If a bank has not returned your original property papers after you repaid a loan, make a dated written demand, preserve proof of repayment and document delivery, and ask for both the papers and confirmation that any registered mortgage or charge has been removed. In India, the Reserve Bank of India (RBI) requires covered regulated lenders to complete both tasks within 30 days for cases where release became due on or after 1 December 2023. If an attributable delay runs past 30 days, compensation is ₹5,000 per day.
Those deadlines and payments are not worldwide rules. The detailed time limits below apply to qualifying Indian borrowers and RBI-regulated entities. Elsewhere, use the lender’s complaints process, the local financial ombudsman or regulator, and the land registry or property authority that records the charge.

First, establish exactly what is still outstanding
A loan account being marked “closed” and a mortgage or charge being removed from a registry are connected but separate administrative events. Your request should therefore ask for three distinct confirmations:

- every original movable or immovable property document held as security will be returned; and
- any mortgage, lien or other charge registered with a land or other registry has been removed.
If the lender says money remains due, ask for an itemized statement and the contractual or account basis in writing. Do not treat a telephone assurance, an internal “closed” status or a verbal promise as proof that the documents and registry filing have been dealt with.

India’s 30-day rule and compensation
The RBI notification RBI/2023-24/60, dated 13 September 2023, says: “The REs shall release all the original movable / immovable property documents and remove charges registered with any registry within a period of 30 days after full repayment/ settlement of the loan account.” The notification applies where release of the documents falls due on or after 1 December 2023.
It covers specified RBI-regulated entities, including commercial banks subject to the notification’s stated exclusions, local area banks, specified cooperative banks, non-bank financial companies (including housing finance companies), and asset reconstruction companies. Check that your lender and transaction fall within the notification before relying on the remedy.
| Situation | Rule in a covered Indian case | What to verify |
|---|---|---|
| Normal return and discharge | Original documents and removal of registered charges within 30 days after full repayment or settlement | Repayment date, lender coverage and whether a charge is recorded |
| Lender-attributable delay | ₹5,000 for each day beyond the 30-day period, with an explanation for the delay | Written proof of when the 30-day clock began and why the delay was the lender’s responsibility |
| Originals lost or damaged | Lender must help obtain duplicate or certified copies and pay associated costs; the replacement process has an additional 30 days | Written confirmation of loss, affected documents and the replacement timetable |
The ₹5,000 figure is not a general penalty for every dispute. Applicability, proof that the account was fully repaid or settled, the lender’s regulatory status and attribution of the delay all matter. The notification also says this compensation does not prejudice rights to seek other compensation available under applicable law.
Step-by-step: make the lender act
1. Assemble closure and custody evidence
Collect your loan account number, loan agreement, final repayment receipt or bank statement, closure or no-dues letter, and any inventory, receipt or acknowledgement listing the originals deposited. If you have a registry or title extract, obtain a current copy so you can see whether a charge remains recorded.

2. Send one clear written request
Address the request to the servicing branch and the lender’s official grievance channel. State the date and amount of final repayment, attach the closure evidence, and list every original document you expect back. Ask the lender to:
- confirm in writing that the account is fully closed;
- return all originals held as security;
- remove any registered mortgage or charge and provide evidence of the filing or release; and
- tell you where and when the documents can be collected.
Under the RBI direction, you may choose collection at the loan-servicing branch or another lender office where the papers are available, according to your preference. Say which location you prefer and request an appointment or collection acknowledgement.
3. Create a reliable record of delivery
Keep the complete letter and attachments, the date sent, acknowledgement or courier tracking, grievance ticket numbers, emails, replies and notes of calls. If you submit at a branch, obtain a stamped copy. A chronological file makes it possible to show when the lender received your request and when the 30-day period expired.

Once 30 days have passed from full repayment or settlement, send a short follow-up referring to the original request. Ask the lender to identify the reason for any delay and to calculate any compensation due under the RBI direction. Request a firm collection date and written confirmation of charge removal rather than accepting an open-ended promise.

5. Escalate within the lender
Use the lender’s published grievance hierarchy if the branch does not resolve the matter. Send the original request, proof of repayment, delivery evidence and the branch’s response to the designated grievance or nodal officer. Keep proof that you complained directly to the regulated entity; the RBI ombudsman process generally expects the lender to have had an opportunity to resolve the complaint first.
When the bank says the originals are lost or damaged
Ask for a written statement identifying each missing or damaged paper, the date the lender discovered the problem, the search or recovery steps taken and the person responsible for coordinating replacement. Do not rely on a statement that the papers are “not traceable” without a document-by-document inventory.
The RBI direction requires the regulated entity to help obtain duplicate or certified copies and to bear the associated costs. It allows an additional 30 days for that process. For compensation purposes, the delay calculation begins after a total of 60 days: the initial 30-day return period plus the additional 30 days for reconstruction or certified copies.

A certified copy may not substitute for an original in every sale, refinance, inheritance or court matter. If a transaction or title decision is at risk, ask a local property lawyer or qualified document-reconstruction professional which registry applications, newspaper notices, indemnities or court steps are appropriate. Keep receipts, because the lender’s obligation covers associated replacement costs under the RBI direction.

Use the current RBI complaint route
The RBI FAQ updated on 1 July 2026 states that the Reserve Bank–Integrated Ombudsman Scheme, 2026 took effect on that date and replaced the 2021 scheme. It describes a cost-free, non-adversarial mechanism for eligible complaints about deficient service by covered regulated entities.
The FAQ lists three filing routes:
- submit an online complaint through the RBI Complaint Management System (CMS) portal;
- email the complaint to [email protected]; or
- send a signed physical complaint to the Centralised Receipt and Processing Centre, Reserve Bank of India, Central Vista, Sector 17, Chandigarh – 160017.
You do not need to select a particular ombudsman office when filing. Before submission, read the 2026 Scheme’s coverage, maintainability requirements, time limits and exclusions. They determine whether the complaint can be accepted, especially if the same issue is already before a court, tribunal or another forum. An RBI complaint is a regulatory dispute-resolution route, not a substitute for every civil or property claim.
What to attach to an RBI complaint
- Loan agreement or account details and the final repayment proof.
- Closure, no-dues or settlement confirmation.
- Inventory or receipt identifying the original documents deposited.
- Your written demand for return and charge removal.
- Delivery proof, grievance reference numbers and the lender’s replies, or evidence of no reply.
- A current registry or title extract if a charge still appears.
- If papers are missing, the lender’s written loss or damage confirmation and replacement proposal.
- A calculation showing the relevant dates and any claimed ₹5,000-per-day period, without assuming compensation where attribution or coverage is disputed.
Submit readable copies and keep the originals. Describe the outcome you want: return of specified documents, proof of registry discharge, replacement at the lender’s cost, an explanation, and compensation where the RBI conditions are met.
If the property or lender is outside India
Do not apply India’s 30-day period or ₹5,000-per-day amount to another country. Start with the lender’s internal complaints team and request the same practical outcomes: return of originals, written confirmation that the mortgage or charge is discharged, and instructions for obtaining or replacing documents.

Then identify the jurisdiction’s financial regulator or ombudsman and the land registry or property authority. GOV.UK’s home-buying complaint guidance, for example, directs a borrower to use the company’s complaint process and then contact the Financial Ombudsman Service about a mortgage lender. That is a UK process, not a universal rule.
A New Zealand Banking Ombudsman case note concerning a mortgage-discharge disagreement involving a partnership cited section 97 of New Zealand’s Property Law Act 2007. The example shows why ownership structure, the document held and local legislation can change the answer; it is not a rule for every New Zealand dispute or for other countries.
Collection choices and practical safeguards
When documents are ready in India, compare collection at the loan-servicing branch with collection at another office where the papers are held. The second location may reduce travel, but confirm that it has the complete inventory and can issue a signed handover receipt. At collection, check names, document numbers, page counts and condition before signing. Photograph the handover receipt and store it with your closure papers.

An expanding file folder is optional; it has no legal effect and is not required by the RBI. The important safeguards are dated copies, delivery proof and a clear inventory.
Common mistakes that weaken a claim
- Waiting for a verbal promise instead of sending a dated written demand.
- Requesting “papers” without listing the documents and asking about registry charges.
- Assuming a closed account automatically means the land registry has been updated.
- Claiming the ₹5,000 payment without proving the repayment date, lender coverage and lender-attributable delay.
- Using an old explanation of the 2021 RBI ombudsman scheme without checking the 2026 framework.
- Throwing away receipts, emails or courier records after receiving a partial set of papers.
- Assuming a certified copy will always be accepted for a sale, refinance, inheritance or court proceeding.
When professional help is justified
A regulator complaint may be enough for a straightforward delay involving a covered Indian lender. Consider local legal or title assistance when originals are lost, several owners are involved, a sale or refinance is blocked, an inheritance is pending, the registry rejects a discharge, or the lender disputes the balance. Ask the professional to identify the specific document and authority involved, not merely to send a generic demand.
The practical objective remains the same: establish repayment, identify what the lender held, obtain the originals or an appropriate replacement, and verify that the public charge record is clear.
