If you find that a rental car has been struck and the other driver is gone, treat it as both a police report and an insurance claim. Get safe, photograph the car and location, report the hit-and-run to local police, notify the rental company, then contact your auto insurer and any credit-card benefit administrator. Keep every document and do not assume the rental-company waiver, your policy or a card benefit automatically eliminates your responsibility.
First, make the scene safe
Check whether anyone is injured and whether the damaged vehicle creates an immediate traffic hazard. Call emergency services when there is an injury, danger, or a need for urgent assistance. If no one needs medical help, move to a safe place when appropriate. North Carolina insurance guidance advises stopping safely, moving the car if necessary to prevent additional damage or an obstruction, and calling police, particularly for a hit-and-run.

Do not drive a car that is unsafe. A hanging bumper, leaking fluid, damaged lights, a compromised tire, or a door that will not close can create a second loss. Ask the rental company whether it wants the vehicle towed, inspected where it sits, or exchanged before you continue your trip.
Document what you found before the evidence changes
Take clear photographs before washing, moving, or repairing anything. Capture the entire vehicle, each damaged area from several angles, the parking space or roadway, nearby signs, debris, paint transfer, and any visible security cameras. Include wide shots that show where the car was parked and close shots that show the condition of the damage.

- Write down the date, approximate time, and exact place you discovered the damage.
- Record the rental vehicle’s make, model, license plate and agreement number.
- Ask witnesses for their names and contact details, and note businesses or buildings that may have camera footage.
- Keep any note left on the vehicle, tow notice, parking receipt, or other physical evidence.
California Department of Insurance guidance recommends photographing vehicle damage and the accident scene when possible. A photograph documents condition and location; it does not by itself prove who caused the collision. Avoid guessing about the other vehicle, speed, or direction. Give police and the rental company only what you actually observed.
Report the hit-and-run to police promptly
Contact the local police department or the appropriate non-emergency reporting channel and ask how to make a hit-and-run report. The correct process can differ by city and by whether the incident occurred on a public street, in a private lot, or on other property. Request an incident number and ask how to obtain a copy of the report or a report confirmation.
There is no single nationwide deadline established by the state guidance commonly cited for these claims. California says most insurance policies require police notification within a specified period for a hit-and-run claim. Illinois advises reporting a hit-and-run loss to police immediately and warns that an insurer could deny a claim without a police report. Your policy and local rules control, so report as soon as you discover the damage rather than waiting until the rental return date.
Give the officer the location, discovery time, photographs, witness information, possible camera locations and the rental-company details. Ask whether you should leave the car in place for an inspection. If police cannot send an officer, follow their instructions for an online or station report and save the submission confirmation.

Notify the rental company before returning or repairing the vehicle
Use the accident or claims number in your rental agreement, app, or rental paperwork. Tell the representative that the damage was discovered after an apparent hit-and-run and that the other driver is unknown. Ask for the company’s incident form and written instructions on the next step.
Questions to ask the rental company
- Does the car need an immediate inspection, tow, or replacement?
- May you continue driving it, and if so, under what conditions?
- Where should you return or exchange it?
- What photographs, police information, statements, or forms are required?
- What is the deadline for reporting under this rental agreement?
- Will the company place a hold, estimated charge, deductible, or other amount on your account while it investigates?
Rental companies use different procedures. Progressive notes that companies commonly require a company-specific accident reporting form and recommends promptly contacting both the rental company and the insurer. Avis’s FAQ says a renter does not need to wait for the company’s claim documents before notifying personal insurance or a card company. That illustrates why you should report through every applicable channel instead of waiting for one company to contact another.
Do not attempt a repair, authorize a body shop, or discard damaged parts without the rental company’s permission. The company owns the vehicle and must coordinate inspection and repairs.

Notify your personal auto insurer and any credit-card benefit administrator that could cover the rental. Describe the exact trip, rental location, vehicle, driver, damage, date discovered, police report number and waiver selected. Ask for a claim number and a list of required documents. Coverage depends on the wording of each contract, so obtain a written explanation rather than relying on a general statement that “rental cars are covered.”

How the main coverage routes differ

These routes are not interchangeable. A collision or loss damage waiver is a provision in the rental contract; it is not the same as making another driver’s liability insurer pay. Utah Insurance Department guidance recommends reviewing your auto policy and checking card benefits. Wisconsin consumer guidance cautions that a rental-company waiver can duplicate protection you already hold, while its terms may still differ in important ways.
California’s consumer guide frames the issue this way: “What is a collision damage waiver and will the insurance company pay these charges for the rental vehicle?” The answer is contract-specific. Read the waiver, policy and card certificate together, including definitions and exclusions.
What to ask about charges beyond visible repairs
A rental company may assess more than the body-shop invoice. Ask whether a proposed amount includes a repair estimate, administrative fee, towing or storage, diminished value, loss of use, a deductible, or taxes. None of these categories is automatically covered or automatically collectible in every contract.

Do not concede fault simply because you rented the vehicle. At the same time, do not assume that an unknown driver means you owe nothing. Your liability depends on the rental agreement, any waiver you accepted, your insurance policy, card terms, facts about the vehicle’s use, and local law.

Create one folder, physical or digital, for the entire incident. Keep the originals rather than only screenshots or edited images.
- Rental agreement, extensions and the page showing whether a waiver was accepted or declined.
- Photographs and a contemporaneous written description of the scene and damage.
- Police incident number, report, online submission confirmation and officer contact information.
- Rental-company incident form, emails, call notes, inspection records and exchange or tow instructions.
- Insurance and card-benefit claim numbers, adjuster names, correspondence and submission receipts.
- Every estimate, invoice, charge notice and payment record.
When speaking by phone, record the date, time, representative’s name and a concise summary of what was said. Follow important calls with an email confirming the instructions. Preserve the vehicle from further damage and cooperate with a requested inspection. Illinois Department of Insurance guidance advises showing the damaged vehicle to the insurer before repair, protecting it from additional damage and cooperating with the investigation. Coordinate that inspection through the rental company because it controls the vehicle.

The state-agency materials used for this guidance come from California, Illinois, North Carolina, Utah and Wisconsin. They describe practical insurance steps in the United States, not one national rule and not advice for another country. Your police agency, rental agreement, insurer and card administrator may impose different deadlines.

California materials also discuss a $750 threshold and a 10-day DMV reporting statement for certain accidents. Those are California-specific DMV rules and should not be treated as a universal deadline for reporting a hit-and-run to police or making an insurance claim. Ask the local police agency and read your policy for the requirements that apply to your incident.
If the rental company charges you before coverage is decided
A temporary authorization or estimated charge is not necessarily the final amount. Ask whether the transaction is a deposit, authorization, deductible, or completed charge, and request the company’s claim contact. Notify your insurer and card administrator immediately, even if the rental company says its investigation is still open.
If you dispute an amount, do so in writing with the itemized statement and evidence supporting your position. Keep paying any undisputed amount required by the rental agreement while the coverage question is reviewed. Do not ignore a demand letter, collections notice or court filing; contact the relevant insurer, benefit administrator or a qualified local attorney about the response deadline.

A compact checklist
- Get people and traffic out of danger; call emergency services for injuries or urgent hazards.

- Report the hit-and-run through the local police channel and obtain an incident number.

- Save the agreement, waiver selection, photographs, police records, forms, correspondence and charge notices.
- Request an itemized explanation of every charge and send it with the claim file to the appropriate coverage providers.
Following this sequence creates the evidence and notifications that the contracts and claims handlers will need, while avoiding unauthorized repairs or unsupported assumptions about who ultimately pays.
