Do not assume every UPI fee or refusal is automatically illegal. A fee added to your bill solely because you chose UPI is different from a merchant-side MDR (merchant discount rate). The Ministry of Finance said on 15 September 2026 that MDR is a merchant-ecosystem charge, not a charge on customers, and that banks have been advised to stop merchants passing it on. However, the official releases reviewed do not establish a clear commencement date for the new MDR framework. A shop’s duty to provide electronic payment is also limited: section 269SU of the Income-tax Act applies to businesses whose immediately preceding year’s sales, turnover or gross receipts exceeded ₹50 crore, subject to the rule’s prescribed modes and conditions.
Start by asking for an itemised bill and the reason for the amount. Preserve evidence. If the payment itself failed, was duplicated, unauthorised or otherwise mishandled, use your UPI app, bank and the National Payments Corporation of India (NPCI) transaction-complaint route. For a merchant’s pricing or refusal policy, there is no dedicated official consumer channel established in the material reviewed, so do not assume a payment-system complaint will resolve the dispute.

First identify what the merchant actually charged
The same words—“UPI charge”—can describe two different events. Your next step depends on which one occurred.
A customer surcharge added at checkout
This is a separate amount added because you selected UPI, such as a bill showing ₹500 for goods plus “UPI fee ₹5.” The Ministry of Finance, Government of India, stated in a 15 September 2026 Press Information Bureau release: “MDR is a charge within the merchant payment ecosystem. It is not a charge on customers making UPI payments.” The release also says banks have been advised to ensure merchants do not pass MDR to customers and that UPI application providers are prohibited from imposing platform fees or hidden charges.

That statement addresses MDR and hidden charges in the payment ecosystem. It does not automatically decide whether every difference between a displayed price and a final bill is a UPI surcharge. A merchant may have a service fee, a separately disclosed delivery charge or a different price for a separate product or service. Ask the merchant to identify the exact line item and whether the price would be the same if you paid by another method.
A merchant’s own MDR cost
MDR is normally a charge within the merchant’s payment arrangement with banks or payment providers. It is not a fee that should be added to the customer’s bill merely because the customer used UPI. Whether a particular merchant transaction attracts MDR depends on the category, amount and implementation of the applicable framework. Do not treat a merchant’s claim that “the bank charges us” as proof that the customer must pay it.
A failed or mishandled transaction
If money left your account but the merchant did not receive it, the payment was duplicated, or a transaction was unauthorised, you have a payment-system problem rather than only a pricing dispute. Record the transaction ID and contact the UPI app or your bank promptly.

What the 2026 MDR announcements actually say
Two Ministry of Finance releases in 2026 describe the policy differently. The later release dated 15 September says a merchant MDR framework has been introduced and that customers will not pay MDR. An 8 August 2026 Press Information Bureau release said MDR would be decided once Parliament passed the Taxation and Other Laws (Amendment) Bill, 2026 and by the UPI and Services Steering Committee. The material reviewed does not provide a verified commencement date that resolves this difference.
Therefore, do not tell a merchant—or rely on a complaint—that a particular rate is definitely in force on a particular date without checking the latest official notification. The figures below are the framework as described in the 15 September release, not a confirmed effective-date notice.
| Item described in the 15 September 2026 release | Published detail | Important qualification |
|---|---|---|
| Transactions of ₹2,000 or less | Remain free of MDR for the described merchant transactions | The release’s framework and commencement status must be confirmed before applying it to a live dispute |
| Qualifying small merchants | Up to ₹1 lakh per month received through UPI QR remains at zero MDR | Only the category described by the release qualifies; not every merchant receiving this amount |
| Specified merchant transactions above ₹2,000 | 0.4% MDR, capped at ₹300 for transactions of ₹75,000 and above | A merchant-side rate; the customer is not meant to pay it |
| Certain essential and thin-margin sectors above ₹2,000 | Flat ₹5 MDR | Applies only to the sectors and transactions covered by the release |
| Described capital-market transactions | 0.02% MDR, capped at ₹300 | Not a general rate for every retail purchase |
| Overall impact | Approximately 96% of merchant transactions expected to remain unaffected | A government estimate attached to the described framework |
The release says customers will not pay these merchant-side amounts. Because the official material does not settle the start date, preserve the bill and ask the merchant or its payment provider which rule they are applying rather than arguing from an unverified rate.

Can a shop legally refuse UPI?
There is no universal rule in the material reviewed requiring every shop, stall or service provider to accept UPI. Section 269SU of the Income-tax Act creates an electronic-payment acceptance duty for a person carrying on business when total sales, turnover or gross receipts in the immediately preceding previous year exceed ₹50 crore. Rule 119AA identifies the prescribed modes as RuPay debit card, UPI (BHIM-UPI) and UPI QR (BHIM-UPI QR Code).

Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →That threshold matters. A small shop that is below ₹50 crore is not automatically covered by section 269SU simply because UPI is widely used. Conversely, a business above the threshold may have a statutory facility requirement, subject to the rule and applicable exceptions. The Income Tax Department also describes a business-to-business-only exception where a 95% non-cash-receipts condition is met; the exception is fact-specific and should not be used to decide an individual dispute without professional advice.
Refusal can also have a non-legal explanation: a damaged QR code, a bank outage, a transaction limit, a network failure or a merchant’s acceptance policy. Ask whether the refusal is temporary or a standing policy, and whether another UPI QR or payment channel is available. Do not claim that the merchant has broken the law unless you know the business falls within the statutory rule and the relevant facility requirement applies.

What to do at the counter
- Ask for the exact amount and reason. Say: “Please show me the itemised bill and identify the UPI fee.” Ask whether the same total applies if you pay by cash or card.
- Separate the payment choice from the product price. Check the displayed price, menu, estimate, invoice and any sign beside the QR code. A separately added amount triggered only by UPI is different from a price that was disclosed before you ordered.
- Request a receipt. It should show the goods or service, taxes or other disclosed charges, the total and any payment-related line item. Do not rely on a verbal explanation.
- Decide whether to proceed. If you need the goods and the merchant refuses UPI, you can ask for another payment method or leave. Do not share your UPI PIN or OTP to persuade the merchant to complete a payment.
- Save evidence before leaving. Photograph a posted surcharge notice or QR sign where lawful, and retain the invoice, payment request, app screen and messages.
Evidence to keep
- The itemised bill, invoice or receipt, including the time and merchant name.
- A screenshot of the UPI payment request, collect request or checkout page showing the amount.
- The transaction ID, date, amount and status shown in your app or bank statement.
- A photograph or screenshot of any displayed “UPI fee,” minimum amount or refusal notice.
- Messages, emails or chat replies in which the merchant explains the charge or refusal.
- The payment method you offered and the merchant’s response, written down while the details are fresh.
Keep originals and redact unnecessary account information before sending copies to anyone. A complaint investigator needs the transaction reference and facts, not your UPI PIN, one-time password or full banking credentials.

For a failed, duplicated or unauthorised payment
Open the transaction in your UPI app and use its dispute or help option. Contact the bank account provider as well, especially for fraud, an unidentified debit or an unauthorised transaction. NPCI’s complaint portal handles payment-system transaction complaints and forwards eligible complaints to the relevant member bank or institution. NPCI specifically directs fraud, unidentified and unauthorised transaction complaints to the customer’s bank.
Provide the transaction ID, date, amount, merchant details and screenshots. Do not wait while a fraud issue develops; use the bank’s urgent reporting channel. A payment complaint can address whether money moved correctly. It does not establish that NPCI will order a merchant to remove a surcharge or accept UPI.

For a surcharge or refusal policy
The sources reviewed did not verify a dedicated official consumer route for a merchant’s UPI pricing or refusal policy. You may ask the merchant for a written explanation and retain the records for advice from a qualified consumer or tax professional. If you contact a government or payment body, describe the issue precisely: “A merchant added a separate amount only when I selected UPI,” or “A business that may exceed the section 269SU threshold refused to provide the prescribed electronic-payment facility.” Do not label an ordinary billing disagreement as fraud unless the facts support that allegation.
How to assess the strongest and weakest cases
| Situation | What it suggests | What to do |
|---|---|---|
| Bill adds “UPI fee” after you choose UPI | A customer surcharge, distinct from merchant MDR | Request itemisation, compare the non-UPI price and preserve proof |
| Merchant says its bank charges MDR | A merchant-side cost being described | Ask why it is being passed to you; retain the explanation and bill |
| QR payment fails or is reversed | Payment-system or bank issue | Check status, avoid paying twice immediately, then contact the app and bank with the transaction ID |
| Money debited but merchant says unpaid | Possible pending, failed or duplicated settlement | Show the app status, contact the bank or app and keep the merchant receipt; do not disclose credentials |
| Small local shop refuses UPI | No automatic section 269SU duty established | Ask for another method; do not assert a universal acceptance mandate |
| Large business appears above ₹50 crore prior-year turnover and offers no prescribed electronic mode | Potential section 269SU issue, subject to facts and exceptions | Record the business identity and refusal, then seek qualified tax or consumer guidance |
Common mistakes to avoid
- Confusing MDR with a customer fee: MDR is described as a merchant-ecosystem charge. That does not make it a line item you must pay.
- Assuming every refusal violates the law: Section 269SU’s ₹50 crore prior-year threshold means the rule is not a blanket mandate for all merchants.
- Relying on an old headline: A 2025 Lok Sabha response said there was then no proposal to impose UPI charges. It is historical context and does not replace the later 2026 Ministry releases.
- Paying twice during a pending transaction: First check the status and transaction reference with your app or bank.
- Sharing security credentials: No merchant, complaint agent or investigator needs your UPI PIN or OTP to verify a dispute.
- Promising a guaranteed NPCI remedy: NPCI’s published route concerns payment-system transactions; it is not proven to be the forum for a merchant’s price policy.
How to describe the incident in a complaint
Use a short, factual chronology:
- State the date, merchant name, location and goods or service.
- State the advertised or quoted price and the final amount requested.
- Quote the exact label used for the additional amount, if any.
- State whether the amount changed only after you selected UPI.
- For a refusal, state which UPI mode you offered and whether the merchant cited a technical problem or a standing policy.
- Attach the bill, screenshots and transaction reference, with sensitive credentials removed.
- Ask for a specific outcome, such as correction of a transaction status or an explanation of the charge.
Keep your description neutral. The question is whether the amount was a customer surcharge, a disclosed price component, a failed transaction or a merchant-side MDR cost—not simply whether the merchant used the word “fee.”
What is established as of 13 October 2026
The Ministry of Finance’s stated customer policy is that MDR is not a charge on people making UPI payments and should not be passed to them. The described 2026 framework includes a ₹2,000 transaction threshold, a ₹1 lakh monthly UPI-QR threshold for a stated small-merchant zero-MDR category, specified rates and a projection that about 96% of merchant transactions remain unaffected.

The official releases do not, however, provide a clear effective date that reconciles the 15 September announcement with the 8 August statement making MDR conditional on legislation and a committee decision. Section 269SU provides a defined electronic-payment facility duty for businesses above the ₹50 crore prior-year threshold; it does not require every merchant to accept UPI. Apply those limits when deciding what to ask for, what evidence to keep and which complaint route fits the problem.
