the £6,000 to £15,000 chattels calculation works

For a qualifying personal-possession disposal where proceeds exceed £6,000 but do not exceed £15,000, HS293 describes a special calculation. You calculate the excess over £6,000, multiply that excess by 5/3 to obtain the maximum chargeable gain, calculate the actual gain using the normal proceeds, value and costs, and use the lower amount.

Disposal proceeds HMRC treatment described in HS293 What you must retain
£6,000 or less The personal-possession threshold generally prevents a charge under these rules, but check linked disposals and sets. Evidence of proceeds and the item’s identity.
More than £6,000 and no more than £15,000 Compare the actual gain with 5/3 of proceeds above £6,000; use the lower figure. Sale contract, valuation at inheritance, costs and the calculation.
More than £15,000 Use the ordinary CGT calculation in HS293, subject to the rules for personal possessions and sets. Full proceeds, valuation, costs and any relevant relief analysis.

Example of the special calculation

Suppose one qualifying item is sold for £12,000. The maximum gain under the special rule is 5/3 multiplied by £6,000 (the amount above £6,000), which is £10,000. If the ordinary calculation using the inheritance-date value and allowable costs produces a £7,200 gain, the lower amount, £7,200, is used. If the ordinary calculation produces £11,000, the special maximum of £10,000 limits the chargeable gain under this rule. This example illustrates the method only; it does not determine your tax rate or final liability.

Do not split a jewellery set casually

Matching or complementary pieces may be treated as a single set. Selling a necklace, earrings and bracelet separately does not automatically create separate £6,000 thresholds. Apply the set rules in HS293 and keep evidence of how the pieces were marketed and sold. If the pieces were inherited together or are designed to be worn together, ask a tax adviser to confirm the treatment before filing.

Correcting your own tax return

When an amendment is still available

HMRC’s voluntary disclosure guide says a previously submitted return for the previous tax year can be amended within 12 months of its statutory filing date. Check the relevant tax year, filing method and current HMRC amendment facility before changing figures. Enter the disposal, proceeds, gain and allowable costs in the appropriate CGT section, rather than inserting a general note in an unrelated box.

When the amendment window has closed

Older errors may need HMRC’s digital disclosure service. The guide covers Income Tax, CGT and IHT and describes four stages: notify HMRC, make the disclosure, make an offer and pay. After HMRC acknowledges the notification, the detailed disclosure and payment are normally due within 90 days. If you cannot pay in full, contact HMRC and make payment arrangements by the deadline rather than ignoring it.

Prepare the facts before notifying: the tax year, why the original return was wrong, the corrected calculation, tax already paid, estimated interest and any penalty position. HMRC warns that disclosure calculations can be complicated and suggests independent professional advice where necessary.

Look-back periods and penalties depend on behaviour

Do not assume one universal deadline or penalty. HMRC’s guide describes different periods for relevant Self Assessment matters: up to four years where reasonable care was taken, six years for careless errors and 20 years for deliberate errors. It describes distinct IHT treatment, including 20 years for previously unreturned or unpaid IHT and no time limit for deliberate IHT non-payment. These are conditional rules, not automatic labels for every late correction.

Issue affecting the period HMRC guide description Why facts matter
Reasonable-care Self Assessment error Up to four years for relevant matters Records, advice and the steps taken when filing help establish reasonable care.
Careless error Six years HMRC may examine what checks a reasonable taxpayer should have made.
Deliberate error 20 years Intent and concealment evidence are material.
Previously unreturned or unpaid IHT 20 years in the guide’s description The estate’s reporting history and the nature of the omission must be established.
Deliberate IHT non-payment No time limit stated in the guide Professional advice is particularly important.

Interest and penalties are calculated separately from the underlying tax. A prompt, accurate and complete disclosure can affect how HMRC assesses the case, but it does not erase tax that is due.

Evidence, valuation and records to assemble

  • The will, grant of probate or letters of administration and estate inventory.
  • Original estate accounts, IHT forms, correspondence and payment confirmations.
  • Photographs, hallmark or gem details, purchase paperwork and insurance schedules.
  • An independent valuation addressing market value at the date relevant to tax, not merely replacement cost.
  • Sale listings, auction statements, invoices, bank records and proof of selling expenses.
  • A timeline showing death, inheritance, valuation dates, sale or gift dates and every filing deadline.

Keep estimates and calculations even where the jewellery was sold quickly. If records are missing, explain how each figure was reconstructed and identify what is uncertain. Do not substitute a later sale price for the date-of-death or inheritance-date value without considering whether market conditions changed.

Common mistakes to avoid

  • Putting an estate omission on the beneficiary’s return instead of asking the personal representative to correct the estate account.
  • Reporting an inheritance as a gain when no sale or other disposal occurred.
  • Calling £6,000 a tax-free gain allowance rather than a personal-possession proceeds threshold.
  • Ignoring the £15,000 boundary and 5/3 calculation for qualifying chattels.
  • Treating matching jewellery pieces as separate articles without checking the set rules.
  • Using an insurance value as though it automatically proves tax market value.
  • Waiting beyond an amendment or disclosure deadline while trying to perfect every document.
  • Guessing the penalty or look-back period before establishing whether the error was careless, reasonable-care or deliberate.

When to obtain professional advice

Use an independent UK tax adviser or accountant when it is unclear who is liable, whether the omitted item changes IHT, which value date applies, how a set is treated, or how to calculate interest and penalties. An independent jewellery valuer may be useful where reliable market-value evidence is missing, but a valuation alone does not file a correction or determine the tax treatment. Ask the adviser to separate the estate issue from any beneficiary disposal and to identify the exact tax years and forms involved.

A practical action plan

  1. Make a timeline of death, inheritance, any sale or gift and every return filed.
  2. Decide whether the missing information belongs to the estate account or your own return.
  3. Collect ownership, valuation, proceeds and cost evidence before calculating anything.
  4. Ask the personal representative to review the estate correction procedure if the item was owned at death.
  5. Calculate any disposal gain under the personal-possession and set rules if you disposed of the jewellery.
  6. Amend an eligible return within the permitted period; otherwise consider HMRC’s digital disclosure service.
  7. Notify HMRC promptly once you know tax is owed, meet the 90-day disclosure timetable after acknowledgement where it applies, and arrange payment if necessary.
  8. Take independent advice where liability, valuation, set treatment, interest or behaviour-based penalties are uncertain.

The correct route depends on the record, taxpayer and transaction—not on the fact that the asset is jewellery. Establish those facts first, then correct the estate account or personal return through the procedure that matches them.
