Act quickly, but do not assume the transfer is automatically invalid. First identify where the property is and whose name is on the current title. Then collect the will, probate or estate-appointment papers, distribution or partition documents, and any power of attorney or court order the relative is relying on. Preserve every message, proposed deed, listing and notice, and contact a lawyer licensed where the property is located if a transfer is imminent. Whether your consent is legally required depends on the title, the type of co-ownership, the estate’s status and the authority claimed.
Take these steps before anything is signed or recorded
1. Confirm the property’s location and current title
Inheritance is a family description, not proof of present ownership. Obtain the most recent recorded deed, land-registry extract or other official title record for the property’s jurisdiction. Note every named owner, the stated ownership form and any mortgage, lien, trust, restriction or pending instrument shown in the record. A relative may be trying to convey only an undivided share, while the estate or several heirs still own the rest.

Use the official recorder, registry or land-office process for the place where the property sits. A family conversation, an old will or a tax bill may not match the current legal title.

Collect the will and any codicils, probate filings, letters appointing a personal representative or executor, trust documents, distribution or partition orders, and every power of attorney or court order the relative mentions. Ask a local lawyer to check whether the document is authentic, still effective and broad enough to authorize the proposed transaction.

California Courts explains that probate is the legal process used to transfer or inherit property after death, but whether a court proceeding is required depends on the property’s type and value and the circumstances. See the court’s overview at California Courts’ probate guide. Other jurisdictions use different procedures.
3. Preserve evidence and avoid creating new problems
Save copies of texts, emails, letters, listing pages, draft contracts, proposed deeds, notices, estate-account records and title searches. Record dates, names, phone numbers and the businesses involved. Keep the original files where possible and make a separate backup.
Do not sign a deed, release, settlement, waiver, consent, renunciation or power of attorney without local legal advice. Do not hand over identity documents or account credentials. A lawyer can tell you whether communicating with the relative, the broker, a title company or a court is strategically safe.

4. Obtain urgent local advice when a transfer is close
If there is a scheduled closing, a new deed has been submitted, a buyer is advertising the property or a probate filing is pending, contact a real-estate, probate or property-litigation lawyer in that jurisdiction immediately. Ask what emergency court relief, registry alert or notice procedure is available and what evidence is needed. The procedure, filing deadline and ability to stop registration vary by location; no single filing guarantees that a sale or registration will be stopped.
Work out which legal situation you actually have
The correct response changes depending on whether the property remains in the estate, has passed to heirs, is held jointly or is being transferred with forged authority. Verify the record rather than inferring the answer from family expectations.
| What the records may show | What the relative may be attempting | Why it matters |
|---|---|---|
| Property still titled to the estate or decedent | An executor, administrator or trustee claims authority to sell | The governing will, trust, appointment and court orders determine what approvals, notices or limits apply. |
| Several heirs hold undivided interests | Transfer of the relative’s own share | Local law may permit a co-owner to convey an interest even when other owners do not consent; the buyer may become a co-owner. |
| Several heirs hold undivided interests | Purported transfer of the entire property or a specific physical part | The relative may lack authority over the other owners’ interests or over a defined parcel. The effect depends on local title and conveyancing law. |
| Partition or distribution has awarded one person a specific parcel | Sale of that separately owned parcel | The person may have authority to sell without other heirs’ consent, subject to liens, restrictions and any court order. |
| Deed, heirship affidavit or probate filing appears fabricated | Fraudulent transfer or false identification of heirs | Prompt title review and a lawyer’s advice about challenging the instrument, court filing or related conduct are critical. |
Separate a person’s share from the whole property
Do not assume that every co-owner can sell the entire property, but do not assume that every co-owner is barred from selling any interest. A deed can purport to transfer the signer’s undivided share while leaving the other owners’ interests intact. A deed that describes the whole property or a specific physical section raises different questions about authority, notice and the buyer’s rights.

A decision of the Supreme Court of the Philippines illustrates why the jurisdiction must be identified. In Reyes v. Spouses Garcia, under the law applied there, one co-owner’s sale of the whole co-owned property without the others’ consent was not wholly void; it transferred only the seller’s rights, leaving the buyer as a co-owner, with partition as the appropriate remedy. Read the decision at the Supreme Court of the Philippines eLibrary. That holding is an example from the Philippines, not a worldwide rule.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsYour lawyer should compare the proposed instrument with the title: Does it name only the relative’s interest? Does it purport to convey everyone’s interest? Does it identify a physical boundary that was never created by a partition? Those details can determine whether the dispute is about an unauthorized deed, an overbroad deed, or a lawful sale of one co-owner’s share.
Check whether the estate has been administered or the property distributed
When the estate is still open
An appointed personal representative may have powers that individual heirs do not. A trustee may have different powers again. Read the appointment and the governing will or trust together, and check whether a court order limits the transaction or requires notice to beneficiaries. An heir’s expectation of receiving property does not itself establish a present right to sign or veto a conveyance.

When distribution or partition is complete
A recorded distribution, deed or partition order may have converted a general inheritance claim into ownership of a particular parcel or percentage. Conversely, paperwork that was never recorded or was later superseded may not reflect the current title. Obtain the latest instrument and ask counsel to reconcile it with probate and land records.
When heirship is being established by affidavit
The National Consumer Law Center’s 2024 report describes heirship affidavits as sworn statements identifying heirs, commonly used in some jurisdictions when a person dies without a will. It also reports deed forgery and fraudulent probate filings as tactics in heirs-property disputes. The report is national consumer-law research, not advice for a particular state; use it as a reason to scrutinize a filing, not as proof that a particular document is fraudulent. Read it at NCLC’s 2024 heirs-property report.
Where a will must be admitted to probate, ask whether that has happened and whether the document was found valid. If a filing omits an heir, uses an incorrect address or contains a signature you do not recognize, give the complete record to local counsel promptly.

If a transfer appears imminent, focus on preserving your position
- Get the current record and the proposed instrument. A lawyer needs the exact deed, contract, listing or filing, not a description passed through relatives.
- Identify the decision-maker. Determine whether the signer is a recorded owner, personal representative, trustee, agent under a power of attorney or someone with no apparent authority.
- Ask about emergency relief and registry procedures. Depending on the jurisdiction, counsel may discuss a court application, a notice or alert to the land registry, or another step designed to protect an asserted interest. Availability and effect are local questions.
- Challenge suspected fraud through the proper channel. If a deed or probate filing is forged, ask counsel about the procedure for contesting it and, where appropriate, contacting the court or law enforcement. Do not confront a suspected forger in a way that risks evidence or safety.
- Track every deadline. Objection periods, probate notices, recording rules and limitation periods differ. Put all hearing, closing and response dates on a calendar and confirm them with counsel.
Understand partition, buyouts and possible sales
Partition is a legal process for ending certain forms of co-ownership. Depending on the jurisdiction and facts, a court may divide the land physically, allow one or more co-owners to buy out another, or order a sale and distribution of proceeds. Filing for partition does not automatically preserve the property; some procedures ultimately lead to a sale.
Texas: Uniform Partition of Heirs’ Property Act
Texas Property Code chapter 23A provides procedures for qualifying heirs’ property. They can include a court valuation, an opportunity for cotenants to buy out the petitioning owner, and a preference for partition in kind unless physical division would substantially prejudice the cotenants as a group. If division in kind is not ordered, the statute specifies circumstances in which a sale may be ordered. Read the statute at Texas Property Code chapter 23A. Coverage depends on the statutory definitions and the property’s facts.
New York: RPAPL § 993
New York Real Property Actions and Proceedings Law § 993 applies to qualifying inherited, family-owned residential or agricultural property held as a tenancy in common. The court determines whether the statute applies, obtains a valuation, provides an opportunity for certain cotenants to buy out interests, and considers in-kind division before a sale. The statute does not protect every inherited property or every co-owner; review its conditions at New York RPAPL § 993.
A 2024 New York decision, Gelinas LLC v. Hayes, summarizes safeguards such as notice, an independent appraisal, a potential buyout, consideration of physical division and conditions on a court-ordered open-market sale. See the decision at the New York courts reporter. It is an illustration of how statutory protection operates, not a substitute for checking whether your property qualifies.
| Your objective | Question to take to counsel | Possible path (jurisdiction-dependent) |
|---|---|---|
| Keep the land in the family | Can eligible co-owners buy out the transferring relative or the buyer? | Statutory buyout or negotiated purchase, with valuation and financing reviewed locally. |
| Receive a distinct physical parcel | Can the property be divided without substantially harming co-owners? | Partition in kind, survey and deed work where allowed. |
| End co-ownership and receive value | What notice, appraisal and sale rules apply? | Partition sale or another court-supervised disposition. |
| Stop an unauthorized conveyance | What relief is available before recording or closing? | Emergency court or registry procedure, if available, based on the actual instrument. |
Common mistakes that weaken an inheritance-property dispute
- Relying on family status alone. Being an heir, child or sibling does not identify the current owner or the signer’s authority.
- Waiting for the deed to appear. A closing or recording may trigger deadlines and complicate the available remedy.
- Assuming “void” without reviewing the law. Some systems may recognize a transfer of only the seller’s share rather than canceling the entire transaction.
- Signing to “keep the peace.” A release, consent or power of attorney can change your legal position.
- Destroying or editing evidence. Keep original messages and files, and preserve metadata when possible.
- Using a procedure from another state or country. Texas, New York, California and the Philippines have different rules; a form or deadline from one place may be useless elsewhere.
Questions to bring to your lawyer
- Who is on the current title, and what ownership form is recorded?
- Is the estate open, and who was formally appointed to act?
- Has a valid distribution or partition awarded a specific parcel or percentage?
- Does the proposed instrument convey only the relative’s interest or purport to convey the whole property?
- Was notice required to heirs, beneficiaries or co-owners, and was it properly given?
- What immediate process can protect the record if closing or registration is imminent?
- If co-ownership cannot continue, would a buyout, in-kind partition or sale best serve your objective?
- What local deadlines, filing costs, appraisal requirements and risks apply?
Bottom line
Start with the property’s location and current title, not the family’s understanding of the inheritance. Verify the relative’s claimed authority, preserve the evidence and obtain local legal advice before signing anything or waiting for a transfer to be completed. A relative may be able to convey an individual share, may lack authority over the whole property, or may be relying on a forged or defective document; only the governing records and law can distinguish those situations. If co-owners remain divided, partition or a buyout can resolve the dispute, but the process may also result in a sale.
