What to Do if GST Officers Visit Your Business (India)

Stay calm, identify the legal process, verify the officers’ authority, cooperate without guessing, and keep a precise record of every request and document. A scheduled GST audit is not the same as an inspection, search or seizure. The response that protects your business is orderly documentation and prompt, case-specific advice—not confrontation or destruction of records. This guide covers the Central Goods and Services Tax Act, 2017 (CGST Act), for Indian businesses; it is general information, not advice on a particular case.

What should I do when GST officers come to my office?

Use this sequence as soon as officers arrive:

  1. Appoint one point of contact. Notify the owner, finance head or designated GST contact. Ask other staff to remain available for factual questions but not to speculate, hide files, alter entries, delete messages or destroy records.
  2. Record the arrival. Note the date and time, officers’ names, designations, department, contact details shown on their identification, and everyone present. Keep a contemporaneous log throughout the visit.
  3. Ask what process is taking place. Politely ask whether the visit is an audit under section 65, an inspection under section 67(1), or a search and seizure under section 67(2). Ask for the notice, authorization or other communication on which the visit is based.
  4. Check the document details. Record the issuing authority, date, reference number, premises covered and officers named or authorized. You may ask to see and record the authorization while remaining calm and not obstructing the officers.
  5. Provide records through the point of contact. Keep a list of each file, data export, device or other item shown or handed over. Preserve the original order of records and make a note of any request you cannot immediately fulfil.
  6. Do not improvise statements. Answer factually, say when you do not know, and ask for time to retrieve records rather than guessing. Do not sign a statement or inventory you do not understand; request a copy and seek professional advice where appropriate.
  7. Escalate quickly when the stakes rise. Contact a qualified Indian GST practitioner or lawyer promptly if officers search, seize records or goods, ask for a formal statement, or issue a summons.

There is no blanket instruction to refuse entry because a copy of an authorization is not immediately available. The safer course is to document your request, avoid obstruction and obtain advice on the actual document and facts.

How can I tell whether it is an audit, inspection, or search?

The label matters because the notice, statutory conditions and follow-up rights differ. Use this comparison to orient yourself, then read the actual document.

Process What it covers Notice or authority point Practical response
Audit (section 65) Examination of a registered person’s records and returns. At least 15 working days’ prior notice; the audit may be at the business premises or at a tax office. Treat it as a scheduled examination, not a search. Prepare the requested books, reconciliations and explanations.
Inspection (section 67(1)) Inspection of specified business premises or other places when statutory conditions are met. A proper officer not below Joint Commissioner rank must have reasons to believe the specified conditions exist. Another central tax officer may act under written authorization. Ask which premises and authority are covered, record the authorization details and cooperate without altering records.
Search and seizure (section 67(2)) Search for and seizure of goods, documents, books or things considered relevant to proceedings. A proper officer not below Joint Commissioner rank must have reasons to believe the statutory conditions exist and may act personally or authorize another officer in writing. Keep a detailed inventory of anything removed and understand the qualified copying and return provisions.

The statutory framework is set out in the CBIC text of section 65 and the CBIC text of section 67.

What does a section 65 GST audit involve?

Advance notice and location

Section 65 requires notice at least 15 working days before the audit. The audit can take place at your registered business premises or at the tax office. An unexpected arrival described as an “audit” should therefore be checked against the notice: note its date, the period and records covered, the proposed location and the officer issuing it.

Your preparation

  • Gather the returns, ledgers, invoices, e-way records, tax-payment evidence, reconciliations and prior correspondence requested in the notice.
  • Nominate staff who understand sales, purchases, input-tax credit, payroll and record retention, and route responses through the point of contact.
  • Keep a question-and-answer log. If a document is held electronically, provide a read-only export or supervised access where practical and record what was supplied.
  • Separate explanations based on verified records from matters that need follow-up. A later written clarification is safer than an unsupported answer.

What happens after the audit?

At the conclusion, the proper officer must inform the registered person of the findings, rights and obligations, and the reasons for those findings within 30 days. Keep the final communication with your audit file and calendar any response or payment deadline stated in it.

“The registered person shall be informed by way of a notice not less than fifteen working days prior to the conduct of audit in such manner as may be prescribed.” — Section 65(3), CGST Act.

Can GST officers inspect or search my business premises?

Inspection under section 67(1)

Section 67(1) links inspection to a proper officer not below Joint Commissioner rank having reasons to believe the specified statutory conditions exist. The proper officer may authorize another central tax officer in writing. Ask to see the written authority and record its reference, date, issuing officer, named premises and authorized officers. Continue to cooperate while you obtain advice; the sources do not support a general right to invalidate or stop an action simply because you do not have an immediate copy.

Search and seizure under section 67(2)

Section 67(2) uses a similar rank and “reasons to believe” threshold for searching for goods, documents, books or things relevant to proceedings. The proper officer may conduct the search or authorize another officer in writing. Ask what categories of material are covered and keep your own log of rooms, systems and records accessed. Do not move, conceal, overwrite or delete anything, including cloud files and messages.

During the search

  • Provide a suitable staff member to identify business records and explain ordinary systems without volunteering speculation.
  • Record start and finish times, areas entered, devices or accounts accessed, requests made and any interruption to operations.
  • Ask for an inventory, receipt or other document identifying every item taken. Check serial numbers, file names, date ranges and quantities against your own log.
  • Preserve backups and ordinary business continuity records; do not create, edit or backdate documents after the visit.

What documents can GST officers take?

In a search under section 67(2), officers may seize goods, documents, books or things they consider relevant to proceedings, subject to the statutory authorization and investigation. Do not assume every item must be returned after 30 days or that every electronic copy is automatically excluded.

Making copies or extracts

Section 67(5) gives the person from whose custody documents are seized a qualified right to make copies or take extracts in the presence of an authorized officer at the place and time indicated by that officer. The exception applies where, in the proper officer’s opinion, copying or extracting may prejudicially affect the investigation. Ask in writing when and where supervised copying can occur, and preserve the request in your log.

“The person from whose custody any documents are seized under subsection (2) shall be entitled to make copies thereof or take extracts therefrom in the presence of an authorised officer at such place and time as such officer may indicate in this behalf except where making such copies or taking such extracts may, in the opinion of the proper officer, prejudicially affect the investigation.” — Section 67(5), CGST Act.

The limited 30-day return rule

Section 67(3) provides for return within no more than 30 days after issuance of the relevant notice for documents, books or things that are not relied upon for that notice. It is not a universal 30-day deadline for every seized record. Ask which notice a retained item is being relied upon for, and have an adviser review any retention or return communication.

How should I handle questions, statements and a summons?

Questions and written statements

Answer only from knowledge and records. Distinguish “I do not know” from “I will check the ledger and respond.” Ask the officer to clarify an ambiguous question. Before signing a statement, read every page, correct factual errors, ask for a copy and seek professional advice if the statement could affect liability. Never sign a blank page, incomplete inventory or document you cannot read.

Summons

If the business or an individual receives a summons, do not ignore it. Promptly give the actual document to a qualified GST practitioner or lawyer for review of the required appearance, records and response. The applicable advice depends on the wording, issuer and facts; do not rely on informal summaries of summons procedure.

How do I verify a suspicious GST or DGGI communication?

Fraudulent notices can copy government logos and language. For communications associated with the Directorate General of Goods and Services Tax Intelligence (DGGI), the official verification service explains that the identifier can differ by platform: a DIN, an eOffice Issue Number or a GSTN RFN No. Use the corresponding identifier and the official DGGI “Verify DGGI Communication” service. Do not click an unfamiliar payment link or send records to an unverified address. If verification fails, preserve the message and seek confirmation through an official channel while avoiding obstruction of a genuine, on-site action.

What should I do after the officers leave?

  1. Close the log. Record departure time, officers present, items removed, documents received, unanswered requests and any stated next step.
  2. Secure working copies. Preserve lawful backups of records that remain, note any system access or device imaging, and avoid changing historical data.
  3. Reconcile the inventory. Compare the officers’ receipt or panchnama-style inventory with your own list. Write promptly about factual discrepancies and retain proof of delivery.
  4. Meet copying arrangements. If documents were seized, request the supervised time and place for copies or extracts and record any refusal or investigation-prejudice explanation.
  5. Build a response file. Keep the notice or authorization, correspondence, visitor log, inventory, statements, data exports and adviser communications together with a chronology.
  6. Assess business continuity and disclosure. Tell only the people who need to act, preserve confidentiality, and avoid public accusations or social-media commentary based on incomplete facts.

Common mistakes and safer alternatives

Mistake Why it creates risk Safer alternative
Calling every visit a raid It confuses an audit with inspection or search and can trigger the wrong response. Use the statutory process named in the notice or authorization.
Refusing entry immediately The reviewed provisions do not establish a blanket right to refuse every request or delay proceedings. Ask to see and record authority details, cooperate and obtain advice.
Guessing an answer An inaccurate statement can conflict with ledgers or later evidence. State what you know and commit to check records.
Deleting or moving files It can destroy evidence and worsen the investigation. Preserve records and document any technical problem.
Assuming all seized material returns in 30 days The statutory return provision is limited to material not relied upon for the relevant notice. Identify the notice connected to each retained item and seek advice.
Signing without reading You may adopt an error or an incomplete inventory. Read, correct, request a copy and obtain professional help where needed.

When should I call a GST professional?

Arrange case-specific help immediately when there is a search, seizure, request for a formal statement, a summons, suspected data copying, disputed inventory or a demand that could affect tax, interest or penalty exposure. Give the adviser the complete notice or authorization, your visit log, the inventory, relevant returns and contracts, and a factual chronology. A professional can assess the statutory authority and deadlines; generic online checklists cannot replace review of the actual documents.

The most defensible approach is consistent: identify the process, verify the communication, cooperate without speculation, preserve evidence, document what happened and obtain qualified advice before making consequential statements or responses.
