If a GST officer stops and detains your truck, do not alter the shipment records or argue about an amount on the roadside. Record the interception, secure copies of the invoice or delivery challan and e-way bill, ask for every notice and report, notify the goods owner and GST adviser, and have them check the proposed demand under the current central and applicable state or Union-territory law.
The release process normally turns on the alleged discrepancy, the documents served, your opportunity to respond, and whether you pay the amount ultimately determined or furnish the security permitted by law. The form sequence described in CBIC Circular 41/15/2018-GST remains a useful way to identify paperwork, but that 2018 circular cannot by itself establish today’s penalty, security or payment deadline. Verify the current text of section 129 of the CGST Act, later amendments and the relevant state or UT enactment before making a case-specific decision.

What detention means
Under section 129 of the Central Goods and Services Tax Act, goods and the conveyance carrying them can be detained or seized when they are being transported contrary to the Act or its rules. A stop for verification is not automatically a final finding that tax is payable. The officer may inspect the consignment, compare the records with the physical goods and issue a notice proposing tax and penalty. You should treat the event as a time-sensitive tax proceeding, not as an informal roadside query.

India’s central rules provide the basic transit-document framework, but the governing state or Union-territory GST enactment and the facts of the movement also matter. Interstate and intrastate movements, the type of goods, the form of document used and any later amendment can affect the result. A lawyer or GST practitioner should confirm the law in force on the date of detention.

First 30 minutes: protect the vehicle, records and timeline
Stay calm and make a contemporaneous note
The driver or person in charge should write down the location, date and time of interception; the officer’s name and designation if provided; the vehicle and transporter details; the goods and quantities; and exactly what explanation or document the officer requests. Note when the vehicle is allowed to move, shifted to a designated place or formally detained. Keep a running timeline rather than relying on memory.
Ask for a copy of every document served or signed. Notify the consignor, consignee or owner of the goods and the transporter’s GST contact immediately. A short message should state where the vehicle is, who intercepted it, what has been requested and whether any notice or detention order has been received.
Do not “correct” records after interception
Preserve electronic and paper copies exactly as they existed when the vehicle was stopped. Do not back-date an invoice, replace a vehicle number, edit a quantity or generate a new e-way bill simply to make the papers match the cargo. Tell the adviser about any genuine data-entry error and keep both the original and any later corrective document, with an explanation of when and why it was created.

CBIC’s transit rules state that the person in charge should carry the applicable transport document and e-way-bill information:
- the invoice, where the supply is supported by an invoice;
- the bill of supply, where that document is applicable; or
- the delivery challan, where a challan is the appropriate document; and
- a copy of the e-way bill or its e-way-bill number.
Keep the records available in the permitted electronic or paper form. The owner or adviser should compare every material field before responding:

A mismatch can be clerical, factual or potentially substantive. The correct response depends on which field differs, whether the goods and tax documents otherwise establish the movement, and what the officer alleges. Do not concede a discrepancy merely because the vehicle is waiting; ask that the allegation and supporting calculation be stated in writing.
What inspection records to expect
INS-03: inspection summary
The CBIC rules provide for an inspection summary in Part A of FORM GST INS-03 within 24 hours of the inspection. Ask for a copy or access to the record and check that it accurately describes the vehicle, goods and documents examined.

INS-03 Part B: final report
The final report is provided in Part B of FORM GST INS-03 within three days under the cited rules. Compare it with the driver’s timeline and the physical verification. If quantities, seals, packages or other facts are recorded incorrectly, send the correction and supporting material to the adviser promptly so it can be raised in the formal response.
Repeat physical verification
After physical verification has been completed at one place, the same conveyance generally should not be physically verified again in transit unless the officer later receives specific information relating to tax evasion. Keep the first inspection record available. If another inspection is attempted, ask what specific information is said to justify it and record the place, time and officer involved.
INS-04 for a hold exceeding 30 minutes
When the vehicle is detained for more than 30 minutes, the transporter may upload the detention information in FORM GST INS-04. This is an optional reporting route under the cited rule. The transporter should preserve proof of the upload, if made, and the exact start and end times of the hold.

Understanding the MOV forms in the detention file
CBIC Circular 41/15/2018-GST describes a sequence of forms used in detention proceedings. The circular is from 2018, so use these names to identify papers, not as proof that the old amounts or deadlines still apply.

The labels may appear differently in a current portal workflow or later instruction. If a document has a different number or name, preserve it rather than assuming it is invalid; have counsel map it to the current procedure.
How to respond to a proposed demand
Build the evidence file
Send the GST practitioner or tax counsel a single indexed bundle containing:
- the detention order and notice, including all annexures;
- the inspection summary and final report;
- invoice, bill of supply or delivery challan;
- e-way-bill copy or number, generation history and any extension record;
- vehicle registration, transporter documents and driver identification requested for the movement;
- purchase order, delivery instructions, packing list, weighment record, photographs or seal record where relevant; and
- a timeline of the interception, communications, submissions and any payment or security offered.
Do not send only a screenshot of the e-way bill if the notice relies on quantities, destination or vehicle identity. The adviser needs the underlying records and a clear explanation of any mismatch.
Use the hearing opportunity
Section 129’s published CBIC Act text describes a notice, an opportunity of hearing before determination and an order. The response should address each allegation separately, attach the supporting record and request that the authority consider the explanation before determining the liability. Keep proof of filing, acknowledgement and any hearing date. A written objection and a payment decision are separate choices; paying does not remove the need to understand what the order says or what release document is required.

Ask for a reasoned order
The circular describes a speaking order in MOV-09. A reasoned order should make clear the factual mismatch found, the statutory basis used, the calculation and the conditions for release. If the order does not address a material document or explanation, tell counsel promptly; the available challenge or correction route and its deadline depend on the current law and forum.
Release choices: compare before committing cash or security
The older circular describes three practical routes: contest the proposed demand, pay the amount determined, or obtain release by furnishing prescribed security. The right choice depends on the current statute, the amount at stake and the evidence, not on an old online formula.

Compare the options on five points: the current legal basis and calculation; the strength of the documentary explanation; cash-flow cost; the time and bank-guarantee requirements for security; and the consequence of missing the applicable deadline. Have the adviser verify the current section 129 wording, penalty amount, payment period and any state or UT variation before signing, paying or furnishing a guarantee.

Wrong vehicle number
Preserve the original e-way bill, vehicle documents and dispatch records. Explain whether the vehicle changed before movement, whether an update was made and when. Do not silently generate a replacement record after detention.
Quantity or description differs
Reconcile the invoice, packing list, weighment and physical packages. Ask the officer to identify the exact line or package said to be different. A photograph, weighbridge record or warehouse dispatch register may help establish what was loaded, but submit only records that genuinely relate to this consignment.

Validity appears expired
Record the actual departure, stoppage, route interruption and any extension. The adviser should check the validity rule and the reason the period ended against the date and time in the notice. Do not assume that an expired display alone decides the case without examining the applicable rule and facts.
Missing or unavailable document
Ask whether the e-way-bill number can be provided electronically and whether the applicable invoice, bill of supply or delivery challan is available in the required form. Tell the owner immediately and preserve the transmission log. The officer’s written allegation, rather than a verbal statement, should guide the response.
What the driver should and should not do
- Do: cooperate with lawful inspection, answer factual questions accurately, request copies, and keep the owner informed.
- Do: sign only after reading; if a signature acknowledges receipt rather than agreement, ensure that distinction is clear where the form permits it.
- Do: record refusals, delays and changes in the vehicle’s location with times and witnesses where possible.
- Do not: hand over original records without retaining a copy or receipt.
- Do not: promise payment, admit tax liability or arrange a bank guarantee without the owner’s authorised decision-maker and adviser.
- Do not: obstruct inspection, move the goods without permission or attempt an off-record settlement.
Escalation checklist for the owner or transporter
- Open a case file with a unique internal reference and the exact interception timeline.
- Collect the served order, notice, reports, shipment records and vehicle papers in one folder.
- Ask a GST practitioner or tax counsel to identify the applicable central and state or UT provisions and verify current section 129 wording.
- Reconcile the alleged mismatch field by field and prepare a document-backed explanation.
- Confirm the response, hearing, payment and security deadlines from the current notice and law; do not rely on a 2018 deadline.
- Choose objections, payment or security only after calculating cash-flow, guarantee cost, delay and challenge consequences.
- Obtain written confirmation of release and keep the release form, payment receipt or discharged security records with the shipment file.
When professional help is urgent
Escalate immediately if the notice proposes a substantial amount, the goods are perishable, the vehicle is carrying high-value or regulated goods, the officer alleges tax evasion or fraud, several consignments are involved, the vehicle has been held beyond the expected inspection period, or a bank guarantee is demanded. Counsel can check whether the notice was served correctly, whether the hearing was offered, whether the calculation follows current law and what remedy is available if release is refused.
