Do not ignore a Section 148 communication. First identify whether it is a Section 148A show-cause notice or a Section 148 notice requiring a return, confirm the assessment year and governing law, and note the exact response date. Then gather the records that address the issue and submit a reasoned response through the official e-Proceedings channel, keeping proof of filing.
The correct response depends on the notice wording, service and issue dates, prior assessment history, and facts. The statutory framework also changed for tax years beginning on or after 1 April 2026, so a response that is appropriate for one year may be wrong for another.

What to do in the first 24 hours
- Save the complete communication. Download the notice, every attachment, and any information statement or annexure shown with it. Record the assessment year, issue date, date you received or accessed it, issuing Assessing Officer, Document Identification Number (DIN) or reference number, and the response deadline printed in the notice.
- Identify the legal section. A Section 148A communication is generally a pre-notice show-cause opportunity. A Section 148 notice generally requires you to furnish a return in response to reassessment proceedings. A later order or information request is a different communication and may carry different instructions.
- Check the tax-year transition. Determine whether the year is governed by the Income-tax Act, 1961 or the Income-tax Act, 2025. The Income Tax Department says the 1961 Act continues for earlier tax years and for proceedings already pending when the new law commenced.
- Calendar the deadline from the document. Do not rely on a generic internet date. For an old-Act Section 148 notice, the Department says the return must be filed within the period stated in the notice, subject to a maximum of three months from the end of the month in which the notice was issued.
- Prevent accidental admissions. Do not send a one-line denial, agree to an amount you have not reconciled, or upload an incomplete explanation merely to show activity. A rushed statement can become part of the record.
- Arrange a review. If the amount, limitation question, transaction history, or factual dispute is material, have an Indian chartered accountant or tax lawyer experienced in reassessment examine the notice before submission.
Section 148A and Section 148 are different stages
The two notices are related but require different actions. Confusing them can lead to a missed deadline or the wrong filing.

The Supreme Court judgment dated 3 October 2024 reproduces the Section 148A sequence: where applicable, the Assessing Officer conducts an inquiry with prior approval, gives the taxpayer an opportunity to be heard, considers the reply, and decides by order whether to issue the Section 148 notice. The statutory phrase is “provide an opportunity of being heard to the assessee.” The Act contains exceptions, including specified search-related circumstances, so do not assume every Section 148 notice must have been preceded by a Section 148A show-cause notice.

Confirm which law governs your tax year
The Income Tax Department describes a transition beginning on 1 April 2026:
- The Income-tax Act, 2025 reassessment provisions, including Sections 279 to 286, apply to Tax Year 2026–27 and later tax years.
- Reassessment for earlier tax years remains under the Income-tax Act, 1961.
- Proceedings already pending when the new Act commenced continue under the 1961 Act.
- Transition rules can also keep the old Act relevant to later action concerning an earlier year.
Do not replace “Section 148” with a 2025-Act section number simply because you received a communication in 2026. Read the assessment year, tax year terminology, transitional wording, and section cited in the actual document. If the notice spans several years, analyse each year separately.
How to respond to a Section 148A show-cause notice
Read the alleged escaped income precisely
Identify the income, transaction, information source, and period mentioned. Separate an allegation that a receipt was omitted from a claim that a reported item was classified incorrectly. Note whether the notice relies on a bank entry, property or securities transaction, withholding data, foreign information, survey material, or an earlier assessment record. Your reply should answer the stated issue rather than provide an unrelated history of your finances.
Build a document-to-allegation schedule
Prepare a simple working table for yourself with one row per allegation: amount cited, amount shown in your return or books, explanation for any difference, and supporting document. Typical records may include the filed return and computation, tax-payment challans, withholding certificates, bank statements, invoices, contracts, sale or purchase deeds, loan documents, and prior correspondence. These are preparation examples, not a universal list of documents required in every case.

Reconcile numbers before writing
Use the same financial year, assessment year, currency, and gross-versus-net basis used in the notice. Explain timing differences, jointly held assets, pass-through receipts, cancelled transactions, duplicate reporting, and income already offered under another head when those facts apply. If a figure in the notice is correct but already taxed, show where it appears in the return and how the tax was paid.
Write a reasoned reply
Organise the response under clear headings that mirror the notice. State the fact, cite the attached record, and then explain the tax treatment. If information is unavailable, say what you have requested and when you expect it, rather than inventing a figure. Do not make a concession merely to end the exchange; obtain professional advice where the amount is significant or the facts are disputed.
Submit within the show-cause period
The Section 148A text reproduced by the Supreme Court provides a period of not less than seven and not more than 30 days from issue, unless extended. The particular notice controls. If you need more time, request an extension through the channel specified in the communication before the original period expires, explaining the concrete reason and documents involved. An extension request is not the same as an extension grant, so continue preparing for the original deadline.
How to handle a Section 148 notice requiring a return
Use the notice deadline, not a guessed date
For an old-Act notice, the Department’s Reassessment Proceedings FAQ says the return must be furnished within the period specified in the notice and that the period cannot exceed three months from the end of the month in which the notice was issued. Check whether the notice asks for a return in a particular form, refers to a revised or updated filing mechanism, or asks for supporting particulars separately.

Reconstruct the return from primary records
Start with the return originally filed for that assessment year, if any. Reconcile salary, business or professional receipts, capital gains, interest, dividends, rental income, deductions, losses, tax deducted or collected at source, advance tax, and self-assessment tax to the records for that year. Explain why the reassessment figure differs from the original filing. Keep a copy of the computation used for the response.
Check payment and disclosure consequences
Calculate the tax, interest, and any other amount required under the return and the notice using the rules applicable to that year. A professional should review consequential issues such as loss carry-forwards, set-off, amended disclosures, and whether a payment is required before or after filing. Do not assume that filing the return alone closes the proceeding.
Answer additional information requests separately
If the notice asks for books, statements, confirmations, or a transaction explanation, label each attachment and cross-reference it in the response. Use readable file names and preserve the original files. If a requested record does not exist, explain the reason and provide the closest reliable substitute rather than uploading an unrelated document.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Check limitation, but do not declare the notice invalid on a quick reading
Limitation is a screening issue that may require a year-by-year legal analysis. The Section 149 text reproduced in the 3 October 2024 Supreme Court judgment describes a general rule that a Section 148 notice may not be issued after three years from the end of the relevant assessment year unless statutory extended-period conditions apply.
The same reproduced text describes an extended period of more than three years and up to ten years where the specified evidence condition is met, including escaped income represented in the form of an asset of at least ₹50 lakh. The section also contains provisos and exclusions. The amount, the nature of the asset, the information available to the authority, prior proceedings, and the notice date all matter.

To assess timing responsibly, collect the original return, earlier notices and orders, dates of service, dates of approvals or orders mentioned, and the transaction records. Then ask a qualified professional to apply the version of the law that governed that assessment year and notice. A notice that appears late at first glance may fall within an exception, while a notice that cites a large amount may still fail another statutory condition. The figures above are not, by themselves, a conclusion about validity.

What happens after you submit
Continue checking the portal and the registered email or postal address used for tax communications. The authority may issue an order, request clarification, ask for additional evidence, or proceed on the material already available. The next deadline and any appeal route depend on that later communication and the facts of the case; there is no single follow-up timetable that applies to every Section 148 proceeding.
When a further request arrives, compare it with what you already submitted. Provide a focused response, identify documents previously filed by their acknowledgement or file name, and keep a chronology of every submission and communication. If an order creates a demand or rejects your explanation, obtain advice promptly because separate statutory time limits may begin from service of that order.
Common mistakes that create avoidable risk
- Using the wrong year: uploading records for a different assessment year or applying the post-2026 framework to an earlier proceeding.
- Confusing 148A with 148: sending a show-cause reply when the notice requires a return, or filing a return without answering the information relied on in a show-cause notice.
- Waiting for a paper letter: failing to check the portal or registered communications after an electronic notice is issued.
- Submitting a generic denial: asserting that all income was disclosed without reconciling the specific amount and source cited.
- Missing the actual deadline: calculating from the date you happened to open the notice instead of reading the issue date and period stated.
- Ignoring attachments: uploading a reply but not the bank statement, contract, computation, or other evidence that makes the explanation verifiable.
- Assuming submission can be corrected: the Department says an e-Proceedings response cannot be edited or withdrawn after submission.
- Treating limitation as automatic: relying only on the three-year or ten-year headline without checking provisos, exclusions, transition rules, and the asset condition.
When specialist help is especially important
Professional review is prudent where the notice involves a high-value transaction, several assessment years, search-related information, foreign assets or income, alleged undisclosed investments, complex business records, a possible limitation defence, or a disagreement about whether income was already taxed. It is also useful when the taxpayer has changed address, lost records, merged entities, died, or needs an authorised representative to manage the portal.
