If a VA appraisal is below your contract price, do not assume the deal is automatically canceled or that VA will finance the difference. Ask your lender for the completed Notice of Value, confirm whether the appraiser used the Tidewater process, and then evaluate four paths: challenge the value with relevant market data, negotiate a lower price, bring cash for the gap, or use the VA Escape Clause if its requirements are met.
Move quickly. Tidewater has a short response period, and your rights depend on the purchase contract you signed, when it was signed, and the exact VA documents in your file.

What does a low VA appraisal mean?
A VA appraisal estimates the property’s reasonable value for VA lending purposes and checks the minimum property requirements that apply to the loan. It is not a guarantee that the home is worth the contract price, and it is not a home inspection.

Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →For an individual property, VA says the maximum VA-backed loan is based on the lower of the purchase price or the VA-established value. If your contract price is $400,000 and the Notice of Value is $385,000, the VA loan does not simply expand to cover the $15,000 difference. You must resolve the difference through a price change, additional funds, or an allowed exit from the contract.

A low value creates choices; it does not itself terminate the agreement. The seller is not automatically required to lower the price, and the buyer is not automatically required to proceed.
First, confirm which appraisal stage you are in
Ask the lender to identify the exact figure, document and deadline involved. You need to know whether you are dealing with an appraiser’s preliminary warning or a completed appraisal and Notice of Value (NOV).
Questions to ask the lender immediately
- What is the VA reasonable value shown on the Notice of Value?
- Has the NOV been issued, or is the appraiser still completing the report?
- Did the appraiser invoke Tidewater?
- What is the deadline for submitting comparable-sale information?
- How would the lower value change the loan amount, cash to close, and any required reserves?
- Which version of the signed purchase contract and VA Escape Clause is in the file?
Keep the lender, buyer’s agent and settlement professionals working from the same number. A figure mentioned informally by an agent or shown in an unfinished report is not necessarily the final VA value.

Tidewater and ROV are different processes
Confusing these procedures can cause you to miss the opportunity that is still available. Tidewater occurs before the appraisal report is complete. A Reconsideration of Value (ROV) follows completion of the appraisal and issuance of the NOV.
| Process | Timing | What it means | What your team can submit |
|---|---|---|---|
| Tidewater | Before the appraisal report is completed | The appraiser expects the value may be below the contract price and notifies the requester. | Relevant market data, generally within two business days of the notice, for the appraiser’s consideration. |
| Reconsideration of Value | After the appraisal is completed and the NOV is issued | A formal request to review the completed value using credible additional evidence. | The Veteran borrower requests an ROV through the route VA specifies, supported by pertinent comparable sales and other factual information. |
This distinction is set out in VA Lender’s Handbook Chapter 10 and current VA fee-appraiser training. Neither procedure guarantees a higher value.

If Tidewater is still open, submit useful market evidence
Under the VA Lender’s Handbook, when an appraiser anticipates an opinion of value below the sales price, the appraiser notifies the requester before finishing the report. The requester then has two business days to provide additional market data.
What to give the appraiser
Work through the lender or the party identified in the notice. Your buyer’s agent can help locate closed sales, but the information should be factual and verifiable rather than a statement that the home “feels” worth more.
- Street address of each comparable sale.
- Closed sale price and closing date.
- Gross living area and other relevant physical characteristics.
- Listing details, when available, including the original list price and marketing history.
- Location, lot, condition, quality, room count and other features that make the sale genuinely comparable.
- A short explanation of material differences between the comparable and the subject property.
Recent, nearby closed sales that resemble the property are generally more useful than distant sales, active listings or a neighbor’s estimate. Do not describe Tidewater as a second appraisal ordered by the buyer; it is a pre-completion opportunity for the appraiser to consider additional data. The appraiser may retain the original conclusion.
After the NOV: consider a Reconsideration of Value
Once the appraisal has been submitted and the NOV issued, the Veteran borrower may request an ROV. VA’s current fee-appraiser training says the borrower submits the request to VA through ServiceNow; coordinate with your lender so the request follows the transaction’s required route and documentation.
Build an evidence-based request
- Obtain the final NOV and appraisal-related instructions from the lender.
- Ask your agent for recent, closed sales that are truly comparable in location, size, condition, quality and amenities.
- Identify factual errors or omissions, such as an incorrect finished-area measurement, missed improvements, an inaccurate bedroom count or a comparable that is materially dissimilar.
- Explain each proposed adjustment with objective information. Do not rely only on an automated estimate, an asking price or an unsupported opinion.
- Send the completed request and evidence through the lender/VA process before any stated deadline, and ask how the decision will affect underwriting and closing dates.
VA guidance describes review of the submitted information, not a guaranteed change. An ROV can leave the value unchanged, alter it, or require additional clarification.

Ask the seller to reduce the price
A price reduction is often the simplest way to align the contract with the VA reasonable value. Present the NOV and explain the financing constraint through your agent. The seller may agree to reduce the price to the VA value, to another mutually acceptable amount, or to make no change.

The appraisal does not force a renegotiation. Any amendment should be written, signed by the required parties and reviewed for its effect on earnest money, concessions, deadlines and financing. Do not assume every seller concession is interchangeable with a price reduction; have the lender confirm that proposed terms comply with current VA and contract rules.
If the seller will not reduce the price
Ask the lender for a revised loan worksheet showing the maximum VA loan, your required down payment or other cash contribution, closing costs and prepaid items. Then compare that amount with your liquid reserves and the financial consequences of using them. A seller’s refusal does not by itself give you a right to cancel; your contract and the Escape Clause determine whether you can leave.
Could you pay the appraisal gap?
You may elect to proceed at the contract price even though the VA value is lower. In that case, the VA-backed loan remains limited by the applicable lower value, so you may need to provide the difference from your own funds in addition to normal cash due at closing.
| Contract price | VA reasonable value | Potential gap before other costs |
|---|---|---|
| $400,000 | $385,000 | $15,000 |
| $325,000 | $315,000 | $10,000 |
These examples show the arithmetic only; your actual maximum loan and cash requirement depend on the lender’s underwriting, entitlement, closing costs, prepaid amounts and any other transaction terms. Request an updated cash-to-close calculation before agreeing to bring funds.

Questions to answer before paying the gap
- Will the contribution leave enough emergency savings and reserves?
- Would using the funds affect moving expenses, repairs or other debts?
- Does the home’s condition or local market justify paying above the VA value?
- What happens if the property does not appraise higher later when you refinance or sell?
- Are there less costly alternatives, such as a price reduction or a different property?
There is no universal rule that paying a gap is wise or unwise. Make the decision only after reviewing the updated figures with the lender and your own financial adviser if needed.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Understand the VA Escape Clause before deciding to walk away
The VA Escape Clause is a limited contractual protection, not a general cancellation right. VA guidance says it must be included in covered VA purchase contracts signed before the buyer receives the NOV. When the contract price exceeds VA’s reasonable value, the clause gives the buyer the option to proceed or to avoid being required to complete the purchase under the clause’s terms.
The official clause includes this sentence: “The purchaser shall, however, have the privilege and option of proceeding with the consummation of this contract without regard to the amount of the reasonable value established by the Department of Veterans Affairs.” In other words, the buyer can still choose to close; the clause does not force an exit.
What the clause may protect
When its conditions apply, the clause is intended to prevent the buyer from forfeiting earnest money or being compelled to complete the purchase solely because the contract price exceeds VA’s reasonable value. Review the exact signed language, addenda and deadlines with the lender and a qualified real-estate professional.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesWhat it does not do
- It does not let you cancel for any unrelated reason.
- It does not guarantee reimbursement of every expense incurred in the transaction.
- It does not make a seller accept a lower price.
- It does not automatically refund inspection or appraisal fees.
- It does not resolve a civil dispute; VA says it cannot intervene or provide legal advice.
The VA Buyer’s Guide explains that earnest money may be returned when the clause is properly used, while home-inspection and appraisal costs generally are not. Follow the contract’s notice and release procedures rather than simply failing to appear at closing.

Special warning for new construction and upgrade deposits
For a new-construction purchase, separate deposits paid for upgrades are not necessarily earnest money protected by the Escape Clause. VA warns that these amounts may not be refundable even when a low appraisal gives you an option under the clause. Before signing or increasing an upgrade order, ask the builder and your real-estate professional how the deposit is classified and what the contract says happens if the NOV is below the price.
Do not treat the appraisal as an inspection
VA’s buyer guidance states: “Please note that an appraisal isn’t the same as an inspection.” The appraisal’s purpose is valuation and review of VA minimum property requirements. It is not a detailed examination of every system, maintenance issue or future repair need.
Arrange a separate home inspection within the contract’s inspection period when possible. A low appraisal and an inspection report answer different questions: the first concerns lending value; the second helps you understand condition and defects. Keep their deadlines and negotiation rights separate.

A practical decision sequence
- Confirm the final number and stage. Get the NOV, determine whether Tidewater is open, and record every response deadline.
- Submit credible data. Use the two-business-day Tidewater window if available; otherwise prepare an ROV after the NOV with relevant closed sales and factual corrections.
- Seek a written price change. Ask the seller whether the contract can be amended and have the lender review any concessions.
- Calculate the cash requirement. Obtain an updated loan estimate or closing worksheet that includes the appraisal gap and all other cash due.
- Review the Escape Clause. Confirm that it is in the signed contract, that timing and notice requirements are met, and which costs are or are not protected.
- Choose and document the path. Proceed, renegotiate or exercise an available contractual right only after the lender and real-estate professional confirm the paperwork and deadlines.
Common mistakes that make a low appraisal harder to resolve
- Waiting until closing week to ask for the NOV or cash-to-close figures.
- Submitting active listings or broad neighborhood averages instead of comparable closed sales.
- Assuming Tidewater and ROV are interchangeable.
- Believing VA will automatically finance the full contract price.
- Assuming the Escape Clause cancels any purchase-related obligation or refunds every fee.
- Skipping a separate inspection because the property received a VA appraisal.
- Paying an upgrade deposit on new construction without understanding its refund terms.
Who should be involved?
Your lender can explain the NOV, loan cap, ROV route and updated cash requirement. Your buyer’s agent can help identify comparable sales and communicate a price proposal. A qualified real-estate attorney or other professional can explain contract rights under the law applicable to the property; VA itself says it cannot provide legal advice or intervene in private disputes.
Keep written records of the NOV, Tidewater notice, comparable data, ROV submission, seller responses and all contract amendments. Clear documentation helps the transaction parties act before deadlines expire.
