A changed explanation can raise notice, fairness, evidence, or authority issues, but it does not automatically void the reassessment. The result depends on the country, tax, year, statutory power and procedural stage.
Request any reasons or documents available under your local rules, but do not assume that a request pauses the formal deadline. If an objection is available, state the disputed amount, the new ground, the relevant facts, the legal or procedural error and the remedy you want, with supporting records. When the liability is material, the deadline is close or the procedure is unfamiliar, obtain advice from a qualified tax controversy professional in the relevant jurisdiction.

First, identify exactly what changed
Read the original assessment or reassessment and the later document together. A later letter may be a corrected notice, an explanation of an existing adjustment, an objection decision, or an appeal-stage document rather than a new assessment. Those categories can carry different rights and deadlines.
- Issuing authority: record the tax department, agency or tribunal named on each document.
- Tax and period: note the tax type, tax year or reporting period, account number and every affected line item.
- Notice type and dates: write down the title, issue date and the date you actually received it. Keep the envelope, delivery confirmation or electronic timestamp.
- Procedural stage: mark whether it is an assessment, reassessment, decision on an objection, demand for payment or appeal notice.
A department can sometimes rely on more than one legal basis or correct a notice while a dispute is pending. Conversely, a genuinely new ground may require a different statutory power, a fresh notice or a fair opportunity to answer. Only the law for your system can determine which description fits.

Protect your deadline before investigating the merits
Formal objection and appeal clocks often run from service or sending of a notice, not from the day an officer explains it by telephone. Save a complete copy of every notice and attachment, your account transcript, filed returns, working papers, invoices, contracts and all correspondence. Make a dated log showing when each item was sent and received.
- Find the official instructions on the notice. Look for the section titled objection, review, dispute or appeal and the required form, portal or address.
- Calculate the earliest plausible deadline. If the start date is uncertain, use the earlier date while you obtain clarification. Check whether weekends, public holidays, business days, service rules or extension provisions apply.
- Calendar internal milestones. Set reminders well before the filing date for obtaining records, drafting, signature, translation and proof of delivery.
- File a protective objection when local law permits. A short but compliant filing is safer than waiting for an informal response that may not stop the clock. Add detail later only if the rules allow amendments.
Do not rely on a general information request, a call-centre ticket or a request for reasons to extend the deadline unless an official rule expressly says it does. Ask the agency how the request affects timing, but continue preparing the objection or appeal.
Compare the original and new grounds in a working table
Create a page for each disputed adjustment. The table should make the change visible to you, your adviser and the decision-maker.
| Item to compare | What to record |
|---|---|
| Original stated reason | Copy the exact wording and identify the paragraph, line or schedule. |
| New stated reason | Copy the later wording and note whether it appears in a notice, reasons letter or objection decision. |
| Amount and line item | Show the tax, penalty, interest and any loss or credit affected by each ground. |
| Evidence cited by the department | List documents, third-party information, calculations and statutory provisions mentioned. |
| What is unexplained | Identify missing calculations, contradictory facts, a new period or a ground you had no chance to answer. |
Then classify the issue. It may be a factual disagreement, a different interpretation of the same facts, a new factual allegation, a limitation-period problem, a notice defect or a question about whether the authority had power to amend the assessment. Use the classification to target your evidence and legal argument rather than asserting simply that the department changed its mind.

Understand the three different requests you may make
Request for reasons or documents
A reasons request asks the authority to explain the basis and calculation of an assessment or to disclose documents available under its rules. It can clarify what you must answer. Some systems start or adjust an objection period after reasons are supplied; others do not. The request is not automatically an objection and may not preserve appeal rights.
Formal objection or administrative review
An objection tells the agency which part of the assessment you challenge and why. It normally requires facts, legal grounds and evidence, and it must be filed through the prescribed channel. A vague statement such as “I disagree” may be rejected or leave issues outside the review.
Court or tribunal appeal
An appeal challenges a confirmation, variation or other review decision in an independent forum. It can have its own form, filing fee, record requirements and deadline. Some jurisdictions permit an appeal after the agency fails to decide an objection within a specified period. Payment and collection rules may continue while the dispute is pending, so check whether a stay, deferral or security is available.

- Identify the decision. Give the notice number, tax, year, issue date and the amount assessed.
- Define the scope. State the exact dollars, line items, penalties, interest or losses disputed. Say expressly if other parts are accepted.
- Quote or accurately paraphrase the new ground. Explain that this rationale was not the reason stated in the earlier notice, and identify the date of each notice.
- Set out the facts chronologically. Tie each material fact to a return entry, contract, invoice, bank record, valuation, correspondence or witness statement.
- State the legal or procedural point. Explain why the new ground is factually wrong, unsupported by the evidence, outside the amendment power, time-barred, inadequately notified or otherwise unfair under the applicable rules.
- Request a remedy. Ask for the adjustment to be vacated, reduced, recalculated or reconsidered, and specify any related penalty or interest relief.
- List attachments and preserve filing proof. Number exhibits, explain what each proves and keep the submission receipt, upload confirmation or postal tracking.
Do not accuse an officer of bad faith merely because the explanation changed. Focus on whether the change caused prejudice, whether you had a fair chance to answer and whether the statute permits the action at that stage.
Evidence that answers a changed rationale
Match each assertion to evidence. If the new ground concerns residency, assemble travel records, leases, utility bills and employment documents. If it concerns the character or timing of income, provide contracts, invoices, bank statements, ledgers and contemporaneous correspondence. For a deduction, show the legal connection to income, the calculation and proof of payment. For a valuation, preserve the methodology, comparable data and date used.
Keep originals and submit readable copies in the format required by the authority. Redact unrelated personal information only when permitted; excessive redaction can make a record unusable. Create an index and a one-page chronology so the reviewer can locate the answer to each allegation.

Under section 165 of the federal Income Tax Act, a notice of objection must state the reasons for the objection and the relevant facts. For an individual other than a trust, or a graduated rate estate, the statutory deadline is generally the later of one year after the return-filing due date and 90 days after the notice of assessment was sent. Other cases generally use 90 days after the notice was sent, subject to the statute’s special rules. The Minister must reconsider and may vacate, confirm, vary or reassess; section 165(3) states: “On receipt of a notice of objection under this section, the Minister shall, with all due dispatch, reconsider the assessment and vacate, confirm or vary the assessment or reassess, and shall thereupon notify the taxpayer in writing of the Minister’s action.”
If the Minister confirms or reassesses, section 169 generally permits an appeal to the Tax Court within 90 days after the notice of confirmation or reassessment. An appeal can also become available after 90 days with no action on the objection. Those are federal statutory examples; provincial taxes, trusts, corporations and other taxes can have different rules. Verify the current statute and notice instructions before relying on any date.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.South African example: SARS reasons and objections
South Africa uses a distinct sequence. SARS guidance generally gives 80 business days to object to an assessment or decision. Where reasons are requested, the published timing is tied to SARS’s notice that adequate reasons have been provided or to the date the reasons are supplied. The objection must identify the disputed part or amount, explain why the assessment is incorrect and include substantiating documents not previously delivered.
Recommended Free Tools
The Tax Administration Act dispute-resolution rules provide that a taxpayer generally requests reasons within 30 days of the assessment, subject to possible extension. They specify an 80-day objection period after the relevant reasons notice or reasons, or after the assessment if no reasons were requested, and require detailed grounds and supporting documents. Rule 6(1) says: “A taxpayer who is aggrieved by an assessment may, prior to lodging an objection, request SARS to provide the reasons for the assessment required to enable the taxpayer to formulate an objection in the form and manner referred to in rule 7.” These South African periods cannot be transplanted to another tax system; confirm the current SARS rules and the notice you received.

What happens after you file
Keep the acknowledgment and monitor the authority’s portal, mail or email. If the department asks for information, answer by the stated date and preserve the transmission record. An objection decision may confirm the assessment, reduce it, increase it where the law allows, vary the reasons or issue a new reassessment. Read the decision for the next forum and deadline rather than assuming the original clock continues.
Check whether collection continues, whether interest accrues, and whether payment, security or a suspension request is required. A successful objection does not necessarily cancel a separate penalty or a different tax period, so reconcile the account after each decision.
When professional help is worth the cost
Prompt local advice is especially important when the amount could affect your solvency, the deadline is within days, several years are involved, a limitation period or anti-avoidance rule is raised, records are missing, or the agency has introduced a ground after an objection was filed. A tax lawyer, chartered or certified accountant, tax agent or equivalent professional can map the statute to the procedural record and determine whether a new rationale requires amendment, disclosure or a different forum. Choose someone authorized to represent taxpayers before the relevant authority and ask how fees, scope and conflicts will be handled.
Practical checklist before sending anything
- Both notices and all attachments saved in their original form.
- Issue and delivery dates verified from envelopes or electronic records.
- Authority, tax, year and procedural stage identified.
- Earliest objection and appeal deadlines calculated and calendared.
- Original and new reasons compared line by line.
- Disputed amount and affected line items stated precisely.
- Reasons request separated from the formal objection.
- Facts, law, requested remedy and exhibits indexed.
- Filing method, signature, translation and size requirements checked.
- Proof of filing, acknowledgment and payment or collection implications recorded.
Bottom line
A tax department’s new explanation is a reason to audit the notice and procedure, not proof that the reassessment is automatically invalid. Preserve the record, protect the earliest deadline, obtain reasons under the applicable rules and file a focused objection that answers the new ground with facts, law and evidence. The controlling statute and procedural stage in your jurisdiction determine whether the change is merely explanatory or legally defective.
