Do not assume you owe a partner’s tax debt simply because a notice names you or because you share a home or bank account. Your exposure depends on the authority, your legal relationship, the tax years and type of debt, and whether you filed or signed a return together. An unmarried partner’s separate tax account is generally a different legal situation from a joint return.
First authenticate the notice through the authority’s official contact channels, record its deadline and proposed collection action, and determine whether it concerns a joint-return assessment, a refund offset, your partner’s separate account, or a business partnership. If a levy, lawsuit, or short response deadline is involved, obtain advice from a qualified tax professional in the relevant jurisdiction while you respond on time.

Start with the notice, not the relationship
A letter from a tax authority can use broad language such as “joint and several liability,” “offset,” or “collection action.” Those terms have different consequences. Do not rely on a caller’s explanation, a text message, or contact information in an unsolicited email. Find the authority’s telephone number and online account address independently, then confirm that the notice is genuine.

- Record the controlling facts. Write down the notice date, response deadline, tax authority, tax type, tax years, amount claimed, and action threatened or already taken.
- Confirm the account. Ask whether the balance is attached to a joint return, your partner’s individual account, a business or partnership account, or a refund that was redirected to a government debt.
- Preserve the original notice. Keep every page, envelope, attachment, transcript, payment record, and prior response. Scan them and maintain a dated log of calls and submissions.
- Meet the stated deadline. Gathering records is not a reason to ignore the letter. Send the required response or request an extension using the authority’s prescribed method.
A notice addressed to both spouses is not proof that an unmarried partner is liable. Conversely, a person who signed a joint return can remain liable even if they did not earn the income that produced the balance.

Identify the legal basis for the debt
Before choosing a form or asking for relief, classify the claim. The following situations are not interchangeable.
| Situation | What it usually means | Key question |
|---|---|---|
| U.S. federal joint income-tax return | Both spouses can generally be pursued for the entire assessed liability, including later additional tax. | Did you file a joint return, and did you sign or otherwise consent to it? |
| Partner’s separate individual tax account | The debt is ordinarily tied to the partner, not automatically to you. Collection rules can still reach jointly owned property or accounts under local law. | Are your name, taxpayer identification number, income, or assets actually on the account? |
| Joint refund offset | A refund from a joint return was applied to a legally enforceable debt owed by one spouse or partner. | Is the issue recovery of your share of a refund rather than cancellation of tax assessed on a joint return? |
| Business or partnership tax | Liability depends on the entity, the partnership agreement, filings, guarantees, and the jurisdiction’s rules. | Did you act as a partner, responsible officer, guarantor, or signatory? |
| State, local, or foreign tax | Rules may differ from U.S. federal income-tax rules and from one another. | Which authority issued the notice and what statute governs that tax? |
Shared housing, marriage, a power of attorney, or a state community-property regime can affect collection, but none of those facts alone answers the liability question. The return, assessment, ownership documents, and governing law do.
What a U.S. federal joint return does to liability
For a joint U.S. federal income-tax return, the Internal Revenue Service generally treats both spouses as responsible for the entire tax liability. IRS Publication 971 (12/2021) states: “When you file a joint income tax return, the law makes both you and your spouse responsible for the entire tax liability.” The rule can apply when the understatement or nonpayment resulted mainly from one spouse’s income, deductions, or conduct.
That responsibility can continue after separation or divorce. A divorce decree or private agreement assigning the bill to the former spouse does not by itself change the IRS’s collection rights. It may give you a claim against the former spouse under domestic law, but it is not an IRS release.

Liability can arise from tax shown on the return, an understatement discovered later, or unpaid tax that was reported but never paid. The relief route depends on which of those occurred and on facts such as what you knew, when you knew it, whether you benefited, and whether holding you liable would be unfair.
Separate the three IRS joint-return relief routes
The IRS distinguishes three forms of relief. They are fact-specific; none is automatic because one spouse earned the income or because a divorce agreement assigns the balance elsewhere.
| Relief | Problem it addresses | Important facts | Request |
|---|---|---|---|
| Innocent-spouse relief | Qualifying understated tax attributable to the other spouse’s erroneous items. | Whether you knew or had reason to know of the understatement, your involvement, and whether it would be fair to hold you liable. | Form 8857 |
| Separation-of-liability relief | Allocates qualifying understated tax between spouses who meet the separation requirements. | Whether you are divorced, legally separated, widowed, or have not lived together for the required period under the applicable rules, plus other eligibility limits. | Form 8857 |
| Equitable relief | Certain unpaid or understated tax when the other two categories do not apply. | All surrounding circumstances, including hardship, knowledge, economic benefit, abuse or financial control, filing and payment history, and whether relief would be fair. | Form 8857 |
These categories concern liability for specified tax connected to a joint return. They do not automatically erase every tax, penalty, or interest item, and they do not decide ownership disputes between former partners.
Innocent-spouse relief
This route is most closely associated with an understatement caused by the other spouse’s erroneous income, deduction, or credit. Eligibility generally requires that you did not know, and had no reason to know, the understatement when you signed the return, together with a fairness analysis. Evidence can include how finances were handled, your education and experience, whether records were concealed, and whether you benefited from the omitted income.

Separation of liability
Separation relief can allocate an eligible understatement between spouses instead of treating both as liable for the whole amount. It is tied to specific marital or living-apart conditions and other statutory limits. A separation agreement alone does not establish eligibility; the filing status, living arrangements, and nature of the understatement must fit the rules.
Equitable relief
Equitable relief may be available for an unpaid balance or an understatement when the other categories fail. The IRS weighs the complete circumstances rather than one decisive fact. Financial hardship, abuse, illness, language barriers, and control over household finances can matter, but the outcome depends on the documented record and current IRS requirements.
How to request IRS relief with Form 8857
- Collect the relevant returns and account information. Obtain copies of each joint return, notices, account transcripts, payment history, and documents showing income, assets, living arrangements, separation, and who controlled the finances.
- Complete Form 8857 for the specific tax years. Explain which items are wrong or unpaid, what you knew when you signed, and why assigning the liability to you would or would not be fair. Answer every question accurately; do not omit unfavorable facts.
- Submit it using the current instructions. Confirm the filing address, electronic options if offered, and any time limits in the latest form instructions. Do not rely on an old deadline from a general article.
- Continue responding to collection correspondence. IRS guidance says it generally will not collect the covered year’s tax from the requester while a qualifying relief request is pending, but interest and penalties continue to accrue. This is not a universal stay for every tax, every year, or every authority.
- Read the determination carefully. The IRS may grant, partially grant, or deny relief. Collection can resume for amounts you remain liable for after the decision, subject to the notice and appeal rights provided.
Submitting Form 8857 does not itself prove eligibility. Keep proof of delivery and copies of everything submitted, and update the IRS if your address changes while the request is pending.
When the issue is a refund taken for your partner’s debt
A refund offset is different from liability for tax on a joint return. If a joint refund was applied to a legally enforceable debt owed only by your spouse, you may be able to recover the portion attributable to you through injured-spouse allocation. IRS materials identify possible offset debts including federal or state tax, child or spousal support, and certain federal nontax obligations.

Form 8379 is the IRS vehicle commonly used for injured-spouse allocation. The analysis separates each spouse’s income, withholding, estimated payments, and allowable credits to determine the injured spouse’s share. Eligibility is not established merely because the other spouse owes money; you must meet the applicable requirements and provide the requested information.
Injured-spouse relief does not cancel tax assessed on a joint return. It addresses where a joint refund goes. A person can therefore need Form 8379 for an offset and Form 8857 for a separate dispute over joint-return liability, depending on the facts.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Can the IRS take your money for your spouse’s tax debt?
If you filed a U.S. federal joint return, the IRS can generally pursue the full joint liability, subject to available relief and collection procedures. If the balance belongs solely to your spouse’s separate account, your personal wages and individually owned property are not automatically transformed into the spouse’s tax debt. The authority may nevertheless examine jointly held accounts, community-property rules, nominee arrangements, transfers, or your role in a business. The notice and local law determine what can actually be levied.

Documents and facts that make a response stronger
- Every notice, envelope, transcript, return, amended return, and payment confirmation.
- Pay statements, bank records, investment statements, and proof of withholding or estimated payments.
- Evidence of who prepared and signed the return and who controlled household or business finances.
- Records of separation, divorce, residence, support, illness, abuse, language barriers, or financial dependence when relevant.
- Deeds, titles, account statements, partnership agreements, guarantees, and ownership percentages for disputed assets or businesses.
- A dated chronology of when you learned about the income, error, balance, refund offset, or collection action.
Protect original records and send copies unless the authority specifically requires originals. Redact unrelated account numbers when permitted, but leave enough information for the authority to match each document.
When professional help is worth the cost
Consider a tax attorney, enrolled agent, or appropriately qualified local tax adviser when the assessment is disputed, a levy or court action is imminent, multiple years are involved, abuse or coercion affected the filing, a business entity is involved, or ownership of property is unclear. Ask whether the professional regularly handles spouse-liability relief and collection notices in the issuing jurisdiction.
Bring the complete notice file to the first meeting and ask for a written explanation of the proposed route, filing deadline, collection risk, fees, and what the professional will not handle. A professional cannot guarantee innocent-spouse approval, a refund, or a pause in collection.
UK partnership profits: a narrower rule
The UK example illustrates why jurisdiction matters. HM Revenue & Customs guidance says each partner is individually responsible for tax on that partner’s share of partnership profits and that there is no joint liability for that tax due on partnership profits. That rule addresses a partner’s tax on partnership profits; it is not a general rule for spouses, other UK taxes, or another country’s law.
If an HMRC notice concerns a partnership, review the partnership agreement, the filed partnership return, each partner’s individual return, and the tax year named. Do not assume the U.S. joint-return analysis applies.
Quick Recap
Common mistakes to avoid
- Ignoring the letter because the debt is “your partner’s.” A missed deadline can remove review or appeal opportunities.
- Using innocent-spouse terminology for a refund offset. Refund allocation and joint-return liability are separate procedures.
- Assuming divorce ends joint liability. A private decree does not bind the IRS by itself.
- Filing an old form or relying on an old time limit. Use the current instructions for the authority and tax year involved.
- Sending a bare statement that you knew nothing. Explain the financial arrangements and provide documents supporting what you could and could not have known.
- Contacting an unverified number. Authenticate the notice before disclosing taxpayer information.
A practical decision checklist
- Identify the authority, tax, years, amount, deadline, and threatened action.
- Determine whether you are married, unmarried, divorced, or acting as a business partner, and whether a joint return exists.
- Classify the claim as joint-return tax, separate-account debt, refund offset, or business liability.
- Preserve returns, transcripts, payment records, ownership documents, and evidence about knowledge and financial control.
- For a U.S. joint-return issue, evaluate Form 8857 relief; for a joint refund offset, evaluate Form 8379 instead.
- Respond by the notice deadline and obtain jurisdiction-specific advice if collection is active or the facts are disputed.
