For U.S. federal income-tax purposes, an individual generally has a reportable capital loss only after a taxable disposition—such as selling Bitcoin for dollars, exchanging it for another digital asset, or using it to pay for something. First establish whether a disposition occurred, then reconstruct the units, dates, dollar values, basis, proceeds, and allocable costs before reporting the result.
This guide covers an individual holding Bitcoin as a capital asset. State, local, non-U.S., business, theft, bankruptcy, and potentially worthless-asset rules can differ.

Start with the event: did you dispose of the Bitcoin?
The first question is not how far Bitcoin fell. It is whether ownership was disposed of in a transaction that closes the tax position. The Internal Revenue Service treats digital assets as property, so a capital-asset disposition is generally measured by comparing adjusted basis with the amount realized.
| What happened | Usually a disposition? | What it means for a loss |
|---|---|---|
| Sold Bitcoin for U.S. dollars or similar currency | Yes | Calculate proceeds minus adjusted basis and allocable transaction costs. |
| Exchanged Bitcoin for another digital asset | Yes | The exchange generally closes the Bitcoin position even if no dollars were received. |
| Used Bitcoin to buy goods or services | Yes | The Bitcoin has a disposition at its fair market value when spent. |
| Bitcoin price declined while you still hold it | Generally no | The decline is unrealized; a market-price change alone generally does not create a capital-loss deduction. |
| Bitcoin remains inaccessible in a frozen exchange account or bankruptcy proceeding | Not necessarily | A frozen account or pending bankruptcy does not, by itself, establish a closed and completed loss. |
A transfer between wallets or accounts that you own is normally not a sale or exchange. Keep the transfer evidence anyway, because it helps prove continuous ownership and basis.

Reconstruct every taxable transaction
Do not begin with an exchange’s annual gain-and-loss number unless you have verified that it includes every wallet and platform. A complete reconstruction should connect each disposed unit to its acquisition record and preserve the calculation in U.S. dollars.
- List the asset and quantity. Record that the asset was Bitcoin, the amount disposed of, and—where relevant—the lot or units matched to the sale.
- Capture the exact date and time. The acquisition and disposition timestamps establish the holding period and help resolve transfers, same-day trades, and price differences.
- Determine fair market value in U.S. dollars. Record the dollar value at acquisition, disposition, exchange, or payment, along with the pricing method and source used.
- Establish adjusted basis. Basis generally starts with what you paid, adjusted for applicable costs and prior events. If Bitcoin was received rather than purchased, preserve the records supporting its basis.
- Establish proceeds or amount realized. For a cash sale, use the cash received and subtract transaction costs allocable to the disposition. For an exchange or payment, determine the fair market value of what you received or purchased.
- Reconcile all platforms and wallets. Match exchange exports with on-chain wallet identifiers, deposits, withdrawals, internal transfers, and fee debits so that a transfer is not mistaken for a sale or counted twice.
The IRS says taxpayers should retain records documenting “Your purchase, receipt, sale, exchange or any other disposition of the digital assets” on its digital-assets guidance. Keep the underlying confirmations, not just a spreadsheet total.
How to calculate the loss, including fees
For a sale for dollars, IRS digital-asset FAQ 52 states: “Your gain or loss on the sale of your digital assets for U.S. dollars or similar currency will be the difference between your adjusted basis in the digital assets and your ‘amount realized’ on the sale.” The same FAQ explains that amount realized is cash received plus the fair market value of services received, reduced by digital-asset transaction costs allocable to the disposition of the transferred digital assets. See the IRS frequently asked questions on digital-asset transactions.

A negative result is a capital loss. A positive result is a capital gain. The calculation must be performed for the units disposed of, not for the current value of Bitcoin still in your wallet.
Fees directly tied to a sale, exchange, or disposition
The IRS definition of digital-asset transaction costs covers amounts paid in cash or property—including digital assets—for services provided by another to effect a purchase, sale, or disposition. Examples include trading or transaction fees, network or gas fees, transfer taxes, and commissions when they are connected to the relevant transaction. A sale fee that is allocable to the Bitcoin sold can reduce the amount realized, subject to the transaction’s documentation.
Fees paid in Bitcoin are separate dispositions
If a platform or service provider takes its fee in Bitcoin, the Bitcoin used to pay that fee is itself disposed of. You therefore need a separate quantity, value, acquisition basis, and date for the fee payment. That fee-payment lot can have its own gain or loss, independent of the trade that generated the main proceeds.
Self-transfer costs are not automatically sale costs
Costs to move assets between wallets or accounts you own are not treated as transaction costs for a purchase, sale, or disposition merely because a network charged a fee. Do not automatically subtract every withdrawal or self-transfer fee from sale proceeds. Preserve the fee record and identify whether the transfer was part of a taxable disposition or simply movement of your own property.

Holding period: short-term versus long-term
For capital-asset digital-asset dispositions, the IRS uses one year or less versus more than one year as the holding-period thresholds (FAQ 50, added December 15, 2025). The acquisition and disposition dates in your records determine which category applies. A trade held for one year or less is short-term; one held for more than one year is long-term. The holding period affects the tax treatment of the resulting gain or loss, so a missing timestamp can change the reporting category.
When multiple lots are sold, document the method used to identify which units were disposed of and apply it consistently. If your records cannot identify the lots, reconstruct the sequence from exchange and wallet data before filing rather than silently assigning a basis.
Report the disposition on the federal return
Capital-asset digital-asset dispositions are generally reported on Form 8949 and summarized on Schedule D, following the instructions for the tax year. Enter each required transaction or the permitted grouped reporting detail, including dates, proceeds, basis, adjustments, and the resulting gain or loss. A taxable transaction must be reported even when it produced a loss and even when no broker statement was issued.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsThe IRS has a broker-reporting exception pathway when a broker provides Form 1099-DA with gross proceeds and basis information. Form 1099-DA reporting began for covered transactions on or after January 1, 2025. The IRS has warned that many 2025 statements may not include basis, so the form may show proceeds without supplying the number needed to calculate the result.

How to use a Form 1099-DA
- Compare the form’s transaction dates, quantities, proceeds, and fees with your exchange and wallet records.
- Determine whether the reported proceeds are gross or have already been adjusted for an allocable cost under the form’s instructions.
- Supply or correct basis from your own records when the form omits it or is incomplete.
- Investigate duplicate transactions, transfers mistakenly reported as sales, and assets held across multiple platforms.
- Report the corrected figures on Form 8949 and Schedule D rather than copying an inaccurate statement without review.
A missing 1099-DA does not eliminate a filing obligation. Conversely, receiving one does not make its information complete by default.
How much of the loss can you use?
Capital losses first offset capital gains under the Schedule D calculation. If losses exceed gains, Internal Revenue Service Publication 550 (2025) states the general annual limit for using net capital losses against other income is $3,000 for most individuals, or $1,500 for married taxpayers filing separately. Eligible unused capital losses generally carry forward to later years.
The $3,000 or $1,500 figure is not a cap on losses you may report. It is the general limit on the net capital-loss amount used against other income in one year after the full capital-gain and capital-loss calculation. The actual deduction and carryover depend on filing status, other capital transactions, and the completed Schedule D calculation. See Publication 550 (2025).

What if the Bitcoin is frozen, stolen, abandoned, or worthless?
Frozen exchange account or bankruptcy
The Taxpayer Advocate Service explains that assets tied up in a frozen account or bankruptcy generally do not create a claimable loss merely because access stopped or the market value fell. The timing and amount depend on what ultimately happens: whether ownership ends, what property or cash is distributed, and whether any recovery remains possible. Preserve account statements, claim forms, notices, and distribution records, then reassess when the proceeding reaches a meaningful conclusion. See Taxpayer Advocate Service guidance on digital assets.
Completely worthless or abandoned Bitcoin
Worthless-asset and abandonment theories have separate requirements and should not be substituted for an ordinary market-loss calculation. The Taxpayer Advocate Service’s discussion notes that miscellaneous itemized deductions for individuals were not deductible for tax years 2018 through 2025 under the Tax Cuts and Jobs Act. That stated period and treatment may be affected by later legislation or guidance, so a taxpayer considering abandonment or worthlessness should obtain current professional advice and document the event, intent, and remaining rights.

Stolen Bitcoin can involve separate theft-loss rules. The event, the year it was discovered, the applicable jurisdiction’s definition of theft, insurance or reimbursement, and any later recovery can all matter. Do not assume every theft creates a currently deductible loss; gather police, exchange, wallet, insurance, and recovery documentation for a tax professional.
Common mistakes and how to correct them
- Claiming a loss while still holding Bitcoin: A falling quote is generally unrealized. Identify a completed disposition before reporting a capital loss.
- Subtracting every fee: Allocate costs to the purchase, sale, exchange, payment, or self-transfer they actually relate to. A wallet-to-wallet fee is not automatically a reduction of sale proceeds.
- Ignoring crypto-to-crypto trades: An exchange for another token is generally a disposition of the Bitcoin given up, even without cash.
- Omitting spending transactions: Paying a merchant or service provider with Bitcoin can dispose of the units spent.
- Relying on one platform’s report: Combine all exchanges and self-custody wallets, then remove internal transfers and duplicates.
- Assuming a 1099-DA supplies basis: Review 2025 statements carefully; basis may be absent.
- Failing to report because no form arrived: The reporting duty is based on the taxable transaction, not on receipt of an information return.
- Treating the annual $3,000 limit as the total reportable loss: Report the full capital calculation and track eligible carryforwards.
When professional review is especially important
Consider an experienced digital-asset tax professional when basis is missing, records span several exchanges or years, you used Bitcoin for payments, a fee was paid in Bitcoin, or a transaction includes lending, derivatives, mining, staking, gifts, or business activity. Professional review is particularly important for frozen accounts, bankruptcy distributions, theft, complete worthlessness, uncertain abandonment, non-U.S. residence, and any return requiring state or foreign reporting. A preparer cannot calculate a defensible result without dates, quantities, basis, proceeds, fees, filing status, and the rest of your capital transactions.
A practical filing workflow
- Freeze the evidence. Download exchange statements, wallet histories, fee details, and account notices before changing accounts or software.
- Classify events. Separate purchases, receipts, self-transfers, sales, exchanges, payments, fee payments, and unresolved access or bankruptcy events.
- Match lots. Link each disposition to its basis and holding period, documenting the method and any assumptions.
- Calculate transaction by transaction. Include only allocable transaction costs and treat Bitcoin-paid fees as their own dispositions.
- Reconcile statements. Compare your ledger with any Form 1099-DA, correcting omissions, duplicates, or missing basis.
- Complete the federal forms. Use Form 8949 and Schedule D as directed for the applicable tax year, then calculate any capital-loss carryforward.
- Retain the support. Keep the ledger, source files, calculations, forms, and explanations with your tax records.
IRS Publication 544, Sales and Other Dispositions of Assets, provides additional federal concepts for dispositions, while the IRS digital-assets page and FAQ explain digital-asset-specific reporting and transaction-cost treatment.
