What to Do After Receiving a Mortgage Foreclosure Sale Notice

Act immediately, but do not assume the date on the notice is your move-out date. Read and preserve every page, verify the sale with the named court or trustee, call your mortgage servicer, and obtain a HUD-approved housing counselor and local legal help. The notice and the law of your state and county control the deadlines, cure amount, postponement rules, redemption rights, and possession timetable.

The steps below help you organize a response in any U.S. jurisdiction. They cannot replace review of the actual notice by a local attorney or counselor, especially when the sale is close.

What to do in the first 24 hours

1. Preserve the complete notice

Make a scan or photocopy of every page, including the envelope, attachments, exhibits, and any earlier default or acceleration letters. Write down:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • the scheduled sale date and time;
  • the property address and legal description;
  • every response, cure, objection, or reinstatement deadline;
  • the court, sheriff, public trustee, foreclosure attorney, or other official named;
  • the mortgage servicer, lender, trustee, and their mailing addresses and phone numbers;
  • instructions for filing an answer, objection, payment, or request for postponement; and
  • any stated payoff, reinstatement, or other amount.

Keep the original in a secure file. HUD advises borrowers to open and respond to lender mail because later notices can contain information about legal action. Do not rely on a text message, voicemail, or a page missing from the mailing.

2. Verify that the sale is still scheduled

Use contact information independently verified through the court or the servicer’s official records, not only a number printed in an unexpected letter. Ask the named court, trustee, or servicer:

  • Is the sale date and location still active?
  • What exact amount and payment method would reinstate the loan, and through what date is that quote valid?
  • What documents or court filings are required to challenge, cure, or postpone the sale?
  • Has any postponement, bankruptcy stay, loss-mitigation review, or other hold actually been entered?

Request written confirmation of every change. A pending assistance application or a favorable phone conversation does not by itself remove a sale from the calendar.

3. Call the mortgage servicer

Call as soon as possible and explain whether the hardship is temporary or lasting. Be prepared to discuss household income, expenses, assets, the reason payments became difficult, and what payment you could realistically make. Ask for a mortgage-assistance or loss-mitigation application and request:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • the current delinquency, fees, escrow advances, and reinstatement figure;
  • the name and direct contact details of the person or team handling the file;
  • a list of every document still missing;
  • the deadline to submit a complete application and the deadline to accept any offer; and
  • whether the sale remains scheduled while the application is reviewed.

Keep a call log with the date, time, representative, reference number, promises made, and documents sent. Send important material through a trackable method and retain proof of delivery.

4. Get free housing counseling

CFPB and HUD direct borrowers to HUD-approved housing counselors for help understanding options and communicating with the mortgage company. CFPB identifies foreclosure-prevention counseling as free; HUD’s counselor line is 800-569-4287. A counselor can help assemble a complete package, but cannot guarantee approval or a postponed sale.

5. Obtain local legal advice

If you were served with a lawsuit, received a judgment or order of sale, or have little time before the auction, contact a local legal-aid office or foreclosure attorney immediately. Ask for review of the actual notice, court docket, service of process, payment history, and state-specific defenses. Tell the lawyer the exact sale date and every deadline; waiting for a routine callback can consume the time available for an objection or emergency motion.

What a sale notice means—and what it does not

A foreclosure sale notice announces a scheduled public sale under a state-specific judicial or nonjudicial process. It is a serious escalation, not proof that you must leave that day. HUD describes the sheriff’s or public trustee’s sale as the foreclosure sale date and notes that a state may provide a post-sale redemption period. CFPB explains that both the time from the first notice to sale and the time to leave after sale vary by state.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

As general federal background, CFPB says the legal foreclosure process generally cannot start until the borrower is more than 120 days delinquent, subject to exceptions. That rule does not give someone who already has a sale notice a guaranteed 120-day extension. The loan type, prior loss-mitigation activity, court status, notice language, and local law determine what can still be done.

Event What it tells you Action
Notice of sale An auction has been scheduled under the stated procedure. Record every date, verify the calendar, and obtain local review.
Reinstatement or cure deadline The notice may identify a date and amount needed to stop the process under its terms. Get a written, account-specific quote; ask whether funds must clear by the deadline.
Scheduled auction The property may be sold unless the sale is stopped, postponed, or otherwise resolved. Do not assume an application, dispute, or phone call cancels it; confirm in writing.
After the sale Ownership and possession consequences depend on state law and the sale result. Ask about redemption, deed recording, notice to vacate, and eviction procedure.

Assemble a response file

Create one paper and digital folder. Include the notice and envelope, the promissory note and mortgage or deed of trust if available, payment records, bank statements, tax and insurance information, hardship evidence, all servicer correspondence, and your call log. Prepare a short factual timeline: when income changed, when payments were missed, when you contacted the servicer, what you submitted, and what response you received.

Use a cover sheet listing the property address, loan number, sale date, preferred phone and email, household income, and the documents enclosed. Label each file clearly and keep a duplicate outside the home. Never send irreplaceable originals unless a lawyer or court specifically requires them.

Ask about every loss-mitigation option

Loss mitigation is a set of possible ways to avoid or resolve foreclosure. Availability depends on the loan, investor, servicer, eligibility rules, and your circumstances. Ask the servicer and counselor to compare the alternatives in writing rather than selecting one based on a generic promise.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Option May fit when Key questions and consequences
Forbearance The hardship is temporary and you expect income to recover. When are missed payments due: lump sum, repayment plan, or modification? Does the sale remain scheduled? Interest and fees may continue.
Repayment plan You can resume the regular payment and add an affordable amount for arrears. What is the new monthly payment, duration, and default consequence? Obtain the agreement before relying on it.
Loan modification The current payment is unaffordable for the long term but the home is otherwise sustainable. What rate, term, principal, escrow, and arrears treatment are proposed? A trial plan is not necessarily a final approval.
Short sale You cannot keep the home and a market sale could avoid foreclosure. Who approves the sale and how is any remaining debt handled? Get written terms on deficiency liability and the sale deadline.
Deed in lieu of foreclosure You want to transfer the home voluntarily and avoid an auction. Will the servicer waive remaining debt, and what liens or tax effects remain? Do not sign a deed without legal advice.

These choices differ in whether you keep the home, how arrears are treated, what payment is required, how quickly documents must be submitted, and what happens to ownership or remaining debt. No option is automatically available or best.

Understand the 37-day, 30-day, and 90-day rules

CFPB guidance describes protections tied to the timing and completeness of a loss-mitigation application:

  • If the servicer receives a complete application more than 37 days before the scheduled sale, it generally must evaluate it and provide a written response within 30 days.
  • If the application arrives within 37 days of the sale, that particular review rule does not necessarily apply, although other mortgage-specific rules may.
  • A complete application received at least 90 days before a scheduled sale may provide an appeal right after a loan-modification denial, if the applicable requirements are met.

These numbers are procedural protections, not a promise of approval, a guaranteed postponement, or time remaining before the auction. Ask the servicer to identify in writing whether it considers your package complete and whether the sale is being held.

If you believe the servicer made an error

Potential issues include payments misapplied, an incorrect delinquency amount, failure to credit a completed application, or foreclosure activity that conflicts with an agreement. CFPB allows a borrower to send a notice of error or request for information through the address designated by the servicer. A notice alleging an error in starting foreclosure, seeking a judgment or order of sale, or conducting a sale generally must be answered before the sale.

This is a technical step with strict mailing and content requirements. Have a lawyer or HUD-approved counselor review the draft and do not treat it as a substitute for meeting the notice’s response deadline. Keep a complete copy and proof of delivery.

Plan for the possibility that the sale proceeds

Ask a local lawyer or counselor what happens after the auction in your county. Depending on state law, the buyer or successful bidder may need to record the deed, send a notice to vacate, or file an eviction case. A redemption period may exist, but its length, eligibility, payment requirement, and effect on possession vary widely. The sale date alone does not answer when you must move.

If keeping the home becomes unlikely, make a contingency plan without abandoning your legal rights:

  • Ask about a written move-out agreement, relocation assistance, or time to remove belongings.
  • Locate affordable housing, storage, transportation, and school or work alternatives.
  • Protect personal records, medication, identification, pets, and irreplaceable items.
  • Continue monitoring mail and the court docket; do not ignore a notice to vacate or eviction complaint.
  • Do not remove fixtures, damage the property, or sign a deed or surrender agreement without advice.

Avoid foreclosure-rescue scams

People facing a sale are frequently targeted by companies demanding large advance fees, promising a guaranteed modification, or telling you to stop communicating with the servicer. Free help is available through the servicer and HUD-approved counselors. Do not pay a rescue firm, sign over title, redirect payments, or sign legal papers you do not understand.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

You may submit a complaint to CFPB to seek a company response, but CFPB states that “Submitting a complaint won’t automatically stop or delay foreclosure.” A complaint is not a substitute for a court response, reinstatement payment, loss-mitigation application, or emergency legal motion.

Use this call script

When you reach the servicer, say: “I received a foreclosure sale notice for [property address]. The scheduled sale is [date and time]. Please tell me the current reinstatement amount, whether the sale is still scheduled, what loss-mitigation options I may qualify for, and exactly what documents are missing. Please send all decisions and any postponement in writing.”

Then ask for the designated address for applications and error notices, the deadline for a complete package, the investor or owner of the loan, and a case reference number. Repeat the sale date on every call.

Match the response to your situation

Temporary income interruption

Prioritize forbearance or a repayment arrangement, but obtain the post-forbearance payment and sale status in writing. Submit evidence of the expected income recovery.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Permanent payment problem

Request a modification analysis and compare the proposed payment with a realistic budget. If the home is not affordable even after assistance, discuss a short sale or deed in lieu before the auction.

Disputed balance or servicing history

Collect bank records and correspondence, send a carefully reviewed notice of error or information request, and involve counsel immediately because a dispute does not automatically stop the sale.

Sale within days

Call the servicer, the named trustee or court, a HUD-approved counselor, and a local attorney the same day. Ask about an emergency motion, reinstatement funds, bankruptcy advice if appropriate, and any written postponement procedure. Do not rely on an unrecorded promise.

Critical facts to remember

  • The notice controls the immediate dates; state and county law controls the process around them.
  • Call the servicer and ask for account-specific figures and options now.
  • HUD-approved counseling is available at 800-569-4287 and is described by CFPB as free.
  • A complete application can trigger procedural review protections, but timing and completeness matter.
  • A sale date is not automatically a move-out date.
  • Local legal advice is especially important after service of court papers or when the sale is imminent.
