Start by identifying which decision is pending or negative. U.S. Citizenship and Immigration Services (USCIS) decides an employer’s H-1B petition, while a consular officer at the U.S. Department of State decides an application for an H-1B visa stamp. A delay or refusal at a consulate is not the same event as a USCIS petition denial, and neither automatically answers whether you may keep working.
Read the notice, confirm your current I-94 and immigration status, and involve your employer’s immigration counsel or a qualified immigration attorney before you work, change employers, file another request, or travel. The correct response depends on your location, petition history, requested extension or change, employer, and the exact wording of the notice.

First determine what was delayed or denied
Collect the document or online status message and check four details: the issuing agency, the case or receipt number, the type of filing, and the action described. These distinctions determine which agency can answer your question and what options may exist.

A visa stamp and immigration status are related but different. A visa generally allows you to seek admission during its validity; status and authorized stay inside the United States are governed by the admission record and underlying immigration documents. A pending label alone does not prove that employment is authorized.

If USCIS has not decided the petition
Monitor the case using the receipt number
- Enter the receipt number in USCIS case-status tools and save screenshots or notices for your records.
- Use the USCIS case-processing-time tool with the particular form and service center shown on the receipt. Posted estimates are agency estimates, not guarantees, and can change as USCIS updates its data.
- Check whether the case is eligible for a USCIS inquiry. If it is outside the agency’s posted inquiry window, submit the inquiry through the channel USCIS provides for that case type.
- Keep your employer or immigration counsel informed of every notice, including a request for evidence, transfer notice, rejection, or change in address.
Do not rely on a generic internet timetable. Processing depends on the form, service center, case facts, and the type of action requested. A USCIS receipt confirms filing; it does not by itself grant a new period of status or permission to work.
Consider premium processing only after verifying current rules
For a petition that is eligible, the employer may ask counsel whether premium processing is appropriate. USCIS directs premium-processing petitioners to use the contact details on the receipt notice. Current H-1B premium-processing fees, deadlines, eligible forms, and required filing procedures can change, so verify them on USCIS’s live instructions before filing Form I-907. Do not assume that paying for premium processing guarantees approval or cures a substantive problem.
Respond to a request for evidence carefully
If USCIS issues a request for evidence, the response deadline and requested evidence are controlling. Give the notice to the employer’s immigration counsel immediately. A response may require employer records, position details, wage documentation, educational evidence, or explanations of prior filings. Missing the deadline can leave the petition vulnerable to denial; sending unrelated material can obscure the answer USCIS needs.

The Department of State describes a refusal under section 221(g) of the Immigration and Nationality Act as a situation in which the consular officer does not have all information needed to conclude that the applicant is eligible for a visa. The officer may request documents, or the case may require administrative processing. This is a refusal of the visa application at that point; it is not a statement that the employer’s USCIS petition was approved or denied.

Follow the written instructions exactly
- Read the refusal sheet and any email or courier instructions from the specific embassy or consulate.
- Identify every requested document, the required format, the submission channel, and the deadline, if one is listed.
- Submit a complete response through the stated channel and keep delivery confirmations, copies, and the date of submission.
- Do not send repeated unsolicited explanations to multiple offices. If the instructions are unclear, ask the consulate how it wants the material provided or have counsel contact the post.
The State Department says a 221(g) case can later be reassessed. After requested information is received, the officer may determine that you qualify, or may determine that you remain ineligible. Administrative processing therefore does not mean approval is coming.
Understand administrative-processing timing
The State Department says, in its After the Interview guidance, that “The duration of the administrative processing will vary based on the individual circumstances of each case.” Except for emergency travel, it advises applicants to wait at least 180 days from the interview or from submission of supplemental documents, whichever is later, before asking about administrative-processing status. That is guidance about when to inquire, not a promise that a decision will arrive after 180 days.
Travel plans, a job start date, or a lease should not be built on an assumed completion date. Ask the employer whether the position can remain open, whether work can be performed lawfully from outside the United States, and what documentation is needed if the start date changes. Those are employment and legal questions for the employer and counsel, not conclusions that can be drawn from a CEAC status alone.
Why CEAC may show refused
In a March 5, 2020 explanation, the State Department said that CEAC could display “refused” for a case that had previously displayed “Administrative Processing.” The explanation reflected the 221(g) refusal status; the status could change if eligibility was later established or outstanding issues were resolved. Treat the status label as a signal to read the consular instructions, not as proof that every possible review has ended.

Can you work while an H-1B matter is pending?
Do not infer work authorization from a pending petition, a pending visa application, or a favorable online status message. The answer depends on the worker’s current status, authorized stay, approved petition, admission record, and the filing requested.
Extension or change-of-status cases
An extension or change-of-status filing can involve different rules from a visa application filed abroad. The notice, approval dates, I-94, and current employment authorization must be reviewed together. If an extension or change-of-status request is denied, the consequences can differ depending on whether the prior authorized stay has ended and what other status, if any, applies. The available facts do not support one outcome for every worker, so obtain individualized advice before continuing employment.
Changing employers and portability
The Department of Labor’s Fact Sheet #62W explains that the H-1B portability provision can allow a qualifying worker to change jobs without the risk of being out of status. The fact sheet identifies key conditions: the new employer must file a nonfrivolous Form I-129 before the worker’s authorized stay expires, and the filing must include an unexpired approved Labor Condition Application covering the work.
Those conditions do not automatically make every job change lawful. The new employer and immigration counsel should verify the worker’s current I-94, prior H-1B approvals, filing timing, job and location, LCA coverage, and any gaps or complications before the worker starts. Keep proof of the filing and follow counsel’s written start-work instructions.

If USCIS denies the petition
Read the entire decision, including the stated basis, effective dates, and any instructions about further filings. A petition denial can affect employment, status, travel, or a requested extension in different ways. The result may differ for an extension of stay, a change of status, consular processing, a petition for a new employer, or a case filed after the worker’s authorized stay expired.
- Send the denial to the employer’s immigration counsel immediately and ask what date controls your work and stay.
- Confirm the I-94 expiration date and compare it with the petition’s requested and approved dates.
- Ask whether any motion, appeal, refiling, departure, or alternative status is legally available in your particular case. Do not assume a deadline or remedy without reviewing the decision and current rules.
- Until counsel confirms authorization, do not continue working, begin with another employer, travel internationally, or file a new application based on assumptions.
The Department of State’s consular role is separate. A USCIS petition denial does not become a consular refusal automatically, and a consular refusal does not by itself describe the disposition of the USCIS petition.
If the visa is refused while you are outside the United States
Ask the consulate what, if anything, is still required and whether your passport will be retained or returned. Notify the employer promptly so it can reassess the start date, payroll plans, relocation expenses, and any assignment that depends on admission to the United States.

Protect your finances while the case is unresolved
Immigration uncertainty can become a cash-flow problem even before a final decision. Separate legal questions from budgeting decisions:
- Preserve a written employment plan. Ask whether salary continues, pauses, or depends on a lawful start date. Get any change in start date or unpaid period in writing.
- Build a delay budget. List rent or mortgage, insurance, debt payments, relocation commitments, and travel costs. Avoid irreversible spending until the employer confirms that the immigration timeline supports it.
- Track reimbursable expenses. Keep receipts for required medical examinations, document delivery, travel changes, and relocation items, but do not assume reimbursement unless the employer’s policy or written agreement says so.
- Protect insurance and benefits. Ask human resources when health coverage, retirement contributions, and other benefits begin or stop if the start date moves.
- Keep tax records organized. A change in work location or a period outside the United States can affect payroll withholding and reporting. Ask a qualified tax professional about your facts rather than treating immigration status as a tax conclusion.
Financial planning cannot substitute for immigration advice, but it can prevent a delayed case from turning into avoidable debt or a missed payment.
A decision checklist for the next 48 hours
- Classify the case: USCIS petition or Department of State visa application.
- Save the evidence: notice, receipt, refusal sheet, CEAC screenshot, passport instructions, I-94, and prior approval notices.
- Identify the issue: pending adjudication, missing document, administrative processing, or stated ineligibility.
- Confirm location and authorization: inside or outside the United States, current status, authorized-stay end date, and present work authorization.
- Contact the right people: employer’s immigration counsel for petition and employment questions; the consulate for consular submission instructions; USCIS for an eligible case inquiry.
- Pause risky actions: do not start unauthorized work, change employers, travel, or submit a new filing until the responsible professional confirms the plan.
- Set a financial checkpoint: update the employer on salary, benefits, relocation, and travel commitments and revise your budget for the realistic range of outcomes.
Questions that require individualized review
Rules for F-1 students, cap-gap calculations, grace periods, appeals and motions, extension-of-stay denials, and the effect of a particular petition denial are not interchangeable. The controlling facts include the notice language, filing type, current I-94, residence, travel history, petition history, and whether another status or employment authorization applies. Ask the employer’s counsel or a qualified immigration attorney to analyze those facts before acting.
