What to Do if an Institute Charges GST on an Exempt Education Service

By TheFinanceBase Team 10 min read

Do not assume the GST line is lawful—or unlawful—until you identify the exact service and the provider’s legal status. India’s education exemption applies only when the institution and the supplied service fit the definitions and conditions in the applicable GST notification. A coaching centre, training company or private institute is not automatically exempt merely because it sells something described as education.

Your most useful first move is to obtain a line-by-line invoice and ask the institute, in writing, which service is taxable and which GST provision supports the charge. Then test that answer against Entry 66 of Notification No. 12/2017-Central Tax (Rate), the relevant CBIC clarifications and the tax period shown on your bill.

Why an education fee can still show GST

Entry 66 of Notification No. 12/2017-Central Tax (Rate), dated 28 June 2017, exempts specified services supplied by an “educational institution.” That term has a defined meaning; it does not cover every business that teaches, coaches or issues a certificate.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The notification’s main routes include:

  • pre-school education and education up to higher secondary school or equivalent;
  • education forming part of a curriculum for obtaining a qualification recognised by law for the time being in force; and
  • education as part of an approved vocational education course.

The service must also be the kind covered by the exemption entry. A separate supply—such as a facility, event, accommodation arrangement or another independently contracted service—may require its own classification. The word “course” on a brochure or receipt cannot decide the tax treatment by itself.

CBIC Circular 177/09/2022-TRU quotes the practical scope of the exemption in this way: “Therefore, it can be seen that all services supplied by an ‘educational institution’ to its students are exempt from GST.” Read that sentence together with the notification’s defined term and the specified supply context; it does not mean that every education-related business or every item sold to a student is exempt. Read the GST rate and exemption notifications and the CBIC Circular 177/09/2022-TRU for the wording applicable to your period.

Rules and notifications have been amended since 2017. Always check the version and amendments that applied on the date of the invoice, not only the current webpage.

Step 1: isolate the exact GST charge

Save the tax invoice, receipt, enrolment form, prospectus, fee schedule and proof of payment. Mark the line on which GST appears. Institutes sometimes combine tuition, examination, registration, materials, transport, accommodation or other items in one total; you need the supplier to separate them.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Send a written request (email is useful because it creates a record) asking for:

  • the description of the taxable service;
  • the GST rate and amount applied to that line;
  • the institute’s GST registration number, if shown on the invoice;
  • the notification entry, circular or other legal basis relied on; and
  • whether the tax has been collected and deposited in the relevant GST return.

Ask for a revised, itemised invoice if the receipt does not identify the supply. Keep the original document; do not alter it yourself. A clear description is essential because exemption depends on what was supplied, by whom and under what arrangement.

Step 2: test whether the provider and course fit the exemption

School-level education

Education up to higher secondary level or equivalent is one of the categories listed in the notification. Verify that the supplier is providing that qualifying education, rather than a separately sold activity offered alongside it.

A qualification recognised by law

For this route, the education must form part of a curriculum for obtaining a qualification recognised by law for the time being in force. CBIC Circular 117/36/2019-GST explains this test in the context of Directorate General of Shipping-approved maritime courses. That circular helps show how the recognised-qualification requirement is analysed; it is not a blanket ruling that every private certificate or coaching course is exempt.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Collect the course curriculum, the awarding body’s approval or recognition documents, and the rule that makes the qualification legally recognised during the billed period. A private completion certificate, an entrance-preparation package or an informal skills class should not be treated as qualifying without evidence of the required recognition.

Approved vocational education

Entry 66 separately refers to education as part of an approved vocational education course. “Vocational” in marketing material is not enough. Ask which approval applies, who granted it and whether that approval covered your course and dates.

Institutional status

Match the supplier itself to the notification’s “educational institution” definition. An institute may teach students but still fail that defined category for a particular service. Obtain the entity’s legal name, affiliation, accreditation and the relationship between the entity named on your invoice and the body that awards the qualification.

Use the notification’s exact language rather than relying on labels such as academy, institute, university partner or training provider. The official notification compilation is the starting point for that comparison.

Fees that CBIC has specifically clarified

CBIC Circular 177/09/2022-TRU addresses several admission-process charges supplied by a qualifying educational institution. It says the exemption covers:

  • admission or entrance fees;
  • an application fee for an entrance examination;
  • an eligibility-certificate fee issued to a prospective student during the admission process; and
  • a migration-certificate fee charged to a leaving or former student.

These examples concern the identified service and a provider that meets the notification definition. They do not turn every incidental charge, merchandise item or separately contracted service into an exempt supply. Compare the invoice description with the clarification and retain the relevant admission or migration paperwork. The full circular is available at CBIC Circular 177/09/2022-TRU.

Use this decision table before demanding repayment

Question What to establish Why it matters
What institution or service is involved? School-level education, a curriculum leading to a qualification recognised by law, or an approved vocational education category under the notification These are defined routes to educational-institution status.
What exactly is the billed fee? A student service, admission or entrance fee, entrance application fee, eligibility certificate during admission, migration certificate, or another service Some categories have express CBIC clarification; other supplies require individual classification.
Who paid and bore the tax? The payer, the person that ultimately bore the GST, and whether the institute collected and deposited it Those facts can determine who has a viable refund route.
When and how was the claim documented? Invoice and payment dates, the relevant date, supporting records and the filing route Section 54 generally uses a two-year period, but the relevant date depends on the claim.

Step 3: ask the institute to correct the bill or repay the amount

If your documents appear to satisfy the exemption, write to the institute’s finance or grievance office. State the invoice number, date, course, disputed line and the exemption route you believe applies. Attach the notification or CBIC circular link, but describe the facts rather than asserting a conclusion that has not been established.

Ask the institute to confirm one of these outcomes in writing:

  • it will issue a corrected invoice without GST and explain any accounting adjustment;
  • it disputes the exemption and will identify the precise taxable supply and legal basis; or
  • it will review whether a repayment or other correction is possible after checking its GST returns.

Do not cancel or edit an invoice yourself. Keep every email, response, payment record and course document. If the institute says the tax was already reported, ask whether it has made or will make the corresponding correction in its records. The official materials establish exemption criteria and refund procedures; they do not require a supplier to refund every amount merely because a customer requests it.

Can a student claim a GST refund?

A refund is not automatic. The answer depends on who paid and bore the tax, whether the tax was collected and deposited, the type of refund claim and the applicable “relevant date.” Section 54 of the CGST Act generally provides a two-year period from that relevant date, but the date differs by claim category.

The GST refund rules generally use FORM GST RFD-01, filed electronically on the common portal either directly or through a notified facilitation centre, together with the evidence required for the particular claim. The rules also address declarations or certification about whether the tax incidence was passed on. Read the CBIC GST refund rules before relying on a filing route.

Section 77 addresses tax that was wrongfully collected and paid to the Central or State Government. That provision does not, by itself, tell you that a student automatically receives the money. The claimant’s identity, the supplier’s accounting, the incidence of tax and the documentary trail remain important. The CBIC FAQ explains the unjust-enrichment principle and its exceptions; consult it at CBIC’s GST FAQ.

Why the “unregistered person” category may not solve this

Circular 188/20/2022-GST discusses RFD-01 applications by unregistered persons in specified situations, including cancellation of construction-service contracts for flats or buildings and termination of long-term insurance policies. Those examples do not create a general refund entitlement for every student or customer charged GST. Do not select that category solely because you are not GST-registered; first determine whether your facts fit a recognised refund provision. The circular is at CBIC Circular 188/20/2022-GST.

Documents to assemble

  • the original tax invoice or receipt showing the GST line;
  • bank, card or online-payment proof;
  • the enrolment agreement, prospectus and fee schedule;
  • the course curriculum and recognition, affiliation or approval evidence;
  • admission, entrance, eligibility-certificate or migration documents where relevant;
  • the institute’s legal name and GST registration details shown on the invoice; and
  • your written request and every response.

Organise the records by invoice date. If the matter reaches a tax professional or authority, a chronological file is more useful than screenshots without context.

Escalation when the institute will not explain the charge

Start with the institute because it supplied the service and issued the invoice. If it refuses to identify the taxable supply, gives contradictory answers or ignores a reasoned request, seek assistance from the relevant tax authority or a qualified Indian GST professional. Provide the complete document set and ask for advice on the exact claim category, relevant date and claimant.

CBIC lists its Mitra helpdesk and contact channels, while GSTN lists portal-help options. These channels can help with information or technical filing problems; they do not adjudicate whether a particular course or invoice qualifies for exemption. Current contact routes are listed at CBIC Contact Us.

If you consult a professional, ask them to review the tax period and amendments to Notification 12/2017, the supplier’s status, the invoice classification, whether tax was deposited, and any unjust-enrichment issue. Avoid paying a fee for a “guaranteed refund”: no official source establishes a guaranteed outcome for an individual dispute.

Common mistakes that weaken a claim

  • Relying on the word education. Exemption follows the defined institution, course and service, not ordinary marketing language.
  • Arguing about the entire fee instead of one line. A mixed invoice may contain both qualifying and separate supplies.
  • Treating a private certificate as legally recognised. Gather proof of the recognition requirement during the billed period.
  • Assuming the student is always the refund claimant. Who bore the incidence and how the supplier accounted for tax can be decisive.
  • Waiting past the limitation period. Section 54 generally uses two years from the relevant date, which must be identified for your claim.
  • Using a helpdesk as an appeal authority. Helpdesks assist with information or portal issues; they do not decide the merits.

A concise email you can send

Use a factual request and customise the bracketed details inside the code block:

Subject: GST charged on [course/fee] — request for classification and correction

“Please provide an itemised explanation for GST of [amount] on invoice [number] dated [date] for [course or service]. Please identify the exact taxable service, GST rate, your GST registration details and the notification entry or other legal basis for charging it. The provider and service may fall within the education exemption in Entry 66 of Notification 12/2017-Central Tax (Rate), including the admission-process clarification in CBIC Circular 177/09/2022-TRU. Please confirm whether you will issue a corrected invoice or review repayment, and advise whether the tax was collected and deposited. I attach the invoice, payment proof and course documents.”

Keep the sent message and attachments. The wording requests an explanation; it does not presume that your individual facts have already been legally determined.

Bottom line

An institute’s GST charge should be tested against the exact provider, course and invoice line. Verify the notification definition, use CBIC’s admission-fee and migration guidance where it fits, and demand a written classification before seeking money back. If the charge appears wrong, pursue correction with the institute and promptly obtain advice on RFD-01, the section 54 deadline, tax incidence and the proper claimant. A government helpdesk can explain process or portal issues, but only a fact-specific review can determine whether your particular fee was exempt and who may claim any refund.

Frequently Asked Questions

Is every tuition or coaching fee exempt from GST in India?

No. The exemption is conditional. The provider must fit the notification’s definition of an educational institution, and the exact service must fall within an exempt category. Coaching, private certificates and separately supplied services cannot be presumed exempt from the label alone.

What should I do if my receipt combines tuition and other charges?

Ask the institute for a line-by-line invoice and identify which item carries GST. Test each supply separately; a qualifying education service does not automatically make every bundled or independently supplied item exempt.

Can I file RFD-01 immediately as a student?

Not automatically. RFD-01 is the general electronic refund form, but eligibility, claimant status, tax incidence, the relevant date and the evidence required depend on the specific refund category.
