Title insurance can cover a forged deed, fraudulent instrument, or another fraud-related defect that existed before your policy began, was unknown to you, and falls within the policy’s terms. It is not blanket protection against every fraud event. A deed fraudulently recorded after you bought the property, or a risk specifically excluded in your policy, may not be covered.
An owner’s policy protects your covered ownership interest. A lender’s policy protects the mortgage lender’s security interest, not your equity. The policy, its exceptions and endorsements, and the law in your state determine the result in a specific claim.

What title insurance is designed to cover
Title insurance addresses problems with legal ownership of real estate, not ordinary damage to the building. Before issuing a policy, a title company examines public records and related documents for ownership claims, liens, easements, recording errors and other encumbrances. The purpose is to identify defects in the chain of title that could affect the buyer or the lender.

Coverage is controlled by the written policy. A title report or commitment issued before closing is not the same as the final policy: the commitment identifies proposed coverage and exceptions, while the final policy states the insurer’s actual obligations after closing.
Title defects are different from home damage
A title policy is not homeowners insurance. It generally does not pay to repair a roof, replace stolen property or cover fire, flood or other physical losses. Its subject is the legal right to own, use or finance the property, and the financial loss that a covered title defect causes within the policy limits.
Examples of defects that can involve fraud
Regulators identify several kinds of past problems that may become title claims:

- False impersonation of an owner or another person in the chain of title.
- Fraud used to create or transfer an ownership interest.
- A lost or improperly executed deed.
- An error in a public record that changes the apparent ownership history.
- An unknown lien, missing heir, undiscovered easement or other encumbrance.
These are examples of potential defects, not promises that an insurer will pay every claim involving them. The insurer investigates the facts and applies the policy’s definitions, exclusions, exceptions, conditions and limits. The NAIC overview and the California Department of Insurance guide both emphasize that policy language controls.

Does title insurance cover title fraud?
The key question is when the fraudulent act or resulting defect existed. Title insurance is aimed primarily at defects that predate the policy or your acquisition and are discovered later. That timing makes an earlier forged deed materially different from a new fraudulent deed recorded after your purchase.
Fraud that predates the policy
Suppose a person impersonated a prior owner and signed a deed several years before you bought the property. The deed appears in the chain of title, the problem was not known when your policy was issued, and the claim is not excluded or excepted. That type of defect is within the category title insurance is intended to address. Depending on the policy, the insurer may defend your title, negotiate or litigate to clear the defect, or pay a covered loss up to the policy’s limit.
A forged mortgage, fraudulent release, undisclosed heir or other earlier transaction can raise the same issue. Whether the insurer must provide a defense or indemnity depends on the policy form, the facts and the law where the property is located.

A stranger who records a fraudulent deed after your purchase creates a different timing problem. The NAIC consumer guide gives later-arising ownership problems, such as a later boundary dispute or contractor lien, as examples of matters its described coverage does not address. A post-purchase fraudulent filing is not automatically covered merely because it affects your title. Check the policy for any applicable provisions and contact the insurer promptly instead of assuming coverage.

Known defects and policy exceptions
A defect identified before closing may be listed as an exception in the commitment or final policy. A risk you knew about, accepted or failed to disclose can also be limited by policy conditions. Endorsements can add or modify protection, but availability and wording differ by state and insurer. The California Department of Insurance explains that the policy’s terms define the risks included and excluded; California examples should not be treated as a nationwide rule.
Owner’s policy versus lender’s policy
Most financed purchases involve a lender’s policy, while an owner’s policy is a separate decision for the buyer. They protect different parties and use different insured amounts and durations.
| Comparison | Owner’s policy | Lender’s policy |
|---|---|---|
| Whose interest is protected? | Your covered ownership interest and investment in the property. | The lender’s security interest in the mortgage loan. |
| Is it usually required? | Often optional; requirements vary by state and transaction. | Usually required by a mortgage lender. |
| Insured amount | Commonly based on the purchase price, subject to the policy’s terms and limits. | Based on the mortgage amount and, as the NAIC describes, decreases as the loan is repaid. |
| How long does it last? | Generally while you retain an ownership interest, subject to the policy’s terms. | Generally until the loan is paid off, the property is sold or the loan is refinanced, as described by the NAIC. |
| Who receives protection if title is challenged? | You, for the covered loss or defense described in your policy. | The lender; it does not insure your equity. |
See the Consumer Financial Protection Bureau explanations of owner’s title insurance and lender’s title insurance. If you buy only the lender’s policy, a successful challenge to your ownership can leave your equity unprotected even though the lender’s interest is insured.
What a covered title-fraud claim may involve
When a covered defect is discovered, the policy may provide more than a payment. Depending on its terms, the insurer can investigate the title, defend an action, try to cure the defect, or pay the insured loss if the title cannot be made acceptable. The exact remedy, deductible or limit is policy-specific; do not assume that the purchase price is always the maximum available recovery or that every legal expense is covered.

Potential claim situations include:
- A prior forged deed makes another person appear to be the rightful owner.
- False impersonation in an earlier transaction creates a competing ownership claim.
- An undisclosed heir asserts an interest that was not found in the records searched.
- A fraudulent release leaves an old mortgage or lien legally outstanding.
- A recording or indexing error obscures a prior conveyance or encumbrance.
The same event can be outside coverage if the policy lists it as an exception, you knew about it before issuance, it arose after the insured date, or another exclusion applies. The NAIC consumer guide and state regulators stress that these examples describe possible title problems, not guaranteed claim payments.
What is generally outside the described protection
Title insurance does not turn every later dispute into an insured loss. The NAIC consumer materials specifically distinguish past title problems from ownership issues arising after purchase, including a later boundary dispute or contractor lien. Other exclusions can apply to matters disclosed in the policy, rights created by the insured’s own actions, or risks that an endorsement was required to cover but was not purchased.
Because forms and exceptions vary, read the schedule of exceptions rather than relying on a summary from a real-estate agent, lender or closing company. A policy may contain broad standard language alongside property-specific exceptions that materially narrow the protection for your parcel.
What to do if you suspect a fraudulent deed or other title fraud
Act quickly, but do not concede ownership or sign a corrective document before you understand the consequences. Use this sequence as a practical starting point; the policy and your state’s procedures control the required notice and documents.

- Confirm the public record. Obtain the recorded instrument and recording information from the county or other land-records office. Compare the signature, notary details, dates, legal description and recording history with your closing documents.
- Notify the title insurer promptly. Use the claim or notice address in the policy and explain the suspected defect in writing. Ask what notice format, supporting documents and deadlines apply. Do not assume that notifying only the lender or closing agent gives the insurer proper notice.
- Notify other relevant parties. If a mortgage is involved, tell the lender’s servicing or legal department. If identity theft, forgery or criminal conduct is suspected, consider a report to the appropriate law-enforcement agency and preserve the report number.
- Get legal advice when ownership is disputed. A real-estate attorney can explain recording remedies, court procedures and whether an emergency order is appropriate. The insurer’s investigation does not replace independent legal advice about your rights or obligations.
- Follow the insurer’s investigation. Provide requested affidavits, identification records and closing documents, and keep a dated log of communications. Ask for a written explanation if the insurer denies or limits the claim, including the policy provision relied upon.
How to read the commitment and final policy
Before closing, focus on the parts that determine whether a fraud concern is actually insured:
- Insured party: Confirm that your name and ownership interest are shown correctly on an owner’s policy. A lender-only policy does not insure your equity.
- Effective date: Check when coverage begins. The date matters when deciding whether a defect predates the policy.
- Legal description: Verify that the parcel, unit, boundaries and recorded references match the property you are buying.
- Schedule of exceptions: Read every listed lien, easement, restriction and other exception. An exception can remove a risk from coverage even if the issue later becomes a dispute.
- Exclusions and conditions: Look for provisions concerning known matters, post-policy events, notice, cooperation, defense and the insurer’s liability limit.
- Endorsements: Identify any added coverage and its conditions. Availability and wording vary by state and transaction.
If a specific forgery or impersonation risk concerns you, ask the insurer in writing whether the policy or an available endorsement addresses it. A general assurance that “title is insured” is not a substitute for the actual wording.
How to shop for title coverage and compare quotes
The CFPB says consumers can shop for title insurance separately from the mortgage and may receive itemized title fees. A lower quote is not necessarily better if it carries broader exceptions or omits an owner’s policy.
Recommended Free Tools
| Question to ask | Why it matters |
|---|---|
| Is the quote for an owner’s policy, a lender’s policy or both? | Only the owner’s policy is intended to protect your covered equity. |
| What amount is insured, and how is it adjusted? | The owner’s amount is commonly tied to purchase price; the lender’s amount follows the mortgage and declines as the loan is repaid. |
| Which fraud, forgery and impersonation risks are covered? | Examples in a brochure do not override exclusions, exceptions or the effective-date requirement. |
| What exceptions appear in the commitment? | Property-specific exceptions can remove a risk from otherwise broad coverage. |
| Are endorsements available for the concern I have? | Additional protection may depend on state, policy form and underwriting requirements. |
| Where and how must a claim be reported? | Using the policy’s notice instructions helps avoid delays or disputes about notice. |
| Can I receive an itemized fee breakdown and shop the provider? | The CFPB’s shopping guidance encourages consumers to compare title and other closing services. |
Use the CFPB’s guidance on shopping for title insurance and other closing services. Compare the insured party, exceptions, endorsements and claims process alongside the price.
Fraud scenarios at a glance
| Scenario | How the timing affects the analysis | What to do |
|---|---|---|
| A prior owner’s deed was forged before your purchase. | Potentially within the type of pre-policy defect title insurance addresses, if unknown, not excepted and otherwise covered. | Notify the insurer and provide the recorded deed and your closing records. |
| A stranger records a fraudulent deed after you buy. | Not automatically covered; it is a post-purchase event and the policy’s specific terms govern. | Contact the insurer, preserve evidence and obtain legal advice promptly. |
| An heir omitted from an earlier estate claims ownership. | May be a covered prior defect if it was undiscovered and not excluded. | Send the claim notice and estate or probate documents to the insurer. |
| A contractor files a lien after your purchase. | The NAIC consumer guide uses a later contractor lien as an example of an issue arising after purchase, generally outside the described protection. | Check your policy and address the lien under applicable construction and property law. |
| A boundary dispute was known and listed as an exception. | The listed exception can remove that risk from coverage. | Review the exception and seek state-specific legal advice before closing or asserting a claim. |
State-specific rules and limits
This explanation uses U.S. federal and state consumer guidance. Insurance rules, policy forms, costs, lender requirements and endorsements vary by state. The California Department of Insurance’s examples of forgeries, false impersonation and other defects are California guidance, not a nationwide promise of coverage. For a live dispute, consult your state insurance regulator and the policy issued for your property.
The NAIC overview was updated December 12, 2024. The CFPB owner-policy page was last reviewed October 19, 2023, and its lender-policy page September 11, 2024. Those consumer explanations describe the roles of the policies; your current policy remains the controlling document.
