A sales label is not enough: rights depend on the country, the contract category and how the sale took place.
Use the agreement, its incorporated booking rules, fee schedules and every written sales promise as your evidence. Take the paperwork away for independent review. The Federal Trade Commission’s plain advice is: “Take your time.”

1. Identify exactly what you are buying
Ask the seller to describe the product in contractual terms, not only with a brand name such as “holiday club” or “exclusive membership.” A conventional timeshare may grant use of a particular property for a fixed or floating week. A points membership may provide an annual points allowance that can be exchanged for accommodation. Another product may offer only discounts or access to a booking platform. Those arrangements can have very different protections, costs and exit rights.

Find the clause that says what you receive and record:

- the membership or ownership term and its start date;
- whether the benefit is a fixed week, floating week, points balance, accommodation access, exchange right or discount;
- the properties, destinations, room categories and seasons covered;
- whether use is guaranteed, subject to availability, or merely eligible for a booking request;
- whether the right is personal, transferable, inheritable or limited to named users; and
- which booking rules, resort rules, fee schedules and privacy or arbitration terms are incorporated by reference.
EU rules cover specified timeshare contracts, long-term holiday products, and associated resale and exchange contracts. The official summary of Directive 2008/122/EC is available from EUR-Lex. Whether a particular membership falls within those rules depends on the contract and the circumstances of the sale.
Separate contractual rights from sales talk
Circle every promise about guaranteed availability, a particular destination, resale value, rental income, upgrades, “free” travel or future fee levels. Ask for each promise to appear in the agreement or in a dated, signed attachment that the contract says forms part of the deal. If a promise is only verbal, treat it as unproven.
2. Calculate the complete cost, not just the joining price
Make a cash-flow list for the entire period you expect to keep the membership. The Federal Trade Commission advises adding the initial payment, recurring fees, taxes, travel and yearly charges, then checking exchange fees and point requirements in its guidance on timeshares, vacation clubs and related scams.

- Initial purchase price, deposit and finance interest.
- Membership, maintenance or club fees.
- Local taxes, resort charges and booking fees.
- Exchange, guest, name-change and cancellation charges.
- Required travel, transfers, meals or other costs that the sales presentation excluded.
- Upgrade charges for larger units, peak seasons or better locations.
Then repeat the calculation for later years. Ask whether each recurring fee can rise, how an increase is calculated and whether the contract sets a cap or requires notice. FTC guidance warns that maintenance fees can increase and may remain payable even when the timeshare is not used.
Stress-test affordability
Calculate the cost if you use fewer nights than planned, travel in a cheaper season, pay an exchange charge, or cannot travel for a year. A membership is not affordable merely because the initial instalment fits your budget. Include financing interest and any penalty for late payment, default or missed annual fees.

3. Test whether the promised holidays are actually bookable
Availability is often the practical difference between a valuable membership and an expensive obligation. Do not rely on photographs, a sample itinerary or a salesperson’s statement that “everything is available.” Use the written booking rules and ask for current examples.
For points systems
Request the points chart and calculate the points required for the trips you would realistically take. Check each combination of:

- trip length and check-in day;
- unit size and occupancy;
- destination or property;
- season, school holiday and public-holiday dates; and
- booking window and release time.
Ask whether points expire, roll over, can be borrowed or transferred, and what happens when a reservation is cancelled. Confirm the exchange charge, guest fee and price of an upgrade in the same written schedule. A large annual points allowance may not secure the dates or unit type you want if peak-period requirements are higher.
For weeks or fixed accommodation
Check whether the week is fixed to a named unit and date or floats within a season. Identify blackout dates, minimum stays, check-in restrictions and the process for requesting a different resort. “Access to hundreds of destinations” can mean only that you may submit an exchange request, with no guarantee that a specific destination or date will be available.
Verify the evidence
Ask the seller to show the booking calendar or written availability terms for a representative trip. Save screenshots or a dated written response, but understand that the signed rules control if they conflict with marketing material. The FTC specifically recommends examining point requirements and added exchange charges before committing.

4. Understand the commitment and the exit route
Locate the dates and renewal mechanics
Find the contract’s start and end dates, automatic-renewal clause, notice period and address for giving notice. Check whether the term continues after the last payment, whether renewal creates a new minimum term, and whether fees continue while an exit request is pending.
Read default and transfer clauses
Determine what happens if you miss a payment: interest, collection costs, suspension of booking rights, loss of points, termination or damage to your credit record may be specified. Check whether you can transfer the membership to another person, what approval is required and who pays the transfer fee. A right to nominate a guest is not necessarily a right to transfer the contract.
Do not assume resale will solve the problem
FTC advice cautions that selling a timeshare can be difficult. Check whether the contract restricts resale advertising, requires use of an approved broker, or imposes continuing fees after a transfer. Treat any claim that the membership will appreciate or produce guaranteed rental income as a claim that must be backed by a signed contractual term and independently verified evidence.
5. Check withdrawal and cancellation rights before signing
There is no universal cancellation period for every holiday club or timeshare. The governing law may be the law of the sale location, the property location, your residence or the contract’s chosen jurisdiction. The product may also fall outside a statute that covers only specified long-term holiday products.
European Union contracts covered by the timeshare rules
Your Europe’s guidance describes a 14-calendar-day withdrawal period for covered timeshare and long-term holiday contracts, without giving a reason. The period can be extended when required pre-contract information or the standard withdrawal form was not supplied. Confirm the national implementation and the exact contract category before relying on the period.

During that covered withdrawal period, the seller cannot require an advance payment or deposit. A separate rule applies to long-term holiday products paid by instalments: payments are made yearly, and after the first instalment the consumer may end the contract without penalty by giving notice within 14 days after receiving the next payment request. A linked exchange contract ends without extra cost when the main contract is withdrawn from. The EU framework and its scope are set out in Directive 2008/122/EC.
United States sales
In the United States, the rescission period may come from state law or the contract. The FTC Cooling-Off Rule is narrower: it generally provides three business days for certain sales made at a consumer’s home or at other covered locations, not for every vacation-club or timeshare sale. See the FTC explanations of the Cooling-Off Rule and its official rule. Check the applicable state law and follow the contract’s notice method exactly.
Other locations
Cancellation periods vary outside these frameworks. Identify the law governing the sale and the property, contact the relevant consumer authority and obtain qualified local advice if the contract is high-value or unclear. Never infer a right from a period that applies in another country.

A demand to sign immediately, a “today only” discount, a promise that the offer will disappear, or a refusal to let you take the documents away is a warning sign. The FTC says consumers should not feel pressured to buy and should review paperwork independently.

- Take the documents away and compare every sales promise with an actual clause.
- Check the seller’s legal name, address, licence or registration where local law requires one.
- Ask who receives each payment and whether a third party is involved.
- Use an independent lawyer or consumer adviser for a high-value or cross-border contract.
Do not sign a blank form, backdated document or acknowledgment that says you received information you did not receive.

7. Treat resale and exit offers as a separate risk
People who already own a membership are often targeted by firms promising a buyer, a refund or a guaranteed release. Before paying an exit or resale provider, ask what specific service will be performed, when it will be performed, who is being paid and whether the provider is licensed where required. Be especially cautious of upfront “tax,” “registration,” “legal” or “transfer” fees tied to a promised buyer.
The FTC warns about timeshare resale and exit scams. For a covered EU resale contract, a resale professional cannot collect payment before the sale or termination of that resale contract. Keep the original membership agreement and all correspondence; do not send identity documents or wire funds merely because a caller knows your ownership details.
8. Compare memberships using the same assumptions
If you are choosing between two clubs, use identical trip assumptions and compare these dimensions:
- All-in cost: initial payment, financing, recurring fees, taxes, travel, booking, exchange and upgrade charges over the intended term.
- Realistic access: the dates, destinations, accommodation size and seasons you actually want, not the broadest catalogue.
- Point economics: annual allowance, points required for representative trips, expiry and rollover rules.
- Fee exposure: how increases are set, whether they are capped and what happens if you do not use the membership.
- Duration: fixed end date, automatic renewal and notice deadline.
- Exit: withdrawal, cancellation, transfer, resale restrictions and any formal exit programme.
The available guidance supports these comparison axes but not a universal break-even figure. Use the prices and rules in each contract; do not assume that a membership pays for itself because a sales presentation compares it with a hotel’s highest rate.
9. A signing-day checklist
Do not pay until you can answer “yes” or provide a documented answer to each applicable item:
- I can state exactly what right I receive—week, points, exchange, accommodation access or discount—and its term.
- I have the full signed agreement, incorporated booking rules and fee schedules.
- Every important sales promise is written into those documents.
- I have calculated the initial payment, annual charges, taxes, travel, exchange, booking and upgrade costs.
- I know how fees can rise and whether increases are capped or otherwise limited.
- I have tested points or availability against the dates, destinations and unit types I want.
- I know the booking window, cancellation penalties, expiry and rollover rules.
- I know the renewal, default, transfer, resale and exit provisions.
- I have identified the correct withdrawal or rescission law and the precise notice method.
- I am not being asked for a prohibited deposit or pressured to sign before independent review.
10. If you have already paid
Act promptly, because any applicable period is measured from a legally defined event such as signing, receiving required information or receiving a payment request. Re-read the contract’s cancellation section and send notice using the specified method and address. Keep a copy, proof of delivery and the date sent. Do not rely on a phone call alone.
If the seller rejects a timely notice, demands a deposit during a protected period, or a resale firm requests an unexpected fee, contact the relevant consumer-protection authority and a qualified local adviser. Gather the contract, receipts, emails, advertisements and notes of what was said; those records help establish which promises were made and when.
