Start by obtaining the complete annuity file, every Form 1099-R, the premium and payment history, and documents proving your authority to act. Then separate records for the deceased person’s final federal return from records for an estate or trust that receives income after death. The contract, the identity of the person who died, the beneficiary, and the timing of payments determine which documents matter and how distributions are reported.
This is a U.S. federal tax-records checklist. State probate, state income-tax, and insurer claim procedures can differ. Confirm the applicable tax year’s form instructions and the insurer’s current requirements.

First identify the people, contract roles, and payment timing
“Annuity recipient” is not a precise tax role. A contract may name an annuitant, an owner, a beneficiary, and a person currently receiving payments, and those roles can belong to different people. Before requesting records, establish from the contract and the issuer:
- Who died: the annuitant, contract owner, payment recipient, or more than one of these.
- Who owns the contract now and who is entitled to a continuing payment or death benefit.
- Whether payments had already begun or the contract was still deferred.
- Whether the contract is qualified or connected to a retirement plan, or is a nonqualified commercial annuity.
- Whether the payee is an individual beneficiary, a trust, or an estate.
These facts control which tax records to request. Do not assume that a payment made after death belongs on the decedent’s records or under the decedent’s taxpayer identification number.

Core document checklist
Use the two-source checklist below. The insurer should provide current contract and distribution information; the decedent’s and estate’s files supply prior returns, authority evidence, and records of expenses or earlier payments.
| Ask the insurer or payer for | Retrieve from the decedent’s or estate’s records |
|---|---|
| Complete annuity contract, riders, amendments, payout election, beneficiary designation, and correspondence about the claim or death benefit | Filed federal returns, wage and retirement statements, Forms 1099, IRS transcripts, and prior correspondence |
| Premium and contribution history, investment-in-the-contract or cost calculation, and an explanation of any unclear figures | Bank or brokerage records showing premiums, payments received, and amounts previously treated as tax-free recovery |
| Every Form 1099-R for payments before death and every Form 1099-R issued after death | Payment ledgers, canceled checks, account statements, and records showing the date and recipient of each payment |
| Gross distribution, taxable amount if shown, federal withholding, distribution code, payee name, and taxpayer identification number used on each form | Death certificate, court appointment papers, Letters Testamentary, or other proof of authority needed for information requests |
| Death-benefit calculation, settlement option, and date and amount of any payment made to a beneficiary, estate, or trust | Estate income, expense, fiduciary-account, and tax-identification records for amounts received after death |
Keep the file for each tax year and each payee together. A paper organizer or digital folder is optional convenience, not an IRS requirement.
1. Obtain the contract and every later amendment
The original policy alone may not show the terms in force at death. Request the full contract and all riders, endorsements, amendments, beneficiary changes, payout elections, and insurer letters. The file should show:

- The owner, annuitant, beneficiary, and any successor owner.
- Whether the contract is qualified or nonqualified and, if qualified, the retirement plan or account context.
- How the insurer will settle the death benefit: lump sum, continued installments, or another election.
- The date the insurer considers the death claim effective and the date each distribution was made.
These details are not merely administrative. The annuity starting date and payment form affect how much of a distribution may represent recovery of investment, while a deferred-contract death benefit can have different treatment from payments under an annuity already in payout status.

2. Preserve cost and payment history
Ask for the insurer’s written investment-in-the-contract or cost calculation. Gather original premium receipts, contribution confirmations, exchange or rollover records, and statements showing payments already made. Also identify amounts previously recovered tax-free, because the remaining investment may differ from the original premiums after prior exclusions.
Gross proceeds do not by themselves establish taxable income. Under annuity rules, part of some distributions can be a tax-free recovery of investment. Conversely, a death benefit from a deferred contract may not follow the same pattern as a routine periodic payment. If the insurer’s taxable amount or basis figure is unclear, request a transaction-by-transaction explanation and retain both the explanation and the underlying statements.
3. Collect and reconcile every Form 1099-R
Form 1099-R is the central reporting document for reportable annuity and death-benefit distributions. Obtain a copy for every payment period and every recipient, including forms issued for payments made before death and forms issued afterward.

- Gross distribution.
- Taxable amount, when the payer reports one.
- Federal income-tax withholding.
- Distribution code.
- Recipient’s legal name and taxpayer identification number.
- Payment date and whether the amount was paid directly, through a trust, or to an estate account.
The IRS says in the beneficiaries instructions for its 2026 Forms 1099-R and 5498 instructions: "If you make a distribution to a beneficiary, trust, or estate, prepare Form 1099-R using the name and TIN of the beneficiary, trust, or estate, not that of the decedent." Therefore, a post-death form showing the decedent as payee may be a reporting error. Contact the payer promptly, provide the legal documents it requests, and ask for a corrected form. Keep the original and corrected versions with notes explaining the resolution.
4. Separate documents for IRS information access from documents attached to a return
A legal representative often needs the deceased person’s prior returns or transcripts before preparing a final return. An IRS information request requires proof of identity and authority. Have the decedent’s full name, last address, Social Security number, death certificate, and evidence of your authority ready. IRS guidance identifies court-approved Letters Testamentary or Form 56 accompanied by court-approved letters as examples of authority evidence. The IRS or an insurer may require certified copies or its own form, so verify the receiving institution’s process.
That purpose is different from filing the final individual return. IRS final-return guidance states: "The IRS doesn’t need a copy of the death certificate or other proof of death." The statement concerns the return itself; it does not eliminate the death certificate and authority evidence needed to obtain confidential records.

If a representative who is not court-appointed claims a refund, Form 1310 may be required. Follow the instructions for the specific tax year rather than attaching documents merely because they were used for an information request.

5. Retrieve the decedent’s prior individual tax records
Locate filed federal returns and supporting Forms 1099 for years in which the annuity paid income. Transcripts or return copies can reveal:
- Whether annuity income was reported and which payer issued it.
- How investment in the contract and tax-free recovery were treated in earlier years.
- Unfiled or unresolved returns.
- Withholding that may be credited on the final return.
- Deductions or carryovers relevant to the final filing.
An authorized representative can request a return copy or transcript from the IRS by following its identity and authority procedures. Keep a log of the tax year requested, the date, and the documents supplied, because obtaining records can take longer than an insurer’s claim process.
6. Keep estate and trust records in a separate workstream
Income payable to an estate after death is not simply an extension of the decedent’s final individual return. Track each post-death annuity payment, the payee name and taxpayer identification number, the account into which it was deposited, estate expenses, and any fiduciary tax documents separately.

Which facts change the document set?
| Situation | Records that become especially important |
|---|---|
| Qualified or retirement-plan annuity | Plan or account statements, rollover or contribution records, plan designation documents, and the applicable retirement-plan reporting information |
| Nonqualified commercial annuity | Premium history, investment-in-the-contract calculation, prior exclusion amounts, and the commercial contract and riders |
| Payments began before death | Annuity starting date, payment schedule, prior Forms 1099-R, and records of the portion previously recovered tax-free |
| Deferred contract with a death benefit | Death-benefit calculation, date of death, settlement election, beneficiary designation, and the Form 1099-R for the resulting distribution |
| Payment to an individual beneficiary | Beneficiary’s legal name and TIN, payment statement, and correspondence confirming the election |
| Payment to an estate or trust | Estate or trust legal name and TIN, fiduciary account records, post-death income ledger, and the entity’s tax filings |
| Request for IRS records | Death certificate, decedent’s identifying information, and court-approved authority evidence |
| Attachment to the final individual return | Proof of appointment when required and Form 1310 when a non-court-appointed person claims a refund; do not automatically attach a death certificate |
A practical collection sequence
- Secure authority. Obtain the court appointment or other fiduciary documentation, certified copies if required, and the decedent’s identifying information.
- Notify the insurer. Ask what it needs to confirm the death, determine the beneficiary, and release contract and payment records. Request the complete contract file, not only a claim form.
- Freeze the timeline. Record the date of death, annuity starting date, last pre-death payment, first post-death payment, and every settlement election deadline.
- Build the payment ledger. List each payment, date, amount, recipient, account, and Form 1099-R number. Mark payments made before and after death.
- Reconcile forms. Compare every 1099-R field with the ledger and contract. Flag wrong names, TINs, amounts, codes, or withholding and request corrections.
- Recover missing history. Request IRS transcripts or return copies for years that are absent from the files, using the authority evidence required for an information request.
- Split the filing folders. Create separate folders for the final individual return, estate income, and any trust income. Store each entity’s Forms 1099-R and expenses in its own folder.
- Prepare return support. Give the tax preparer the contract, cost calculation, payment ledger, corrected forms, authority documents, and prior-return information, along with a note describing unresolved insurer questions.
Common mistakes and how to correct them
Using the decedent’s TIN for every payment
A payer may issue a post-death distribution to a beneficiary, trust, or estate under that payee’s name and TIN. If the form identifies the wrong recipient, request a corrected Form 1099-R rather than altering the form yourself.
Relying on the gross distribution alone
Gross proceeds do not establish the taxable amount when investment in the contract and prior tax-free recovery affect the calculation. Obtain the insurer’s basis explanation and earlier payment records.
Combining the final return with estate income
Payments received by an estate after death, and expenses paid by the estate, belong in the fiduciary records even when the same person signs both returns. Keep separate ledgers and tax-identification numbers.
Sending a death certificate with the final return automatically
The IRS does not require a death certificate as an attachment to the final return under the cited final-return guidance. Keep it available for information requests and insurer claims, where proof of death and authority may be required.
Assuming every inherited annuity has the same tax result
Qualified versus nonqualified status, prior payments, the contract’s payout terms, beneficiary identity, and the timing of distributions can change the reporting analysis. Do not decide the taxable amount from the word “inherited” alone.
When to obtain specialized tax help
Consider a tax professional experienced with inherited annuities or estates when the contract has multiple owners or beneficiaries, a large or unclear basis, a rollover or exchange history, a trust or estate payee, missing prior returns, corrected Forms 1099-R, or competing settlement elections. Provide the professional with the complete document set and a written chronology; a summary without the contract and payment history can conceal the facts that drive the result.
Federal rules are the focus here. Confirm state probate, state income-tax, and insurer procedures separately, and use the form instructions for the tax year being filed because IRS forms and instructions are revised annually.
