What to Do if a Strike or Plant Shutdown Cuts Your Work Hours

First find out exactly what has changed: are you taking part in a strike, locked out, temporarily scheduled for fewer hours, furloughed, stood down, or permanently laid off? Those labels determine which pay, benefit and notice rules may apply. Ask the employer for the reason, start date and expected duration in writing, then preserve schedules, time records, pay statements and every notice.

Next, contact the unemployment or labor agency for the country and state or territory where you work. In the United States, ask specifically about partial unemployment and Short-Time Compensation; if a closure or mass layoff is announced, check WARN and state Rapid Response services. The examples below come from the United States, United Kingdom and Australia and are not interchangeable legal rules.

Identify the event before you apply for help

A “shutdown” can describe several legally different situations. Use the employer’s written description, not workplace shorthand, when speaking with an agency or adviser.

What may be happening Who usually controls the loss of hours What to confirm immediately
Reduced schedule The employer keeps you employed but schedules fewer hours. New schedule, pay rate, effective dates and whether the reduction is temporary.
Furlough The employer pauses work, often temporarily, while employment may continue. Whether you may work, use leave, keep benefits and when the next review occurs.
Stand-down The employer stops work without pay under a specific legal rule. The event outside the employer’s control that allegedly permits the stand-down and the governing agreement.
Strike or other industrial action Workers withhold labor or take action short of a strike. Whether the action is official or protected, what the union has instructed and how pay is treated.
Lockout The employer prevents workers from working during a dispute. Whether you are locked out rather than on strike and what notices or representation apply.
Layoff or permanent closure The employer ends jobs or shuts a site. Final day, final-pay arrangements, severance or contractual notice and any government notice.

The same worker can move from one category to another. A temporary cut in shifts is not automatically a layoff, and a worker who cannot work because a site is closed is not necessarily participating in a strike.

Your first 24 hours

  1. Request a written explanation. Ask whether the change is a reduced schedule, furlough, lockout, stand-down, strike-related interruption, layoff or closure. Request the effective date, expected end date, affected location and the policy, agreement or law the employer is relying on.
  2. Build a contemporaneous record. Save posted schedules, time sheets, clock-in data, pay statements, emails, text messages, meeting notes and closure notices. Record hours actually worked beside the pay you received. Keep copies outside a workplace system you may lose access to.
  3. Check the next pay date. Confirm how already-worked hours, overtime, accrued leave and expense reimbursements will be paid. Do not assume that a promise made verbally changes your written employment terms.
  4. Contact the relevant agency promptly. Ask about ordinary unemployment, partial benefits and any reduced-hours program. Agencies often need the dates and hours in your records to decide a claim.
  5. Speak with a union or worker representative. Ask whether the action is authorized, whether you are covered by a collective agreement and what assistance is available. A union may explain strike or lockout procedures, but do not assume strike pay exists or has a standard amount.
  6. If a closure is possible, contact public employment services. In the United States, an American Job Center, state Rapid Response team or dislocated-worker unit can explain retraining, job-search and benefit routes.

United States: when your hours are cut but the job continues

Short-Time Compensation and partial unemployment

The U.S. Department of Labor says Unemployment Insurance Short-Time Compensation may let employees work fewer hours instead of being laid off and receive partial unemployment benefits for lost work time. It is available only in states that operate such a program, and both the employer’s plan and the individual worker must meet state requirements. Ask your state unemployment agency whether to file an ordinary partial-benefit claim, use a Short-Time Compensation plan or follow another process. Eligibility, waiting periods, reporting duties and maximum amounts are state-specific; none should be assumed from the program’s name.

Pay for hours actually worked

For covered, non-exempt employees, the federal Fair Labor Standards Act (FLSA) still requires at least the applicable federal minimum wage for hours worked and required overtime. The Wage and Hour Division’s Fact Sheet #70, dated September 2019, says: “The FLSA does not preclude an employer from lowering an employee’s hourly rate, provided the rate paid is at least the minimum wage, or from reducing the number of hours the employee is scheduled to work.” That federal baseline does not answer state or local wage rules, a contract, or a collective-bargaining agreement. Check those sources before accepting a permanent rate change.

What to compare on your pay stub

  • Scheduled hours versus hours recorded and paid.
  • Regular and overtime rates, including the workweek used for overtime.
  • Any deductions that changed when hours fell.
  • Accrued leave, holiday pay or benefit premiums shown separately.

If the numbers do not match your records, ask payroll for a written calculation. Keep the question and response with your other documents before escalating to a state labor agency, the U.S. Department of Labor or your representative.

United States: plant closure or mass layoff

When federal WARN may apply

The U.S. Department of Labor describes the federal Worker Adjustment and Retraining Notification (WARN) Act as generally covering employers with 100 or more employees. For a covered plant closing or mass layoff affecting 50 or more employees at a single site, the general notice period is at least 60 calendar days of written notice. These are coverage thresholds, not a guarantee that every shutdown qualifies.

The Department of Labor lists exceptions and exclusions, including certain unforeseeable business circumstances, faltering-company situations and natural disasters. Some states impose additional or different closure-notice requirements. Ask whether the site, employer, employment relationship and event meet the applicable definition, and retain any notice that names the effective date and reason.

If notice was short or missing

  1. Ask the employer whether it considers the event covered by federal WARN or a state equivalent and request the explanation in writing.
  2. Contact your state labor department or an employment lawyer, union or worker center with your records. The facts can include transfers, temporary layoffs, part-time status and the number of workers at one site.
  3. Use the state Rapid Response team and American Job Center even while a notice question is pending. Those services can connect affected workers with unemployment, training and job-search support.

United States federal employees: furlough is its own category

The Office of Personnel Management distinguishes an administrative furlough, used for funding, downsizing or lack-of-work situations, from a shutdown furlough caused by a lapse in appropriations. Whether you may work, must report, can use leave and when pay is issued depends on your agency’s instructions and your status. Follow current agency human-resources and OPM guidance rather than treating a federal furlough like a private-sector schedule cut.

United Kingdom: strikes, lockouts and action short of a strike

UK government guidance treats industrial action as including strikes and action short of a strike, and recognizes that an employer may lock workers out during a dispute. A worker taking industrial action is generally unlikely to be paid for work not performed. The legal consequences, including protection from dismissal, depend on whether the action is official, the ballot and notice requirements, the worker’s role and the employer’s conduct.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask your union whether the action is authorized and what instructions apply to your workplace. Keep the union notice and your own attendance and pay records. Check current government guidance before acting because the rules and remedies can change. Do not assume that a reduction in pay during a dispute is the same as a redundancy or that a lockout makes you a striker.

Australia: stand-downs and protected industrial action

When an unpaid stand-down may be lawful

The Fair Work Ombudsman says an employer may stand down employees without pay in specific circumstances outside the employer’s control, such as certain equipment breakdowns or industrial action, subject to the Fair Work Act and any applicable award, agreement or contract. It also states: “Employers can’t stand an employee down just because the business is quiet or there isn’t enough work.” Ask the employer to identify the event, the dates and the legal or contractual basis.

During a qualifying stand-down, leave accrual and public-holiday treatment can differ from ordinary work. Check the applicable award, enterprise agreement or contract and the Fair Work Ombudsman’s current guidance for your circumstances rather than relying on a general workplace announcement.

Protected industrial action

For protected industrial action, the Fair Work Ombudsman describes rules under which employers are prohibited from paying employees for the period of protected action, with qualifications for different forms of action and partial work bans. The Australian rules do not transfer to the UK, United States or another jurisdiction. Confirm whether the action is protected, whether you performed any work and how a partial ban is recorded.

  • Calculate the gap. Compare reliable take-home pay under the reduced schedule with essential bills for the next four weeks. Separate housing, utilities, food, insurance, transport and medication from discretionary spending.
  • Preserve liquidity. Pause optional transfers and subscriptions only after checking cancellation costs. Keep enough cash for transport, food and required insurance while an agency decides a claim.
  • Call creditors before a missed payment. Explain that hours were reduced or a site closed, ask what hardship or due-date options exist, and record the representative’s name and any agreement. An accommodation is not automatic and may affect interest or fees.
  • Coordinate household benefits. Check health coverage, paid leave, tax withholding and employer contributions separately. A pause in work does not necessarily end each benefit on the same date.
  • Use public job services early. American Job Centers, Rapid Response teams and state dislocated-worker units can provide job-search and training referrals. Similar services may exist through the labor agency where you live.

Avoid borrowing against an uncertain strike or reopening date until you know the total cost and repayment date. Keep every agency confirmation, claim number and employer notice with your budget file.

Who to contact, by situation

Situation First contact Useful question
U.S. hours reduced State unemployment agency Does the state offer Short-Time Compensation or partial unemployment, and what weekly reporting is required?
U.S. closure or mass layoff State Rapid Response team, American Job Center and dislocated-worker unit Is the site eligible for closure or layoff services, and what training or claims deadlines apply?
U.S. wage or overtime concern State labor agency, U.S. Department of Labor Wage and Hour Division, union or adviser Are my recorded hours, minimum wage and overtime calculated correctly?
Federal furlough Agency human-resources office and current OPM guidance What is my furlough status, reporting instruction, leave treatment and pay schedule?
UK industrial action Union or worker representative and the relevant government labor guidance Am I participating, locked out or otherwise affected, and what pay and dismissal protections apply?
Australian stand-down or protected action Fair Work Ombudsman guidance, union and the applicable award or agreement What event permits the stand-down or pay deduction, and how are leave and public holidays treated?

Warning signs that require a second check

  • The employer will not identify whether the change is temporary, permanent, a lockout or a stand-down.
  • Your schedule was cut but your pay stub shows fewer hours than you actually worked.
  • You received a closure announcement without the site, worker count, effective date or contact person.
  • A manager says benefits or final pay are “automatic” but provides no written terms.
  • You are told to file for benefits in a country or state where you do not perform the work.
  • A union message conflicts with a supervisor’s instruction about reporting or picket-line conduct.

Pause before signing a release, resigning, crossing a picket line or accepting a permanent transfer. Ask your union, agency or qualified adviser how that action could affect benefits, notice rights or collective-agreement protections.

A practical decision checklist

  1. Write down your work location and the employer’s exact description of the event.
  2. Mark the first day hours changed and the last day you were paid for work performed.
  3. Save schedules, time records, pay statements, notices and communications.
  4. Ask the relevant agency about partial benefits, Short-Time Compensation or local equivalents.
  5. For a U.S. closure, check federal WARN coverage and any state notice law without assuming either applies.
  6. Ask a union or worker representative whether the action is official, protected or a lockout.
  7. Contact public employment services and make a four-week essential-expense plan.
  8. Recheck the agency’s current rules before relying on a deadline, payment estimate or eligibility decision.

The safest approach is to match the documented event, jurisdiction and dates to the agency that administers the rule. Reduced hours, industrial action, furloughs, stand-downs and closures can look similar on a rota but produce different rights and obligations.
