Read a home equity investment (HEI) contract as a long-term, property-secured obligation—not as free cash. You receive money now and generally owe one large settlement later, based on a contract-specific formula tied to your home’s value. Before signing, verify the formula, valuation rules, payment triggers, fees, property duties, default remedies, lien documents and realistic payoff plan. Have an independent attorney familiar with your state review the documents if any term is unclear.
Understand what you are agreeing to
HEIs are also marketed as home equity agreements, shared-equity agreements or shared-appreciation arrangements. The usual structure is an upfront payment in exchange for a future lump-sum settlement linked to the property’s value. The Consumer Financial Protection Bureau (CFPB) explains that “The homeowner must typically repay the home equity contract company with a single large payment, often called the ‘repayment amount’ or ‘settlement amount.’” Read the complete CFPB market overview at consumerfinance.gov.

“No monthly payment” describes only the usual payment schedule. It does not eliminate the eventual settlement, fees, mortgage payments, taxes, insurance, maintenance or other obligations. Your signed agreement, rather than a sales presentation or online calculator, controls what you owe.
1. Check the exact payment formula
Ask the provider to calculate your settlement using the definitions and numbers in your proposed contract. Do not rely on a generic example: providers use different methodologies, and small changes in definitions can materially change the payoff.

| Contract item | What to locate | Why it matters |
|---|---|---|
| Initial advance | Gross amount approved and net amount you actually receive | Fees may be deducted before funds reach you. |
| Starting value | Property value at origination and the valuation method | The baseline drives the later gain or loss calculation. |
| Provider share | Percentage of total value, appreciation, or another defined amount | A share of total value can produce a larger payoff than a share of appreciation. |
| Multiplier or adjustment | Any factor applied to appreciation, depreciation or the advance | A multiplier can increase the provider’s claim faster than the home’s raw gain. |
| Caps, floors and minimums | Maximum, minimum or guaranteed repayment provisions | These can apply even when the property changes little or loses value. |
| Discounts and credits | Origination discount, market adjustment and improvement credit rules | They may reduce or increase the amount used in the settlement formula. |
Request written examples for at least four outcomes: a flat home value, substantial appreciation, a decline in value and an early payoff. Each example should show the starting value, ending value, advance, provider share, multiplier, cap or floor, every fee and the final amount due. Have the provider identify which numbers are contractual and which are merely illustrative.
2. Establish how the home’s value is set
At the beginning
Find out whether the starting value comes from an independent appraisal, an automated valuation model, an inspection or another method. Check the valuation date, assumptions, permitted comparable sales and who selects and pays the appraiser. Ask whether you receive the report and can challenge errors before the agreement is finalized.
At settlement
Determine whether the ending value is the actual sale price, an appraisal, an automated estimate or a contract-specific figure. Read the rules for a sale below market value, a distressed sale, a sale to a relative, a transfer without a conventional sale, refinancing without a sale and a disagreement over value. Some providers may dispute a sale-based value; the contract should state the evidence, deadlines and decision-maker for resolving that dispute. The CFPB discusses these valuation differences in its market overview.

Ask how documented renovations, additions and other value-increasing work are treated. Identify the records required—such as permits, invoices, photographs or contractor statements—and the deadline for submitting them. Clarify whether the improvement value is excluded before the provider’s share is calculated. Also ask how uninsured damage, deferred maintenance or a major casualty affects the valuation and settlement.

3. Identify every payment trigger and the final deadline
Make a list of every event that can make the settlement due. Depending on the document, triggers may include:
- Sale of the home.
- Refinancing or borrowing secured by the property.
- Transfer of title or a change in ownership.
- Death of a homeowner.
- Moving out or changing the permitted occupancy.
- Failure to perform a contractual duty.
- The scheduled end of the contract term.
Record the exact maturity date, notice requirements, cure periods, extension rights and hardship provisions. The CFPB says typical market terms described in its overview can run 10 to 30 years, but that range is not your deadline; only the signed agreement controls.
Early payoff
Confirm whether you may buy out the provider before a sale or maturity date. Ask how the buyout is calculated, whether a fresh appraisal is required, who pays for it, how long the quote remains valid and whether a settlement or administrative fee is added. Obtain the procedure in writing, including required notices and the documents needed to release the lien.
Plan for the lump sum
Write down the source of the future payoff: sale proceeds, savings, refinancing or another asset. Stress-test that plan if home prices fall, interest rates rise, your income changes or a lender declines a refinance. A future refinance or sale may not be available on acceptable terms, so an HEI is risky when the only repayment strategy is an unconfirmed loan approval.

4. Add up fees and calculate the cash you really receive
Request an itemized closing statement before signing. Separate costs deducted from the advance from costs you pay separately and costs charged at settlement.
- Processing or origination fee.
- Appraisal and inspection charges.
- Recording, transfer-tax and title charges.
- Legal, escrow or other closing costs.
- Future settlement, valuation or administrative fees.
The CFPB’s 2025 market overview reports that processing fees are often 3–5% of the initial payment. That is a reported market pattern, not a guaranteed fee for your offer. Calculate net cash received by subtracting every upfront deduction from the stated advance. A $50,000 advance, for example, is not $50,000 available for your use if fees are withheld.
Read the sale-cost language carefully. The provider’s share may be calculated from a gross sale price while you remain responsible for commissions, transfer taxes, repairs, liens and other selling expenses. Ask for a written cash-to-close and net-proceeds example showing both the provider’s settlement and your remaining proceeds.

Ask whether failure to maintain the property can reduce its credited value, increase the settlement or constitute default. Confirm who may inspect the home, how much notice is required and whether you must obtain consent for a lease, renovation or additional borrowing.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.6. Understand default, lien and foreclosure risk
Read the definitions section and the remedies section together. Identify what constitutes default, the notice method, the length of the cure period, whether the amount can accelerate and what happens if you cannot pay by maturity. Ask specifically whether the provider can enforce a lien, require a sale or pursue foreclosure.
California’s Department of Financial Protection and Innovation (DFPI) says an HEI creates a legal claim or lien against the home and warns that failure to comply with the terms or repay in full and on time could lead to foreclosure. That is California consumer guidance, not a universal statement of every state’s procedure; residents elsewhere should check local law and their own documents. See the California DFPI guide and its consumer alert.

7. Read every document and check lien priority
Obtain complete copies before signing, including:
- The HEI, option or shared-equity agreement.
- Any mortgage, deed of trust, lien or security instrument to be recorded.
- Required disclosures and acknowledgments.
- Side letters, servicing terms and payoff instructions.
- Forms governing appraisals, inspections, transfers and releases.
Confirm what will be recorded in land records, its lien priority, whether your existing mortgage lender must consent and what restrictions apply to future borrowing or title transfers. Ask for the exact release process after settlement: who files the release, who pays recording charges and how long confirmation takes.
Regulation Z, 12 CFR §1026.40, contains disclosure and other provisions for home equity plans. Whether it applies to a particular HEI depends on that product’s legal structure and facts; do not assume every agreement called an investment is covered. Review the current regulation text at consumerfinance.gov and ask a qualified professional how it applies to your transaction.
8. Compare the offer with realistic alternatives
Compare the same cash need—not just the advertised payment—with options available to you. Include net funds, all fees, repayment under several home-price outcomes, monthly-payment burden, rate or appreciation exposure, maturity, sale triggers and lien consequences.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errors| Option | Key exposure to compare | Questions to ask |
|---|---|---|
| HEI | Future value-linked lump sum and property duties | What is the settlement in flat, rising and falling markets? |
| HELOC | Variable interest rate, monthly payments and possible payment changes | What is the draw period, repayment period and rate ceiling? |
| Home equity loan | Fixed or stated-rate payments and foreclosure risk if unpaid | What is the total repayment and monthly payment? |
| Cash-out refinance | New mortgage rate, term, closing costs and loss of an existing favorable loan | How does the new payment and lifetime interest compare? |
| Reverse mortgage, if eligible | Age and occupancy rules, fees, insurance and eventual repayment | What happens when the last borrower moves or dies? |
| Delay, downsize or another funding source | Less immediate cash or a different transaction cost | Can the need be reduced or funded without a property claim? |
The CFPB identifies these as comparison products but does not name one universally best choice. Compare written offers with an independent local attorney or qualified housing counselor when the stakes are significant.
9. Send these questions before you sign
- Show the payoff formula with flat, rising and falling home values, including every cap, multiplier, discount, floor and fee.
- Which events require settlement, what is the maturity date and what exact steps permit early payoff?
- How are the starting and final values established, who selects the appraiser and how can I challenge a valuation?
- How are documented renovations treated, and what happens in a distressed sale or transfer without a conventional sale?
- Which costs reduce my upfront cash, which are due later and who pays selling costs?
- What maintenance, tax, insurance, mortgage, occupancy, rental and transfer duties apply?
- What is default, what notice and cure period will I receive and what lien-enforcement remedies are reserved?
- What documents will be recorded and when will the lien be released after settlement?
Keep the answers with the final contract. If an answer is verbal, ask for a contract amendment or written clarification before signing.
