If the amount at the pump or on your receipt is higher than the price you saw advertised, first compare the same fuel grade and payment conditions. Keep the receipt, photograph the sign and pump when it is safe, and write down the station details. Ask the station to review the transaction and return any apparent difference. If the station will not resolve it, report the discrepancy to the state or local weights-and-measures, agriculture, or consumer-protection office. Explain whether the problem is a sign-versus-pump price, a receipt error, a cash-versus-card difference, or a meter that registered more fuel than you received; the correct agency and remedy depend on where the station is located.
Check exactly what price was promised and what you paid
Do not assume every number refers to the same transaction. A roadside sign may show a price for regular gasoline paid in cash, while the pump displays a card price, a loyalty-program price, or a different octane. Compare all three points of sale: the street sign, the pump display before and during fueling, and the receipt after payment.

- Fuel grade: Confirm that the sign, pump button, and receipt all say regular, mid-grade, premium, diesel, or the applicable grade you selected.
- Payment condition: Look for cash, credit, debit, fleet-card, or loyalty requirements. Some jurisdictions require particular disclosures for different cash and card prices, but there is no uniform nationwide rule.
- Unit price and total: Compare the per-gallon price as well as the gallons and final charge. A receipt can be wrong even when the pump’s unit price looked correct.
- Location and time: Make sure the sign belongs to the station where you fueled and that a recently changed sign was not being replaced or covered.
Oregon illustrates why location matters: its Department of Justice says the state does not require gasoline stations to post prices on street-facing signs. In a state with that rule, the absence of a roadside price is different from displaying one price and charging another.
Preserve evidence before the display changes
Save the original receipt, whether printed or electronic. Photograph the roadside sign and the pump screen if you can do so without standing in traffic or creating a safety risk. A practical record should include:

These details are not a single nationwide official checklist. They are the information that makes the complaint examples identified by Nassau County Consumer Affairs of Weights and Measures and the Georgia Attorney General’s Consumer Protection Division understandable. A clear record lets an investigator tell whether the issue concerns advertising, a transaction calculation, or measurement.
Ask the station to review and correct the transaction
Return to the cashier or ask for a manager while you still have the receipt. Calmly show the price evidence and identify the precise difference: for example, “The sign showed $X for regular, but pump 4 charged $Y,” or “The pump showed one unit price, but the receipt used another.” Ask the station to review its price settings and transaction record and to refund the difference if the records confirm a mismatch.
Request a written explanation if the employee says the lower price applied only to cash, a particular grade, or a loyalty account. Keep the name of the person who handled the complaint and the date of the conversation. A station may correct an error immediately, but the sources reviewed do not establish a single nationwide rule guaranteeing a refund in every case. Do not describe a requested refund as an automatic legal entitlement unless the law where the station operates provides one.

Identify which kind of discrepancy you have
The distinction matters because a price-advertising complaint can go to a different office than a pump-measurement complaint. Use the facts that match your situation.

Georgia’s agriculture authorities test pump calibration, and Georgia’s consumer guidance specifically treats a receipt suggesting that you were charged for more fuel than entered the tank as a measurement concern. Nassau County likewise lists a meter that already shows money before fueling as a complaint issue. State the symptom plainly instead of reporting every problem as “price gouging.”
Report an unresolved problem to the right public office
Start with weights and measures or the agriculture department
Fuel-pump inspections are commonly assigned to a state department of agriculture, weights-and-measures program, or a local office operating under one of those authorities. Arizona directs consumers with sign-versus-pump discrepancies to its Department of Weights and Measures. Georgia identifies its Fuel and Measures Division for advertising violations and pump-calibration concerns. Nassau County’s Office of Consumer Affairs of Weights and Measures regulates local gas-station pumps and accepts complaints within the county.

Use consumer protection when the issue is advertising or a charge
A state attorney general’s consumer-protection division, county consumer-affairs office, or similar agency may handle a misleading advertised price or a receipt that does not match the represented transaction. If you are unsure which office has jurisdiction, contact the state consumer-protection office and describe the station’s city and county; ask to be directed to the agency that investigates fuel pricing or measurement.

- Give the station’s legal or posted name and full address.
- Describe the advertised price, the pump price, and the amount charged in separate sentences.
- Identify the fuel grade and whether the purchase was cash, card, or discount-conditioned.
- Attach a copy or scan of the receipt and photographs of the sign or pump, if available.
- List gallons, pump number, date, time, and the station’s response when you requested a correction.
- Ask whether the office wants the original receipt, additional photographs, or a follow-up inspection.
Keep the originals and submit copies unless the agency specifically instructs you otherwise. A complaint can help an inspector identify a broader setting or calibration problem, even when the amount in one transaction is small.
What state examples show about legality
Georgia: a specific advertised-price rule
The Georgia Attorney General’s Consumer Protection Division states: “it is a misdemeanor to place a higher price on the gas pump or to charge a higher price than is posted on signs, billboards or in other advertising (O.C.G.A. Section 10-1-164).” That statement is Georgia-specific. It supports reporting a verified sign, pump, or transaction mismatch to Georgia’s consumer-protection or Fuel and Measures authorities; it does not establish the rule for every state.

Arizona: accurate posting versus a high price
Arizona tells consumers to report discrepancies between advertised and pump prices to its Department of Weights and Measures. Its Attorney General’s guidance also explains that a high price by itself is not illegal absent unlawful conduct. In other words, an expensive gallon is not automatically the same thing as a deceptive price representation.
Oregon: no required street sign and emergency limits
Oregon says stations are not required to post gasoline prices on street signs. The Oregon Department of Justice also describes an emergency-related rule authorizing action against gasoline upselling of more than 15 percent after the required market-disruption declaration. That threshold applies only in the circumstances and jurisdiction described by Oregon law; it is not a national limit.
Maine: no general retail-profit cap
Maine’s Attorney General explains that Maine has no general state cap on a retailer’s gasoline profit, while emergency price-gouging rules may apply after a gubernatorial declaration. A high posted price and a mismatch between a representation and a charge therefore involve different legal questions.

Price gouging is not the same as a posted-price mismatch
Price gouging generally concerns how much a seller raises a price during a declared emergency or market disruption. A posted-price mismatch concerns whether the seller charged more than the price represented for the product and payment conditions. The same transaction could raise both questions, but proving one does not automatically prove the other.
Before using the term “illegal,” identify the jurisdiction, the applicable declaration if an emergency rule is involved, and the exact conduct you can document. The reviewed state guidance does not establish a nationwide refund, fine, criminal charge, or private recovery for every discrepancy.
If the gallons or meter seem wrong
Tell the agency that you are questioning measurement, not only price, when the display appears to register more fuel than entered the tank. Note whether money or gallons appeared on the meter before you began. Do not rely solely on a vehicle’s fuel gauge; it is not a calibrated measuring device. The useful evidence is the pump’s displayed gallons, the receipt, the pump number, and the circumstances you observed.

Weights-and-measures inspectors can test calibration and examine whether the pump starts at zero. Georgia identifies its measurement division for this type of concern, and Nassau County lists a meter with money already showing before fueling as a complaint example.
