First, obtain the complete recorded instrument and verify whether the lien is an active, paid-off, transferred, or potentially fraudulent reverse-mortgage claim. A lien is a security interest; it does not by itself mean the lender owns your home. The Consumer Financial Protection Bureau (CFPB) explains that when you take out a reverse mortgage, “the title to your home remains with you.”
Get the document from the county recorder or other local recording office, compare it with your deed and loan papers, then contact the named servicer through a phone number or website you already trust. If the loan is paid, ask for the release or satisfaction and its recording information. If nobody recognizes the loan, the document appears forged, or you receive a foreclosure notice, preserve every record and obtain state-specific real-estate legal advice promptly.

What a reverse-mortgage lien means
A reverse mortgage is secured by the home, just as a traditional mortgage is. The lender records a mortgage, deed of trust, or similar security instrument in the property records so the debt is tied to the home. The borrower generally keeps title and may continue living in the property while meeting the loan’s obligations.

HUD states that for its FHA-insured Home Equity Conversion Mortgage (HECM), “The lender does not own the home, and does not ‘get’ the home when the borrower or non-borrowing spouse passes away.” The lien can remain in the public record while the loan is active, and a paid loan can also remain listed temporarily if the release has not yet been recorded.

Most reverse mortgages are HECMs, but proprietary reverse mortgages also exist. HECM rules and protections should not automatically be applied to a private loan. The exact document names, recording practices, deadlines, and remedies depend on the property’s state and county.
Identify which situation you have
| What you find | Likely meaning | Next action |
|---|---|---|
| Recognized reverse mortgage with current statements | The lien may be a normal, active security interest. | Confirm the current servicer, balance, obligations, and account status. |
| Loan was paid, but no release is visible | The release may not have been recorded yet; public records can lag after payoff. | Check recent recording entries and request the release’s recording number from the servicer. |
| Assignment or transfer document | The lien may have been transferred to another lender or beneficiary. | Use the assignment and account records to identify the current holder or servicer. |
| Unrecognized names, property description, or signatures | The instrument could be an error, an unrelated filing, or an alleged forgery. | Save the complete document, ask the recorder about fraud procedures, and contact a local title or real-estate attorney. |
| Default, acceleration, or foreclosure notice | The loan may be due and payable or the borrower may have violated an obligation. | Treat every date in the notice as urgent and obtain housing-counselor or attorney help immediately. |
Step 1: Obtain the complete recorded instrument
Do not rely on a search-result summary, index entry, or a third-party title screen. Request every page of the recorded document from the county recorder, recorder of deeds, register of deeds, or equivalent office. Ask for the document or recording number, recording date, book and page or electronic reference, and any attached legal description.
Save a certified copy if the office offers one, plus the electronic or paper version you received. Note the property address and parcel number shown in the index. These details let a servicer, title professional, or lawyer locate the same instrument and any later release.
Recognize common document types
- Mortgage or deed of trust: creates the security interest securing the reverse-mortgage debt.
- Assignment: records a transfer of the mortgage or beneficial interest to another party.
- Satisfaction, release, discharge, or reconveyance: indicates that the security interest has been released, although terminology varies by state.
- Subordination, modification, or other amendment: changes priority or terms and does not necessarily pay off the lien.
A recorder typically checks whether an instrument meets filing requirements, not whether the signatures, debt, or transaction are legally valid. California’s Department of Real Estate cautions that recording offices may not determine a document’s validity; that principle is a useful warning, but California procedures should not be treated as nationwide law.

Step 2: Compare the filing with your own records
Read the legal description, not just the street address. Compare the parcel or lot description and tax-assessor number with your deed, title policy, and property-tax records. Then check:
- Every borrower and owner name, including middle initials and former names.
- The lender, beneficiary, trustee, and any successor listed in the instrument.
- The execution and recording dates.
- The loan number, if present, against closing papers, annual statements, and payoff correspondence.
- Notary acknowledgments, signature pages, and exhibits.
A mismatch does not prove fraud: names can change, lenders can assign servicing, and legal descriptions can use technical language. It does mean you should not assume the filing applies to your loan until the servicer or a qualified property lawyer explains it.
Step 3: Contact the named servicer through a trusted channel
Use the phone number on an existing statement, a payoff letter you independently confirmed, or an official account portal. Do not use contact details supplied only in an unexpected email, text, letter, or social-media message. Ask for written answers to these questions:

- Does the company service or own a reverse mortgage secured by this property?
- What is the loan type—FHA-insured HECM or proprietary reverse mortgage?
- Who is the current lender, beneficiary, and servicer?
- Is the account active, paid in full, due and payable, in default, or in foreclosure review?
- What balance, fees, taxes, insurance, repairs, or occupancy issues are outstanding?
- If the loan was paid, when was the release, satisfaction, or reconveyance prepared and recorded?
Keep names, dates, confirmation numbers, letters, account statements, and call notes. Send sensitive documents only through a verified channel. A servicer’s response can identify the correct party, but it does not replace legal advice when ownership or forgery is disputed.

Step 4: If the reverse mortgage was paid off, verify the release
Paying the debt and removing the lien are related but separate record events. The lender or successor generally must send a release, satisfaction, discharge, or reconveyance to the same local recording office that recorded the original mortgage or deed of trust. Ask the servicer for the document’s recording date and number, then search that number in the county records.
CFPB guidance notes that a delay can occur between payoff and the appearance of a release in public records. Ask the servicer what processing period applies and request written confirmation that no balance remains. If the stated period has passed, make a formal written request for the release and retain proof of delivery. A title company or real-estate attorney can help determine whether the release was filed under a slightly different name or whether a corrective filing is needed.
Do not sign a corrective deed, affidavit, or “lien removal” form from an unfamiliar company merely because the property search still shows the mortgage. Have the document reviewed first.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsStep 5: Respond to an unrecognized or suspicious instrument
If no owner recognizes the reverse mortgage, or the legal description, names, signatures, notarization, or dates appear inconsistent, treat the record as a potential title problem without declaring it fraudulent yourself.

- Download or order the complete recorded instrument and preserve the original file, envelopes, emails, and search results.
- Write down the recording number, date, parties, and every discrepancy you found.
- Ask the county recorder whether it offers an owner-alert service, fraud-reporting process, or instructions for submitting a suspected fraudulent recording.
- Contact the named lender or servicer using independently verified information and ask whether an account exists.
- Consult a real-property, title, or foreclosure attorney licensed in the state where the home is located.
Recording staff generally cannot cancel a document simply because an owner objects. A lawyer can explain whether the state provides a quiet-title action, declaratory relief, corrective instrument, statutory fraud affidavit, or another remedy, and which filing and service deadlines apply. Do not send money, wire funds, transfer title, or sign an admission until the claim and payment instructions have been verified.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Step 6: Treat default, foreclosure, or death notices as time-sensitive
A reverse mortgage can become due and payable after a triggering event such as the last surviving borrower’s death, sale of the home, no longer occupying it as a principal residence, or failure to meet loan obligations. HECM borrowers also remain responsible for property taxes, homeowner insurance, maintenance, and occupancy requirements. A notice may cite unpaid charges, needed repairs, or an occupancy issue rather than a problem with the recorded lien itself.
If a notice threatens foreclosure, acceleration, or a sale, read the deadline and contact the servicer immediately. CFPB recommends prompt help from a reverse-mortgage housing counselor or attorney when the borrower cannot resolve the issue. Continue making required tax and insurance payments where possible and document any hardship or repair efforts.

For an HECM, CFPB says heirs generally have 30 days after receiving a due-and-payable notice to buy the home, sell it, or turn it over to satisfy the debt. An extension of up to six months may be possible in some circumstances, such as time needed to sell or obtain financing. This is not a universal deadline for every reverse mortgage or every disputed lien: check the notice, loan type, co-borrower status, eligible non-borrowing-spouse protections, and applicable rules with a counselor or attorney.

Protect yourself from payoff and foreclosure-rescue scams
HUD warns consumers about companies that promise to stop foreclosure immediately, demand upfront fees, or pressure an owner to transfer title. Contact the lender and a HUD-approved housing counselor instead of paying an unverified “rescue” service.
For HUD Secretary-held HECM liens, HUD specifically warns: “FHA does not accept wire transfers to payoff Secretary-held Liens.” A payoff statement for one of those liens that supplies wire instructions is a fraud warning; call the FHA Resource Center to obtain and verify the correct statement. This warning is specific to Secretary-held liens and should not be generalized to every privately serviced reverse mortgage.
Where to get help and what to bring
HUD’s housing-counseling search tool and referral line can connect homeowners with reverse-mortgage counselors. HUD says counseling is free or very low cost. A counselor can organize statements, explain HECM obligations, and help communicate with the servicer. A lawyer is the appropriate professional for a disputed title instrument, alleged forgery, foreclosure filing, probate issue, or request for a court order.

How to decide your next move
- Recognized and active: verify the account, current servicer, balance, and ongoing tax, insurance, maintenance, and occupancy duties.
- Paid but unreleased: confirm payoff, allow for recording delay, and obtain the release’s recording information or professional help if it does not appear.
- Unrecognized or inconsistent: preserve evidence, use the recorder’s local reporting process, and obtain state-specific legal advice.
- Default or death notice: prioritize the stated deadlines, contact the servicer, and involve a HUD-approved counselor or attorney immediately.
The lien entry alone does not establish that the lender owns the home or that the filing is invalid. The complete instrument, loan status, payoff history, notices, and the law where the property sits determine what should happen next.
