What to do if a bank keeps crediting interest after the account holder dies

If a bank keeps adding interest after an account holder dies, do not assume the credits are automatically wrong or that you can treat them as your own money. First establish when the death was reported, whether the account was sole or joint, and whether the entries are interest paid on a deposit or interest charged on a debt. Notify the bank’s bereavement or deceased-estate team in writing, obtain a dated explanation and transaction history, and have the personal representative apply the tax and estate rules for the country where the account is held.

What to do immediately

  1. Write to the bank’s bereavement or deceased-estate team. State the account holder’s full name, account details, date of death, and the date the bank was first notified. Ask what documents it requires from the executor, administrator, or other personal representative. Send the notice through a channel that provides proof of delivery and keep the bank’s acknowledgment.
  2. Ask the bank to confirm its status record. Request confirmation that it has recorded the death, the date it did so, whether the account is restricted, and what withdrawals, transfers, or standing instructions remain possible. A continuing interest credit can occur alongside a block on withdrawals, so a credit alone does not prove the bank failed to act.
  3. Request a complete interest and transaction statement. Ask for the balance at the date of death and every later interest credit, with the dates and calculation periods. Request a clear split between pre-death and post-death amounts if the bank can provide one. Preserve statements, tax forms, correspondence, and the bank’s explanation in the estate records.
  4. Check the recipient and tax treatment before distributing money. The personal representative should establish which amounts belong on the deceased person’s final return, which are estate income, and which may pass to beneficiaries. Rules differ by country and can depend on when the bank was notified and when interest was credited.
  5. Complain in writing if the explanation is incomplete. Set out the dates, amounts, and question that remains unresolved. Ask for a corrected statement or tax-reporting document where appropriate. The regulator, ombudsman, filing form, and deadline depend on the account’s country and the bank.

Why interest may continue after death

Death does not necessarily end an interest-bearing account’s contractual calculation. A bank may stop ordinary operation while continuing to calculate interest until the balance is paid, transferred, or otherwise settled. In France, for example, public-service guidance says that a sole-holder account is blocked once the bank learns of the death, while an interest-bearing account can continue accruing interest until the balance is settled. The continuing credit therefore may be an expected consequence of the product terms rather than an unauthorized payment.

The accounting date also matters. Interest earned before death and interest credited after death can be treated as different items even when they appear in one statement. A bank may post interest monthly, quarterly, or annually, so a single posting after death can include earnings from days before the death as well as days afterward. Ask the bank to identify the accrual period, not just the posting date.

Four facts that determine the answer

Fact Why it matters
Date of death Separates earnings attributable to the deceased from later estate income under some tax systems.
Date the bank learned of the death Can determine when restrictions began and how the bank reports interest when notice was late.
Account ownership A sole account generally enters the estate process; a surviving joint holder may have authority to operate it, subject to local law and the account mandate.
Type of interest Interest paid on savings or deposits follows different rules from interest charged on a loan, overdraft, or credit account.

Sole account versus joint account

Sole-holder account

With a sole account, the personal representative normally deals with the bank after proving authority. The bank may restrict withdrawals and require a death certificate, probate or letters of administration, identification, and its own estate forms. Continuing credits should be left in place until the bank confirms the amount and the person entitled to receive it. Do not move the money to a personal account merely because you can access online banking or hold a debit card.

Joint account

A joint mandate can change both access and reporting. Some mandates allow either holder to transact; others require all holders to agree. Banco de España’s consumer guidance specifically advises checking whether the account is individual or joint and, for a joint account, whether any holder can act alone or all must consent. A surviving holder’s ability to use the account does not by itself answer who owns every post-death credit or how it must be reported for tax. Ask the bank for its joint-account procedure and preserve evidence of contributions and beneficial ownership if the estate may dispute entitlement.

When does the interest belong to the estate?

There is no worldwide rule. The governing law may follow the account location, the deceased’s tax residence, the estate’s residence, or a combination of those rules.

United Kingdom

HM Revenue & Customs (HMRC) states in its Trusts, Settlements and Estates Manual: “Interest credited to an account after the date of death is treated as the income of the deceased person’s estate.” Under HMRC’s bank and building-society reporting guidance, when the holder dies before interest is paid or credited, the personal representative or executor receives or benefits from the entitlement from the date of death. HMRC also says that where notification was late, the return is based on facts known at the time and depends on both the date of death and the date interest was paid or credited.

For UK administration, the representative should be identified as a non-individual for the estate reporting process so that estate interest is not incorrectly treated as the representative’s personal income. When estate income is later paid to beneficiaries, HMRC says the personal representative should provide an income statement, which may be form R185, showing the amount and tax deemed paid. These are UK rules and should not be applied to an account in another country without checking its law.

United States

IRS Publication 559 (2025) explains that a Form 1099-INT issued for interest payable to a deceased person can include amounts reportable on the deceased person’s final return and amounts reportable by the estate or another recipient. In the circumstances described by the IRS, interest earned up to death plus further interest earned before distribution is income to and reportable by the estate. Ask the payer, where possible, for a form identifying the correct recipient and amount rather than assuming the name printed on the form settles the issue. This is U.S. federal guidance; state probate and tax rules may add requirements.

France

French public-service guidance provides a useful operational example: once the bank learns that a sole account holder has died, the account is blocked, but an interest-bearing account can continue to accrue interest until the balance is settled. The guidance demonstrates why continued posting and restricted access can coexist. It does not determine how another country taxes or allocates that interest.

India

Reserve Bank of India material describes an account styled “Estate of [deceased]” for certain pipeline credits, with no withdrawals, and specifies interest treatment for particular current-account balances of deceased depositors. The treatment is account- and rule-specific. Confirm the current Reserve Bank circular and the bank’s own deceased-account policy before relying on it; do not extend a current-account rule to every savings or term deposit.

Spain

Banco de España’s guidance emphasizes that the individual-or-joint distinction and the account mandate affect operation after death. Use that as a starting point for gathering the bank’s instructions, not as a universal answer to ownership or tax questions.

How notification timing changes the record

Keep two dates separate in every letter and spreadsheet: the date of death and the date the bank received reliable notice. If notice was delayed, interest may have been credited under the bank’s ordinary system before its death marker was entered. In the UK, HMRC says reporting for a late-notified account is governed by the facts known at the time and by the dates of death and credit. That does not automatically make the posting improper; it means the representative may need a corrected allocation or reporting document.

Give the bank copies of earlier notices, delivery receipts, branch acknowledgments, and any probate correspondence. If the bank says it received notice on a different date, ask it to identify the record on which that date is based.

Deposit interest is not the same as interest on a debt

This guidance concerns interest the bank pays or credits on a deposit, savings account, or similar balance. Interest charged on a deceased person’s loan, overdraft, mortgage, or credit account follows the contract, secured-debt law, probate rules, and local limitation rules. Do not use deposit-interest tax treatment to decide whether a debt charge is valid. For a charged amount, request the loan statement, rate, accrual period, insurance or repayment terms, and the bank’s estate-claim procedure.

  • the bank’s acknowledgment and any reference number;
  • statements covering at least the period before death through final settlement;
  • an interest schedule showing posting date, accrual period, rate if shown, and amount;
  • probate, letters of administration, or equivalent authority;
  • tax forms and corrected forms, if issued; and
  • the personal representative’s distribution calculations.

Keep the bank’s explanation with the statement it explains. If a later tax form combines pre-death and post-death amounts, mark the figures that require clarification rather than altering the document yourself.

What to ask the bank

  • On what date did you record the death?
  • Is the account sole or joint in your records, and what mandate applies?
  • Is the account blocked, restricted, or still fully operational?
  • What accrual period does each post-death interest credit cover?
  • Who is recorded as the recipient for tax reporting?
  • Can you issue a statement separating amounts earned before death, after death, and after any transfer or distribution?
  • What documents are required to close, transfer, or settle the account?
  • If a tax form is inaccurate, what correction process and deadline apply?

Common mistakes and safer alternatives

Mistake Safer approach
Assuming every post-death credit is an error Check whether the account terms continue interest until settlement and obtain the accrual period.
Treating all credits as the executor’s income Separate the deceased’s final-return amounts from estate income and beneficiary distributions under local rules.
Ignoring a joint holder Confirm the mandate, surviving-holder authority, and beneficial ownership before transferring funds.
Using the posting date as the earning date Ask for the period over which the interest accrued.
Moving money before the bank confirms authority Leave credits in the account and follow the bank’s deceased-estate process.
Applying deposit rules to a loan Request the debt contract and estate-claim statement separately.

When professional help is justified

Consider a probate or tax professional familiar with the account’s jurisdiction when the estate crosses borders, the account is jointly held, the bank issued a combined tax form, beneficiaries disagree, or the interest is material relative to the estate. A professional can reconcile the bank’s ledger with the estate accounts; the bank remains responsible for explaining its own postings and correcting records it issued inaccurately.

Escalating an unresolved case

Start with the bank’s formal complaint process and attach the timeline and documents rather than making a general allegation that “interest was added after death.” Ask for a written decision addressing the death-notification date, account restrictions, accrual periods, recipient, and tax form. If the response is unsatisfactory, use the financial regulator or ombudsman for the country in which the account is held and observe its filing deadline. Because escalation routes differ by jurisdiction, identify the correct body from the bank’s complaint response or the relevant government authority.

Practical decision checklist

  • Interest credited before death: ask how it belongs on the deceased person’s final tax return.
  • Interest credited after death on a sole account: keep it in the estate records and ask for the bank’s post-death statement.
  • Late notification: document both dates and request an explanation of reporting based on the bank’s knowledge at the time.
  • Joint account: obtain the mandate and determine whether a surviving holder can act alone.
  • Tax form in the deceased’s name: ask whether it combines final-return and estate amounts and request a corrected recipient form if available.
  • Interest charged rather than paid: stop using this deposit-interest process and obtain the debt statement and contract.
