First identify whether you received a section 148A show-cause communication or a section 148 notice requiring a return. They are different stages: a 148A communication asks why reassessment should not proceed, while a 148 notice requires you to furnish a return under the applicable Act. Section 147 generally describes the Assessing Officer’s reassessment power; it is not, by itself, the same thing as a return-filing notice.
Before replying, record the assessment year or tax year, issue and service dates, statutory section, allegations, document identification number, and deadline. The governing law depends on the year involved and on whether proceedings were already pending on 1 April 2026. The Income Tax Department’s official Reassessment Proceedings FAQs provide general procedure, but the validity, limitation, approval and best response for a particular notice require review of the notice and the full chronology.

Start by identifying exactly what communication you received
Do not rely on a letter’s subject line alone. Read every page, including annexures and portal attachments, and find the provision that creates your immediate obligation.
| Communication or reference | What it generally means | What you must determine |
|---|---|---|
| Section 147 (old Act reference) | Describes the Assessing Officer’s power to reassess income believed to have escaped assessment. | Whether the document is actually a section 148A show-cause notice, a section 148 return notice, or another procedural communication. |
| Section 148A (old Act) | Pre-notice show-cause stage. The Department gives an opportunity to respond to information suggesting escaped income before deciding whether reassessment is a fit case, subject to legal exceptions. | The allegations, relied-on information, response method and deadline stated in the communication. |
| Section 148 (old Act) | Notice requiring a return in response to proposed reassessment. | The return deadline stated in the notice, the relevant assessment year and the documents needed to reconcile the information cited. |
| Sections 281 and 280 (Income-tax Act, 2025 process) | The Department describes these as the corresponding general reassessment process under the new Act: information, show-cause opportunity, consideration of the response, a reasoned order and a notice where reassessment is considered fit. | The tax year, the exact provision quoted and the action requested by the new-Act communication. |
If a communication casually refers to “section 147 notice,” check the operative section and the requested action. A reference to section 147 does not automatically mean that a return must be filed immediately.

What should I do after receiving an income tax notice under section 148?
A section 148 notice in the old-Act framework calls for a return. Work through these steps in order.
- Save the complete notice. Download the PDF and every annexure from the e-filing portal, preserve the email or SMS alert, and keep the physical envelope or delivery record if one was used. Record the document identification number, issue date, service date and the assessment year.
- Read the deadline exactly as written. The official FAQ says the response period is the time specified in the notice, subject to a maximum of three months from the end of the month in which the section 148 notice was issued. The date of issue and the date you received it may differ, so keep both dates and do not calculate from memory.
- Confirm the year and governing Act. A return for an old-Act notice must follow the old Act’s framework, including where the response is furnished after 1 April 2026. The transition rules below determine whether the 1961 Act or the Income-tax Act, 2025 applies.
- Reconcile the allegation with your records. Compare the information in the notice with the return and computation for that year, tax-payment records, bank statements, investment and property documents, invoices, salary or business records, and earlier correspondence. Gather only documents relevant to the information identified, but keep the underlying records available.
- Prepare the return required by the notice. Use the applicable return form and reporting framework for the relevant year. Check income, deductions, losses, taxes paid, interest and any revised figures against your source documents before submission.
- Submit through the Department’s e-filing services. Follow the notice’s filing instructions, complete any verification or authentication step, and download the submitted return, acknowledgement number and proof of successful filing.
- Make a response file. Keep the notice, return, acknowledgement, payment challans, attachments, portal messages and a dated chronology together. If the portal shows a separate response option, save the submission confirmation as well.
- Obtain advice if the exposure or legal issue is material. A professional should review the notice and chronology where the amount is substantial, the alleged income is disputed, the year appears close to a limitation boundary, or the notice raises approval, jurisdiction or procedural questions.
How do I reply to a section 148A notice?
A section 148A communication is a show-cause stage, not the later section 148 return notice. Its deadline is the one printed in that communication; the separate three-month cap described for a section 148 return notice should not be substituted for it.
- Map every allegation. Make a list of each transaction, information item, account, document or mismatch mentioned. Number your reply so the officer can match each answer to the corresponding allegation.
- State the factual position first. Explain what the item is, when it occurred, how it was reported and where it appears in the return or books. If the information relates to another person, account or year, identify that distinction clearly.
- Attach supporting evidence. Use readable statements, invoices, contracts, confirmations, ledgers, withholding certificates, tax-payment records and correspondence that directly address the cited information. Label each attachment and refer to it in the numbered answer.
- Explain corrections where needed. If the original return contains an omission or error, quantify the difference and explain the proposed treatment. Do not make an unsupported admission merely to close the communication.
- Preserve legal objections separately. If you believe the notice has a limitation, approval, jurisdiction or procedural defect, state the objection with the relevant dates and documents. Whether that objection succeeds is case-specific and cannot be decided from the heading alone.
- File before the stated deadline. Submit the response using the Department’s designated portal service or the method specified in the communication. Save the final response, attachments and acknowledgement.
- Watch for the next order or notice. The old-Act process contemplates consideration of the reply and an order deciding whether the case is fit for reassessment before a section 148 notice is issued, subject to exceptions in the law. A response to 148A does not itself replace a later return if a section 148 notice follows.
How many days do I have to respond to a section 148 notice?
There is no single number of days printed in the statute summary that you can safely apply to every case. For an old-Act section 148 notice, the Income Tax Department FAQ states that you must file within the time specified in the notice, and that period cannot exceed three months from the end of the month in which the notice was issued. For example, a notice issued on 10 July has a stated outer limit measured from 31 July, not three calendar months from the day you happened to open the email. The notice’s own deadline controls within that cap.

Does the old Income-tax Act still apply to my reassessment after 1 April 2026?
The transition is based on the tax year and procedural status, not simply on the date you receive a message.
| Situation | Governing framework described by the Department | Practical implication |
|---|---|---|
| Tax year 2026–27 or later | Reassessment provisions of the Income-tax Act, 2025. | Read the notice under the new-Act provisions and follow the section and portal process stated there. |
| Tax year beginning before 1 April 2026 | Income-tax Act, 1961 provisions continue to apply. | Earlier-year reassessment is not automatically converted to the new Act merely because action occurs after 1 April 2026. |
| Old-Act reassessment proceedings already pending on 1 April 2026 | Continue under the Income-tax Act, 1961. | Keep using the old-Act procedural history when responding to later orders or notices. |
| New old-Act proceedings concerning an earlier year after 1 April 2026 | May continue under the old Act, subject to the old Act’s limitation rules. | Check the chronology and limitation provisions rather than assuming the new Act applies. |
The Department’s FAQ also states that a return furnished after 1 April 2026 in response to an old-Act section 148 notice must still be furnished under the old Act’s framework. Keep the assessment year, issue date, service date and any earlier show-cause or order dates together so the applicable regime can be identified from the record.

Build a document pack that answers the notice
The Department’s general procedural guidance does not prescribe one universal document list. In practice, a focused pack helps you answer the information actually cited:

What can make a notice legally contestable?
Receiving a notice does not establish that reassessment is valid, and the notice title alone does not establish that it is defective. A proper review may need to examine:

Ignoring the assessment year
A message received in 2026 may concern an earlier year governed by the 1961 Act. Confirm the year before choosing a form, legal framework or response path.
Submitting a narrative without evidence
A bare denial may not answer transaction-level information. Tie each factual statement to a numbered, legible attachment.
Relying on an email alert as the filing record
Portal delivery alerts are not a substitute for the submitted response or return acknowledgement. Download the final acknowledgement and retain the complete submission.
Waiting until the last day to investigate
Bank records, historical returns and third-party confirmations can take time to obtain. Start the reconciliation immediately and seek advice early if a deadline is close.
When to obtain professional help
Prompt tax advice is especially important where the notice alleges a large or complex amount, concerns several years, involves property or undisclosed investments, follows an earlier assessment or appeal, or arrives near a limitation date. It is also prudent where the communication appears to lack an approval, reasoned order or required opportunity, or where the information belongs to another taxpayer or year.
Give the adviser the complete notice and annexures, proof of service, prior returns and orders, portal history, your chronology and the source documents for each disputed item. Ask for two separate outputs: the immediate procedural action and the merits or legal challenge. That separation helps prevent a limitation argument from causing you to miss a return deadline, or a hurried return from waiving a factual explanation that the notice requires.
