Identify exactly what happens if you withdraw, miss an instalment, or the promoter fails to deliver. The deduction may depend on the signed wording, the project’s state or Union Territory rules, and whether the event is buyer default or promoter default.
This guide uses India’s Real Estate (Regulation and Development) Act, 2016 (RERA), Haryana RERA material, a 2016 Government of India release and Supreme Court decisions. RERA procedures and agreement rules vary by project location, so verify the current local authority’s rules before signing or demanding a refund.

Start with the project and the documents
A refund dispute is usually decided by the documents and the applicable local law, not by a salesperson’s explanation. Complete these checks before transferring a substantial amount.
Recommended Free Tools
- Verify registration. Search the relevant state or Union Territory RERA portal for the exact project name, promoter, registration number, registered completion or possession date and current status. A registered project should disclose promoter and project information. Check that the sanctioned plan, specifications, amenities and stage-wise completion schedule shown in the portal match what you were offered.
- Obtain the full document set. Request the booking or application form, allotment letter, draft Agreement for Sale, payment schedule, cost sheet, specifications, layout, amenity list and every addendum. Keep the version you received; later drafts can change the risk allocation.
- Track the contract stage. Note whether the booking form says it is binding, whether an allotment letter has been issued, and whether the sale agreement has been signed and registered. The consequences of withdrawing before and after each stage may differ.
- Put promises in writing. Possession dates, price adjustments, amenities, layout changes and refund treatment should appear in the agreement or a signed addendum. Oral assurances that conflict with signed terms are difficult to enforce.
The 10% rule: a payment threshold, not a cancellation cap
RERA Section 13 states that a promoter must not accept more than 10% of an apartment’s cost as an advance or application fee before first entering into a written Agreement for Sale and registering it. Haryana RERA reproduces this statutory rule, and its buyer guidance describes it as a 10% ceiling on the booking amount.
#1 Best Overall
That rule controls how much can be collected before the registered agreement. It does not automatically mean that a buyer who voluntarily cancels can lose no more than 10%, or that every 10% deduction is lawful. For a cancellation, examine the earnest-money definition, the event triggering forfeiture, notice requirements, and the local agreement rules.
Three figures that are often confused
| Figure | What it refers to | How to use it |
|---|---|---|
| 10% of apartment cost | RERA Section 13’s pre-agreement advance/application-fee threshold. | Check payment chronology and whether the written, registered agreement was in place. Do not treat it as a universal cancellation deduction limit. |
| 45 days | A refund period described in the Ministry of Housing and Urban Poverty Alleviation’s 2016 release for promoter default under the Agreement for Sale Rules it announced. | The release states that those rules applied to specified Union Territories. Confirm that the project falls within that scope and check current local rules. |
| 20% of basic sale price | The earnest-money term in the agreement examined by the Supreme Court in Godrej Projects Development Limited v. Anil Karlekar (2025). | This is a fact of that contract and case, not a recommended or universally permitted deduction. |
Read the cancellation clause line by line
Mark every sentence that changes the amount you could recover. A usable clause should make the trigger, calculation and timing understandable without relying on a sales representative.
Define the event that permits cancellation
Separate voluntary withdrawal for personal or market reasons, failure to pay an instalment, promoter cancellation, and promoter failure to deliver. A clause that uses “default” without saying whether notice, a cure period or a missed instalment is required creates avoidable uncertainty.

Identify earnest money precisely
Look for a specific amount or percentage identified as earnest money when the contract is formed. Ask whether the percentage is calculated on the booking amount, amounts actually paid, the basic sale price or the total consideration. The Supreme Court has reiterated that forfeiture of advance money as earnest money requires clear and explicit contractual terms. A label added only after you cancel is not the same as a clearly agreed term.
List every additional deduction
Check separate provisions for interest on delayed instalments, late-payment charges, taxes, government levies, brokerage, administrative fees, legal costs and other dues. Each item should have a contractual basis and a calculation method. A clause allowing an undefined “processing” or “market” charge makes the refund impossible to audit.
Check the refund mechanics
The agreement should state how the balance is calculated, the date by which it is paid, the account or method used, and whether the promoter can substitute a credit, transfer or voucher for cash. Confirm whether the period runs from your cancellation request, acceptance of cancellation, resale of the unit or another event. A condition that delays repayment until an unspecified future sale deserves particular scrutiny.

Look for reciprocal remedies
Read the promoter-default section alongside the buyer-default section. It should address refund, interest and compensation if the promoter cannot give possession in accordance with the agreement. One-sided powers to cancel the allotment, change specifications or retain large sums may be challenged, but the outcome depends on the contract and facts.

You withdraw for personal, financial or market reasons
The deduction normally turns on the signed booking and sale documents, the characterization of payments, local regulations and the circumstances. Do not assume that a pre-agreement booking is automatically refundable or automatically forfeitable. Ask the builder for a written calculation showing the contractual clause, amount treated as earnest money, every other deduction and the net refund.
You miss instalments and the promoter cancels
The Agreement for Sale Rules described in the 2016 Government release allow cancellation for buyer default after specified demands and an agreed period; the release says the promoter may deduct the booking amount and interest liabilities from the amount to be repaid. The exact notice, cure period, deduction and refund rules must be checked against the project’s agreement and local rules. Keep evidence of payments, bank failures, correspondence and any request for extra time.

The promoter misses possession or cannot deliver
RERA’s allottee provisions address a promoter who fails or is unable to give possession in accordance with the agreement. In the specified circumstances, the allottee can seek a refund with prescribed interest and compensation; an allottee who remains in the project may instead have a claim to interest for the period of delay. The 45-day statement in the 2016 release is tied to the central rules and their stated geographic scope, so it cannot be assumed to apply nationwide.
The promoter cancels your allotment
Haryana RERA’s FAQ states that a promoter may cancel only in accordance with the Agreement for Sale. An allottee may approach the Authority if the cancellation is unilateral, lacks sufficient cause or does not follow the agreement. Other states and Union Territories have their own procedures and deadlines. Request the written reason, notice, cure opportunity and refund calculation immediately.

In B.B. Patel & Ors. v. DLF Universal Ltd. (2022), the Supreme Court stated: “the entitlement of the flat buyers to compensation for deficiency in service on the part of the builder cannot be restricted by the agreements which are one sided.” The passage concerns buyer remedies in delay or service-deficiency disputes. It is a warning against assuming that every one-sided term will control, not a blanket rule that makes every voluntary cancellation refundable.

In Godrej Projects Development Limited v. Anil Karlekar (2025), the Court examined an agreement treating 20% of the basic sale price as earnest money and reiterated, by reference to Satish Batra v. Sudhir Rawal, that “to justify the forfeiture of advance money being part of ‘earnest money’ the terms of the contract should be clear and explicit.” The decision must be read with its contract, facts and procedural history. It does not create a universal 20% ceiling or guarantee a particular refund.

When evaluating competing projects or draft agreements, compare the actual wording rather than headline prices.
| Comparison point | Questions to ask |
|---|---|
| Default triggers | What exactly counts as buyer or promoter default? Are grace periods stated? |
| Notice and cure | How is notice delivered, and how many days are available to correct a missed payment? |
| Earnest money | Is it defined at contract formation? Is the base the booking amount, paid amounts, basic sale price or total consideration? |
| Refund calculation | Which deductions are itemized, and can the builder replace cash with credit? |
| Refund timing | When does the clock start, and is a definite payment deadline stated? |
| Promoter delay | What possession date, extension events and force-majeure wording apply? What interest or compensation is provided? |
| Balance of rights | Can the promoter cancel unilaterally, while the buyer has no comparable remedy? |
Keep a complete evidence file
Maintain a paper and digital folder containing:
- Booking form, allotment letter, registered agreement and every addendum.
- Payment receipts, cancelled cheques, bank statements and dated account ledgers.
- Project registration details, sanctioned plans, specifications and construction updates.
- Advertisements, emails, messages and signed promises about price, amenities or possession.
- Cancellation requests, notices, delivery proofs, replies and the builder’s refund calculation.
Use an expanding file folder or a clearly named digital archive so that each document can be matched to a payment and date. This is an organizational aid, not a legal requirement.

- Send a precise written request. Identify the project, unit, booking and agreement dates; state whether you are withdrawing or invoking promoter default; list the amount paid; cite the clause; and request an itemized calculation and payment by a definite date.
- Preserve delivery proof. Use the notice method specified in the agreement and retain email headers, courier tracking, portal acknowledgements and replies.
- Reconcile the numbers. Compare the builder’s statement with your bank records. Separate principal, contractually stated interest, taxes and disputed deductions rather than arguing about one combined figure.
- Check the local forum. Review the relevant state or Union Territory RERA authority’s complaint process, limitation rules and required documents. Depending on the facts, consumer-dispute remedies may also be available. The correct forum and relief depend on jurisdiction and the signed documents.
- Obtain local advice for a significant sum. A qualified real-estate or consumer-law lawyer can assess the agreement, registration status, notices and calculation without promising a particular outcome.
Questions to answer before you sign
- What is the exact registered possession date, and what extensions are permitted?
- Has the promoter disclosed sanctioned plans, specifications, amenities and the stage-wise schedule?
- How much will be paid before the registered Agreement for Sale, and does that stay within the statutory threshold?
- Which amount is expressly earnest money, and what formula calculates forfeiture?
- What notice and cure period applies to a missed instalment?
- When does a refund period begin, and is cash repayment required?
- What interest and compensation apply if the promoter cannot deliver?
- Are the buyer’s and promoter’s remedies written with comparable clarity?
Jurisdiction and currency warning
The title does not identify a country, while the rules discussed here are Indian. State and Union Territory RERA authorities can prescribe different forms, procedures, interest rates, deadlines and model-agreement wording. The 2016 Government release is historical, and the cited Supreme Court decisions are fact-specific. Before acting, verify the project location, the law in force on the agreement date, the registered documents and the authority’s current complaint procedure.
