What the GST changes mean for consumers, small businesses and freelancers (2026 guide)

For most goods and services covered by the 56th GST Council’s rate decisions, the revised rates started on 22 September 2025. The change is not a universal “GST is now 5% or 18%” rule: specified sin and luxury goods can carry a 40% rate, tobacco products remained on their existing GST and compensation-cess treatment until a later notified date, and the exact classification must be checked in the relevant CBIC notification.

For households, the tax component of specified purchases and some insurance policies changed. For businesses, the rate revision did not by itself change the goods-registration threshold or erase filing and input-tax-credit duties. Freelancers still need a fact-specific review of their service, client location, place-of-supply rules and export conditions. The 57th Council meeting on 8 October 2026 proposed additional process reforms, but recommendations are not operative law until the required notifications and commencement dates are issued.

The two GST timelines you must keep separate

The first timeline is the 56th GST Council’s broad rate rationalisation. Most revised rates for goods and services took effect on 22 September 2025. The government’s shorthand describes two principal rates—5% and 18%—alongside a 40% special rate for specified sin or luxury goods. That shorthand is useful for orientation, not for deciding an invoice. A product can sit in a different entry, condition or exemption in the applicable CBIC notification, so businesses should verify the HSN or service classification and effective date before charging tax.

Specified tobacco products were an explicit exception in the 2025 FAQ: they continued under the existing GST and compensation-cess rates pending a later notified date. Do not assume the general 22 September change applied to every tobacco product.

The second timeline is the 57th Council meeting held on 8 October 2026. Its release focuses on registration, returns, reconciliation and refunds. It records recommendations, including a proposed alternate mechanism from the April 2027 return period. Until legislation, rules or notifications bring a measure into force, taxpayers should continue using the current statutory process.

Timeline What is established How to use it
22 September 2025 Most 56th Council rate revisions for covered goods and services became effective. Apply the rate in the relevant notification, using time-of-supply rules for transactions around the date.
8 October 2026 The 57th Council released process recommendations. Treat registration, return, ITC and refund changes as proposals until commencement is notified.
April 2027 return period The release proposes that an alternate liability-and-ITC amendment mechanism could begin from this period. Wait for the legal instrument and implementation instructions before changing return workflows.

What consumers see at the checkout

A lower GST rate does not guarantee an identical price cut

A rate reduction lowers the tax component of a specified supply. It does not prove that every seller reduced the final retail price by the same amount. The pre-tax price, discounts, freight, packaging, commissions and rounding can all change the amount printed or charged. Compare the invoice’s taxable value, GST rate and total rather than inferring the tax from a shelf label.

During the 2025 transition, the government allowed revised maximum-retail-price information on old packages by sticker, stamping or online printing. Re-stickering was optional, and pre-change packaging could be sold through 31 March 2026 or until the stock ran out, whichever came first. That temporary allowance had expired by October 2026. Current packages and invoices should therefore reflect the applicable present requirements; an old sticker allowance is not a continuing justification for a tax calculation.

Insurance exemptions are limited to the described individual policies

The 2025 explainer says individual life-insurance policies—including term, endowment and unit-linked insurance plans—and individual health-insurance policies—including family-floater and senior-citizen policies—are exempt under the decision. “Insurance is exempt” is too broad. Group, commercial or other insurance arrangements may have different treatment, and the policy wording and notification control.

The same explainer identifies reinsurance services as exempt among the insurer-input categories it discusses and addresses input-tax-credit reversal. An exemption for an individual policy does not mean every service an insurer buys is exempt or that all related input tax remains available. Policyholders should check the premium document; insurers must follow the specific credit and reversal rules applicable to their supplies.

How to check a disputed charge

  1. Ask for a tax invoice or other legally permitted document showing the taxable value, GST rate and amount.
  2. Identify the item or service classification and compare it with the current CBIC notification, not a generic rate chart.
  3. Check whether the transaction is exempt, zero-rated or taxable; these categories have different consequences.
  4. If the seller says a price change is due to GST, compare the pre-tax value and the effective date, not only the final total.

What small businesses need to do

The goods-registration threshold did not change with the rate revision

The official 2025 FAQ answers the question “Is there any change in threshold of the registration required for goods under CGST Act, 2017?” with no change as part of the rate revisions. A lower rate does not automatically remove a registration obligation, and a higher rate does not automatically create one. Registration still depends on the statutory threshold, the nature and location of supplies, compulsory-registration provisions and other facts.

Do not use a rate change as a reason to cancel an existing registration or to delay registration. Check the current threshold and compulsory-registration rules for your state and supply pattern.

Existing small-taxpayer mechanisms continue to have conditions

Government background material describes several mechanisms already available to eligible small taxpayers:

  • The composition scheme, subject to its turnover limits, tax restrictions and other conditions.
  • The QRMP arrangement, under which eligible taxpayers file quarterly returns while making monthly tax payments.
  • An exemption from mandatory registration for certain small taxpayers making intra-state supplies of goods through e-commerce operators.

These are not blanket concessions. Inter-state supplies, excluded goods or services, compulsory-registration categories and turnover calculations can change the answer. Confirm eligibility before omitting GST from an invoice or filing less frequently.

Transactions that straddle 22 September 2025

For a supply made before the rate change but invoiced or paid afterward, the invoice date alone may not decide the rate. The time-of-supply provisions examine when the supply occurred, when the invoice was issued and when payment was received. A business should map those dates and apply the rule for the particular type of supply.

For example, do not automatically re-rate every invoice issued after 22 September if the relevant time-of-supply event occurred earlier. Conversely, do not retain the old rate merely because an order was placed before the change if the statutory events point to the later rate. Keep contracts, delivery records, invoices, payment entries and credit or debit notes together so the conclusion can be demonstrated.

Input tax credit is not retroactively repriced

The FAQ states that input tax credit on a purchase is not retroactively reduced merely because the rate later changed, provided the statutory conditions for credit are met. A correctly charged pre-change invoice therefore does not become wrong solely because the same item carries a different rate later.

The opposite issue arises when an outward supply becomes exempt. The 2025 explainer says the relevant input-tax-credit reversal rules apply. Reconcile common inputs, capital goods and services used for taxable and exempt supplies, and document the calculation in the return period required by law.

Practical controls for a rate change

  • Update product and service tax masters with the notification number, effective date and classification.
  • Configure billing software to use the time-of-supply decision, not simply the invoice date.
  • Separate old and new stock records where valuation, pricing or credit-note treatment depends on the date.
  • Review purchase invoices for correct GST and preserve evidence supporting eligible ITC.
  • Test exempt-supply calculations and ITC reversals before filing the return.
  • Train staff to escalate mixed, bundled or reclassified supplies instead of selecting a rate from memory.

What the 57th Council recommendations could change

The 8 October 2026 release proposes process reforms rather than announcing an immediate replacement for the 2025 rate schedule. It discusses clearer requirements for registration applications, simpler amendments and cancellations, improved return reconciliation and ITC reporting, and automated refund processing.

Conditional e-commerce registration route

The release recommends a simpler registration route for certain small suppliers of goods selling through e-commerce operators in states where they have no physical presence. The described conditions include an ITC limit and use of an e-commerce warehouse as the principal place of business. Until the conditions, form, eligibility and commencement are notified, a seller should not treat the recommendation as a current entitlement.

Proposed return amendment mechanism

The Council release says an alternate mechanism for amending liability and ITC in returns may be brought into force from the April 2027 return period. That is a proposed start date, not proof that the mechanism is available now. Keep using the currently prescribed amendment, reconciliation and payment process until the relevant legal instructions are published.

Prosecution threshold recommendation

“The GST Council recommends raising prosecution threshold from ₹1 crore to ₹5 crore.”

This wording is a recommendation heading in the 8 October 2026 government release. It should not be rewritten as an effective increase until the law is amended and brought into force.

Freelancers: why there is no single GST answer

The 2025 rate FAQs cover goods and services, but they do not establish one GST rate, registration threshold, place-of-supply result or export treatment for every individual freelancer. A designer, software developer, consultant, writer or coach can provide a different service, use a different contractual model and serve clients in different locations.

Facts to establish before invoicing

  1. Describe the service precisely and identify its current GST classification and rate.
  2. Determine whether the client is in India or outside India and whether the client is registered.
  3. Apply the place-of-supply rule for that service, including any special rule for performance, property, events or intermediaries.
  4. Check whether the transaction satisfies all export or zero-rating conditions; an overseas client alone does not prove export treatment.
  5. Assess registration using turnover, compulsory-registration provisions and the state from which the service is supplied.
  6. For work delivered around 22 September 2025, document supply, invoice and payment dates to apply the time-of-supply rule.

A freelancer should not copy a client’s rate or assume that “professional services” is a universal category. The engagement letter, invoice, client-location evidence and payment records should support the chosen treatment.

How to verify the rate and commencement date

Use the latest CBIC notification for the exact goods or service, along with any circular or official FAQ explaining the transition. Confirm four points before filing or billing:

  • The classification and description match the actual supply.
  • The rate or exemption is effective on the relevant time-of-supply date.
  • Any condition, value limit, geographic restriction or recipient requirement is met.
  • The rule is operative law, rather than a Council recommendation awaiting notification.

Keep a dated copy or internal reference to the notification used. Rate schedules can be amended after a Council meeting, and a press release or summary cannot replace the legal text for a disputed transaction.

What the reform says about GST’s scale

A Press Information Bureau backgrounder reports 66.5 lakh GST taxpayers in 2017 and 1.65 crore taxpayers as of May 2026. It also reports GST collections of approximately ₹13.76 lakh crore in 2021–22 and approximately ₹22.27 lakh crore in 2025–26. These are reported government figures, not a promise that an individual business will pay less or that compliance will become simpler immediately.

The practical dividing line is the transaction: consumers should verify the tax component and invoice; businesses should verify classification, time of supply, registration and ITC; freelancers should establish service and client-location facts. The 2025 rates are operative where notified from 22 September 2025, while the 2026 process changes remain recommendations until the corresponding legal instruments take effect.
