What to do if a bank charges an overdraft fee you thought was waived

By TheFinanceBase Team 8 min read

Start by identifying the exact fee, the transaction that triggered it, and the bank’s written waiver terms. A fee you believed would be refunded is not automatically an unauthorized fee. Compare your account agreement, fee schedule, opt-in records, waiver message and transaction ledger, then ask the bank to explain the charge and credit it if its promise or the applicable rule supports your position.

If the bank does not resolve a well-documented request, submit a complaint to the Consumer Financial Protection Bureau (CFPB). The bureau says companies generally respond within 15 days; some provide an interim response and a final response within 60 days. A complaint requests review and a response, but it does not guarantee a refund.

First, identify exactly what was charged

Download or print the transaction-level ledger for the relevant period. Record the fee amount, the date it posted, the description used by the bank, and the transaction that preceded it. Also note whether a later credit appears. A statement’s overdraft total can conceal the status of one particular item, so the individual entries matter.

Classify the transaction

Write down whether the triggering item was an ATM withdrawal, a one-time debit-card purchase, a check, a recurring electronic payment or another ACH transaction. The transaction type determines whether the federal overdraft opt-in rule applies.

Triggering transaction Does Regulation E’s overdraft opt-in rule generally apply? What that means for a fee
ATM withdrawal Yes, for the bank’s payment of the transaction into overdraft The bank generally may not charge the overdraft-service fee without the consumer’s affirmative opt-in.
One-time debit-card transaction Yes, for the bank’s payment of the transaction into overdraft The bank generally may not charge the overdraft-service fee without affirmative opt-in.
Check No A fee may be charged even when the customer has not opted in to debit and ATM overdraft coverage.
Recurring electronic payment or ACH debit No A fee may be charged under the account’s terms without the Regulation E opt-in used for ATM and one-time debit transactions.

This distinction comes from the CFPB’s consumer guidance and Regulation E. Declining debit-card overdraft coverage therefore does not prevent every overdraft, returned-item charge or other consequence. A check or recurring payment can still overdraw the account, and a transaction can be declined under the bank’s or merchant’s terms.

Separate a waiver promise from a legal restriction

There are several different arguments a customer might be making:

  • Courtesy refund: A representative said the bank would refund this charge, perhaps as a one-time exception.
  • Conditional waiver or promotion: The bank promised no fee if a stated condition was met, such as maintaining a balance, using a particular account feature or completing an action by a deadline.
  • Contractual term: The account agreement or fee schedule excludes the charge in the circumstances that occurred.
  • Regulatory opt-in issue: The fee was for paying an ATM or one-time debit transaction into overdraft, but the bank cannot show your affirmative consent to the overdraft service.

These grounds require different evidence. A remembered conversation may support a courtesy review, while a screenshot of a waiver notice or an enrollment confirmation can establish the exact conditions. Whether your particular bank made a promise, whether you satisfied its conditions and whether the fee was later credited cannot be determined without your documents.

Build a record before contacting the bank

Collect the transaction and communication evidence

Create a short timeline containing:

  • The date and amount of the overdraft fee.
  • The posting date, amount and description of the transaction that caused the negative balance.
  • The transaction type (ATM, one-time debit, check, recurring debit or ACH).
  • Any date on which the account was brought positive and any subsequent credit or reversal.
  • The exact wording, date and channel of the waiver promise, confirmation or notice.
  • A copy of the statement and a transaction-history screenshot showing both the fee and any credit.

Save secure-message threads, emails, letters and text alerts in their original form. If you spoke by phone or in a branch, write down the date, representative’s name or identification number, what was promised and any case or reference number. Do not put a full account number or other sensitive credentials in a public complaint narrative.

Check the governing terms

Compare the account agreement, current fee schedule and overdraft-service enrollment record with the transaction. Look for definitions of “overdraft fee,” “returned-item fee,” “courtesy refund,” balance or timing conditions, and any language describing when a credit appears. Confirm whether the fee schedule in effect on the transaction date differs from a newer version.

For a debit or ATM transaction, look for the bank’s opt-in record. Regulation E requires an institution to provide a reasonable opportunity to opt in, obtain affirmative consent, provide the required notice and confirm enrollment with a notice about revocation rights. The CFPB explains in Circular 2024-05, “Improper Overdraft Opt-In Practices,” that: “A bank or credit union can be in violation of the Electronic Fund Transfer Act (EFTA) and Regulation E if there is no proof that it obtained affirmative consent to enrollment in covered overdraft services.” The phrase “covered overdraft services” matters; this rule does not convert every overdraft-related charge into an opt-in violation.

Ask the bank for a specific review

Use the bank’s secure-message channel, its customer-service number or a branch. Put the request in writing when possible so the facts and requested remedy are clear.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Identify the charge. State the fee amount, fee-posting date, account type and the transaction that appears to have triggered it.
  2. Explain the inconsistency. Quote the waiver promise or identify the account term, and say whether your concern is a missing refund, a condition you met, or lack of opt-in for an ATM or one-time debit transaction.
  3. Attach or offer the records. Provide the relevant statement page, ledger entries, waiver message and enrollment confirmation. Redact unnecessary account numbers.
  4. Request a concrete resolution. Ask for a refund or credit if the bank’s terms or representation support it. If the issue involves overdraft coverage settings, ask the bank to confirm in writing what is enabled, disabled or revocable going forward.
  5. Request an explanation. Ask which transaction and rule the bank used, whether it found an opt-in record, how it applied the waiver conditions and when any credit was posted.
  6. Preserve the response. Record the date, representative or department, case number and decision. Keep copies of every message and attachment.

CFPB complaint guidance recommends contacting the company first and supplying dates, amounts, communications and supporting documents. A precise request gives the bank an opportunity to correct a posting error or explain why a condition was not met.

When the charge involves an ATM or one-time debit transaction

Regulation E’s overdraft-services provision generally bars a fee for paying an ATM withdrawal or one-time debit-card transaction into overdraft unless the consumer affirmatively opted in. Ask the bank for the enrollment record and the notice confirming the opt-in. If the bank cannot produce evidence of consent, state that fact in your written review request and identify the transaction as covered by the rule.

Do not apply that conclusion to a check or recurring electronic payment. The CFPB’s consumer answer at What can I do if my bank charged me a fee for overdrawing my account? explains that checks and recurring electronic payments may still incur fees without opt-in. A debit transaction may also be declined rather than paid, and a merchant or account agreement may impose separate consequences. Your dispute should identify the covered transaction and the exact fee instead of asserting that all overdraft charges are prohibited.

Read the statement totals correctly

Regulation DD requires a periodic statement to show total overdraft fees for the statement period and for the calendar year to date. Those summary figures are useful for spotting an unexpected charge, but they do not replace the ledger.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The official interpretation permits certain ways to reflect a later waiver. A fee assessed in a prior statement period may be removed from the current year-to-date total, while the adjustment should not change the current period’s total. When a fee is assessed and waived within the same cycle, the institution may show the net amount. Consequently, a year-to-date total can change without showing which individual line item was credited, and a current-period total may not reveal a prior-period waiver.

Escalate an unresolved dispute to the CFPB

If the bank’s answer does not address the evidence or refuses a reasonable correction, submit a complaint at consumerfinance.gov/complaint. The CFPB can route a complaint to the company or, when another agency is better placed, refer it and tell you. It is a channel for review and a company response, not an order guaranteeing reimbursement.

Prepare the complaint

The CFPB asks consumers to include:

  • The company’s name and the account or product involved, without posting unnecessary full account numbers.
  • Key dates, amounts, transaction descriptions and the sequence of events.
  • The waiver promise, enrollment communication or account term you rely on.
  • Copies of statements, ledger entries, messages and the bank’s response.
  • The fair resolution you want, such as a specified credit, a written explanation or correction of the account record.

Write a chronological narrative. Distinguish what you know from the records from what a representative told you. Include the case number from your bank contact and explain why the response did not resolve the issue.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Know the response timetable

According to the CFPB’s complaint-process guidance, companies generally respond within 15 days. In some cases, the company says its response is in progress and provides a final response within 60 days. You can review the company’s response and provide feedback through the CFPB process. These are service-process timeframes, not a promise about a refund amount or outcome.

Evaluate the bank’s decision

If the fee is refunded

Verify that the credit appears in the ledger, note its posting date and check the next statement’s period and year-to-date totals. Keep the written confirmation and the waiver conditions in case a later statement appears to reverse or misclassify the credit.

If the bank denies the request

Read the stated reason against your records. A denial may say the transaction was a check or recurring payment outside the Regulation E opt-in rule, that a promotional condition was not met, that the fee was assessed under the agreement in effect on the posting date, or that the bank’s records show affirmative opt-in. If the explanation omits the transaction, dates or evidence you supplied, ask for a written clarification and identify the unanswered point in any CFPB complaint.

If the bank says it issued a credit you cannot find

Request the credit’s exact amount, posting date, description and statement period. Compare those details with the ledger rather than relying on a total. A credit may be reflected differently in current-period and year-to-date overdraft totals under Regulation DD, so the line-item record is the decisive check.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A concise checklist for your next action

  • Circle the exact fee and the transaction that triggered it.
  • Classify the transaction before arguing that opt-in was required.
  • Locate the account terms, fee schedule, waiver wording and opt-in record in effect at the time.
  • Save the ledger, statement, messages and any credit entry.
  • Ask the bank, in writing, for its explanation, the evidence it relied on and the refund or correction you seek.
  • Keep the case number and response.
  • Submit a CFPB complaint with the timeline and documents if the bank does not resolve the issue.
  • Check the ledger and statement totals after any promised credit posts.
